This permit, issued on December 15, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Dockine Facility
1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

ADDITIONAL CONDITIONS
3) The pennittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third parry.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 5 formalized boat slips.
6) In accordance with the stipulations of the waiver signed by the adjacent riparian property owner to the
north, the tie pilings to the north shall not exceed a distance of 15' from the floating dock.
7) Should the adjacent property to the north be sold prior to the initiation of construction, the permittee shall
be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement
of any structures within the 15 foot riparian corridor.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
General
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest. 0

13) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. >

approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2017-01749), which was issued on 8/21/17.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2017-
0947.

This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on July 24, 2017. Processing of the application
was placed on hold October 2, 3017 pending the need for a waiver from the adjacent riparian

received the requested approval on December 7, and the revised plan reflecting the authorized tie
piling location on December 8, 2017. Processing of your permit application officially resumed as
of December 8, 2017. The revised projected deadline for making a decision was December 13,
2017, but an additional 75-days is provided by G.S. 113A-122(c), and therefore the standard
processing time was extended to February 26, 2018.

The Division of Coastal Management hereby acknowledges receipt of your application on behalf
of Mr. Brad Sizemore for State approval for development of the subject property located at 833
Inlet View Drive, Wilmington, New Hanover County. It was received as complete on July 24,
2017 and appears to be adequate for processing at this time. The projected deadline for making
a decision is October 7, 2017. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 24, 2017, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and
notify me in writing if you wish to receive a copy of my field report and/or comments from
reviewing agencies.

The Department of Environmental Quality hereby gives public notice as required by

under the CAMA: Bruce Chappell proposed to expand an existing docking facility and
perform maintenance dredging at 21 Bahama Dr., adjacent to Banks Channel, in Wrightsville
Beach; Fred Ireland proposed to expand an existing docking facility at 619 Canal Dr.,
adjacent to the CB Yacht Basin, in Carolina Beach; and Brad Sizemore proposed to expand
an existing docking facility at 833 Inlet View Dr., adjacent to the AIWW, in Wilmington.

This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on July 24, 2017. Processing of the application
is ongoing. However, it has been determined that additional information will be required prior to
the Division taking final action on your application. These required items are summarized
below:
1) The proposed project requires a waiver from the adjacent property owner, Mr. Phil
Van Campen, due to the placement of three pilings within the 15' riparian setback.
Please submit a signed agreement from Mr. Van Campen waiving the 15' riparian
setback.
If you can provide a signed waiver to this office within five working days from the date of this
letter, DCM staff will continue processing of the application and the processing clock will not be
suspended. If the required information is not received in this office within the specified
timeframe, processing of the application will be suspended in accordance with 15A NCAC
07J.0204(d) until such time as the requested information is provided.

9. PROJECT DESCRIPTION:
The project site is located at 833 Inlet View Drive in Shinn Point Subdivision, adjacent to the
AIWW and Greenville Sound located in the City of Wilmington, New Hanover County. To locate
the property from Oleander Dr. (NC Highway 17), turn onto Greenville Loop Road and travel
approximately 0.6 miles south. Turn left onto Shinnwood Road and travel approximately 0.5
miles east. Turn right onto Inlet View Drive and the property of interest will be the eighth property
on the left.
The lot is approximately 0.63 acres with approximately 89' of shoreline frontage. The lot
averages approximately 10' above normal high water (NHW) and a timber bulkhead stabilizes
the shoreline. The lot is currently developed with a single-family home and swimming pool.
Highground vegetation consists of lawn grasses, ornamental landscaping. The property has a
patch of Coastal Wetlands along the shoreline measuring approximately 60' in width and 80' in
length consisting primarily of Smooth Cordgrass (Spartina altemiflora).
The applicant currently maintains an existing docking facility. An access pier measuring 6' by
347' extends in an easterly direction into Greenville Sound toward the AIWW and leads to a 12'
by 13' gazebo approximately 41' from the terminus of the pier along the southern side of the
access pier. There is a 4' by 10' fixed finger pier extending from the waterward end of the
southern edge of the gazebo. From that fixed finger pier a ramp leads onto an existing floating
dock, measuring approximately 33' in length by 6' in width, which runs perpendicular to the
shoreline. There is an existing boatlift, measuring approximately 14' in length by 14' in width,
which is located between the terminus of the 6' by 347' fixed pier and the terminus of the 6' by
33' floating dock. The application states that the existing docking facility currently accommodates
up to two (2) slips and existing water depths at this location are approximately 44" at normal
low water (NLW) (see Sheet 1 of 4).
The Wilmington/New Hanover County Land Use Plan 2006 update classifies adjacent waters as
Conservation, and the adjacent high ground portion of the project area as Resource Protection.
The waters of the AIWW and Greenville Sound are classified SA by the Division of Water
Resources. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of
Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to expand an existing private docking facility. The applicant proposes to
add a 4' by 20' fixed finger pier extending in a perpendicular direction from the main pier along
the northern edge approximately 50' landward of the terminus. From the northern most end on
the waterward edge of that fixed finger pier a ramp would lead to a 6' by 38' floating dock running
perpendicular to the shore. Between the terminus of the main pier and the terminus of the new
floating dock would be a boat lift measuring approximately 14' by 14'. Three mooring pilings
would be installed along the northern property line approximately 17' from the new floating dock
(see Sheet 2 of 4). These mooring pilings encroach into the 15' adjacent riparian setback
requirement. The application states that the proposed docking facility would accommodate up
to five (5) slips within water depths ranging from approximately -2'10" to 44" at

