Lake Park Blvd Carolina Beach, NC 28428 RE: EXEMPTED PROJECT (MINOR) - MAINTENANCE AND REPAIR (15A NCAC 07K .0103) PROJECT ADDRESS — Boardwalk Beach Access AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard Dear Mr. Hardison: Natural Resources Dee Freeman Secretary Exemption Number— CB 09-20 I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on August 12, 2009,1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing and materials list submitted by email on August 12, 2009, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. MAINTENANCE AND REPAIR - (G.S. 11 3-103(5)(B)(5) and 7K.0209) - Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible. The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions. 1. The project consists of the repair of the oceanfront boardwalk beach access, as shown on the attached drawing and materials list. 2. The proposed repairs shall be consistent with all other applicable local ordinances and North Carolina Building Code standards. 3. This exemption applies to repairs of the deck boards on the existing oceanfront boardwalk and associated beach access ways. 4. No expansions to the existing oceanfront boardwalk and associated beach access ways are authorized under this exemption. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization and N.C. Building Permits. This exemption expires 90 days from the date of the letter. The following is a supplies list for the repairs that we would like to make to the Boardwalk Walkways. The planned work is simply repairing damaged older boards so that they are no longer a hazard to pedestrians. 1. Ramp from main walkway going West near Marriott - 56' of repairs (112 2"x 6"x 5' boards) 2. Ramp from main walkway to Putt -Putt - 42' of repairs (84 2" x 6" x 5' boards) 3. Ramp from Cape Fear towards beach - 86' of repairs (172 2" x 6"'x 5' boards) 4. Ramp from South Pavillion towards beach - 79' of repairs (158 2" x 6" x 7' boards) 5.
