MINOR DEVELOPMENT
PERMIT
as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to the Town of Oak Island, c/o Gene Kudgus, authorizing development in the Estuarine Shoreline (AEC) at the
end of NE 2nd Street, in Oak Island, Brunswick County, as requested in the permittee's application, dated 9/4/08. This
permit, issued on 8/21/09, is subject to compliance with the application and site drawing (where consistent with the
permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may
subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: the construction of a gravel parking area, wooden steps to a 10' in length by 20' in width elevated, wooden,
slatted, unroofed platform and 4' wide steps off the bulkhead.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated revised on 10/18/08 and received on October 31, 2008.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations. Construction shall be consistent with US Army Corps of
Engineers Consent No. DACW21-0-09-5009, issued August 11, 2009.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7424 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing dale. From the dale of an appeal, any
work conducted under this permit must cease unfit the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:

In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) No impervious surface within the AEC is authorized under this permit.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of normal high water. The 20' x 10'
platform shall be located entirely landward of the bulkhead, shall be elevated, slatted, wooden and unroofed, as
required in 15A NCAC 07H.0209(d)(10)(F), and shall not exceed a total area of 200 square feet. The platform and
stairs shall be elevated above the existing grade, so as to not cut into the existing slope of the bank.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. No grading within the 30' buffer, as measured from the normal
high water, is authorized under this permit. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover. The silt fence shall be properly maintained throughout the
construction period and shall be installed such that it is properly toed -in to the soil.
(8) All disturbed areas outside of the authorized parking area shall be vegetatively stabilized (planted and mulched)
within 14 days of construction completion.
(9) The exempt access stairs waterward of the bulkhead shall be consistent with plans, local ordinances and NC
building code.
(10) If a court of competent jurisdiction determines that a party other than the permittee has legal rights to any part of the
area approved under this permit, this permit shall be null and void as to the area the court determines is not owned
by the permittee. This condition shall take effect on the date such court judgment becomes final. In such event, the
permittee shall consult DCM prior to initiating or continuing any further development under this permit.
