Dear Mr. Filippini, Jr.:
I have reviewed the information submitted to this office in your inquiry
concerning the necessary filing of an application for a major development
permit under the Coastal Area Management Act. After making a site
inspection on 12/18/2009, 1 have determined that the activity you propose is
exempt from needing a major development permit as long as it remains
consistent with your site drawing and materials list submitted on December
17, 2009, and meets the conditions specified below. If your plans should
change and your project will no longer meet these conditions, please contact
me before proceeding.
MAINTENANCE AND REPAIR - [ G.S. 113-103(5)(B)(5) and 15A NCAC 7K.0103(a)]
- Maintenance and repairs (excluding replacement) necessary to repair
damage to structures caused by the elements are specifically excluded
from the definition of development under the conditions and in the
circumstances set out in G.S. 113A-103(5)(b)(5). Individuals required to
take such measures within an AEC shall contact the local CAMA
representative for consultation and advice before beginning work.
Structures may be repaired in a similar manner, size and location as the
original structure. No expansions or additions are permissible. The repairs
are limited to 50% of the market value of the existing structure and the
following specific conditions.
1. The project consists of the repair of non-structural concrete on the
underside of the pier and pier house structure and located above the
Normal High Water Level as described in letters from both the General
Contractor and Engineer.
2. The proposed repairs shall be consistent with all other applicable local
ordinances and North Carolina Building Code standards.

3. Appropriate devices, measures and/or structures shall be implemented
to capture all material removed from the pier structure and to ensure
that materials do not enter adjacent watercourse and property.
4. The proposed project must not alter the land form or vegetation of a
frontal dune or the beach access.
This exemption to CAMA permit requirements does not alleviate the necessity
of your obtaining any other State, Federal or Local authorization and N.C.
Building Permits. This exemption expires 90 days from the date of the letter.

This is in response to your request and communication to me by Vincent Barger of Allspan
Construction Co. and by George Alsma, Architect, to examine the under -floor area of the
pier -house and surrounding structure and to give my views on some deficiencies which you
have noted.
On August 7, I went to the Pier and made a visual inspection of some reported cracks and
surface defects in the beam structure of the pier -house floor. I talked to you on that day by
phone prior to my visit I had been sent some photos by Vincent and also made some photos
on that date.
I noticed several defects which I think need attention and will list the categories and
recommended repair below.
1. Spalled concrete in beams at 3 locations. (1) at the end of a ramp beam next to the south
side beam of the pier -house floor, (2) At the southeast comer of the pier -house , (3) At the
side of a beam under the pier -house. Item 1 and 2 are at an end and comer which has
cracked and partly displaced probably due to an inadvertent tie or hang-up across the
control joint. Item 3 appears along side the beam where the slab was not provided a smooth
and even bearing. None of these present an indication of immediate pending danger , but
should be repaired as soon as possible.
REPAIR: Remove all loose concrete. If epoxy coating on re -bar is damaged, repair with
Armatec mating per Sika recommendations. Patch concrete with Sika-top per Sika
instructions.
2 Rust spots. There are several rust spots underneath which are usually caused by a
hardware item such as a beam support left too close to the surface. They present no
immediate problem, but should be repaired as soon as possible.
REPAIR: Grind away the rust and underlying steel at least 1" deep and apply a patch of
Sika-top per Sika Instructions.
3. Wall water intrusion There are 3 to 4 wall segments which indicate water seeping from
the wall base in 2 zones on the north wall and 2 zones on the south walL These could be
cased by either (or a combination of) (1) water intrusion thru the wall envelope from the
outside (2) water leaking around the window flashing (3) A plumbing leak within the wall
(4) surface water from wet area floors(toilets or kitchen) running underneath the walls and
showing up on the face of the concrete beam. REPAIR: First, the actual cost should be
determined. Maybe, there is not a flashing problem, but most of the time, this will require

