This permit, issued on September 8, 2009, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: replacement and improvements to existing drainage pipe and associated landscaping. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on August 11, 2009. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 798-7118 for a final inspection at completion of work. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further wdtten permit approval. All work must cease when this permit expires on: DECEMBER 31, 2012 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. (6) Unless:specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (10) This permit does not authorize development within any wetlands or open water areas. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands all permit requirements. From time to time, staff will visit the site to monitor the project. Box 75 Wrightsville Beach, NC 28480 PURPOSE: Resolution to drainage issues within Shipwatch Village Development Initial on -site investigation results with Regional Coastal Area Management (CAMA) representatives, Shipwatch Village Development representatives of the H.O.A. and consultants 1/24/09: Shipwatch Village Development has four primary drainage outlets to the Cape Fear River vicinity. Each outlet has its own particular problem. The following is a description of each drainage outlet problem as per the initial on -site investigation: *Area "D" Area "D" is the northernmost drainage outlet of the development and consists of a broken metal catch basin grate, 190 ft. of metal corrugated pipe showing signs of deterioration, and an outlet end covered with soil/debris and with restricted flow due to a soil berm build-up located between the outlet and the river vicinity. *Area "C„ Area "C" is the shortest pipe length (10 ft.) and also showed signs of deterioration and had improper grade (the outlet end was higher than the catch basin pipe end). The outlet pipe was covered with soil/debris restricting proper functioning. During the initial inspection, the defined protected marsh grass was approximately 16 ft. ± west of the outlet pipe. *Area "B„ Area "B" consists of 199 ft. of metal corrugated pipe with approximately 110 ft. ± ofthe western end located at or beneath an adjacent concrete driveway and 51 ft. additionally to the outlet pipe end with the front portion located beneath landscaping and concrete walk. The outlet end at the sand shore area has marsh grass croppings to be avoided. The raised wood walkway at the boat dock has an electrical panel on the north entry side. In discussions with the adjacent property owner to the south, it was stated that several services were located within the drainage easement area. Also numerous preferred vegetations were located within what appeared to be the easement area. Page 1 of 4 6f-oL • •Area"A" ea " A', the southernmost drainage outlet area, has an existing pipe length of 244 ft. within additional 21 ft. located within a built-up mixed vegetation and soil area The outlet end pipe bottom is located approximately 2 ft. below grade. The system has not functioned for several years and stagnant water was in the roadside catch basin. To reach an area where the outlet pipe could reasonably flow to the river area would mandate dredging approximately 71 ft.+to through the mixed marsh area. Secondary on -site investigation results with Regional Coastal Area Management (CAMA) representatives, representative of the H.O.A. and consultants and follow-up discussions with representatives: *Area"D" The outlet end area had changed as a result of a natural occurrence which removed the built-up soil berm which initially prevented the flow to the river vicinity. Also additional debris was removed by the occurrence. This allows a more reasonable outlet area without pipe extensions. *Area" C" Basically the same as the initial on -site investigation with the exception that seasonal protected marsh grass encroachment is occurring which means that this area should be renovated soon to allow sufficient area for the rip/rap retention area. oArea"B" The outlet area has developed additional protected marsh grass croppings which will need to be avoided during renovations. *Area "A" e outlet area to the river showed no change from the initial on -site investigation CONCLUSIONS/RECOMMENDAUONS: As a result of numerous on -site investigations and discussions with the Regional Coastal Area Management (CAMA) representatives, we offer the following conclusionstrecommendations: *Area "D" Recommendations: 1. replace broken metal grate at catch basin 2. replacel90' of deteriorated metal corrugated pipe with double wall plastic 3. establish a better outflow elevation 4. install a rip/rap outflow retention area with 6"x6" bollards for protection from debris *Area "C" Recommendations: 1. replace 10 ft. deteriorated metal corrugated pipe with double wall plastic pipe set at proper elevation 2. install a rip/rap outflow retention area Page 2 of 4 6, f4-,� 2 eArea'B" Recommendations (as discussed previously in the initial on -site investigation there are numerous problems to be resolved by the H.O.A concerning: 1. Existing pipe beneath the concrete driveway 2. Existing pipe beneath the landscaping and walkway 3. Potential services within the drainage easement area 4. Existing preferred vegetation within the drainage easement 5. Electrical panel adjacent to walkway. Considering that all the above situations are resolved by the H.O.A. we recommend two possible options for proper drainage of the area. I . Relocate and replace the existing deteriorated metal corrugated pipe so that the driveway is not impacted and existing services are not disturbed. The outflow pipe will be located on the north side of the wood walkway to the boat dock since no protected marsh grass presents a problem in that area. A rip/rap retention area can be installed with 6"x6" bollards for debris protection. NOTE. That the electrical panel on the north side of the walkway will need to be relocated based upon its location within the easement area. 2. Install an underground storage area with a 6" PVC overflow pipe outlet located on the north side of the walk. The underground storage system could be designed to be in -line or side -by - side. t cussions with the Regional Coastal Area Management (LAMA) representatives we were informed that the outlet pip end, located in a mixed marsh vegetation area and with the enormous length needed to trench through the vegetation to an adequate outflow area would require approval of the U.S. Army Corps of Engineers and that it was, in their opinion, that authorization to perform the needed work was doubtful. With this in mind we recommend an in - _ground storage system with a 6" PVC outfall to the marsh age on the north side ofire walkway the *Area "D" and Area "C" As CAMA representatives have stated, Area "D" and Area "C" recommendations can 6% easily be authorized under application for a "minor" CAMA permit. The application cost is PW 00*Wwith a $69r96 preparation fee. The turn around time is approximately two weeks. Depending on resolution to Area `B", as stated herein it may easily be included within the application as well or may simply be a notification to the county CAMA representatives for authorization to commence work. Area "A" will also fall under this method. As you have requested, enclosed herein is the anticipated pricing for the work proposed under my recommendations. Please recognize that pricing may vary based upon your decision to construct one or more at a time due to the contractor's equipment/manpower mobilization costs.
