This permit, issued on April 6, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Bridge Replacement 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the replacement of the bridge, including associated abutment walls and road realignment, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910)796-7215 for this determination. 2) The elevation of the authorized bridge shall be no lower than the elevations shown on the attached workplan drawings. 3) No vegetated wetlands or open water areas shall be filled, even temporarily. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on Signed by the authority of the Secretary of DEQ and the Chairman of the Coastal Resources Commission. Braxton C. Any other construction method may require additional authorization from the N.C. Division of Coastal Management (DCM). 5) The permittee shall exercise all available precautions during construction of the authorized facility to prevent pollutants or other waste materials from entering the adjacent waters and wetlands. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized bridge. At a minimum, permanent reflectors shall be attached to the bridge in order to make it more visible during hours of darkness or inclement weather. Abutment Walls 7) The abutment walls shall be constructed prior to any backfilling activities. 8) The abutment walls shall be structurally tight so as to prevent seepage of backfill materials through the structure. 9) The abutment walls shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by department personnel. 10) The backfill material shall be clean and free of any pollutants except in trace quantities. 11) This permit does not authorize any riprap in association with the authorized abutment walls. If riprap is proposed for use in the future, additional authorizations will be required. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 14) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. NOTE: Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The existing bridge is an aging concrete bridge which would be removed and replaced with a timber bridge in roughly the same location and alignment. The timber bridge would span the creek with only two sets of support pilings located below mean high water (MHW). A 57' width would remain under the proposed bridge for navigation and access to public trust waters. No wetland fill is proposed, and no excavation or fill in state waters is needed. The existing road would be slightly realigned to straighten the approach to the new bridge with minimal grading in the 75' Coastal Shoreline AEC. To find the project site, travel west of US Hwy 74/76 out of Wilmington to NC Highway 133 South towards Southport. Travel approximately 12.5 miles to Plantation Road SE. Turn left and travel a distance of approximately 0.4 miles until you reach Orton Rd SE. Turn left on Orton Road SE, the road will veer to the right in approximately 0.6 miles. Follow Orton Road SE for .08 miles until you reach the bridge spanning Orton Creek. The Creek is the dividing line between two undeveloped parcels and the property is bordered by the Cape Fear River to the east and Orton Pond to the west. Orton Plantation is now a private property and can be accessed by calling Steve Morrison with Land Management Group at 452- 0001 Orton Plantation is a former rice plantation developed around 1725. Construction included a gravity -based water control system, with Orton Pond as the water supply source, and creation of several rice fields on the property. State Permit # 176- 88 was issued by CRC variance to Kenneth M. Sprunt on September 2, 1988 for the reconstruction of a dam/spillway. The named "Front Rice Fields" (both North and South) are bordered by Orton Creek to the north, Orton Pond spillway to the south and the Cape Fear River to the east. One of the water control structures on the southern end of the Front South Rice Field drains directly to the Orton Pond Spillway. State Permit #65-02 was issued to Orton Plantation by Settlement on June 3, 2002 for the long-term maintenance of the outer dike adjacent to the Cape Fear River. State Permit No. 83-12 was issued to Orton Plantation Holdings on July 17, 2012 for construction of dike and marsh revetments along the Cape Fear River, Orton Creek and the Orton Pond Spillway, to augment the dike, replace existing water control structures and to revert the historic rice fields back to rice production. The waters of Orton Pond are classified as C;Sw by the NC Division of Water Resources. They are not designated as Primary Nursery Area (PNA) by the NC Division of Marine Fisheries, nor open to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to remove the existing concrete bridge, construct a new timber bridge with head walls and realign the existing roadway. According to the applicant a 57 ft. width would remain under the proposed bridge for navigation and only two sets of support pilings would be located below mean high water (MHW) within the Orton Creek Spillway, which drains to the Cape Fear River (see Sheet 201A). As proposed, the bridge would be 120 ft. in length by 15 ft. in width, which is the same width as the existing concrete bridge. Four headwalls, each measuring approximately 23.5 linear ft., would be installed within the 30 ft. Coastal Shoreline Buffer and minimal grading will be required in the 75 ft. Coastal Shoreline AEC due to the road alignment (see Sheet 100A-2). The applicant states that there will not be any wetland impacts or any excavation or fill in public trust waters. 10. ANTICIPATED IMPACTS: Approximately 1,320 square of open water would be spanned within the bridge footprint in the Orton Creek Spillway.