opening the wall from one side or the other. If the water reaching the concrete has caused it
to crack or deteriorate, the concrete should be repaired same as noted above.
4. Deck/floor control joints. Many -of the,control joints have deteriorated(mostly worn-out)
sealant in the joints. Some have pulled loose,from the sides. and some have a longitudinal
crack The joint running along the south side of the pier house next to the ramp and along the
ramp as it runs out to the pier is worn out and has foreign material and grass in it This is bad
because it allows water to ran into it and in some places collect and in some places carry sand
where it should not be and fill the joirrt When freezing weather comes, this causes stresses
which will crack and deteriorate the joint and concrete very quickly.
REPAM The joints surrounding the pier house should be deaned and have the sealant re-
placed Seethe original drawings for the joint and sealant details.
5. Pier control joints. AJI of the transverse control joints should be checked as soon as '
possffile for proper maintenance. Those showing failure should be cieaned(remove^ old, t.
sealant) and re -sealed per original details. -
CALK AND JOINT SEALANT has a normal life in this exposure of 6 to 10 years dependant
of its exposure to sunlight heat, cold, salt, sand, some chemicals, and extremes of any.of
these. The sealants are vital to the overall condition of the structure.
6. Side Grout joint at base of guard rail. This grout joint which fills the drain space between
dram holes has deteriorated. in some locations and should be checked for removal of sand and
foreign material. Where a crack has formed large enoagh to allow water to seep thm, it
should be re -grouted
7. Surface deterioration -Until a few years ago, it was accepted by the industry to build with
concrete and understand that it will last for 30 to 40 years and the aging(deterioration) will
progress at an mcreasnrg rate until it is un-safe or unusable But now there are coatings and
preservatives which reduce the rate by preventing the salt from penetrating the concrete and
reaching the reinforcing steel and causing both to break down. Some of this was done on
the piling in the splash zone(epoxy coating). It was cost prohibitive to do more when this
was built Now there are clear and colored coatings as well as cementitious coatings which
are being used, on floors and decks which prolong the life of the concrete exceptionably well
These are becoming common on balcony decks on hotels/.condos along the shore. Whether
or not you choose to add any prolonging coatings to the surfaces, at the least, we recommend
that you include in your -maintenance schedule periodic: inspections :to.locate any_areaswhich - are beginning to deteriorate and to take preventative measures as soon as possible.
I understand that ALLSPAN is experienced in doing the above type of work and with this
letter should have sufficient instructions to proceed with whatever repair you should direct

Proposal and Quote for Miscellaneous Concrete Repairs
At Johnny Mercer's Pier, Wrightsville Beach, NC
We hereby submit specifications and estimates for furnishing labor, materials, tools and equipment to
perform miscellaneous concrete repairs to the pier and pier house structural concrete per the basic
repair instructions and guidance provided in a letter from Mr. Charles E. "Bud" Davis of Criser
Troutman Tanner Consulting Engineers, dated August 14, 2009, and with the scope based on a walk-
through with the Owner on November 17, 2009. The included work in this proposal is as follows:
Large Concrete Spall and/or Large Broken Concrete Area Repairs:
♦ Repairs to be made at five (5) separate identified (overhead) locations on the underside of the
pier and/or pier house structure(s).
♦ Chip and remove broken, cracked and/or otherwise damaged concrete from the areas to be
repaired.
♦ Coat any and all exposed reinforcing steel or other exposed embedded steel items with Sika
Armatec 110 EpoCem epoxy -modified, cementious coating with corrosion inhibitors.
♦ After curing of the Armatec coating, form (as required) and repair/rebuild the area of the missing
and removed concrete back to the original profile and dimensions with SikaTop 123 Plus
polymer -modified, Portland cement, non -sag mortar.

