This permit, issued on November 27,2017 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Excavation 1) No excavation shall take place outside of the area indicated on the workplan drawings. 2) The property line that extends through the man-made. canal, as depicted on the attached certified workplan dated 9/21/17, which is the western extent of the authorized dredge footprint, shall be marked with visual indicators prior to the initiation of excavation activities. The visual indicators shall be removed after work has concluded. 3) Excavation shall not exceed -3 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the pemrittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Blount -Simpson Permit No.134-17 Page 2 of 3 ADDITIONAL CONDITIONS The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. Maintenance Clause The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. 13. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved'by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Spoil Disposal No spoil material shall be placed within 30 feet of the normal water line. All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 'E: The permittee is advised that any dredging activity that takes place outside the authorized footprint or within the adjacent property shall be considered a violation of this CAMA permit. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Department Of Coastal Management (Part 1 of 2) Martha Simpson has stated the canal has been permitted by the Department of Coastal Management 3 times. Martha Simpson left out that one of the 3 dredges was done with out a permit. Unless after Mr. Simpson paid his $250.00 fine and he was issued a $250.00 dredging permit. Illegal dredging 1 by Mr. Simpson: The first time I was mailed an Adjacent Riparian Property owner Notification/waiver form from Mr. Simpson was not by certified mail. I filled out my objection on the form and mailed it back to Mr. Simpson in the envelope enclosed addressed to Mr. Simpson. Not long after that without notice I could see the canal being dredged. I informed Jonathan Howell, "District Manager," of the Division of Coastal Management. His response was that it had never happened before. Mr. Simpson "illegally" dredged his side of the canal and my side of the canal with no consequences. Truck load after truck load was hauled off. I asked the dredger if he would give me some of the sand and he said he would at $350.00 a truck load like everyone else. This first illegal dredging was catastrophic to my property. My property at the water's edge is a wall 8ft straight up. The sand beside my property was now 6ft. lower. The waves from the first storm filled up 300 ft. of sand from my property. The property lost about 20 ft. inland. At this time I had owned the property 12 years and with out dredging we lost only minuscule amounts of property. Illegal dredging 2 by Mr. Simpson: The second time Mr. Simpson dredged the canal without a permit. I asked the person dredging if he had a permit and he said yes. He lied. I had not been notified and called the police. The policeman asked him if he had a permit and he said yes. He lied again. I asked the policeman to have him show it to him and the policeman said water was out of his jurisdiction. Kevin Hart came out to the site and saw the big mounds of sand that had been dredged out of the canal. Kevin Heart said he was going to issue him a fine. The fine was $250.00 the same as if Mr. Simpson applied for a permit. Load after load of mostly my sand was trucked away at $350.00 a truck load. This second illegal dredging of my already destabilized property expedited further catastrophic erosion. This was the second time there was no observation or measuring of area that had been dredged. Attempted illegal dredging 3 by Mr. Simpson: The third dredge request I received by certified mail. The form was already filled out by I have no objections to this proposal checked and I do wish to waive the 15' setback requirement checked. I asked Kevin Hart for a new form and my request was denied. I was given no choice but to send the illegal, doctored form in with it checked that there was objections and there was no objections. I sent it in protesting the illegal form. Kevin Hart contacted me and said another form would be sent. Mr. Simpson's lack of integrity, being dishonest, and trickery in falsifying a document has led me to question his motives in going forward. I will prove in part 2 the dredging is not for boats to go in and out of the canal. I contacted Kevin Hart as I did not understand what the numbers meant on the survey in relationship to where the Simpsons where allowed to dredge. Kevin Hart told me they could dredge from the left side of the boat ramp to the mouth of the canal. They could dredge 30 foot out from the bulk head towards the adjacent bulk head. I paid someone to come out with a 100 ft. measuring tape and we spent several hours placing poles 30 ft out from the bulkhead towards the adjacent bulkhead from the boat ramp to the mouth of the canal. It basically left 7 ft all the way down the canal on my side. I called Kevin Hart and told him our findings and he said their bulk head had nothing to do with this type of permit. I did get him to come out to answer questions so I would know how to respond to the Simpson's request for a major permit. Kevin Hart came out and looked at the poles with 30 ft on one side and 7 on the other. I said this can not be right. I asked Kevin how does the dredger know were 30 ft is. Kevin said he had a 30 ft. arm he could attach to the excavator. Why do they Simpsons need 30 ft? Kevin said so all the boats can go out and come in at the same time. I called the surveyor and he figured out the line down the center of the canal and sent me an email of that map. Mr. Talley gave me 3 different numbers to use to contact Kevin Hart. I had tried Mon. Tues. Wed. with no reply. I called Jonathan Howell and