This permit, issued on March 28, 2017 is subject to compliance with the application (where consistent,.with the permit), all applicable regulations, special conditions and notes set forth below: Any violation of these terms may

Boat Ramp'-& Docks
1) This permit authorizes only the relocated boat ramp and associated docks, and other•structures and
uses located in or over the water that are expressly and specifically'set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this boating
access area without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
boating access area. Any sewage discharge at the boating access area shall be considered a violation
of this permit for which the pennittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.,

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval:
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal

ADDITIONAL CONDITIONS
Tlie boat ramp, shall either be.poured at anupland location and pushed into place once hardened, orpoured;
entirely, within a watertight containment structure. Live concrete shall not be -allowed to contact waters
of:the State or. waters that will enter waters of the State.'
The permittee shall maintain'the • authorized work in;good condition and in conformance with the terms
and conditions of this permit. The permittee is not. relieved of this requirement if he abandons the
permitted activity without having if transferred to a third"party.
The permittee shall install and maintain at his expevse.any: signal lights _or signals prescribed by the U.S.
Coast Guard, through regulafron-or otherwise, on the authorized facilities.' At a'minimum, permanent,_
reflectors shall;be. attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit does not authorize any formalized boat slips.
7) No portion of the authorized floating docks shall extend past the alignment depicted on the plans.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
.Excavation
9) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between
April 1 and September 30 of any year without prior approval from the Division of Coastal Management
in coordination with the appropriate resource agencies.
10) No. new excavation shall take place outside the area indicated on the attached workplan drawings.
Excavation shall not exceed -5 feet below normal low water. In no case shall the depth of excavation
exceed the depth of the connecting waters.
11) No vegetated wetlands shall be excavated or filled, even temporarily.
12) The authorized project is located within a designated Primary Nursery Area (PNA). Therefore, in
accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging
or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking"
with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.
Spoil Disposal
13) All excavated materials shall be confined above normal high water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any
marsh or surrounding waters.
14) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the
beginning of any dredge activities.

15) No spoil material is to be placed within 30 feet of the normal high water line.
Maintenance Clause
161) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Upland Development
17) Unless specifically altered herein, this permit authorizes the vehicle -trailer parking area and other land
disturbing activities associated with the development of the above referenced property, all as expressly
and specifically set forth in the attached permit application and workplan drawings. Any additional land
disturbing activities and/or construction may require a modification of this permit. Contact a Division of
Coastal Management representative at (910)796-7215 for this determination.
Stormwater Management
18) A stormwater management permit from the Division of Energy, Mineral and Land Resources will be
required for the authorized project. A copy of the stormwater management approval shall be obtained
and a copy provided to the Division of Coastal Management prior to the initiation of any development
activities authorized by this permit.
Sedimentation and Erosion Control
19) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
21) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within 30 days of project completion.
U.S. Army Corvs of Engineers Conditions
22) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws. ovg_/nc-

23) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opllllon of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due
notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or
obstructions caused thereby, without expense to the United States or the State of North Carolina.
24) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
25) Approval of the structure is based on determinations that there would be no obstruction to navigation.
The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not
be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats
will not be damaged by wave wash.
26) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before
completion of the work will, without expense to the United States and in such time and manner as the
Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -
project condition.
General
27) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party
without the written approval of the Division of Coastal Management.
28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

Project Summary:

The West Onslow Boating Access Area project it located at the end of Shrimp Lady
Lane. off of Island Drive (NC Highway 210). in North Topsail Beach, NC. The current
property is a gravel parking area with a two lane concrete boat ramp and wood floating
dock. The ramp is on an unnamed channel that is approximately 1000' in length from the
Intracoastal Waterway. The access area is open 24 hours a day, 7 days a week free of
charge to the boating public. The area is unmanned and receives routine maintenance at
two week intervals during boating season. The current conditions of this site are
substandard, and at this time NC Wildlife would like to complete a renovation of the
access area to bring it up to the current access area standards.
This property is within the NCDOT Right -of -Way of Island Drive/Highway 210 and
NCWRC holds an encroachment agreement with NCDOT to operate & maintain the
boating access area. NC WRC received a CAMA permit for construction of the boat ramp
facility and dredging of the channel in 1984. Other CAMA permits have been granted
since for dredging of the access channel and upgrades to the boat ramp and floating dock.
This project involves the renovation of the current WRC boating access area. This site
renovation will include a new, relocated double lane launch ramp, floating dock, a new
ADA accessible parking space, a re -built floating dock in the location of the old ramp,
and dredging. Construction will also include the asphalt paving of the gravel parking lot..
Impervious Surface:
The total project area within the NCDOT Right -of -Way is 42,003 sf (.96 acres). The pre -
development impervious surface on the site is 32,006 sf (76.68 %). The post -
development impervious surface on the site is 31,288 sf (74.82 %). The net loss is 778 sf.
The entirety of impervious surface loss is within the 75`AEC buffer.

