Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) Should either adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 6) This permit authorizes a maximum of 4 formalized boat slips. 7) No portion of the authorized docking facility shall extend past the established Carolina Beach Pier Head Line. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. PROJECT DESCRIPTION The project site is located at 619 Canal Drive, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in the Town of Carolina Beach, New Hanover County. To get to the site from the Wilmington Regional Office travel south onto College Road and then continue on Carolina Beach Road (US Highway 421) for approximately 15 miles. Travel approximately 2.5 miles after crossing Snow's Cut Bridge, turn left onto Carl Winner Drive and continue until you reach a stop light at Canal Drive. Turn left onto Canal Drive and continue north. The subject property is a developed lot and will be located on your left adjacent to residential properties to the north and south. The applicant's lot is approximately 8000 sq. ft. and averages approximately 5 ft. above normal high water (NHW). High ground vegetation that exists on the property consists of native grasses and the lot is developed with a condo building. The applicant's measured shoreline is 60 ft. in length. The property is stabilized by a bulkhead which ties into the adjacent bulkheads to the north and south. An existing four (4) slip docking facility extended approximately 78 ft. waterward of the bulkhead. It included a 28 ft. by 6 ft. access pier leading to a 40 ft. by 10 ft. fixed pier that was situated parallel to the shoreline. Waterward of the fixed pier was a U-shaped floating dock consisting of an 8 ft. by 25 ft. float, a 10 ft. by 40 ft. float, and a 6 ft. by 25 ft. float. The facility encroached into the 15-ft. Riparian Corridor Setback Area on the north and south sides. This facility was damaged in Hurricane Matthew and in need of replacement for safety concerns. GP#68075 was issued on 3/8/17 to replace a portion of the facility while the applicant sought this Major Permit to replace the remainder of the facility. As such, an existing two (2) slip docking facility extends approximately 68 ft. waterward of the bulkhead into the Yacht Basin with a 20 ft. by 20 ft. fixed L-head which transitions via ramp to a 6 ft. wide by 20 ft. long floating dock perpendicular to the shoreline. The facility encroaches into the 15-ft. Riparian Corridor Setback Area on the south side. There is an approximately 22 ft. wide pocket of coastal wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora) adjacent to the existing bulkhead. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to reconfigure an existing non -conforming docking facility. An 8 ft. wide by 32 ft. long section of floating dock would be added to the landward edge of the existing floating platform and extend in a northerly direction, parallel to the channel. A second section of floating dock measuring 6 ft. in width and 16 ft. in length would be added to the northerly end of the section running parallel to the channel. This section of floating dock would be oriented perpendicular to the channel to create a 'U' configuration (see Sheet 2 of 3). The application states that the proposed new docking configuration would provide docking space for up to four (4) vessels within existing water depths ranging from — 4.0 ft. to -8.0 ft. at normal low water. (NLW) (See Sheet 3 of 3). 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 352 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structure would extend approximately 68 ft. into a water body, which measures approximately 460 ft. across. The structures would be located in water depths of -4.0 ft. to -8.0 ft. at NLW and would conform to both the 1/4 width rule and the Carolina Beach VLID AUG 01 2017 DCM- KMD CITY 619 Canal Drive HOA c/o Fred Ireland Page Three pier head line per the application. The proposed structures would encroach into both adjacent 15' Riparian Corridor Setback Area, and signed waivers are included in the application materials. The proposed structures would not encroach into the USACE 80 ft. setback requirement. The proposed structures consist of 632 sq. ft. of platform which would not conform with the 8 sq. ft. rule, however, it would be a reduction in platform area from the previous docking facility and stay within the previous footprint. Minor increases in turbidity should be expected during construction. Agent, Boatzright Inc. / Hobie Buffington On march 012017 an existing structure consisting of a fixed pier of 568 square foot and a floating dock of 750 square foot were on site. Storm damage from Matthew in 2016 made the pier and floating dock unsafe. A proposal for a replacement pier and floating dock was made that reduced the original footage to 508 square foot for the fixed pier and 512 square for the floating dock. This effort was made to reduce the shaded water area and reduce construction cost. After several consultations with CAMA it was agreed that a general permit would suffice, however at a final meeting for the issue of the general permit. It was decided by Ms. Wilson that because the foot print of the new structure was not the same as the original a CAMA major permit was needed. The proposed fixed pier and a portion of the floating dock was allowed under CAMA general (permit #68075). The remainder of the floating dock to replace the original existing floating dock would require a major permit and are the subject of this narrative. Give complete description: On march 01 2017 an existing structure consisting of a fixed pier of 568 square foot and a floating dock of 750 