Box 475 Carolina Beach, NC 28428 RE: EXEMPTED PROJECT (MINOR) • MAINTENANCE AND REPAIR (15A NCAC 07K .0103) PROJECT ADDRESS — Walkway Bridge on Swamp Trail within Carolina Beach State Park AREA OF ENVIRONMENTAL CONCERN — Coastal Wetlands Dear Mrs. Lynch: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on August 28, 2009,1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing and materials list submitted by email on October 7, 2009, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. MAINTENANCE AND REPAIR • (G.S. 11 3-103(5)(B)(5) and 7K.0209) - Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible. The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions. 1. The project consists of the repair of the walkway bridge located on Swamp Trail within the Carolina Beach State Park, as shown on the attached drawing and materials list. 2. The proposed repairs shall be consistent with all other applicable local ordinances and North Carolina Building Code standards. 3. This exemption applies to maintenance of the existing bridge by repairing the walkway bridge and constructing handrails . This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization and N.C. Building Permits. The water flow beneath the current bridge is blocked by debris due to low clearance. The new bridge will allow water to flow between a Tidal Cypress -Gum Swamp and a Salt Marsh. Allowing salt water to flow naturally between these two Plant, communities should act as a deterrent to the rapidly multiplying invasive plant species, Phragmites. Project Specifications: 1. The design includes handrails that meet the requirements of the NC Accessibility Code (NCAC), Section 5.4. The top of both handrails will be 34"-38" above the walking surface. There will be a minimum clearance of 1'/" between the handrail -grasping surface and the adjacent surface. All rails will have an edge radius of at least 1/8" and be free of sharp edges, splinters, etc. 2. The walking surface of the bridge will be more than 30" above grade much of the way_ Guardrails will be included at a height of 46 %" from the top of the walking surface to the top of the guardrails and will be outside the handrails. Handrails will be attached to the guardrail structure. 3. To meet the spacing requirements permitted by the NCAC (i.e. 3/8",or 7/16". spacing between deck boards), 2"x6"x7' deck boards will not be spaced apart when 'nailed. This will compensate for board drying and shrinkage, imperfections, and nailing tolerances. 4. The 6"x6" posts will be embedded 4' to help prevent pullout of the posts resulting from buoyant forces imposed in the unlikely event that the bridge is submerged. 5. This bridge shall be constructed to support a live load of no more than 4,000 Pounds. It shall be constructed to support ATV off road utility vehicles only and will not be constructed to support the weight of large tractors, dump trucks, etc. 6.
