This permit, issued on July 25, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to tines, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead 1) The bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawing. 2) The bulkhead shall not be constructed outside the lateral bounds of the permittee's property. Additionally, no land -disturbing activity is authorized on adjacent properties. 3) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 4) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Andrew O'Quinn Permit No. 86-17 Page 2 of 2 ADDITIONAL CONDITIONS 5) The bulkhead shall be constructed prior to any backfrlling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 8) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 11) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project by way of General Certification No. 4097 (DWR Project No. 2017-0676), which was issued on 7/11/17. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide Permit 3 (Action ID No. SAW-2017-01183), which was issued on 6/6/17. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division,Qfr Resources. The additional wetlands that are located within the boat ramp area are volunteer wetlands that are currently growing over a concrete base and mixed with high marsh species. Given these circumstances, the staff feels that this development will not cause significant adverse impacts to the resources. It is the staff's recommendation that the construction of a new timber bulkhead landward of an existing deteriorating sheet metal bulkhead along the northern shoreline is CONSISTENT with the Rules of 15 NCAC 71-1.0208 (b) (7). The proposed alignment would tie into the existing bulkhead to the east and would be landward of any existing Coastal Wetlands. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for private docking facilities. RECEIVED MAY 2 6 2017 DCM- MHD CITY MEMORANDUM To: Heather Coats From: Michael Christenbury, Wilmington District Planner Subject: Consistency Determination, Major Permit Application — Andrew O'Quinn, Wrightsville Beach, New Hanover County Date: July 18, 2017 This project is consistent with the 2005 Wrightsville Beach Land Use Plan Update. The applicant proposes to replace a portion of bulkhead and construct a new bulkhead with backfill. The project is located at 126 Parmele Blvd. adjacent to Lollipop Bay in Wrightsville Beach. Areas of Environmental Concern (AFC's) impacted by the proposal are PTA and EW and ES. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2005 Wrightsville Beach Land Use Plan Update and offer the following comments. The general area of the project is classified as Developed and Conservation. In general, the Wrightsville Beach Land Use Plan contains policies, which allows development in Developed and Conservation classified AECs, which is consistent with the State's minimum use standards. PROJECT DESCRIPTION: The project site is located at 126 Parmele Blvd., adjacent to Lollipop Bay in Wrightsville Beach, New Hanover County. To locate the property of interest from the Wilmington Regional Office (WiRO) travel east approximately 3.0 miles on Eastwood Rd. towards Wrightsville Beach. Cross the drawbridge and take a slight lefts onto W Salisbury Street. Take a left onto N Lumina Ave and travel approximately 0.3 miles and turn left onto Parmele Blvd. Travel approximately 0.4 miles and the property of interest will be on the right, just before Wrightsville Beach Public Works. The property is currently developed with a single family home and an existing private docking facility, concrete bulkhead along the eastern shoreline, a concrete boat ramp at the southern end of the eastern shoreline, and a sheet metal bulkhead along the northern shoreline. The docking facility consists of a fixed pier measuring approximately 6' wide by 87' long terminating in a "T" head platform measuring approximately 19.5' wide by 19.5' long. From the "T" there is a ramp leading to a floating platform measuring approximately 12' wide by 20' long oriented in an easterly direction. The docking facility extends in an easterly direction into Lollipop Bay. The existing concrete bulkhead runs along the eastern shoreline and is approximately 50' in length, near the southern end of the shoreline is an existing 11' wide boat ramp. On the northern shoreline there is a section of failing sheet metal bulkhead that is approximately 38' in length. The property has current elevations of approximately 5' above normal high water (NHW). The high ground area is vegetated with lawn grass and there is a concrete walkway leading to the docking facility. Directly behind the single family home on the remainder of the parcel is a concrete parking area. There are Coastal Wetlands on the property along the bulkhead and partially encroaching into the existing boat ramp consisting primarily of Saltmeadow Cordgrass (Spartina patens) and Glasswort (Salicomia spp.) and mixed with other high marsh species. Normal high water is approximately 12- 15' from the bulkhead with Coastal Wetlands waterward of that consisting of Smooth Cordgrass (Spartina alterniflora). Coastal Wetlands and Normal High Water were flagged by DCM Field Representative Brooks Surgan on 1/23/17. The Town of Wrightsville Beach Land Use Plan classifies the upland areas of this project as Developed. The waters of the project site are classified as SB by the NC Division of Water Resources. The NC Division of Marine Fisheries has not designated this area of Banks Channel as a Primary Nursery Area, and the waters adjacent to the proposed project are closed to the harvesting of shellfish. PROPOSED PROJECT: The applicant proposes to replace a portion of bulkhead and construct a new bulkhead with backfill. The failing portion of sheet metal bulkhead along the northern shoreline would be replaced by a new timber bulkhead immediately landward of the current alignment. The new timber bulkhead would measure approximately 38' in length, 3' in height, and 1' in width. Along the eastern shoreline a timber bulkhead would be constructed along the length of the shoreline, approximately 61' in length, an average of 2' waterward of the existing alignment. The existing 11' boat ramp would be incorporated into the bulkhead and backfilled. The area between the old bulkhead and new bulkhead would be filled with 57 stone wrapped in filter fabric and then topped with clean sand fill. The proposed project would fill approximately 147 ft2 of Coastal Wetlands. 10. ANTICIPATED IMPACTS The proposed bulkhead construction would fill approximately 147 ft2 of Coastal Wetlands consisting primarily of Saltmeadow Cordgrass (Spartina patens) and Glasswort (Sa/icornia spp.) and approximately 220 ft2 of highground in the boat ramp area, and disturb approximately 2,520 ft2 of high ground for the associated backfill and tie -back anchor system. The proposed structures would extend waterward a maximum of 2' beyond the current bulkhead alignment to encapsulate the existing concrete bulkhead. The wetlands within the boat ramp area appear to be growing from an area of wrack that has naturalized. The application states that backfill material would consist of sandy loam and washed stone. Minor increases in turbidity should be expected during construction. The wall was constructed as was the practice at the time I presume without providing weep holes so that the naturally occurring hydrology could release in this case back to the sound. Rather than demolish the existing wall and destabilizing the lawn and the tidal area across the front of the wall, I propose that the hydrostatic issue with the existing wall be alleviated by digging out on the street side to a depth of 24 to 30 inches and filling the area next to the wall with a washed stone and clean sand . Dimensions of this area will be approximately 24 inches wide and 24 to 30 inches deep. At this point weep holes will be drilled into the existing wall so that run off water can flow through the weep holes into the washed stone held in place between the existing wall and the new sea wall proposed to sit two feet waterward from the existing wall. This takes the pressure off of the old wall and allows it to be used as a dead man to anchor the new wall. So in summary; Step 1. excavate behind existing wall and fill with clean stone and sand Step 2. drill weep holes in existing wall to allow run off to weep into filled area between existing and new wall Step 3. Construct new wall, fabric and fill as per plans. Step 4. Drill through pilings of new wall and existing wall and install threaded rod to use the old wall as dead man.