10. ANTICIPATED IMPACTS
The proposed fixed finger pier, floating dock, and boatlift would incorporate an additional
approximately 533 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structures
would extend approximately 170' into a waterbody which measures approximately 860' across.
This distance would conform to both the % width distance rule and the 80' setback from the
AIWW. Based on the application, the proposed structures would encroach into the adjacent 15-
foot riparian corridor setback requirement on the northern side and. Minor increases in turbidity
should be expected during construction.

The total square footage of the docking facility was calculated as follows:
Shoreline length = 89' x 8 ft2 = 712 ft2 allowable.
Existing gazebo = 12' x 13' = 156 ft2
Existing finger pier = 4' x 10' = 40 ft2
Proposed finger pier = 4' x 20' = 80 ft2
Proposed floating dock = 6' x 38' = 228 ft2
Total = 504 ft2
It appears that the project is CONSISTENT with the use standards set forth in NCAC
07H .0208(b)(6), including the eight -square foot rule and the quarter width rule. The
proposed facility would meet the 80' AIWW setback. The facility would encroach into the
15' adjacent riparian corridor setback requirement on the northern side for which a
waiver has not yet been obtained. This office has no objection to the proposed work,
provided it is consistent with all other state and federal permitting requirements and a
waiver is obtained from the property owner to the north for the installation of the
mooring pilings. In the absence of any concerns from the commenting agencies, it is
recommended that a permit be issued subject to the standard conditions for private
docking facilities.

This project is consistent with the 2006 Wilmington -New Hanover County Joint
Land Use Plan Update.
The applicant proposes to expand a private docking facility. The project is located at 833
Inlet View Drive, adjacent to the AIWW and Greenville Sound in Wilmington, New
Hanover County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Residential/Conservation.
In general, Wilmington -New Hanover County allows development in Residential and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The Wilmington -New Hanover County Land Use Plan contains some policies,
which exceed the State's minimum use standards, however none of these policies are
applicable to this project.
This project appears to be consistent with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to expand an existing private docking facility at 833 Inlet View Drive, in
the Shinn Creek subdivision, adjacent to the AIW W/Greenville Sound, in Wilmington, New
Hanover County, North Carolina. Coordinates are: 34.191972 N,-77.827506 W.
On January 1, 2017, we renewed General (Regional) Permit No. 197800056, (copy
enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks,
boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in
navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the
Rivers and Harbors Act of 1899. General Permit No. 197800056 expires December 31, 2021.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

Narrative for 833 Inlet View Drive:
My client, Brad Sizemore wishes to construct a 6'x38' floating dock to place on
the northern side of his existing pier to accommodate a larger boat which he
intends on purchasing in the future and additional space for his family. The 6'x38'
floating dock will be placed at the waterway end of his pier and access by a 4'x20'
finger dock perpendicular to his existing dock to the north. He would like to install
a boat lift between the new floating dock and existing pier along with the mooring
piles on the riparian line to the north of his floating dock.