Dredging:

Dredging is required for this project. The access channel was previousl3Qre*dM kI CITY
as part of a ramp & dock renovation, under CAMA major permit #5-10. The previous
maintenance dredge was to a depth of -5 feet. The current depth of the channel varies, but
is an average depth of-3.77'. Therefore, to excavate to the desired depth of -5', the
average removal depth is 1.23'. The area to be dredged is 15' wide for approximately
930', totaling 16,786 sf. The revised plans, dated 11/17/2016, show additional dredging
to the location of the current rump/proposed floating dock. This dredging will be done
bucket to barge and will remove approximately 765 cubic yards of material.
The dredge spoil will be hauled off -site as to not interfere with ramp & parking lot
construction activities. During a site visit with the CAMA representative, it was
determined that no Submerged Aquatic Vegetation was present in the area to be
excavated.
Per NCDOT/NCWRC encroachment agreement, all dredging activity is to maintain a
minimum 10' setback from all bridge structures.
Existing Stormwater Conditions:
The existing site has no stormwater controls. The current runoff is both infiltrated in
vegetated areas or sheet flows off the site. The current drainage patterns will not be
changed by this renovation.
Ramps/Docks:
The proposed project includes the construction of a 38' wide x 76' long, concrete launch
ramp. The ramp lanes are 15' wide with an 8' wide center abutment. An 8' floating dock
will be installed between the ramps. Beneath the floating dock, the ramps are widened to
16' wide so that the floating dock can rest on the concrete at times of low water. The
remainder of the ramp area beneath the floating dock, below NWL is rip -rap fill.
The new ramp will be constructed approximately 190' to the north of the existing ramp,
centered between the existing bridge bents. The ramps will be cast on site and then
pushed in place with a bulldozer. The upper portion of the ramp (above NWL) and the
abutment will be cast in place. The concrete slab of the existing ramps and floating dock
will be removed and a new free standing floating dock and abutment will constructed in
its place. The free standing floating dock will provide users an additional point of
embarkment, as the length of the floating docks are limited.
The average channel width is 140', therefore %. of the average channel width is 35' A 35'
offset line from the NWL has been shown on sheet PD-2.0, Layout Plan. It was
determined by the CAMA representative that the two dock structures shaJkhtd

This is a renovation of an existing Wildlife Resources Commission boating access area. The renovation will include the
relocation of a double lane concrete boat ramp and floating dock, construction of a new ADA accessible parking space, and
resurfacing of the parking area with asphalt. The project will include the maintenance dredging of existing access channel.

of equipment and where it is to be stored.
Construction equipment will include (but not limited to) excavators, backhoes, bull dozers, motor graders and dump trucks.
Marine construction may include a barge and trackhoe. All equipment will be stored on site.

9. PROJECT DESCRIPTION:

The project site is located at 656 Island Drive, adjacent to Stump Sound, in North Topsail Beach, Onslow
County. To get to the site from Wilmington, take NC Highway 17 north toward Jacksonville. Turn right
onto Old Folkston Road (approximately 28 miles from Wilmington) and continue to the intersection of
Old Folkstone Road and NC Highway 210. Turn right and cross over the high rise bridge onto Topsail
Island. Turn left at the first paved entrance on the left known as "Shrimp Lady Lane" and the project site
will be located along the left hand side at the terminal end.
The project site is located within an NC Department of Transportation (NCDOT) right-of-way/easement.
However, permission has been granted by NCDOT, authorizing the NC Wildlife Resources Commission
to reconfigure and improve the existing public boat ramp. The subject tract is approximately 1 acre in
size, with approximately 435 linear feet of shoreline frontage along a man-made canal bordering the
AIW W and Stump Sound. Elevations at the site range from 3'-5' above normal high water (NHW) and
water depths average approximately -3.0' deep, relative to Normal Low Water (NLW). The property is
bordered by Alligator Bay and an undeveloped spoil island to the north, a man-made canal to the south,
the AIW W to the west and the Town of North Topsail Beach to the east. There is an existing paved road
(Shrimp Lady Lane) that leads from Island Drive to the subject property. Currently, the public boat ramp
facility consists of a gravel parking area, two -single ramps and one -floating dock. According to the
applicant, the existing concrete ramps and floating dock would be removed as part of this project.
As for the natural conditions at the site, the majority of vegetation consists of scrub type with a mixture of
coastal wetlands located along the southern and northern shorelines. Coastal Wetland vegetation in these
areas include: Salt Marsh Cordgrass (Spartina alterni,Jlora), Glasswort (salicornia spp.), Spike Grass
(Distichlis Spicata) and Salt Meadow Grass (Spartina patens). The Coastal Wetlands on site range in
width from 2' to 150'. It should be noted the areas in the immediate vicinity of the existing and proposed
ramp(s) are void of any Coastal Wetlands. Cobble to boulder size rubble exist along the shoreline within
the transition zone between the normal low water (NLW) line and the edge of high ground.
The Onslow Land Use Plan classifies the upland areas of this project as conservation. The waters of the
project site are classified as SA-ORW by the NC Division of Water Quality. The NC Division of Marine
Fisheries HAS designated this area of Stump Sound as a Primary Nursery Area, and the waters adjacent
to the proposed project are OPEN to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant proposes to re -develop and improve the public boat ramp located at 656 Island Drive, North
Topsail Beach, which is referred to as the "West Onslow Beach Boating Access Area" (WOBBAA). In
addition, the applicant proposes to maintenance dredge the existing canal, located immediately adjacent to
the site.
As proposed, the applicant would eliminate the existing two-lane concrete boat ramp and floating dock
and replace the floating dock only, abandoning the existing ramp. The new floating dock would be
installed in the same location as the existing dock and would include two-8' x 20' sections bolted end -to-
-end, totaling 8' x 40'. The concrete which comprises the boat ramp would be removed and the bottom
contour would be maintained at its current depth through the proposed maintenance dredging activities. In
this location, the proposed floating dock would be positioned so that the terminal end of the float would
not extend beyond (waterward) the existing bridge bent (footer) which is located within the man-made
canal.

