New Hanover County 09.046 Local Government Permit Number CAMA MINOR DEVELOPMENT -� PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management" Issued to John W. and June E. King Jr. authorizing development in the Estuarine Shoreline (AEC) at 6604 Sedgewood Road in Wilmington,. N.C. as requested in the permittee's application dated November 19,2009. This permit issued on December 18, 2009, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of a single family residence, and infiltration basin as per drawings submitted. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on November 19, 2009. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations., Contact New Hanover County Inspections department (Building Division) for any questions pertaining to this. You may call the New Hanover County Public Service Center with questions pertaining to needed permits at 798-7304. Questions pertaining to City of Wilmington zoning and variance BADV-2-0409 call 910-254-0900. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at ((910) 798-7118 for a final inspection at completion of work. RECEIVED (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2012 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. (Infiltration basin is approved per drawings submitted) (6) Unless specifically -allowed in 15A NCAC 07H. 0209(d) (10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of work shall encroach into the 30 ft. buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) This permit does not authorize development within any wetlands or open water area. ""No development and or materials will be allowed in 404 wetlands or coastal wetlands. (9) All other disturbed areas shall be vegetative stabilized (planted and mulched) within 14 days of construction completion. King, Jr. and wife June King, for a variance for property located at 6604 Sedgewood Road, to allow a dwelling -to be constructed within a portion-ofthe-requiredseventy-five (75) foot setback in a Conservation Overlay District (COD). The Board of Adjustment having heard the evidence.presented at the hearing makes the following: FINDINGS OF FACT 1. The,propertyat 6604 Sedgewood Road is a pie -shaped lot with substandard width at the northern end along the street and a very wide width along the southern boundary of the lot along the marsh. 2. The.property contains 19,911 square feet (.46 acres) and is Lot number 21 located in the Parsley Woods Subdivision. 3. The property is currently vacant of any structures. 4. The property is zoned R-15, Residential District and is partially within a Conservation Overlay District (COD). 5. The propertyAot was included in the Parsley Woods Subdivision while under the jurisdiction.of New Hanover County and was subject to a Conservation Overlay District -that required a 75-foot setback from the marsh when the lot was created and the subdivision approved by the County;and the COD setback line was identified as a linear line on;the survey of the lot as shown in Exhibit "King l (a)". 6. The property and the Parsley Woods Subdivision was included in an area annexed into the City of Wilmington and zoned R-15, Residential District and became subject to the City's zoning regulations on January 31, 1999. 7. The City's COD regulations are set forth in Chapter 18 "Land Development Code Article 6, Division III of the City Code and were recently amended on March 24, 2009. 8. The COD designation for this property is "salt marsh" (coastal wetlands), and the property is subject to the 75-foot residential "conservation space -setback" (COD setback) set forth in Section 18-341 of the City Code to protect the resource. The City's COD regulations also increased the front setback for the property by 5 feet. 9. The applicants purchased the property about a year ago knowing.the County COD line delineation -but without a current COD line study. 10. When the 75-foot COD line was studied for the applicants in February 2009, it was determined'to be a jagged line as shown in Exhibit "King 1(b)", rather than a straight line, and the building area on the lot was significantly reduced to approximately 2351 square feet. 11. The changes in the location and, configuration of the COD line could be due to natural conditions as well as better delineation techniques. 12. Section 18-341(d)(5)a of the City Code permits encroachments into the COD setback up to one half the depth and one half the length of the setback provided certain conditions are met relative to stormwatec control as set forth in, as follows: i. All runoff from any impervious surface is infiltrated or otherwise treated so as to not impact the resource by us*mga stormwater treatment device designed to infiltrate runoff from the 1-year 24-hour storm; or ii. Where soils allow, pervious pavement is used'with sub -base filtration capacity ,designed to be equivalent. to the:required protection; or iii.. Any structure has•a vegetated roof constructed in accordance with the State BNT manual. 13_ The applicants can meet condition'V and/or.condition "u' of Section 18-341(d)(5)a. 14. The area of encroachment allowed with:conditions on the property is a rectangular shape along 50% (1/2) of the COD.line and measures approximately 1688 square feet. 15. To meet the COD regulations, the applicants would be required to build their house as a large box along the northern one-half of the COD line which -would intrude 37.5 feet into the,required COD setback from the marsh and 1762 square feet. The house would. also block their adjacent neighbors' views of the marsh. 16. The applicants propose an encroachment along 100% of the length of the required setback with an encroachment area of approximately 1400 square feet, which is less than the square, footage that is•allowed under the 50% requirement. 17. The applicants propose to use impact development techniques and build an accordion - shaped house on the property with approximately 2500 square feet of heated area with a garage that will encroach up to twenty-two (22) feet and up to I427 square feet -into the required COD,setback as shown in Exhibit "King 1(c)". 18. The design of the house as shown in Exhibit 'Ting i(c)" encroaches an average of 14 feet into the COD setback rather than the 37.5 feet permitted under the COD regulations and lessens the environmental impact on the COD as the house will be further back from the salt marsh, 19. The encroachment into the required COD setback would be less or non-existent if the lot was not pie -shaped or if the pie -shape of the lot was reversed. Based on the foregoing Findings of Fact, the Board of Adjustment makes the following: CONCLUSIONS 1. Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district. 