Section 1 is 335 linear feet of shoreline. All riprap will be placed landward of the normal water level (NWL). The riprap will impact between 4,020 to 5,025 sq. ft. of unvegetated beach within Zone 1 of the buffer. Section 2 is 1,222 linear feet of shoreline. The unvegetated beach is narrower therefore approximately half of the riprap will be landward of the NWL. The riprap will impact between 6,110 to 9,776 sq. ft. of unvegetated beach within Zone 1 of the buffer. Section 3 is 193 linear feet of shoreline. Riprap will be placed to form a free-standing breakwater with a base width of 10 feet. Half of the structure will be landward of the NWL. The structure will impact approximately 965 sq. ft. of unvegetated beach within Zone 1 of the buffer. Section 4 is 658 linear feet of shoreline. The shoreline has a 2 to 3-foot-high escarpment and no beach. A 20-foot wide construction corridor will be needed along the shoreline. Riprap will impact between 3,290 to 5,264 sq. ft. of Zone 1 of the buffer. Any part of the construction corridor not impacted by riprap will be allowed to revegetated from the existing undisturbed root mat. The long-term cumulative buffer impacts due to riprap placement for sections 1, 2 and 3 will be between 11,095 to 15,766 sq. ft. of unvegetated beach in Zone 1. Once the shoreline is protected by riprap any unvegetated beach not impacted by riprap is expected to be colonized by Spartina patens. The existing roads will provide access to the shoreline in sections 1, 2 and 3. Equipment will work along the existing beach which minimizes impacts to the vegetated parts of the buffer. Wescott Environmental Services, The long-term buffer impacts for section 4 will be between 3,290 to 5,264 sq. ft. to Zone 1. Any debris removed from the construction zone will be placed on uplands outside of the buffer. The intent of the proposed design is to minimize impacts to buffers. The development never materialized and the current owners purchased the property for recreational enjoyment for themselves and their families. The property will continue to be a managed pine plantation. Shoreline erosion is occurring at an annual rate of 5 to 6 feet per year and has resulted in the loss of three sections of the existing timber road. The owner relocated two sections of the road away from the shoreline and beyond the 75-foot CAMA AEC. In an effort to prevent future loss of shoreline and road infrastructure the owner is proposing to stabilize a section of shoreline along the Pungo River. This proposal is the most practical long-term approach instead of rebuilding roads again in just a few years. The previous owner had obtained a CAMA Major permit for 2,311 linear feet of vertical breakwater but only 1,100 linear feet were constructed. The current owner prefers to use a more permanent approach to shoreline stabilization and is proposing to place riprap along 2,408 linear feet of shoreline. This shoreline project will start where the previous shoreline project stopped. After meeting with NCDCM and USACE representatives, the project was redesigned to further minimize impacts to public waters. The proposed project will place 12,245 square feet of riprap below the NWL and 20,909 square feet of riprap above the NWL. No wetlands will be filled. Trees and shrubs will be cut within a 20-foot wide corridor for the purpose of equipment access during construction. Only the above ground vegetation will be removed but the stumps and root mat will remain in place. Temporary mats will be used to access segment three of this project. Any fallen trees currently in within the footprint of this project will be placed landward of the riprap. The temporary access corridor will re�EIVED naturally after construction. The erosion has caused the loss of logging roads and access to parts of the property. New logging roads have been recently constructed but shoreline stabilization is needed to prevent the loss of these roads again. c. Staff recommends the standard permit conditions for riprap toe revetments including height above the wetland escarpment, distance offshore and slope of the revetment. Also, a condition requiring the use of construction mats for the crossing of wetlands with mechanized equipment is needed. Staff recommends a standard permit condition prohibiting the double handling of riprap materials in wetlands or open waters. The applicant's consultant has indicated that the shoreline stabilization will be done in phases, with the areas where erosion threatens the existing logging road getting the work done first. Therefore, I recommend a standard