Dockine Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Brad Sizemore Permit No.14347 Page 2 of 3 ADDITIONAL CONDITIONS 3) The pennittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 5 formalized boat slips. 6) In accordance with the stipulations of the waiver signed by the adjacent riparian property owner to the north, the tie pilings to the north shall not exceed a distance of 15' from the floating dock. 7) Should the adjacent property to the north be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 0 LU 13) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. > Lu NOTE: Future development of the permittee's property may require a modification of this pemut. DAVIS Director SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for Brad Sizemore Dear Mr. Conway: This letter is in response to the above referenced CAMA permit application, which was accepted as complete by the Division's Wilmington office on July 24, 2017. Processing of the application was placed on hold October 2, 3017 pending the need for a waiver from the adjacent riparian property owner authorizing placement of the proposed tie pilings in the 15' riparian setback. We received the requested approval on December 7, and the revised plan reflecting the authorized tie piling location on December 8, 2017. Processing of your permit application officially resumed as of December 8, 2017. The revised projected deadline for making a decision was December 13, 2017, but an additional 75-days is provided by G.S. 113A-122(c), and therefore the standard processing time was extended to February 26, 2018. PROJECT DESCRIPTION: The project site is located at 833 Inlet View Drive in Shinn Point Subdivision, adjacent to the AIWW and Greenville Sound located in the City of Wilmington, New Hanover County. To locate the property from Oleander Dr. (NC Highway 17), turn onto Greenville Loop Road and travel approximately 0.6 miles south. Turn left onto Shinnwood Road and travel approximately 0.5 miles east. Turn right onto Inlet View Drive and the property of interest will be the eighth property on the left. The lot is approximately 0.63 acres with approximately 89' of shoreline frontage. The lot averages approximately 10' above normal high water (NHW) and a timber bulkhead stabilizes the shoreline. The lot is currently developed with a single-family home and swimming pool. Highground vegetation consists of lawn grasses, ornamental landscaping. The property has a patch of Coastal Wetlands along the shoreline measuring approximately 60' in width and 80' in length consisting primarily of Smooth Cordgrass (Spartina altemiflora). The applicant currently maintains an existing docking facility. An access pier measuring 6' by 347' extends in an easterly direction into Greenville Sound toward the AIWW and leads to a 12' by 13' gazebo approximately 41' from the terminus of the pier along the southern side of the access pier. There is a 4' by 10' fixed finger pier extending from the waterward end of the southern edge of the gazebo. From that fixed finger pier a ramp leads onto an existing floating dock, measuring approximately 33' in length by 6' in width, which runs perpendicular to the shoreline. There is an existing boatlift, measuring approximately 14' in length by 14' in width, which is located between the terminus of the 6' by 347' fixed pier and the terminus of the 6' by 33' floating dock. The application states that the existing docking facility currently accommodates up to two (2) slips and existing water depths at this location are approximately 44" at normal low water (NLW) (see Sheet 1 of 4). The Wilmington/New Hanover County Land Use Plan 2006 update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Greenville Sound are classified SA by the Division of Water Resources. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to expand an existing private docking facility. The applicant proposes to add a 4' by 20' fixed finger pier extending in a perpendicular direction from the main pier along the northern edge approximately 50' landward of the terminus. From the northern most end on the waterward edge of that fixed finger pier a ramp would lead to a 6' by 38' floating dock running perpendicular to the shore. Between the terminus of the main pier and the terminus of the new floating dock would be a boat lift measuring approximately 14' by 14'. Three mooring pilings would be installed along the northern property line approximately 17' from the new floating dock (see Sheet 2 of 4). These mooring pilings encroach into the 15' adjacent riparian setback requirement. The application states that the proposed docking facility would accommodate up to five (5) slips within water depths ranging from approximately -2'10" to 44" at AUG 01 2017 DCM- MHD CITY 10. ANTICIPATED IMPACTS The proposed fixed finger pier, floating dock, and boatlift would incorporate an additional approximately 533 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structures would extend approximately 170' into a waterbody which measures approximately 860' across. This distance would conform to both the % width distance rule and the 80' setback from the AIWW. Based on the application, the proposed structures would encroach into the adjacent 15- foot riparian corridor setback requirement on the northern side and. Minor increases in turbidity should be expected during construction. The 6'x38' floating dock will be placed at the waterway end of his pier and access by a 4'x20' finger dock perpendicular to his existing dock to the north. He would like to install a boat lift between the new floating dock and existing pier along with the mooring piles on the riparian line to the north of his floating dock.