Grout Repair/Replacement at Exposed (or Rusted) Pier Deck Precast Plank Anchors:
♦ Repairs to be made at approximately eight (8) separate identified locations on the topside of the
pier deck.
♦ Chip away loose grout and/or visibly rust -stained grout areas over and around the anchors.
♦ Chip down into the.good grout (or concrete) to provide adequate depth for proper bonding of the
new grout.
♦ Coat any exposed portions of the steel plank anchors with Sika Armatec 110 EpoCem epoxy -
modified, cementious coating with corrosion inhibitors.
♦ Apply non -shrink, cementious grout into the created depression or cavity around and over the
end(s) of the steel plank anchor(s) back to level with the surrounding pier deck surface.
Repair of Underside or Vertical Small Rust Blooms and/or Exposed Steel Areas:
♦ Repairs to be made at approximately ten (10) to fifteen (15) separate identified locations on the
underside of pier or pier house structure(s) and/or on the concrete pier support pilings.
♦ Chip'away loose concrete and/or visibly rust -stained concrete areas over and around the.
corroded and/or exposed steel embed item(s).
Chip down into the good concrete to provide adequate depth for proper bonding of the new repair
mortar.
♦ Coat any exposed portions of the steel embed items with Sika Armatec 110 EpoCem epoxy -
modified, cementious coating with corrosion inhibitors.
♦ Apply SikaTop 123 Plus.polymer-modified,.Portland-cement,-non-sag mortar into the created
depression or cavity around and over the end(s) of the steel exposed steel embed item(s) back to
even with the surrounding overhead horizontal or vertical surface of the structure or support
piling(s).

♦ Repairs to be made at approximately five (5) separateidentified locations at or near grade -level
and/or on the topside. of the pier, pier house, stairs and stair railings, etc. (where no manlift is
required for access to the repair areas).
♦ Chip away loose concrete and/or visibly rust -stained concrete areas over and around the
corroded and/or exposed steel embed item(s).
♦ Chip down into the good concrete to provide adequate depth for proper bonding of the new repair
mortar.
♦ Coat any exposed portions of the steel embed items with Sika Armatec 110 EpoCem epoxy -
modified, cementious coating with corrosion inhibitors.
♦ Apply SikaTop 123 Plus polymer -modified, Portland cement, non -sag mortar into the created
depression or cavity around and over the end(s) of the steel exposed steel embed item(s) back to
even, with the surrounding,overhead horizontalor vertical surface of,the structure or support '
piling(s).
Cleaning and Repair/Recaulking of Large (>_ 1" Width) Deck Control Joints:
♦ Cleaning and repair/recaulking of approximately 130 LF to 140 LF (total) of identified joints of this
size/width along the pier deck (where it abuts the pier house and adjoins the access ramp) and
the access ramp (where it abuts the pier house structure).
♦ Clean out a d,;gmoved.any dirt, trash, debris and,.plant matter -from the joints to.be
repaired/recaulked.
♦ Remove any loose expansion joint material and replace with (layers of) new expansion joint
material (as required).

♦ Install appropriately sized foam backer rod down in the joint below the deck or ramp surface to
contain the new joint filler material.
♦ Install new Tremco Vulkem 45 self -leveling polyurethane caulk to fill the joint for the full -width of
the joint up to level with the lowest surrounding concrete and at a minimum depth of
approximately''/" to'/<".
Cleaning and Repair/Recaulking of Standard Width ('/" to <1" Width) Deck Control Joints:
♦ Cleaning and repair/recaulking of approximately 35 LF to 40 LF (total) of identified joints of this
size/width along the access ramp (where it abuts the pier house structure).
♦ Clean out and removed any dirt, trash, debris and plant matter from the joints to be
repaired/recaulked.
♦ Remove any loose expansion joint material and replace with (layers of) new expansion joint
material (as required).
♦ Install appropriately sized foam backer rod down in the joint below the deck or ramp surface to
contain the new joint filler material.
♦ Install new Tremco Vulkem 45 self -leveling polyurethane caulk to fill the joint for the full -width of
the joint up to level with the lowest surrounding concrete and at a minimum depth of

We hereby propose to furnish labor, materials, tools and equipment to complete the, above described
and quantified repairs in accordance with the description and specifications above,
for the sum of $ 10,250.00.
All material is guaranteed to be as specified. All work to be completed in a workmanlike manner
according to standard practices. Before any additional repairs over and above the defined scope in
the base proposal are preformed, written approval will be obtained from the Owner and will be billed
as an extra charge over and above the base proposal amount. The work will be billed based on the
alternate prices listed above or, if the type of repair is a new type not identified in this proposal, a new
estimate and written change order proposal will be submitted for Owner's approval prior to
commencement of the additional work.