permit condition requiring the work begin within 30 days of the staked alignment established during the required preconstruction meeting with the landowner and his contractor. The project is located within in Tar -Pamlico River Basin and is subject to the Tar - Pamlico Buffer Rule. The Pungo River is classified as SA;HQW;NSW. The site is a not a Primary Nursery Area, there is no submerged Aquatic Vegetation (SAV), and is open to shellfishing. The property is comprised mainly of managed pine plantation in various stages from recent clear cuts to mature stands of loblolly pine with some mixed hardwoods. Vegetation on the project site consist of coastal wetlands (Juncus roemaerianus, Spartina cynosuroides, Caldium jamaicense and Spartina patens) wooded Section 404 wetlands A review of archaeological/cultural resources was not provided. Anticipated impacts resulting from this project are expected to include: the filling of ±13,120 ft2 of shallow Pungo River bottom and 4,523 ft2 of Estuarine sandy beach. Placement of the riprap revetment will cause temporary impact to vegetation in the work corridor totaling 48,160 ft2. The hardening of the sediment bank will likely increase erosion on the adjacent unprotected shorelines. The sandy beach that remains seaward of the revetment will erode over time. The riprap will impact between 4,020 to 5,025 sq. ft. of unvegetated beach within Zone 1 of the buffer. Section 2 is 1,222 linear feet of shoreline. The unvegetated beach is narrower therefore approximately half of the riprap will be landward of the NWL. The riprap will impact between 6,110 to 9,776 sq. ft. of unvegetated beach within Zone 1 of the buffer. Section 3 is 193 linear feet of shoreline. Riprap will be placed to form a free-standing breakwater with a base width of 10 feet. Half of the structure will be landward of the NWL. The structure will impact approximately 965 sq. ft. of unvegetated beach within Zone 1 of the buffer. Section 4 is 658 linear feet of shoreline. The shoreline has a 2 to 3-foot-high escarpment and no beach. A 20-foot wide construction corridor will be needed along the shoreline. Riprap will impact between 3,290 to 5,264 sq. ft. of Zone 1 of the buffer. Any part of the construction corridor not impacted by riprap will be allowed to revegetated from the existing undisturbed root mat. The long-term cumulative buffer impacts due to riprap placement for sections 1, 2 and 3 will be between 11,095 to 15,766 sq. ft. of unvegetated beach in Zone 1. Once the shoreline is protected by riprap any unvegetated beach not impacted by riprap is expected to be colonized by Spartina patens. The existing roads will provide access to the shoreline in sections 1, 2 and 3. Equipment will work along the existing beach which minimizes impacts to the vegetated parts of the buffer. The project site is located adjacent the Pungo River within Linear Bay off Pamlico Beach Road near Ransomville, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes complete shoreline stabilization for a 960-acre tract of land that previously had been permitted (#104-09) for a bulkhead. The remaining +2,400' of shoreline is proposed to be stabilized with either a riprap revetment or breakwater in front of wetlands. The Pungo River at this location is classified SA HWQ NSW by the Environmental Management Commission and is subject to the Tar / Pamlico Basin Buffer Rules. The NCWRC has reviewed the permit application and while we do not object to shoreline stabilization, we believe insufficient information regarding construction methodology and avoidance / minimization of impacts to the Tar / Pamlico buffer, wetlands, and shallow water habitats has been provided. Pungo River Farms LLC Pungo River Beaufort County Project Setting The 960-acre project site is located off SR 1725, Pamlico Beach Road, on the Pungo River and Satterthwaite Creek, near Belhaven in Beaufort County, North Carolina. This tract of land was previously owned by a land developer who planned a 400-lot residential subdivision. The proposed subdivision development was never undertaken and the property has been sold to Pungo River Farms LLC. The property is comprised mainly of managed pine plantation in various stages from recent clear cuts to mature stands of loblolly pines with some mixed hardwood areas. The understory is vegetated with red maple, sweet gum, wax myrtle, groundsel bush, switch cane and poison ivy. There are existing logging roads used to manage and harvest timber. There is an existing logging road that parallels the Pungo River shoreline. A portion of this road recently succumbed