Any violation of these terms may to lines, umpnsomnem or civil acuun; or may cause we porn w oc ❑ua auu vow. 1) Unless specifically altered herein, this Minor Modification authorizes the reconstruction and reconfiguration of the authorized docking facility, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. 2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. (See Attached Sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. This major permit was issued on June 5, 2017 to expand an existing private docking facility at 5329 Holt Road in Wilmington. Major Permit No. 61-17 is due to expire December 31, 2020. The proposed expansion, authorized under Permit No. 61-17, had not yet been constructed by the time the majority of the existing facility was destroyed by Hurricane Florence. This minor modification request is to rebuild the majority of the facility that was destroyed by Hurricane Florence, and then continue to expand the facility as originally authorized. The applicant is seeking to rebuild a 378' x 6' fixed pier, a 24' x 24' octagonal shaped fixed platform, a floating dock (20' x 6') and boatlift (14' x 12'). The applicant would also like to complete the features originally authorized in this permit, specifically a 20' x 6' fixed finger pier and 14' x 12' boat lift on the southern side of the fixed access pier. This request was submitted in a letter dated May 15, 2019 and features are to be constructed consistent with a drawing dated as received by DCM on March 24, 2017, with the original permit. The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which include the use standards for piers and docking facilities. This office has no objection to the modification of State Permit No. 61-17, provided it is consistent with all other local, state, and federal regulations. Michael Papagikos has submitted a check (check No. 0027422634) in the fee amount of $100. By copy of this memo, DCM is requesting that the USACE, NC DWR, and the NHC LPO to provide any comments that your agency may have on the proposed project to Courtney Spears of DCM's Wilmington office within 14 days of receipt of this memo. Please see the attached email — Mr. Papagikos has requested a reconfiguration of his docking facility area — it does not appear that the facility would extend any more waterward than its current configuration and would stay in the same basic "footprint'. The reconfiguration does appear to be a slight reduction in shading, and moves the slips to deeper water. Would this require written approval from DWR? Or is a minor mod still appropriate here? Attached you will see a 114 scale drawing of our "original" rebuild intent. You will also now find a 1/4 scale "revised" rebuild intent. The revised drawing stays within the same envelope as the original, has less foot print, and same features (two solar powered boat -lifts, finger dock, floating dock, and gangway). 1 V Would you please advise best.way to proceed based on this information? This minor modification request is to rebuild 402 feet of main pier, rebuild existing 6'x20' floating dock on South side, repair existing 12'x14' boat lift, install 6'x20' pier and 12'x14' boat lift on North side. Thought I'd give you an update on this. After being told that no one at the UNCW MCS could figure out who was authorized to sign the form, they said just send us the certified letter and we will ignore it and then in 10 days you should be good to go. On June 28th I sent a certified first class return receipt letter to UNCW. As far as I can tell that letter was lost after going out for delivery on July 2nd. Since you already have the active Major Permit to add the finger pier and boatlift, if we proceed with a Minor Modification to that permit, I've received authorization to cover the rebuild within that minor modification. Since the major permit you have (MP 61-17) is active until December 31, 2020, this would give you until that date to rebuild the facility in the same footprint, and add the remaining finger pier and boatlift that were not yet constructed. If this is how you would like to proceed, we would need an agent authorization form (if bauen group is going to obtain the modification), notification of both adjacent riparian property owners, and a check for $100, made out to NCDEQ-DCM.
