After making a site inspection on August 20, 2009, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing and materials list submitted on August 19, 2009, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. ACCESSORY BUILDINGS — [15A NCAC 7K .0209(a)] — those structures that are customarily incident to an existing structure are specifically excluded from the definition of development if the work does not involve filling, excavation, or the alteration of any sand dune or beach as set out in G.S. 1I3A- 103(5) b.6. Accessory buildings are subordinate in area and purpose to the principal structure and do not require, or consist of the expansion of the existing structure as defined by an increase in footprint or total floor area of the existing structure. A building with a footprint of 100 square feet or less is considered an accessory building as long as it is customarily incident to and subordinate in area and purpose to the principal structure. Buildings of a larger size may be considered accessory buildings if necessary for customary use. The following specific conditions apply: 1. The project consists of the construction of an elevated wooden deck and installation of a chiller to serve the battleship and associated landscaping, as shown on the attached drawing. 2. Hines, Chief Zoning Enforcement Official LMG LAND MANAGEIVIFANT GROUP e c Environmental Consultants 12 August 2009 Ms. Linda Painter New Hanover County Inspections Department 230 Government Center Drive, Suite 110 Wilmington, NC 28403 RE: Request for Exemption to CAMA Permitting Battleship NORTH CAROLINA, Cape Fear River, New Hanover County Dear Linda, The State of North Carolina, Department of Cultural Resources, is proposing improvements to the LISS NORTH CAROLINA Battleship Park, New Hanover County. Specifically, utility improvements are needed including air conditioning upgrades which would allow Boy Scouts to camp on the Battleship. The existing mechanical yard is located at the southeastern corner of the visitor's center within the CAMA Coastal Shoreline AEC and partially within the 30' Coastal Shoreline Buffer. A new chiller and an elevated wooden deck to support the chiller are proposed adjacent to the existing generator and electrical transformer. This location places approximately 2/3 of the chiller and new decking in the 30' Coastal Shoreline Buffer. Re -locating the chiller to an area completely outside the Coastal Shoreline buffer was not practicable due to the cost associated with re -locating the'generator and other associated components of the mechanic yard. It is noted that approximately half of the structure within the buffer would be elevated, unroofed wooden deck which would minimize new.impervious cover in the buffer. Approximately 100-sq.ft of elevated decking and 120- sq.ft. of the chiller unit would be located in the buffer. The area is currently maintained in a mowed condition and the chiller unit would be elevated on the wooden decking rather than be placed directly on the existing grade. Land Management Group recently delineated a normal high water (NHW) based on vegetation, coastal marsh limits, and "404 wetland" limits along the shoreline in the area of the proposed work. Division of Coastal Management staff approved the normal high water and coastal marsh limit on 6/16/2009. Enclosed are: (1) site plans and utility details (2) an existing conditions survey from McKim and Creed including the updated NHW and coastal marsh limits and (3) figures which overlay the DCM-approved limits on the site plan detail. We are requesting written confirmation that the proposed work is exempt from CAMA permitting as an accessory structure defined in 15A NCAC 07K.0209(a).
