PROJECT SUMMARY: The applicant proposes to construct a pier, enlarge an existing rip rap breakwater and backfill adjacent the Albemarle Sound in Columbia, Tyrrell County. Ramsey Tyrrell County PROJECT SETTING Barry and Elaine Ramsey have submitted a Major CAMA permit request to construct a pier, platform and an uncovered deck, enlarge an existing rip rap breakwater and backfill on their property at 276 Owens Lane (off SR#1209) in the development of Albemarle Estates in the Town of Columbia, Tyrrell County adjacent the Albemarle Sound. The 1 acre site currently has a single family residence, 2 sheds, an offshore breakwater and has 404 wetlands consisting mainly of Phragmites and an area of Coastal Wetlands (Spartina patens and Scirpus spp) present. The area of coastal wetlands has eroded through the past two Hurricanes (Matthew and Hermame) leaving a small fringe on the property. In addition to the eroding wetlands the Hurricanes have eroded a large area of uplands, leaving open water within 15ft of the existing house. Following the hurricanes, repairs to the existing rip rap breakwater have been authorized. The f applicant is working with a contractor to raise the existing rip rap breakwaterl' to 1 '/z' above the W V , mK existing height and extend a return wall landward of the erosion escarpment. There will be a 5ft cs opening between the breakwater and return wall to allow water and fish passage. There are remnants of a rip rap retaining wall at the landward edge of the wetlands. After the Hurricanes there is very little left of the retaining wall but the property owners have been authorized to repair this retaining wall and backfill some open water and high grounds to pre -storm conditions to minimize further erosion threatening the structure. Both of the adjacent properties' shorelines are protected with rip rap revetments. This site was originally permitted to Hubert and Shelvia Barber (Permit number 105-90) in 1990 to bulkhead 550ft of the shoreline along the NWL which was modified in 1994 to install rip rap instead of the permitted bulkhead. A small amount of rip rap was placed in front of the entire development and raised as funds became available. The permit was renewed in August 1995 and July 1997. In 1999 the permit holders requested to renew permit 105-90 which was denied. This denial was due to the presence of coastal wetlands landward of the rip rap and the property owner to reclaim lands that had been lost over a 10 year period. The Albemarle Sound at the project site is classified as SB by the Environmental Management Commission. Water depths landward of the breakwater range from -1.5ft to -2ft NWL. Water depths waterward of,the breakwater range from -2ft and -2.5ft NWL. The Albemarle Sound is approximately 7.5 miles across at the project site. RECEIVED PROJECT DESCRIPTION DEC 21 2016 The applicant proposes to expand the footprint of the existing 192ft rip rap breakwQQ aMJP CITY 1 base width and be 3ft tall (2ft above NWL) filling an additional 384 sq ft of soft bottom. The a \applicant will baud the breakwater filling 1,532 square feet of open water, 3,685 sq ft of and sq of coastal wetlands. Additionally, the applicant is proposing to construct ,Nk a 100' x 6' pier with a 20' x 20' platform. This applicant is also proposing to construct a 10' x 15' uncovered deck on high ground immediately adjacent to the existing house and within the 30' buffer.. After construction of the uncovered deck there will be approximately 26% of impervious within the Coastal Shoreline AEC. - ANTICIPATED IMPACTS The project will result in localized turbidity due to the construction of the pier and installation of the rip rap and backfill. The construction of the pier and platform will shade 1,000 sq ft of sound bottom, and the installation of the rip rap will convert 384 sq ft of soft bottom to rip rap. Approximately 1,532 sq ft of open water, 3,68§ sq ft of 404- wedmds and-gaT sq ft of coastal wetlands will be converted to high ground. 51935 4T" --w Kevin Hart- 6 December 2016 Washington Regional Office RECEIVED DEC 21 2016 DCM- MHD CITY DIVISION OF COASTAL MANAGEMENT APPLICATION TRANSMITTAL AND PROCESSING RECORD 1) APPLICANT: Barry and Elaine Ramsey County: Tyrrell LOCATION OF PROJECT: Project site is located at 276 Owens Lane (off SoundsWe Rd SR 1209) in Columbia, Tyrrell County. The applicant will backfill behind the breakwater filling 1,532 square feet of open water 3,685 sq ft of 404 wetlands and a fringe of 905 sq ft of coastal wetlands. Additionally, the applicant is proposing to construct a 100ft by 6ft pier with a 20ft by 20ft platform and a 1 Oft by 15ft uncovered deck on the existing house. Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in Coastal Shorelines. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H.0208 and 15A NCAC 07H.0209. The rip rap revetment is being expanded to tie into adjacent bulkheads. The pier and platform will extend less than a 'A width of the waterbody and will not exceed 2,000 sq ft. Date: December 20, 2016 Consistency Determination: The request is consistent with/not in conflict with the Tyrrell County/Town of Columbia Land Use Plan certified by the CRC on March 25, 2010. Overview: The 1 acre subject property has approximately 192 linear feet of shoreline along the Albemarle Sound. A portion of the property contains Section 404 wetlands. A Coastal Wetlands fringe is located along the shoreline. The property is within an AE flood zone. Existing site improvements consist of a single-family house with outside deck and two (2) sheds. Existing shoreline improvements consist of 192 linear feet of riprap breakwater with a 6 foot wide base. The breakwater is in