square foot were on site. Storm damage from Matthew in 2016 made the pier and floating dock unsafe. A proposal for a replacement pier and floating dock was made that reduced the original footage to 508 square foot for the fixed pier and 512 square for the floating dock. This effort was made to reduce the shaded water area and reduce construction cost. After several consultations with CAMA it was agreed that a general permit would suffice, however at a final meeting for the issue of the general permit. It was decided by Ms. Wilson that because the foot print of the new structure was not the same as the original a CAMA major permit was needed. The proposed fixed pier and a portion of the floating dock was allowed under CAMA general 68075 The remainder of the floating dock to replace the original existing floating dock would require a major permit. (6 ft. not counted due to alignment) Existing floating dock = 6 ft. x 20 ft. = 120 sq. ft. (not counted due to alignment) Proposed floating dock 1 = 32 ft. x 8 ft. = 256 sq. ft. Proposed floating dock 2 = 16 ft. x 6 ft. = 96 sq. ft. Total counted= 632 sq. ft. The docking facility would provide docking space for the total up to four (4) vessels at this location. It is staff's recommendation that the proposal appears to be CONSISTENT with most of the use standards set forth in NCAC 07H .0208(b)(6), including the % width rule and the pier width rule. The proposed structure does not appear to be consistent with the 8-square foot rule and exceeds to allowable shading impact by 152 square feet. However, the previous facility incorporated a much larger total area of 1,318 sq.ft., and the proposed development occurs within that footprint and reduces shading to 980 sq. ft., which is a reduction of 338 sq. ft. It is staff's recommendation that this proposal appears to be CONSISTENT with NCAC 07J .0211 non -conforming development. The facility will provide a seating area, dockage for four (4) vessels, will not be enlarged, and complies with the rules to the maximum extent possible. A Unit Owner shall not be responsible for repair occasioned by casualty occurring outside a Unit, unless such casualty is due to the act of negligence of the Unit Owner, or guests, licensees, agents, invitees, users, occupants, or tenants of such Unit Owner. A Unit Owner is responsible for a repair resulting from a casualty occurring within or affecting the inside of the Unit. F. No Unit Owner shall permit any structural modification or alteration to be made to any Unit, nor alter or cause any changes to be made to or alter the appearance of the exterior of any building (including painting, installing television, satellite dish, radio antennae, or signs, without fast obtaining the written consent of all members of the ASSOCIATION, except as may be otherwise allowed by law. H. No animals, livestock or poultry of any kind shall be raised, bred, kept or maintained on any Unit or in any dwelling except certain domestic household pets, such as may be otherwise provided by rules and regulations approved all members of the ASSOCIATION. The rules and regulations may regulate, permit or prohibit the kind and number of domestic household pets. Domestic household pets may not be raised, bred, kept or maintained for any commercial purposes. All household pets shall be kept on a leash at all times when outside the Units and animal waste must be immediately removed. Such pets may not be permitted to run at large at any time. Owners of pets on the Property shall control excessive barking or other disturbances caused by the pets. I. Unit Owners shall not park or store any camper, trailer, boat trailer, trailer vehicle, or similar vehicle anywhere on the Property. No trucks shall be permitted except for standard 2-ton pickup trucks, or smaller sized trucks. All tools or other materials stored in vehicles for overnight parking shall be kept out of sight. No striped, wrecked or partially wrecked, or junk motor vehicle or part thereof, or any motor vehicle not displaying a current valid inspection sticker shall be permitted to be parked or kept on the Property J. No burning of wood, leaves, trash, garbage or household refuse or buming as a means of clearing brush shall be permitted on the Property. K. Garbage and trash shall be disposed by Unit Owners in accordance with rules and regulations approved by all members of the ASSOCIATION. L. No laundry or wash shall be dried or hung outside any Unit. M. There shall be no obstruction of the Common Elements, nor shall anything be kept or stored on any part of the Common Elements by any Unit Owner without the prior written approval of the ASSOCIATION. N. No trash containers maybe stored on the balconies or screened porches of Units. Barbecue grills may NOT be stored or used on balconies or screened porches of Units de to the associated fire hazard. O. The ASSOCIATION is authorized to regulate parking by adopting the rules and regulations relating thereto, which rules and regulations will include the right to assign or reassign parking spaces if it deems it appropriate or necessary. If the Unit Owner fails to repay the expenses incurred by the ASSOCIATION within 30 days after notice to the Unit Owner of the amount owed, then the failure to so repay shall be a default by the Unit Owner under the provisions of this Section, and such expenses shall automatically become a Default Assessment enforceable in accordance with Article IX herein. R. The initial rules governing the piers and dock are set out hereafter. The Declarant retains the right to amend these rules, add additional rules, and retract any rule at their sole discretion so long as Declarant owns a Unit. a. No boat longer than