Re -development of the subject property would include paving the existing gravel d aye
designating lanes for single and trailer parking (to include handicap), creating a " n nV I I Y
lane", installation of a kiosk (sign) near the new ramp and installation of a new two-lane ramp with single
floating dock.
Beginning along the entrance to the ramp, the applicant proposes to grade and pave the existing gravel
parking area, which is an area approximately 85' x 340', or 28,900 sq. ft. Currently, there are no
identifiable, or designated parking spaces, and the applicant proposes to improve parking by creating both
single vehicle and trailered spaces using lanes and wheel stops. In total, twenty-seven (27) parking spaces
would be created as part of the renovation, including the handicap space located at the far end of the
property, immediately adjacent to the proposed ramp. The remaining twenty-six (26) parking spaces
would be located along the northern edge of the property, adjacent to the existing guard rail. A 10' x 120'
tie -down area would be created along the southern portion of the parking area, at the base of the proposed
ramp, and a small kiosk would be installed just to the west. According to the application package, the
overall percentage of impervious coverage within the Coastal Shoreline Area of Environmental Concern
(AEC), as a result of the proposed project, would total approximately 75%, with roughly 31,288 sq. ft.
being graded, filled and/or disturbed. The re -development plan would result in a net reduction of
approximately 778 sq. ft. of impervious coverage. On November 7, 2016, NCDEMLR's Stormwater
Section authorized the proposed project as a redevelopment — State Stormwater exclusion, subject to
project no. SW8090804.
The proposed ramp would be located in the far northwest corner of the property and would consists of
two concrete launch/retrieval ramps and one floating dock. As designed, the boat ramps would include a
single 20' x 38' concrete pad, placed at the top of the ramp, and two-15' x 75' concrete strips (ramp
proper) along either side of the ramp approach and floating dock. An 8' x 40' floating dock (2-8' x 20'
sections) would be installed between the two ramps, which would span toward the south, into the man-
made canal. As shown on the attached workplan drawing (Sheet No. PD-2.0), the floating dock would
terminate along the alignment of the existing bridge bents; however, the proposed concrete ramps would
extend approximately 12'-15' beyond. This length appears to be necessary in order to gain the correct
"rise/run" of the ramps. Approximately 2,014 sq. ft. of shallow bottom habitat would be impacted as a
result of the proposed boat ramp(s).
In addition to the proposed ramp(s), floating docks and parking areas, the applicant proposes to
maintenance dredge the majority of the man-made basin, or at least the center line of the canal and
connecting areas surrounding the ramps and dock. As proposed, a 15' x 930' cut would be made along the
center of the canal, within the confines of what appears to be the "historical" limits of dredging. The
dredge cut would originate from the area surrounding the existing boat ramp and would continue toward
the west, ultimately tapering off along the edge of the AIW W. Existing depths within the footprint of the
proposed dredge cut average approximately -1.5' (NLW), and the applicant proposes to deepen the cut to
a depth of approximately -5.0', NLW. The proposed dredge cut does not appear to include any beds of
submerged aquatic vegetation, no shellfish beds, and no Coastal Wetlands. In total, approximately 920
cubic yards of dredge spoil material would result from the project, all of which would be transported, via
roadway, to the Onslow County landfill.
10. ANTICIPATED IIWPACTS:
The proposed NCWRC - West Onslow Beach Boating Access Area re -development plan would disturb
approximately 2,014 sq. ft. of previously disturbed shallow bottom area (due to ramp installation), and
would incorporate approximately 960 sq. ft. of open water area (floating dock construction).

