This permit, issued on Aueust 31, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Bulkhead 1) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the existing deteriorated bulkhead. 2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) The bulkhead shall be constructed prior to any backfilling activities. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Alonzo Pringle Permit No. 95-17 Page 2 of 2 5) 6) 7) 8) ADDITIONAL CONDITIONS The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 10) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. 2017-0826. NOTE: The U.S. Army Corps of Engineers assigned the project Action ID No. SAW-2017-01496. NOTE: An application processing fee of $400 was received by DCM for this project. Processing of the application is ongoing. However, it has been determined that additional information will be required prior to the Division taking final action on your application. These required items are summarized below: . 1) The Return Receipts (green cards) or signed statements of no objection are needed to show proof of adjacent property owner notification, as required by15A NCAC 07J .0204. Adjacent landowners have 30 days from the date notification is received in which to comment. If you can provide to this office with the requested information within five working days from the date of this letter, DCM staff will continue processing of the application and the processing clock will not be suspended. If the required information is -not received in this office within the specified timeframe, processing of the application will be suspended in accordance with 15A NCAC 07J.0204(d) until such time as the requested information is provided. It is also necessary that the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c). However, we expect to take action prior to that time and will do so as soon as possible once we resume processing of your application. It is the opinion of this office that the proposed bulkhead is CONSISTENT with the Use Standards for Coastal Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0205, .0206 & .0207. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued provided the proposed bulkhead steps out in front of the existing bulkhead only what is necessary for the driving of the vinyl sheet piles and associated tie back system, with a 2' maximum distance waterward of the existing bulkhead. Ocean Isle Beach Land Use Plan The applicant is proposing to construct approximately 50 linear feet of new vinyl bulkhead with approximately 80 square feet of coastal wetland fill. The project is located at 8 Monroe Street, adjacent to a manmade canal off the AIWW in Ocean Isle Beach, Brunswick County. Areas of Environmental Concern (AFC's) impacted by the proposal are Estuarine Waters, Estuarine Shoreline and Coastal Wetlands and PTA. Waters at the project site are classified as SA and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan and offer the following comments. The general area of the project is classified as Residential. In general, Ocean Isle Beach allows development in Residential classified AECs, which is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Ocean Isle Beach Land Use Plan update. RECEIVED JUL 0 7 2017 DCM- MHD CITY Alonzo Pringle c/o Pauline Benton Page Two PROJECT DESCRIPTION The applicant's property is located at 8 Monroe Street, adjacent a man-made canal contiguous with the AIWW in the Town of Ocean Isle Beach, Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2nd St. and travel approximately 0.21 miles. Turn left onto Monroe St. and travel approximately 0.1 miles. The project site will be located on the right side of the street. The project site is a canal front lot with approximately 50' of shoreline frontage. The elevation of the high ground area of the lot averages approximately 2'-3' above normal high water (NHW). High ground vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The shoreline of the property has been stabilized with an existing timber bulkhead and the existing house structure is located approximately 15' landward of the existing bulkhead. There are Coastal Wetlands present waterward of the bulkhead, consisting primarily of Smooth Cord Grass (Spartina alterniflora), which are, on average, 21' in width as measured from the existing bulkhead. There are no Coastal Wetlands present waterward for approximately 10' of shoreline on the northern side of the property. Normal High Water (NHW) is located along the existing bulkhead for the property. There is an existing docking facility which consists of a fixed platform measuring approximately 12' in width by 8' in length which leads to a pier measuring approximately 4' in width by 16' in length. An existing ramp measuring approximately 4' in width by 16' in length leads to an existing floating dock aligned parallel to the canal which measures approximately 8' in width by '16' in length. The adjacent property's shoreline to the north has been stabilized with an existing timber bulkhead that ties into the existing bulkhead on the applicant's property. The adjacent property's shoreline to the south has been stabilized by an existing timber bulkhead with an alignment approximately 5' landward of the applicant's bulkhead. Both of the adjacent properties to the north and south are developed with single-family residences and docking facilities. No known archaeological sites are within the project vicinity. The Town of Ocean Isle Beach Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of the canal are contiguous with the AIWW are classified SA by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. PROPOSED PROJECT: The applicant proposes to install approximately 50 linear feet of new vinyl bulkhead approximately 2' waterward of the current alignment with approximately 80 square feet of associated Coastal Wetlands fill. As proposed, the bulkhead alignment would be approximately 2' waterward of the adjacent bulkheads to the north and approximately 7' waterward of the adjacent property to the south. The existing timber bulkhead would remain in place and the limits of disturbance would be located approximately 15-20 feet landward of the proposed bulkhead alignment for the tie -back system. The applicant is proposing to install the tie -backs thru the existing wall to prevent land disturbance associated with removal of the old wall. This method of construction would also aim to alleviate threats to the existing house which resides in close proximity relative to the existing bulkhead wall. The adjacent owners to the north (Ervin) and south (Fisher) have also submitted applications for major development proposing bulkhead alignments that would tie into the applicant's proposed bulkhead. 11. ANTICIPATED IMPACTS The proposed new bulkhead construction with associated backfill and tie back/anchor system would result in the filling of approximately 80 square feet of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora) and approximately 20 square feet of open water within the Estuarine Waters and Public Trust Areas of Environmental Concern. The proposed bulkhead construction would result in the disturbance of approximately 900 square feet of high ground for the tie -back system. The property can be reached by traveling highway 179 across the causeway, turning left onto East 2nd St. then left on Monroe St. The property is adjacent to 6 and 10 Monroe St. The site is currently developed with a single family residence, bulkhead and pier. PROJECT DESCRIPTION Construct new bulkhead approximately 2 feet waterward of existing bulkhead. EXISTING CONDITIONS The existing bulkhead is only 15' 5" from existing foundation. If the bulkhead had to be replaced in its' existing location it would jeopardize the house foundation. To take out the old wall it could have a greater impact to the existing marsh. STORMWATER MANAGEMENT No upland improvements, pavements, walkways or other impervious surfaces will be constructed as part of the project. No stormwater management or additional stormwater measures are proposed for this project.
