In an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to HERON CAY HOME OWNERS ASSOCIATION, authorizing development in the Estuarine Shoreline - ORW
(AEC) ON HWY 210 / ISLAND DRIVE in NORTH TOPSAIL BEACH IN ONSLOW COUNTY, as requested in the
permittee's application, dated 10/0812009. This permit, issued on 10/26/2009, is subject to compliance with the
application and site drawing (where consistent with the permit), all applicable regulations and special conditions and
notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may
cause the permit to be null and void.
This permit authorizes: REMOVE 85 SOFT. ASPHALT, MOVE IRRIGATION LINES FROM ADJACENT OWNERS PROPERTY TO
CURRENT OWNERSHIP PROPERTY OF HERON CAY
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 10/08/2009 DRAWINGS BY ANDY CAVENDER LANDSCAPING, INC.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 910-328-1349 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further wdtten permit
approval. All work must cease when this permit expires on:

In issuing this permit it is agreed that this project is consistent with the local Land

completion.

In accordance with the North Topsail Beach Flood Damage Prevention Ordinance, a Floodplain Development Permits is hereby granted to
CAVENDER ANDY to conduct development activities within the area of special flood hazard on property
located at ISLAND DRIVE NTB. This Permit is issued to the aforementioned individual,
firm, partnership, etc. for the purpose noted above and in accordance with the North Topsail Beach Flood Damage Prevention Ordinance,
Floodplain Development Permit and attachments thereto; and is subject to the following modifications and/or performance reservations:

2. Pursuant to Aticle 4. Section B (3) (a) ii) of the North Topsail Beach Flood Damage Prevention Ordinace, tt shall be the duty of the permit holder to
submit to the Floodplain Administrator the Elevation Certification within 7 calendar days after establishment of the lowest floor.
3. All buildings or structures shall be located and comply with all applicable CAMA setback requirements and as specified by your CAMA MINOR PERMIT#_
4. Below DFE enclosures are to be used for parking vehicles, building access, or storage only. Living space below DFE is not only a violation but will
result in an insurance submit -to -rate to FEMA headquarters which will require an explanation from the town. If the plans indicate storage below DFE, the
flood development permit requires flood resistant materials below DFE, all electrical work below DFE within enclosed area will be in accordance with
NEC210.70A3 for storage room in a regulated flood zone and a statement on the certificate of occupancy will indicate that "habitable space" below DFE
is considered a violation of the building and flood codes.
5. Proper Erosion and Sediment control measures shall be installed and maintained in accordance with North Carolina State Standards during fill operations.
6. All buildings or structures shall be elevated so that the bottom of the lowest supporting horizontal member (excluding pillings or columns) is AT OR ABOVE
DESIGN FLOOD ELEVATION (BFE + 2 feet freeboard MSL) [NGVD 1929 or NAVD 19881 with all space below the lowest supporting member open so as
not to impede the flow of water. Open lattice work or decorative screening may be permitted for aesthetic purposes only and must be designed to breakawa-
in the event of abnormal wave action pursuant to the North Topsail Beach Flood Damage Prevention Ordinance.
7. All attendant utilities shall be AT OR ABOVE DESIGN FLOOD ELEVATION (BFE + 2 feet freeboard MSL) [NGVD 1929 or NAVD 19881.
8. All building or structures shall be securely anchored on pillings or columns and meet the following minimum criteria:
a. All pillings and columns and the attached structures shall be anchored to resist flotation, collapse, and lateral movement due to the effect of wind
and water loads acting simultaneously on all building components.
b. A registered professional engineer shall certify that the design, specifications and plans for construction are in compliance with the provisions
contained in Article 4, Section B, Article 5, Section G (3)(a&b), Article 5, Section G(4) and Article 5, Section G(6) of this ordinance on North
Carolina's "National Flood Insurance Program V-Zone Certification" form dated May 1992 or newer.
9. Non -compacted fill may be used around the perimeter of a building for landscaping and/or aesthetic purposes. The local floodplain administrator
shall approve design plans for landscaping and/or aesthetic fill only after the applicant has provided an analysis by an engineer, architect, and/or soil
scientist which demonstrates that the following factors have been fully considered to meet compliance of this ordinance:
a. Particle composition of fill material does not have a tendency for excessive natural compaction;
b. Voulme and distribution of fill will not cause wave deflection to adjacent properties; and,
c. Slope and fill will not cause wave run-up or ramping.
10. Maximum thickness of concrete shall not exceed 4 inches. The slab must be frangible to allow the slab to collapse if significantly undercut by scour,
rather than damaging the structure. The use of fill beneath an elevated building to elevate a slab above natural grade is considered an obstruction
and is therefore prohibited.
11. Lattice work or decorative screening shall be allowed below the base flood elevation provided they are not part of the structural support of the building
and are designed so as to breakaway, under abnormally high tides or wave action, without damage to the structural integrity of the building on which
they are to be used and provided the following design specifications are met.
a. No solid walls shall be allowed. Only breakaway walls will be allowed BELOW DESIGN FLOOD ELEVATION (BFE + 2 feet freeboard MSL)
[NGVD 1929 or NAVD 1988]. Material shall consist of wood or mesh screening only.
b. Design safe loading resistance of each wall shall be not less than 10 nor more than 20 pounds per square foot or,
c. If more than 20 punds per square foot, a registered professional engineer or architect shall certify that the design wall collapse would result
from a water load less than that which would occur during the base flood event, and the elevated portion of the building and supporting
foundation system shall not be subject to collapse, displacement, or other structural damage due to the effects of wind and water loads
acting simultaneously on all building components (structural and non-structural). The water loading values used shall be those associated
with the base flood. The wind loading values used shall be those required by the North Carolina State Building Code.
12. If aesthetic lattice work or screening is utilized, such enclosed space shall not be designed to be used for human habitation, but shall be designed to be
used only for parking of vehicles, building access, or limited storage of maintenance equipment used in connection with the premises.
13. Prior to construction, plans for any structures that will have lattice work or decorative screening must be submitted to the local administartor for approval.
14. Any alteration, repair, reconstruction or improvement to a structure shall not enclose the space below the lowest floor except with lattice work or decorative
screening, as provided for in the North Topsail Beach Flood Damage Prevention Ordinance.
15. No manufactured homes shall be permitted except in an existing manufactured home park or subdivision. A replacement manufactured home may be
placed on a lot in an existing manufactured home park or subdivision provided the anchoring and elevation standards are in compliance with the North
Topsail Beach Flood Damage Prevention Ordinance.
16. Recreational vehicles shall be permitted in Coastal High Hazard Areas provided that they meet the provisions of the North Topsail Beach Flood Damage
Prevention Ordinance.
17. Temporary Structures shall be permitted in Coastal High Hazard Areas provided that they meet the provisions of the North Topsail Beach Flood Damage
Prevention Ordinance.

In 1974, the Forth Carolina General Assembly passed the Coastal Area
Management Act and set the stage for guiding development in fragile and
productive areas that border the state's sounds and oceanfront. Along with
requiring special care by those who build and develop, the General Assembly
directed the Coastal Resources Commission (CRC) to implement clear
regulations that minimize the burden on the applicant.
This application for a minor development permit under CAMA is part of the
Commission's effort to meet the spirit and intent of the General Assembly. It
has been designed to be straightforward and require no more time or effort
necessary from the applicant. Please go over this folder with the Local Permit
Officer (LPO) for the locality in which you plan to build to be certain that
you understand what information he or she needs.
Under CAMA regulations, the minor permit is to be issued within 25 days once
a complete application is in hand. Often less time is needed if the project is
simple. The process generally takes about 18 days. You can speed the approval
process by making certain that your application is complete and signed, that
your drawing meets the specifications given inside and that your application
fee is attached.
Other permits are sometimes required for development in the coastal area.
While these are not CAMA-related, we urge you to check with the Local
Permit Officer to determine which of these you may need. A listing is included
on page 2 of this folder.

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and acknowledge
that notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened by
changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is Z ' feet per year.
The rate was established by careful analysis of aerial photographs
of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
SO' feet landward in a major storm.
The flood waters in a major storm are predicted to be about
31 t & feet deep in this area.

Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and requirements
by signing this notice in the space below. Without the proper
signature, the application will not be complete.
Inlet Hazard Area
SPEC IAL NOTE: This hazard notice is required for development
in areas subject to sudden and massive storms and erosion. Permits
issued for development in this area expire on December 31 of the
third year following the year in which the permit was issued.
Shortly before work begins on the project site, the Local Permit
Officer must be contacted to determine the vegetation line and
setback distance at your site. If the property has seen little change
since the time of permit issuance, and the proposed development
can still meet the setback requirement, the LPO will inform you
that you may begin work. Substantial progress on the project
must be made within 60 days of this setback determination, or
the setback must be remeasured. Also, the occurrence of a major
shoreline change as the result of a storm within the 60-day period
will necessitate remeasurement of the setback. It is important
that you check with the LPO before the permit expires for official
approval to continue the work after the permit has expired.
Generally, if foundation pilings have been placed and substantial
progress is continuing, permit renewal can be authorized. It is
unlawful to continue work after permit expiration.

Setting Back for Safety: A Guide to Wise Development Along the Oceanfront
When you build along the oceanfront, you take a calculated risk.
Natural forces of water and wind collide with tons of force, even
on calm days.
Man-made structures cannot be guaranteed to survive the force
of a hurricane. Long-term erosion (or barrier island migration)
may take from two to ten feet of the beach each year, and,
sooner or later, will threaten oceanfront structures. These are the
facts of life for oceanfront property owners.
The Coastal Resources Commission (CRC) has adopted rules
for building along the oceanfront. The rules are intended to avoid
an unreasonable risk to life and property, and to limit public and
private losses from storms and long-term erosion. These rules
lessen but do not eliminate the element of risk in oceanfront
development.
As you consider building along the oceanfront, the CRC wants
you to understand the rules and the risks. With this knowledge,
you can make a more informed decision about where and how to
build in the coastal area.
The Rules
When you build along the oceanfront, coastal management rules
require that the structure be sited to fit safely into the beach
environment.
Structures along the oceanfront must be behind the frontal dune,
landward of the crest of the primary dune, and set back from the
first line of stable natural vegetation a distance equal to 30 times
the annual erosion rate (a minimum of 60 feet). Large structures
(multi -family residential structures greater than 5,000 square feet
and nonresidential structures greater than 5,000 square feet) must
be set back from the first line of natural stable vegetation a distance
equal to 60 times the annual erosion rate of 120 feet, whichever

is greater. If the erosion rate is greater than 3.5 feet/year, the
setback is 30 times the erosion rate plus 105 feet.
The Reasons
The beachfront is an ever -changing landfonn. The beach and the
dunes are natural "shock absorbers," taking the beating of the
wind and waves and protecting the inland areas. By setting back
30 or 60 times the annual long-term erosion rate, you have a
good chance of enjoying the full life of the structure. At first, it
seems very inviting to build your dream house as close to the
beach as possible, but in five years you could find the dream has
become a nightmare as high tides and storm tides threaten your
investment.
The Exception
The Coastal Resources Commission recognized that these rules,
initially passed in June 1979, might prove a hardship for some
property owners. Therefore, they established an exception for
lots that cannot meet the setback requirement. The exception
allows buildings in front of the setback line if the following
conditions apply:
(1) the lot must have been platted as of June 1, 1979, and is not
capable of being enlarged by combining with adjoining land under
the same ownership; (2) development must be as far back on the
property as possible and in no case less than 60 feet landward of

and square footage must be met; and (5) all other CAMA, state
and local regulations must be met.
The exception is not available in the Inlet Hazard Area.
To determine eligibility for the exception, the Local Permit Officer
will make these measurements and observations:

exception setback (maximum feasible)
rear property line setback
max. allowable square footage on lowest floor
lot area as calculated from vegetation line
piling length needed to extend 4 feet below MSL

Pursuant to NCGS 113A-119(b), NORTH TOPSAIL BEACH, a locality authorized to issue CAMA
permits in Areas of Environmental Concern, hereby gives notice that on 10/08/09, ANDY