The proposed parking area would result in the grading and paving of approximately 31,288 sq. ft. of
highground. The proposed maintenance dredginglexcavation would result in the removal of
approximately 920 cubic yards of material from an area measuring 15' x 930' x -5.0'. The open water
structures would be located within the applicant's area of riparian access. Minor increases in turbidity
should be expected during construction/development.

NCAC 7H.0206 (d) Use Standards for Estuarine Waters, and Rules of 15 NCAC 7H.0207 (d) Use Standards
for Public Trust Areas, Rules of 15 NCAC 7H.0208 (b) Specific Use Standards.
It is the staffs recommendation that the proposal to construct a public boating access area with driveways,
parking area, boat ramp and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC
7H.0208 (b) (6) (A) Specific Use Standards for Piers and Docking Facilities states "Piers shall not exceed
six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary
for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur."
The applicant has stated that the need for piers wider than six feet is to aid both boaters with disabilities
and the general public; the width of the piers is consistent with previously permitted boating access area
improvements.
It is the staff s recommendation that the proposal to construct a public boating access area with driveways,
parking areas, boat ramp and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC
7H.0208 (bx6XB) Specific Use Standards for Piers and Docking Facilities states "the total square footage
of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet
per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact,
uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than
those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to
improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions
shall not apply to marinas." The proposed project is the development of a public boating access area and
the applicant has stated that the proposed dimensions are necessary to provide access to both boaters with
disabilities and the general public.
It is the staffs recommendation that the proposal to construct a public boating access area with driveways,
parking areas, boat ramp and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC
711.0208 (b)(6)(G) Specific Use Standards for Piers and Docking Facilities states, "pier and docking facility
length shall be limited by: (i) not extending beyond the established pier or docking facility length along the
same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless
necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); (ii)
not extending into the channel portion of the water body; and (iii) not extending more than one-fourth the
width of a natural water body, or human -made canal or basin. Measurements to determine widths of the
water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that
borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army
Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an
official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located
between longer piers or docking facilities within 200 feet of the applicant's property. However, the
proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers
or docking facilities, nor longer than one-third the width of the water body." The proposed access pier
would not extend beyond the outer bridge bents which should be considered the outer most limit.

It is the staffs recommendation that the proposal to construct a public boating access area with driveways,
parking areas, boat ramp and floating access pier appears to be CONSISTENT with the Rules of 15 NCAC
7H.0209 (d)(2) which states "within the Coastal Shorelines category (estuarine and public trust shoreline
AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal
high water level, with the exception of the following: (A)Water-dependent uses as described in Rule 07H
.0208(a)(1) of this Section." The proposed boat ramp approach is considered a water -dependant use and
would be located within 30 feet of the NHW boundary. The proposed kiosk would be installed consistent
with other pile supported information signs through the State, and as seen at multiple public boat ramps.
It is the staffs recommendation that the proposal to construct a public boating access area with driveways,
parking areas, boat ramp and floating access pier appears to be CONSISTENT with15 NCAC 07H.0208
(bx 1) and (2). It is the opinion of this office that the area for the proposed excavation is located in an area
that has been historically impacted and in continuous use for docking and navigational purposes.
This office has NO OBJECTION to the proposal construct a public boating access area with driveways,
parking areas, kiosk, boat ramp and floating access piers. Any permit issued should include the standard
permit conditions.

classified AECs which is consistent with the State's minimum use standards. The North
Topsail Beach Land Use Plan contains some policies, which exceed the State's minimum
use standards. However, none of these more restrictive policies appear to be applicable
to this project.
Provided all other local, state and federal requirements can be met, this project
appears to be consistent with the North Topsail Beach Land Use Plan Update.

You have our approval, in accordance with the attached conditions and those listed below to perform maintenance
excavation and redevelopmentof an existing public boat -ramp, as described in your CAMA application dated November
17, 2016 and received by the Division of Water Resources (Division) on January 3, 2017. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification Number 3900 (GC
3900).
This Certification allows you to use the General Permit No.198000291 when issued by the US Army Corps of Engineers
and the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you should obtain or
otherwise comply with any other required federal, state or local permits before you go ahead with your project including
(but not limited to) Erosion and Sediment Control, Non -discharge, Water Supply Watershed, and stormwater
regulations. Also, this approval to proceed with your proposed Impacts or to conduct Impacts to waters as