disrepair. Water depths at the breakwater range from -1.5 to -2 feet below Normal Water Level (NWL). Water depths waterward of the breakwater range from -2 to -2.5 feet below NWL. Remnants of a riprap retaining wall are located at the landward edge of the wetlands. The past two (2) hurricanes have resulted in the erosion of Coastal Wetlands and a large area of uplands, leaving open water within 15 feet of the house. Repairs to the existing riprap breakwater have been authorized. The breakwater will be raised 1 foot to 1.5 feet above the existing height and a return wall will be installed, extending landward of the erosion escarpment. A 5 foot wide opening will be provided between the breakwater and return wall to allow water and fish passage. Repair of the riprap retaining wall and placement of backfill to pre -storm conditions have also been authorized. Expansion of the existing riprap breakwater, construction of a 6 foot wide by 100 foot long pier with a 20 foot by 20 foot terminus platform, and installation of a 10 foot by 15 foot uncovered deck are proposed. The base width of the breakwater will be widened to 9 feet and the height will be 3 feet tall (2 feet above NWL). Backfill will be placed behind the breakwater. VAN DER VAART Secretary TRACY DAVIS Director On December 8, 2016, the Washington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of your CAMA Major application for a proposed bulkhead and pier project, located at 276 Owens Lane, Columbia, NC in Tyrrell County. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000. For this reason, we are informing you by way of this letter that your project will not require a State stormwater management permit at this time. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a SEC plan or CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 21-1.1000 and may result in appropriate enforcement actions by this Office. Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals, which may be required by Federal, State, or local government agencies, rule or law. If you have any questions, or need additional information concerning this matter, please contact me at (252) 946-6481. The drawings that were included with the application indicated a 3,685sq ft area of section 404 wetlands that would be filled. This information was provided in both the application and the DCM field investigation report. After discussion with Raleigh Bland of the United States Army Corps of Engineers (USACE) on 3 January 2016 it was determined that this information is not accurate and that this area is not considered 404 wetlands by the USACE. After this correction the impacts should be changed from 404 wetlands to high ground making the total fill for high grounds to 5,935sq ft. There was also 905sq ft of coastal wetlands indicated in the application to be filled. These numbers were from prior to Hurricanes Hermine and Matthew. PROJECT SUMMARY: The applicant proposes to construct a pier, enlarge an existing rip rap breakwater and backfill adjacent the Albemarle Sound in Columbia, Tyrrell County. f RECEIVED Ramsey Tyrrell County DEC 12 2016 PROJECTSETTPvc DCM- MHD CITY Barry and Elaine Ramsey have submitted a Major CAMA permit request to construct a pier, platform and an uncovered deck, enlarge an existing rip rap breakwater and backfill on their property at 276 Owens Lane (off SR#1209) in the development of Albemarle Estates in the Town of Columbia, Tyrrell County adjacent the Albemarle Sound. The 1acre site currently has a single family residence, 2 sheds, an offshore breakwater and has 404 wetlands consisting mainly of Phragmites and an area of Coastal Wetlands (Spartina patens and Scirpus spp) present. The area of coastal wetlands has eroded through the past two Hurricanes (Matthew and Hermaine) leaving a small fringe on the property. In addition to the eroding wetlands the Hurricanes have eroded a large area of uplands, leaving open water within 15ft of the existing house. Following the hurricanes, repairs to the existing rip rap breakwater have been authorized. The applicant is working with a contractor to raise the existing rip rap breakwaterl' to 1 ''/z' above the existing height and extend a return wall landward of the erosion escarpment. There will be a 5ft opening between the breakwater and return wall to allow water and fish passage. Water depths waterward of the breakwater range from -2ft and -2.5ft NWL. The Albemarle Sound is approximately 7.5 miles across at the project site. PROJECT DESCRIPTION The applicant proposes to expand the footprint of the existing 192ft rip rap breakwater to have a 9ft base width and be 3ft tall (2ft above NWL) filling an additional 384 sq ft of soft bottom. The applicant will backfill behind the breakwater filling 1,532 square feet of open water, 3,685 sq ft of 404 wetlands and 905 sq ft of coastal wetlands. Additionally, the applicant is proposing to construct a 100' x 6' pier with a 20' x 20' platform. This applicant is also proposing to construct a 10' x 15' uncovered deck on high ground immediately adjacent to the existing house and within the 30' buffer.. After construction of the uncovered deck there will be approximately 26% of impervious within the Coastal Shoreline AEC: RECEIVED DEC 12 2016 ANTICIPATED IMPACTS The project will result in localized turbidity due to the construction of the pier &WirWlii M0tJ@ I TY rip rap and backfill. The construction of the pier and platform will shade 1,000 sq ft of sound bottom, and the installation of the rip rap will convert 384 sq ft of soft bottom to rip rap. Approximately 1,532 sq ft of open water, 3,685 sq ft of 404 wetlands and 905 sq ft of coastal wetlands will be converted to high ground.