Feet (') may be moored at the dock. b. Boat Lifts are not permitted at any pier or dock. c. All watercraft must be parked parallel to the dock. d. All watercraft must be removed from the pier and dock prior to any hurricane getting within seventy-five miles of New Hanover County. e. Each user of the pier and dock shall clean the facility after each use. f. All water supply lines serving the pier and dock shall be drained in anticipation of any freezing weather. g. The pier and dock must be promptly rebuilt and/or repaired following any damage or destruction, whether or not they are insured against such loss. ARTICLE IV EASEMENTS A. Each Unit shall be subject to an easement in favor of the other Unit to use the pipes, ducts, cables, wires, conduits, public utility lines and other Common Elements serving such other Unit and located in such Unit. ARTICLE V A. The ASSOCIATION, or any Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges now or hereafter imposed by the provisions of this Declaration. Failure by the Association or by any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. B. Each Unit Owner shall be liable solely for the amount of taxes against his individual Unit and Undivided Interest in the Common Elements and facilities and shall not be affected by the consequence resulting from the tax delinquency of any other Unit Owner. Neither shall the Building, the Condominium Property, nor any of the Common Elements and facilities be deemed to be a separate parcel for the purpose of taxation. ARTICLE VIII INSURANCE The Association shall purchase, maintain in force and administer insurance coverage as provided by N.C.G.S. §47C-3-113, the teens and provisions of which are incorporated herein. In addition, the Association shall meet the following requirements regarding insurance: (a) Property Insurance. All Common Elements of the Condominium (including all Limited Common Elements), except land, excavations, foundations and other items normally excluded by property insurance policies, shall be insured by the Association in an amount equal to at least one hundred percent (100%) of their insurable replacement value as determined annually by the Association, with the assistance of the insurance company underwriting the coverage. The sole duty of the Association or its authorized representative as insurance trustee shall be to receive such proceeds as are paid and to hold the same in trust for the purposes stated herein. Subject to the provisions of N.C.G.S. §47C-3-113, proceeds of insurance received by the insurance trustee shall be distributed to or for the benefit of the beneficiaries in the following manner: (i) Proceeds shall first be paid to cover the cost of reconstruction and repair of any damage covered; (ii) Proceeds shall then be paid to the trustee to reimburse it for costs reasonably incurred in discharging its duties as trustee; and (iii) Any remaining proceeds shall then be distributed to the beneficiary or beneficiaries of the trust, as their interests may appear. (b) (d) Insurance Obtained by Unit Owners. It shall be the responsibility of each Unit Owner, at such Unit Owner's expense, to maintain fire and extended property damage insurance on such Unit Owner's Unit and any personal property and furnishings, and to maintain public liability insurance covering such Unit Owner's Unit. In addition, a Unit Owner may obtain such other and additional insurance coverage on and in relation to the Unit Owner's Unit as the Unit Owner, in the Unit Owner's sole discretion, shall conclude to be desirable or reasonably obtainable. However, no such insurance coverage obtained by the Unit Owner shall operate to decrease the amount that the ASSOCIATION may realize under any policy maintained by the ASSOCIATION or otherwise affect any insurance coverage obtained by the ASSOCIATION or cause the diminution or termination of that insurance coverage. ARTICLE XII AMENDMENT This Declaration may be amended at any time and from time to time by an instrument in writing executed by all the Owner's of both Units of 619 CANAL, a Condominium and shall be effective upon the recording of such Amendment(s) in the Office of the Register of Deeds for New Hanover County. The parties hereto may file Supplemental Declarations from time to time authorizing, approving, and detailing the reconfiguration, renovation and remodeling of the Condominium Units, Common Elements, and Common Areas. In the event of any disagreement between the owners of the Units as to what is fair, proper and appropriate and in order to prevent a stalemate which would result in a detriment to all concerned parties it is agreed that any dispute or disagreement that can't be settled to the satisfaction of both Unit Owners within thirty days will be submitted to binding arbitration in accordance with Arbitration as set forth in North Carolina General Statute Chapter 1 Article 45C, the Revised Uniform Arbitration Act, and settled in that manner. ARTICLE XIII THE ASSOCIATION A. Association Management Duties. Subject to the rights and obligations of the Owners as set forth in this Declaration and the Act, the ASSOCIATION shall be responsible for the administration and operation of the Condominium and for the exclusive management, control, maintenance, repair, replacement and improvement of the Common Elements (including facilities, furnishings, and equipment related thereto) and the Limited Commons Elements, and shall keep the same in good, clean, attractive and sanitary condition, order and repair. C. Membership. Every Unit Owner shall be a member of the ASSOCIATION. Membership shall be appurtenant to and may not be separated from ownership of any Condominium Unit.