4. This General Certification shall expire on the same day as the expiration date of the corresponding General
Permit. The conditions in effect on the date of issuance of the Certification for a specific project shall remain in effect
for the life of the project, regardless of the expiration of this Certification.
5. The applicant/permkee and their authorized agents shall conduct all activities in a manner consistent with
State water quality standards (including any requirements resulting from compliance with 303(d) of the Clean Water
Act), and any other appropriate requirements of State and Federal law. If the Division determines that such standards
or laws are not being met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, than the Division may reevaluate and
modify this General Water Quality Certification.
6. All mechanized equipment operated near or in surface waters will be regularly inspected and
maintained to prevent contamination of waters from fuels, lubricants, hydraulic fluids or other potential toxic
chemicals. In the event of a hydrocarbon or chemical spill, the penoitee/contractor shall immediately contact
the Division of Water Resources, between the hours of 8 am to 5 pm at the Wilmington Regional Office at
910.796.7215 and after hours and on weekends call (800) 85"368. Management of such spills shall comply
with provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act.
Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant and/or authorized agent is required to return the enclosed certificate of
completion form to the NCDENR DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617 Mail
Service Center, Raleigh, NC, 27699 within ten days of project completion (the certification of completion is also
available at:

Violations of any condition herein set forth may result In revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to

This approval and its conditions are final and binding unless contested. This Certification can be contested as provided

RULES)
Water Quality Certification Number 3900 is issued in conformity with the requirements of Section
401, Public Laws 92-500 and 95-217 of the. United States and subject to the North Carolina
Division of Water Quality (DWQ) Regulations in 15A NCAC 021-1.0500 and 15A NCAC 02B .0200
for the discharge of fill material to waters and wetland areas as described in General Permits
198000291, 198000048, 198700056, 197800080, 197800125, and 198200277, Nationwide
Permits 3, 12, 13, 14, 18, 27, 29, 33, 35, 39, and 43, and for the Riparian Area Protection Rules
(Buffer Rules) in 15A NCAC 02B .0200.
The State of North Carolina certifies that the specified category of activity will not violate
applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217
if conducted in accordance with the conditions hereinafter set forth.
Activities meeting any one (1) of the following thresholds or circumstances require written
approval for a 401 Water Quality Certification from the Division of Water Quality (the
"Division"):
a) Activities authorized by CAMA major permits, except:
i. Boat Ramps and associated access (i.e. roads and parking lots) that involve the
excavation or filling of less than 500 square feet total of wetland and open water
area, with the exception that the excavation or filling of coastal wetlands may not
exceed 100 square feet;
ii. Shoreline protection measures that be into existing bulkheads, land or other
shoreline protection measures or do not extend waterward of the normal high water
line or normal water level more than 10 feet provided that the activity will not
involve the excavation or filling of any SAV or significant shellfish resources as
identified by the Division of Marine Fisheries and impacts less than 500 square feet
total of wetland, with the exception that the excavation or filling of coastal wetlands
may not exceed 100 square feet;
iii. Piers and docks designed to accommodate up to but not exceeding 10 vessels
(except where prohibited in ORW Waters as defined in 15A NCAC
02B.0225(7)&(8)) and where the water depth is equal to or greater than two feet of
water at normal low water level or normal water level (whichever is applicable);
iv. Maintenance dredging of less than 0.5 acres of open water or non -vegetated
wetlands provided that the applicant can provide documentation showing the
historic dimensions of the dredged channel, and no Submerged Aquatic Vegetation
or shellfish beds are excavated or filled;
V. Projects that involve only shading of waters or wetlands;
vi. Utility lines, except wastewater lines and potable water discharge lines which are

subject to an NPDES Permit, as long as wetland or water impacts are temporary;

stabilization measures. The applicant must comply with all applicable coastal
stormwater rules,
viii. Single family home construction that results in fill of 404 wetlands as long as
written concurrence is not required from DWQ for the applicable Corps of
Engineers Nationwide Permit; or
b) Any stream relocation; or
c) Any impact associated with a Notice of Violation or an enforcement action for violation(s)
of DWQ Wetland Rules (15A NCAC 02H .0500), Isolated Wetland Rules (15A NCAC 02H
.1300), DWQ Surface Water or Wetland Standards, or Riparian Buffer Rules (15A NCAC
0213.0200Y or
d) Any impacts to streams and/or buffers in the Neuse or Tar -Pamlico River Basins (or any
other basin or watershed with Riparian Area Protection Rules [Buffer Rules) in effect at
the time of application) unless the activities are listed as "EXEMPT' from these rules or a
Buffer Authorization Certificate is issued through N.C. Division of Coastal Management
(DCM) delegation for "ALLOWABLE" activities.
In accordance with North Carolina General Statute 143-215.3D(e), written approval for a 401
Water Quality General Certification must include the appropriate fee. If a project also requires a
CAMA Permit, then one payment to both agencies shall be submitted and will be the higher of the
two fees.
Activities included in this General Certification that do not meet one of the thresholds
listed above do not require written approval from the Division as long as they comply with
the Conditions of Certification, listed below. Activities authorized by Coastal Area
Management Act (CAMA) General Permits do not require written approval from the
Division as tong as they comply with the Conditions of Certification listed below. If any of
these Conditions cannot be met, then written approval from the Division is required.
Conditions of Certification:
1. No Impacts Beyond those Authorized in the Written Approval or Beyond the Threshold of Use
of this Certification
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre -Construction Notification, as
authorized in the written approval from the Division or beyond the thresholds established for
use of this Certification without written authorization, including incidental impacts. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices shall be performed so that no
violations of state water quality standards, statutes, or rules occur. Approved plans aC E IVE D

