This permit, issued on June 29, 2017 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the 12-unit multi -family structure with associated infrastructure, pool with bathhouse, and parking, all as expressly and specifically set forth in the attached permit application and workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to. Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Easement i Easement from the Department of Administration's State Property Office may be required under C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of lstruction of any structures over state-owned submerged lands to determine if such an easement will required. Any required easements shall be obtained, and a copy provided to the Division of Coastal magement, prior to the construction of any new boat slips or other docking facilities authorized under s permit. Stormwater ,The Division of Water Resources is currently reviewing the permit application to determine if the project is in compliance with North Carolina's Water Quality Certification program. The permittee shall "receive a Water Quality Certification from DWR prior to the initiation of any construction activities. Sedimentation and Erosion Control _ An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Energy, Mineral, and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. � 13 East'Properties LLC. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2007-00211). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 2007-0015 V2. NOTE: Future development of the permittee's property may require a modification of this permit. Barbour, Manager a P.O. Box 97397 Raleigh, NC 27624 The Pinnacle project was permitted in 2006 as a redevelopment project. The property is located at 431 East Fort Macon Road in Atlantic Beach. The site drains to Money Island Bay, Class SA; HOW, within the White Oak River Basin. The State Stormwater rules, at the time of approval, for redevelopment were to maintain the previously existing impervious coverage and meet the requirements of rules to the maximum extent practicable. The tract area above normal high water is 46,017.59 +/- square feet. The project site previously contained a mobile home park consisting of approximately 14,915 square feet of impervious area, 32.41%. The existing site provided no stormwater treatment, only sheet flow. The volume of runoff from the pre -developed site is 1,966 cubic feet. The development is permitted for an infiltration trench system designed to treat, based on the 1-1/2" design storm, 12,455 square feet of impervious area. Permeable pavement was also incorporated into the project which at the time of approval provided a 60% impervious credit to meet the no net increase of impervious coverage for the redeveloped site. These permitted BMPs are to remain as previously permitted as designed by Stephen Janowski, PE of Baldwin and Associates. The approved stormwater plans proposed a wood apron around the pool, however the approved CAMA plans proposed a concrete apron. North Carolina Environmental Health rules require the apron be constructed of a slip -resistant, impervious surface per 15A NCAC 18A .2522 DECKS (g). This equates to a post -development percent impervious of 2.78% for the project. There is no additional treatment proposed for the pool house and concrete apron (approximately 1,200 square feet), other than sheet flow. There were three existing mobile homes and parking areas In this general vicinity totaling close to 2,500 square feet, also only treated by sheet flow, therefore providing better stormwater control. This CAMA Major application is being submitted to construct a 12-unit multifamily structure, associated parking, amenities and reconstruction of a boat slip. The development was originally permitted in 2007 to Pinnacle East, LLC. The permitted bulkhead alignment, boat slips and maintenance dredging are the only improvements that have been completed to date. The remaining upland development is proposed in this application. The request also includes the reconstruction of a boat slip (#13), previously permitted and existing within the riparian setback, however currently proposed outside the setback. The new slip will consist of a 3.25' x 36' floating finger pier and 12' x 12' boat lift. The specifics of the proposed work are in the enclosed forms and drawings. The development conforms to the guidelines set forth under 15A NCAC 07H .0208 and 15A NCAC 07H.0209. The adjacent waters of Money Island Bay and Money Island Slough are closed to shellfish harvest but are not considered Primary Nursery Areas. Assuming that state and federal agencies concur with the proposal; the District recommends the project be authorized as proposed, contingent upon the following conditions: • The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion. • No vegetated coastal wetlands/marsh grass will be excavated or filled. • Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). • All portion of the development for slip area 13 shall meet the 15' riparian access line setback and not exceed a max of 46' from nhw (as shown on plats dated received 4/26/17). • All portions of the proposed upland development shall be constructed as shown on plats dated received by DCM on 4/26/17. Determination: The request is consistent with/not in conflict with the 2008 Town