to erosion and had to be reconstructed approximately 80' landward of the NWL. Significant areas of the pine plantations (249.3 acres) have been delineated as Section 404 wetlands by the US Army Corps of Engineers. There are several coastal wetland marsh fingers off Satterthwaite Creek that bisect the blocks of managed pines. The wooded 404 wetlands are vegetated with loblolly pine, red bay, red maple, ferns, wax myrtle, greenbrier and switch cane. The coastal wetland marsh areas are vegetated with black needle rush Juncus roemerianus), giant cordgrass (Spartina cynosuroides), sawgrass C( aldium jamaicense) and salt meadow hay (Spartm patens . The shoreline along the Pungo River is actively eroding with a t2' escarpment with most areas having a sloping sandy estuarine beach. The project area shoreline is orientated to the north and northeast. Along the southern half of the project area shoreline the sandy beach narrows and the erosion escarpment is more pronounced likely due to more clay than sand present in the sediment bank. The top of the escarpment is vegetated with salt meadow hay, wax myrtle, groundsel bush and pines. The beach area and shallow nearshore area is littered with stumps and blown over pine trees. The adjacent land areas to the Pungo River have been delineated as wooded 404 wetlands. There is an area of coastal wetlands marsh in the project area along the Pungo River shoreline. There is a sandy beach ±10' wide between the vegetated marsh and the NWL. Major CAMA permit 104 -09 issued on 24 July 2009 to the previous landowner authorized 3,162 linear feet of free standing vertical breakwater for shoreline stabilization along the normal water level (NWL) of the Pungo River. The height of the breakwater was permitted at l' above NWL. The permit was modified later to increase the height of the breakwater to 1.5' above the NWL. Approximately 1,200' linear feet of breakwater was constructed. A site visit related to this permit application was conducted on 18 July 2017. There was no submerged aquatic vegetation (SAV) observed in the nearshore of the project area. The Pungo River is classified as Coastal Waters by the NC Marine Fisheries Commission and SA; HQW NSW by the Environmental Management Commission and is open to shellfishing at tliis iff iqv SEP 112017 DCM- MHD CITY Pungo River Farms LLC Pungo River Beaufort County Page Two Project Description The applicant proposes to stabilize f2,400 linear feet of Pungo River shoreline with a riprap revetment to protect the existing logging road. Construction of the riprap revetment will begin on the southern end of the existing vertical freestanding breakwater and will end at an area of coastal wetlands marsh near the confluence of Satterthwaite Creek and the Pungo River. Much of this riprap revetment would remain above the NWL on the slope of the existing sandy beach to the top of the erosion escarpment. In areas where the sandy beach is absent with a more vertical escarpment, the rip rap will be placed on a 2' :1' slope against the bank with the toe of the revetment 5' to 8' below the NWL depending on the height of the bank. The one area of coastal wetlands marsh in the project alignment will be protected with a rock breakwater. The breakwater will straddle the NWL with a 10' base width and a height 1.5' above the NWL. The construction of the revetment will require a work corridor on the landward side of the revetment. This is necessary to provide space for the excavator to swing while placing the riprap and for the movement of materials down the shore. Stumps and blown over trees in the alignment of the revetment will be removed and placed on the landward side of the work corridor. Trees and shrubs in the work corridor will be cut to ground level and placed on the landward side of the work corridor. As much as practical the existing logging road will be used to move equipment and riprap material for final placement. Wooden equipment mats will be used to support the heavy equipment and an assortment of rock boxes will be used to contain the riprap stock pile along the top of the bank. Project Impacts The project as proposed will result in the filling of ±13,210 ft2 of shallow Pungo River bottom. Placement of the riprap revetment will cause temporary impact to vegetation in the work corridor totaling 48,160 ft. The hardening of the sediment bank will likely increase erosion on adjacent unprotected shorelines. The sandy beach that remains seaward of the revetment will erode over time. Construction of the riprap revetment will result in temporary short-term turbidity.