2. Standard Erosion and Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specificdtfogM- M H D C ITY
governing the proper design, installation and operation and maintenance of such Best
Management Practices and if applicable, comply with the specific conditions and
requirements of the NPDES Construction Stormwater Permit issued to the site:
a) Design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal or exceed the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor -owned or leased borrow pits associated with the project.

b) For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
c) Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act and the
Mining Act of 1971.
d) Sufficient materials required for stabilization andlor repair of erosion control measures
and stormwater routing and treatment shall be on site at all times.
e) If the project occurs in waters or watersheds classified as Primary Nursery Areas (PNAs),
SA, WS-I, WS-II, High Quality (HOW), or Outstanding Resource (ORW) waters, then the
sedimentation and erosion control designs must comply with the requirements set forth
in 15A NCAC 04B .0124, Design Standards in Sensitive Watersheds.
3. No Sediment and Erosion Control Measures in Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters.
Exceptions to this condition require application submittal to and written approval by the
Division. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, then design and placement of temporary erosion control measures shall not be
conducted in a manner that may result in dis-equilibrium of wetlands, stream beds, or banks,
adjacent to or upstream and downstream of the above structures. All sediment and erosion
control devices shall be removed and the natural grade restored within two (2) months of the
date that the Division of Land Resources (DLR) or locally delegated program has released
the specific area within the project.
4. Construction Stormwater Permit NCG010000
An NPDES Construction Stormwater Permit is required for construction projects that disturb
one (1) or more acres of land. This Permit allows stormwater to be discharged during land
disturbing construction activities as stipulated in the conditions of the permit. If your project
is covered by this permit, full compliance with permit conditions including the erosion &
sedimentation control plan, inspections and maintenance, self -monitoring, record keeping
and reporting requirements is required. A copy of the general permit (NCG010000),
inspection log sheets, and other information may be found at

The North Carolina Department of Transportation (NCOOT) shall be required to be in full
compliance with the conditions related to construction activities within the most recent version
of their individual NPDES (NCS000250) stormwater permit
5. Construction Moratoriums and Coordination
If activities must occur during periods of high biological activity (i.e. sea turtle nesting, fish
spawning, or bird nesting), then biological monitoring may be required at the request of other
state or federal agencies and coordinated with these activities.
All moratoriums on construction activities established by the NC Wildlife Resources
Commission (WRC), US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries
(DMF), or National Marine Fisheries Service (NMFS) to lessen impacts on trout, anadromous

implemented. Exceptions to this condition require written approval by the resource agency

Work within the twenty-five (25) designated trout counties or identified state or federal
endangered or threatened species habitat shall be coordinated with the appropriate WRC,
USFWS, NMFS, and/or DMF personnel.
6. Dredging shall not cause Shellfish Closures
The effluent water from the dredge spoil should not be released into open shellfish waters.
Shellfish Sanitation and the Division of Water Quality must be notified if this is to occur.
7. Work in the Dry
All work in or adjacent to stream waters shall be conducted so that the flowing stream does
not come in contact with the disturbed area. Approved best management practices from the
most current version of the NO Sediment and Erosion Control Manual, or the NO DOT
Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams,
and other diversion structures shall be used to minimize excavation in flowing water.
Exceptions to this condition require application submittal to and written approval by the
Division.
8, Riparian Area Protection (Buffer) Rules
Activities located in the protected riparian areas (whether jurisdictional wetlands or not),
within the Neuse, Tar -Pamlico, or Catawba River Basins or in the Randleman, Jordan, or
Goose Creek Watersheds (or any other basin or watershed with buffer rules) shall be limited
to "uses" identified within and constructed in accordance with 15A NCAC 02B .0233, .0259,
.0243, .0250, .0267 and .0605, and shall be located, designed, constructed, and maintained
to have minimal disturbance to protect water quality to the maximum extent practicable
through the use of best management practices. All buffer rule requirements, including diffuse
flow requirements, must be met.
9. If concrete is used during the construction, then all necessary measures shall be taken to
prevent direct contact between uncured or curing concrete and waters of the state. Water
that inadvertently contacts uncured concrete shall not be discharged to waters of the state RECEIVED
due to the potential for elevated pH and possible aquatic life/ fish kills.
10. Compensatory Mitigation