he was in a meeting all day Thursday and Friday would not be in. I tried Kevin Thurs. and Fri and he never returned my phone calls after a week. According to the permit he was the one I was to get in touch with. The next week I finally got a hold of Jonathan Howell. I emailed him the second map from the surveyor with the center line. Jonathan was able to measure it from the bulk head and it complied with the survey map from the surveyor. Jonathan Howell was able to answer all my questions. How does the dredger know where the middle is down the canal. His previous dredging showed he does not. Jonathan said that they would put several thin pipes down the center of the canal. I sent Jonathan an email for him to confirm what was to be done and he confirmed on the phone but would not by email. I had one last question. Would these pipes remain in the canal? If not who was going to put the pipes in the canal every time they dredged for the next 5 years. I was not able to get in contact with anyone before I had to make my decision. Listed below are the facts of why they are not dredging the canal so that boats can go in and out. 1.Only 3 families have boats or skiffs. One is a small platoon, one a tiny skiff, and one a very small boat. 2. Their boats are always docked in the part of the canal that has never been dredged. 3. A medium boat can not launch from the boat ramp because it is extremely steep and not built correctly. Blount Washington County PROJECT SETTING Wayne Talley has submitted a Major CAMA request on behalf of Martha Blount to perform maintenance excavation in a manmade canal connecting to the Albemarle Sound. The 1.9-acre project site is located at the end of Batemans Beach Road, off NC32 in the Town of Roper in Washington County. The canal is currently protected by a bulkhead along the eastern side while the western side has some remnants of bulkheads or is currently not protected. Water depths in the canal range from -1.5ft below Normal Water Level (NWL) to -5ft below NWL. There are three boat basins, a boathouse and a boat ramp in the canal. The properties on the east of the canal currently have single family residences while the properties to the west are currently undeveloped. The canal was originally permitted in 1979 (Major CAMA 52-79) to be excavated from high ground with the dimensions of 500ft long by 50ft to 100ft wide by -6ft below NWL. Since the basin was originally permitted a 400ft long by 30ft wide channel by -6ft below NWL was excavated in the Albemarle Sound. Due to shoaling at the mouth of the canal extending to the boat ramp, the canal has been excavated six times since the permit was originally issued (2002, 2003, 2012, 2015, 2016, and 2017). Although the proposed work can be permitted through the Division of Coastal Management General Permit process, the applicant is applying for this Major CAMA permit so they will not have to obtain a new permit on a yearly basis. The Albemarle Sound at the project site is classified as SB by the Environmental Management Commission and Coastal by the Marine Fisheries Commission. PROJECT DESCRIPTION The applicant is proposing to perform maintenance excavation (170ft by average of 20ft) beginning at the mouth of the canal and extending south towards the first boat basin in the canal to -3ft below NWL. The applicant is proposing to excavate their portion of the canal extending approximately 19ft to 35ft from the eastern bulkhead removing approximately 77 cubic yards. The work will be performed using an excavator on the shore and the spoil will be placed along the high ground adjacent the bulkhead. ANTICIPATED IMPACTS The project will result in localized turbidity due the excavation of the material removing 77 cubic yards of sandy material. DATE: October 9, 2017 Consistency Determination: The request is consistent with/not in conflict with the 1994 Washington County Land Use Plan certified by the CRC on July 29, 1994. Overview: The subject property consists of a 1.94 acre tract with approximately 180 linear feet of shoreline along a manmade canal and 40 linear feet of shoreline along the Albemarle Sound. The man-made canal has divided ownership, with the eastern portion being owned by the applicant. Water depths in the canal range from -1.5 to -5 feet below Normal Water Level (NWL). Shoreline adjacent to the canal is located within the AE Floodzone. The subject property is grassed with few trees and contains approximately 585 feet of Bateman's Beach Road including its terminus at the manmade canal. Existing shoreline improvements consist of bulkhead, and a boat basin and boat ramp along the manmade canal. The canal was originally permitted in 1979 (Major CAMA 52-79) to be excavated from high ground with the dimensions of 50 foot to 100 foot wide, 500 foot long, and -6 feet below NWL. Since the basin was permitted, a 30 foot wide by 400 foot long channel -6 feet below NWL was excavated in the Albemarle Sound. Due to shoaling at the mouth of the canal extending to the boat ramp, the canal has been excavated six (6) times since the permit was originally issued. Maintenance excavation has been permitted three (3) times over the past four (4) years. Although maintenance excavation can be permitted through a General Permit, the applicant is applying for a Major Permit so she will not have to obtain a new permit every year. Maintenance excavation of a 20 foot wide and 170 foot long area of the canal to a depth of -3 feet is proposed. Excavation will begin at the mouth of the canal and extend south toward the boat basin. Excavation will extend 19 to 35 feet from the eastern bulkhead. The work will be performed using an onshore excavator. Spoil will be placed on high ground adjacent to the bulkhead. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. The canal is currently protected by a bulkhead along the eastern side while the western side has some remnants of bulkheads or is currently not protected.