2. Literal; interpretation of the provisions of the Land- Development Code would deprive the applicant of rights commonly enjoyed by other properties in the same district.under the terms of the Land Development Code. The site is situated on 0.45 acres in the Parsley Woods Subdivision off of Wrightsville Avenue on Bradley Creek. All stormwater runoff from impervious areas within the 75 ft COD setback must be infiltrated or otherwise treated to as to not impact the resource by using a stormwater treatment device designed to infiltrate runoff from the 1-yr, 24-hr storm. The soils on site are Craven Fine Sandy Loam, Class C soils. A curve number of 74 was used for grassland in good condition for non impervious areas for the site. PROPOSED IMPROVEMENTS/ STORMWATER The plans for treating runoff from the 1-yr, 24-hi storm are to use a shallow depressed area on the downslope side of the house to capture and infiltrate the runoff from the 1-yr, 24-hr storm. The soils report prepared by RFTS, PLLC indicated that the seasonal high water table was 16 inches below the surface and the infiltration rate of the soils was 0.59 in/hr. The elevation at the test location was 6.5 ft. The seasonal high water table is at elevation 5.2 and the bottom of the infiltration trench is set at elevation 7.5. Runoff in excess of the 1-yr, 24-hr storm will be allowed to sheet flow over a sodded berm 801f in length at elevation 8.0 and allowed to sheet flow into the natural vegetation between the infiltration area and Bradley Creek. Based upon information provided to us by the Architect, runoff from 529 sf of building area and 271 sf of decking must be treated. The infiltration area as designed is actually treating runoff from 1,046 sf of impervious area. This is due to the shape of the house and slopes of the roof tops. The drainage area for the infiltration area is 2,669 sf. General (a) Purpose. The purpose of the Conservation Resource regulations is to protect important environmental resources within the city. Protection of these resources is necessary to maintain the city s diverse and ecologically important natural systems; to preserve the citls estuarine systems important for fin fis'nins and sheii nshing; to preserve natural open space; and to protect the resources critical to the city's economic development and tourism industry. The conservation resource regulations shall be in addition to any other regulations that may apply. In the event that the conservation resource regulations conflict with other regulations, the more stringent regulations shall take precedence. (b) Applicability. The development and improvement of property, including the subdivision of land, shall be subject to these performance controls if the parcel is associated with a conservation resource as defined in this division. A parcel is considered to be associated with a conservation resource if either the resource is contained partially or wholly on the parcel or if the resource is located next to a parcel such that a resource setback as defined herein extends into the subj ect parcel. If a parcel contains a resource that was defined under any previous regulations in the county or city, then it is considered to be associated with a resource under these regulations and the standards herein shall apply. It is the responsibility of the applicant for a development resource. controls: (1) The construction of one single-family detached structure or one residential duplex, or the location of a manufactured home on a parcel or lot of less than one (1) acre unless the lot was part of a subdivision that was subject to conservation resource protections either under this division or any prior city or county conservation resource protection ordinances or regulations. The exemptions do not extend to any accessory structures. (2) Commercial, industrial, office or institutional development on a parcel less than one (1) acre in area unless the development was part of a development or subdivision that was subject to conservation resource protections either under this division or any prior city or county conservation resource protection ordinances or regulations. (3) The development or redevelopment of a parcel in the Urban Waterfront as defined by NC Administrative Code 15 NCAC 07H .0209(g) that meets the following conditions: a. To the extent practical, the project meets the baseline criteria of Article 10 for exceptionally designed projects; b. The project includes an extension of or connection to the Riverwalk consistent with city plans and design standards and meets ADA design standards along with a public access easement approved by the City Attorney, 9 OK C. The project includes public access traversing the project connecting to the Riverwalk with easements approved by the City Attorney spaced at intervals of approximately two hundred (200) feet, or intervals dictated by established or approved street patterns. The establishment of a vegetated buffer is intended to promote high water quality in the creeks and sounds, to protect the public health and to ensure the protection of the natural resources within the City of Wilmington. A properly vegetated buffer is essential to filter and biologically process nutrient rich ranoff, animal, wastes, and sedi,neni heiore it enters coastal creeks, canals, and rivers. Buffers also function to moderate water temperatures, maintain the desired dissolved oxygen levels in the water, and stabilize the soils immediately adjoining the stream. In urban environments, the function of a buffer is especially critical to the balance of the plant and animal life in fresh and saltwater creeks. Buffers are most effective when they contain native and naturalized plants appropriate in size, adaptability (salt tolerance, wind tolerance, etc.) and hardiness for the area. Plantsrequiring, intensive or routine maintenance should be avoided in buffer areas. (2) Applicability. We live at 6600 Sedgewood Road. In order, my specific concerns are: 1. The swale or retention pond that is to be constructed between their lot and ours. There is an approximate 4-foot drop between the two properties which naturally raises concerns about runoff. 2. It would appear that the proposed dwelling intrudes into the 75-foot CAMA setback. 3. Drawings show that approximately one half of the house will be in the COD. 4. It appears that as drawn, the house intrudes on about 1.5 feet into the setback between our two properties. In general my concerns are these : As a member of the CRC, I know that we spend a lot of time agonizing over rules and variances. If someone is going to have a permit issued at the local level to put 600-plus square feet of a dwelling within a setback zone, then we on the CRC are wasting our time. I also worked on the $6 million grant from the Clean Water Trust Fund that helped purchase Airlie Gardens. At that time, the county commissioners committed themselves to doing everything possible to keep Bradley Creek pollution free. I may be wrong, but this case calls into question the commitment made regarding Airlie. The County Environmental Planning website states: "New Hanover county's water quality has suffered in recent years. This has led to a strong community desire for greater protection and enhancement of surface and ground water resources. The County continues to work toward preventing further deterioration and loss of public uses in surface water and improvement of current water quality. I don't wish to be troublesome or a bad neighbor, but given the time and effort I've spent on conservation issues in the state and county, I can hardly keep quiet in the face of what appears to be a flaunting of pertaining rules and regulations.