In accordance with 15A NCAC 02H .0506 (h), compensatory mitigation may be required for
losses of equal to or greater than 160 linear feet of streams (intermittent and perennial) CM- MHD CITY
and/or equal to or greater than one (1) acre of wetlands. For linear public transportation
projects, impacts equal to or exceeding 150 linear feet per stream shall require mitigation.
Buffer mitigation may be required for any project with Buffer Rules in effect at the time of
application for activities classified as "Allowable with Mitigation" or "Prohibited" within the
Table of Uses.
A determination of buffer, wetland, and stream mitigation requirements shall be made for any
General Water Quality Certification for this Nationwide and/or Regional General Permit.
Design and monitoring protocols shall follow the US Army Corps of Engineers Wilmington
District Stream Mitigation Guidelines (April 2003) or its subsequent updates. Compensatory
mitigation plans shall be submitted to the Division for written approval as required in those
protocols. The mitigation plan must be implemented and/or constructed before any impacts
occur on site. Alternatively, the Division will accept payment into an in -lieu fee program or a
mitigation bank. In these cases, proof of payment shall be provided to the Division before
any impacts occur on site.

11. Placement of Culverts and Other Structures in Waters and Wetlands
Culverts required for this project shall be designed and installed in such a manner that the
original stream profiles are not altered and allow for aquatic life movement during low flows.
Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal
profile) must be maintained above and below locations of each culvert.
Placement of culverts and other structures in waters and streams must be below the
elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than or equal to 48
inches, to allow low flow passage of water and aquatic life.
When topographic constraints indicate culvert slopes of greater than 5%, culvert burial is not
required, provided that all alternative options for flattening the slope have been investigated
and aquatic life movement/ connectivity has been provided when possible (rock ladders,
crossvanes, etc). Notification to the Division including supporting documentation to include a
location map of the culvert, culvert profile drawings, and slope calculations shall be provided
to the Division 60 days prior to the installation of the culvert.
When bedrock is present in culvert locations, culvert burial is not required provided that there
is sufficient documentation of the presence of bedrock. Notification to the Division including
supporting documentation such as, but not limited to, a location map of the culvert,
geotechnical reports, photographs, etc shall be provided to the Division a minimum of 60
days prior to the installation of the culvert. If bedrock is discovered during construction, then
the Division shall be notified by phone or email within 24 hours of discovery.
If other site -specific topographic constraints preclude the ability to bury the culverts as
described above and/or it can be demonstrated that burying the culvert would result in
destabilization of the channel, then exceptions to this condition require application submittal
to, and written approval by, the Division of Water Quality, regardless of the total impacts to
streams or wetlands from the project.
Installation of culverts in wetlands must ensure continuity of water movement and be
designed to adequately accommodate high water or flood conditions. Additionally, when
roadways, causeways, or other fill projects are constructed across FEMA-designated
floodways or wetlands, openings such as culverts or bridges must be provided to maintain
the natural hydrology of the system as well as prevent constriction of the floodway that may
result in destabilization of streams or wetlands.
The establishment of native, woody vegetation and other soft stream bank stabilization
techniques must be used where practicable instead of riprap or other bank hardening
methods.
12, All temporary fill and culverts shall be removed and the impacted area returned to natural
conditions within 60 days of the determination that the temporary impact is no longer
necessary. The impacted areas shall be restored to original grade, including each stream's
original cross sectional dimensions, plan form pattern, and longitudinal bed and bed profile,
and the various sites shall be stabilized with natural woody vegetation (except for the
approved maintenance areas) and restored to prevent erosion.
13. All temporary pipes/ culverts/ riprap pads etc, shall be installed in all streams as outlined in

the most recent edition of the North Carolina Sediment and Erosion Control Planning and

Design Manual or the North Carolina Surface Mining Manual so as not to restrict stream flow

