HomeMy WebLinkAboutPC_09-01_WeirPander County PC 2009.01 Local Government Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development In an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management' Issued to Dewey Fred Weir, Jr., authorizing development in the Estuarine Shoreline - ORW (AEC) at Great Oak Drive, in Hampstead, Pander County, as requested in the permlitee's application, dated March 30, 2009. This permit, issued on. August 7, 2009, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below, Any violation of these terms may subject permittee to a fine, Imprisonment or civil action, or may cause the permit to be null and void. . This permit authorizes: Extension of Great Oak Drive from edge of existing pavement approximately 535 feet In length northeastward, not to exceed 9,905 square feet in built upon area. (1) All proposed development and associated construction must be done in accordance with the revised permitted work plat drawings(s) dated received by Pander County on April 6, 2009, (2) All construction must conform to the N,C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes In the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (7) All unconsolidated material resulting from associated construction activity shall be retained on site by effective sedimentation and erosion control measures, Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any area proposed for grading within the 30' buffer from the normal high water must be contoured to prevent additional stormwater runoff to the adjacent marsh, This area shall be Immediately vegetatively stabilized, and must remain in a vegetated state. The proposed street extension has been shortened, reducing the disturbed area to less than one acre. As a result of the reduced disturbed area this project no longer requires an Erosion and Sedimentation Control Permit. Weir, Jr., at Great Oak Drive, adjacent to the Atlantic Intracoastal Waterway, in Pender County. The project consists of the extension of Great Oak Drive approximately 535 linear feet, not to exceed 9,995 square feet of built upon area. The proposed project has been determined to comply with local regulations and the Rules of the Coastal Resources Commission (71-1.0209), and as such, a permit has been issued to authorize the development. I have enclosed a copy of the permit as well as the applicable rules. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for a Contested Case Hearing. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days of the disputed permit decision. Due to a reduction in the scope of work, a June 25, 2009 letter from DWQ exempted the project from obtaining a stormwater management permit. As such, the referenced project is again considered minor development and will be facilitated through the local jurisdiction in accordance with NC GS 113A —118 (d)(2). This letter serves to notify you as an adjacent property owner that the minor permit application process will again be processed through our office. Accordingly, on April 29, 2009, a letter from the North Carolina Division of Water Quality (DWQ) stated that the total scope of work, including future road extension and development of lots in the subdivision, would be considered a common development plan. Therefore, a stormwater permit will be required through DWQ as the development plan exceeds the threshold of 10,000 square feet in built upon area. In accordance with NC GS 113A —118 (d)(1), the proposed development will require a CAMA Major development permit to be issued through the Division of Coastal Management (DCM) Wilmington Regional Office. Therefore, I am unable to process the request for a CAMA Minor Permit and as such the application process will be terminated. As for the USPS receipts for 09-01, we never did receive them as certified from the applicant. Upon submission I immediately noticed this and referenced 7J .0204(5)(B) where it discusses the notification requirements for minor permits. My interpretation of the language here was that certified mailings were not specifically required, but rather what they had submitted did constitute "actual notice... which satisfies the Local Permit Officers that a good faith effort has been made to provide the required notice." Part of this interpretation was the fact that I had been in communication verbally and in writing with the adjacent property owners throughout the process so was confident that they had been adequately notified.