of Atlantic Beach Core Land Use Plan certified by the CRC on July 24, 2008, provided the project meets the requirements outlined for the "Medium Density Residential" Future Land Use Category. Overview: The applicant is proposing to build a 12-unit multi -family structure with all required infrastructure, pool with bathhouse, parking and the reconfiguration of existing slip #13 at 431 East Fort Macon Rd., Atlantic Beach, Carteret County, North Carolina. The project is in the Estuarine Shoreline and Public Trust Area AECs. The waters at the site are classified as SB (Primary Recreation, Salt Water) and is open to the taking of shell fish. Anticipated impacts resulting from this project are expected to include: the disturbance of 72, 914.95 ft2 (1.7 acres) of high ground. The development would result in 52.93% impervious coverage for the entire tract. Basis for Determination: The project site is located in the Town of Atlantic Beach and is subject to the town's 2008 Land Use Plan. The Future Land Use Map (FLUM) designates the site as Residential/Medium Density and the subject AECs as "Conservation". Development within the designated AECs is limited by CAMA regulations and development guidelines. Residential land uses are divided into three land use categories: high, medium, and low (pg.200). Narrative Description: The J&B East Properties, LLC (The Pinnacle) project is located at 431 East Fort Macon Road Field Investigation Report: J&B East Properties LLC Page 2 of 3 in the Atlantic Beach, Carteret County. The project area is found by turning off of Highway 70 East in Morehead City (Arendell Street) onto the on -ramp for Atlantic Beach. Follow the Atlantic Beach Causeway to the 4-way stop light and turn left onto East Fort Macon Road. Follow East Fort Macon Road for approximately 2,247'. The entrance to the property will be located on the left and next to Anchorage Marina. The vacant/commercial property is 1.72 acres in its entirety and was previously a mobile home park (up until late 2005). It is currently used for boat trailer parking and slips. The average elevation of the property is 4' to 5' above nhw and is developed with an existing bulkhead, 12- slip docking facility with boatlifts, a standalone 13a' slip area and an existing gravel driveway. The project is adjacent to commercial marinas to the east and west along Money Island Slough. The upland vegetation mainly consists of lawn grasses. There are coastal wetlands along the west side of the basin which are comprised predominately of Smooth Cordgrass (Spartina altemiflora). The Division of Water Resources classifies the waters of Money Island Slough as SA/HQW. This area is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of Atlantic Beach's Land Use Plan classifies this area as vacant/commercial with Conservation within the AECs. There were no shellfish resources observed within the area. 10) Proposed Development: The applicant is proposing the reconfiguration of slip # 13, the construction of a 12-unit multifamily building, pool with bathhouse, all required infrastructure and parking. The first portion of the proj ect is the reconfiguration of existing slip area # 13. This slip area is stand alone and has dilapidated over time. It was also located within the 15' setback, however the applicant is proposing to relocate this to the west and locate it a minimum of 15' from the eastern riparian access line. The applicant is proposing a 3.25' x 36' floating platform (accessed via gangway) and a 12' x 12' boatlift along the west side. All portion of this would not exceed a maximum of 46' from normal high water. The width of Money Island Slough within this location is 160'. The water depths are -2'nlw to 4' nlw depending on location. The remaining portion of the project consists of the construction of a 12-unit multi family structure with concrete parking under the building, pool, infrastructure, bathhouse and parking. The multi -family structure would be 120' x 70' and be located 50' to 140' above normal high water depending on location. There would be associated walkways (some covered) and decks that connect to the pool area as well as parking and the placement of an infiltration trench BMP for stormwater collection. The impervious surface coverage within the 75' AEC is 31.2% pre -developed and 28.4 % post development with a pervious paver credit proposed. The total impervious surface coverage for the entire tract would be 32.41 % which includes a 50% pervious credit. Per the applicant runoff from the building and other impervious surfaces would be collected and treated via an infiltration trench. The applicants have stated that they have applied for a modification to the Division of Water Resources for permit SW8 061003. The pool would be located along the west side of the property approximately 30' to 40' above nhw depending on location. Anticipated Impacts: The slip #13 reconfiguration would incorporate 261 ftz and shade 117ft2of open water area. The placement of the pilings has the potential to result in temporary impacts due to turbidity; Adverse impacts are not expected, due to water depths within the area (-2'nlw to 4'nlw). There should be no undue interference to navigation from the proposed development since the proposed work would remain approximately 10' landward of the navigation channel.
