HomeMy WebLinkAboutNH_09-036_GrimesNew Hanover County Local Government 09-036 Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-116 of the General Statutes, "Coastal Area Management" Issued to Mr. David A. Grimes authorizing development in the Estuarine Shoreline - ORW (AEC) at 7209 Grouper Court, in Wilmington, N.C., New Hanover County, as requested in the permittee's application, dated August 8, 2009. This permit, issued on September 1, 2009, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Landscaping. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on August 8, 2009. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 910-798-7118 for a final inspection at completion of work. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2012 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. (6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion shall encroach into the 30 ft. buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land disturbing activities a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the areas has been properly stabilized. Please retain the other original, as it must be available on site when the project is inspected for compliance. If you object to the permit, or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150E with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands all permit requirements. From time to time, staff will visit the site to monitor the project. F€ti,l�ft AUG 0 200 DESCRIPTION OF PROJECT, 7209 Grouper Ct. (Lot 69, Dolphin Bay) I plan to make the lot adjacent to my house at 7207 Grouper Ct. an extension of my yard. My plan is to preserve the mature trees on the lot, which include pines, a few cedars, and one live oak. I would like to clear out the underbrush and vines and then professionally landscape the lot to make it resemble a wooded park. I hope to disturb the contour of the land as little as possible during the clearing process, and my thoughts are to leave the ground natural, rather than covered in grass. I would like to repeat some of the plantings that have done well at my house next door. These include pittosporum (dwarf and regular), azaleas, Indian hawthorne, wax -leaf ligustrum, crepe myrtle trees, ruby lorapetaluin, and knock -out roses. I envision putting in a few concrete benches and perhaps a picnic table or two under the live oak tree. I may plant a vegetable garden as well. I do not plan to erect a permanent building or do any paving on the lot. I conducted the delineation using the three parameter approach outlined in the 1987 US Army corps of Engineers Delineation Manual and the 2008 Regional Supplement to that manual. I have enclosed a sketch of the findings. As you can see, there are no wetlands on the property other than the small fringe of marsh along the waterway.