14. Any riprap required for proper culvert placement, stream stabilization, or restoration of
temporarily disturbed areas shall be restricted to the area directly impacted by the approved
construction activity. All rip -rap shall buried and/or "keyed in" such that the original stream
elevation and streambank contours are restored and maintained. Placement of rip -rap or
other approved materials shall not result in de -stabilization of the stream bed or banks
upstream or downstream of the area.
15. Any rip -rap used for stream stabilization shall be of a size and density so as not to be able to
be carried off by wave, current action, or stream flows and consist of clean rock or masonry
material free of debris or toxic pollutants. Rip -rap shall not be installed in the streambed
except in specific areas required for velocity control and to ensure structural integrity of bank
stabilization measures.
16. If this Water Quality Certification is used to access building sites, then all lots owned by the
applicant must be buildable without additional impacts to streams or wetlands. The applicant
is required to provide evidence that the lots are buildable without requiring additional impacts
to wetlands, waters, or buffers if required to do so in writing by the Division. For road
construction purposes, this Certification shall only be utilized from natural high ground to
natural high ground.
17. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters, and protective buffers within the project boundaries in order to assure
compliance for future wetland, water, and buffer impact. These mechanisms shall be put in
place at the time of recording of the property or of individual lots whichever is appropriate. A
sample deed notification can be downloaded from the Division's web site at
http://portal ncdenr org/web/wci/swo/ws/401/certsandoermAs/apply-/forms. The text of the
sample deed notification may be modified as appropriate to sud to a specific project.
Documentation of deed notifications shall be provided to the Division upon request.
18, If an environmental document is required under the National or State Environmental Policy D
Act (NEPA or SEPA), then this General Certification is not valid until a Finding of No CE�V E
Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State FtE

19. In the twenty (20) coastal counties, the appropriate DWQ Regional Office must be contacted
to determine if Coastal Stormwater Regulations will be required. DCM- MHp CIT
20. This General Certification does not relieve the applicant of the responsibility to obtain all other
required Federal, State, or Local approvals.
21. The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal Law. If the Division determines that such standards or laws are not being
met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, then the
Division may reevaluate and modify this General Water Quality Certification.
22. When written authorization is required for use of this certification, upon completion of all
permitted impacts included within the approval and any subsequent modifications, the
applicant shall be required to return the certificate of completion attached to the approval.
One copy of the certificate shall be sent to the DWQ Central Office in Raleigh at 1650 Mail
Service Center, Raleigh, NC, 27699-1650.
23. Additional site -specific conditions, including monitoring and/or modeling requirements, may
be added to the written approval letter for projects proposed under this Water Quality

Certification in order to ensure compliance with aft applicable water quality and effluent
standards.
24. This certification grants permission to the director, an authorized representative of the
Director, or DENR staff, upon the presentation of proper credentials, to enter the property
during normal business hours.
This General Certification shall expire on the same day as the expiration date of the
corresponding Nationwide and/or Regional General Permit. The conditions in effect on the date
of issuance of Certification for a specific project shall remain in effect for the life of the project,
regardless of the expiration date of this Certification.
Non-compliance with or violation of the conditions herein set forth by a specific project may result
.in revocation of this General Certification for the project and may also result in criminal and/or civil
penalties.
The Director of the North Carolina Division of Water Quality may require submission of a formal
application for Individual Certification for any project in this category of activity if it is determined
that the project is likely to have a significant adverse effect upon water quality, including state or
federally listed endangered or threatened aquatic species, or degrade the waters so that existing
uses of the wetland or downstream waters are precluded.
Public hearings may be held for specific applications or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina
Division of Water Quality.

On November 7, 2016, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) received a complete request to exclude the subject proposed redevelopment project from Stormwater
Management Permit requirements. Staff review of the plans and supporting documentation has determined that the
project proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section
2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC
2H.1000, as amended.
Therefore, the director of the DEMLR is hereby providing confirmation that the subject project is excluded from
State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as
shown on the plans submitted to this Office; 2) The proposed built -upon area of 31,288 square feet does not exceed
the existing built -upon area of 38,956 square feet leaving 7,668 square feet available for future development; and, 3)
The proposed stormwater control, vegetated sheet flow and/or infiltration in vegetated areas, provides equal
protection of surface waters as the existing stormwater control, which is vegetated sheet flow and/or infiltration in
vegetated areas.
Under Section .1003 (b) of the stormwater rules, the entire common plan of development must be permitted.
Therefore, any future development or changes to the proposed development, including, but not limited to, the
relocation of built -upon area and the construction of additional built -upon area, may require approval or a
Stormwater Management permit application and permit issuance from the DEMLR prior to any construction.
Construction of the project prior to receipt of the required approval or permit or failure to maintain compliance with
the exclusion conditions, are violations of Title 15A NCAC 2H.1000 and Session Law 2008-211, and may result in
the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and
approvals, which may be required by Federal, State, or local government agencies, rule or law. If you have any

SUBJECT: CAMA Dredge/Fill Permit Application for NCWRC, West Onslow Beach BAA,
Onslow County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 656 Island
Drive adjacent the AIW W in North Topsail Beach, NC. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat 401, as amended, 16 U.S.C. 661 et seq.).
The applicant proposes redevelop the existing boating access area (BAA) and perform maintenance
dredging associated with the ramp. The current two-lane concrete ramp will be removed and relocated
further downstream the canal. A new floating dock will be installed at the same location of the existing
dock The relocated ramps will be moved to the far northwest comer of the lot consisting of two lanes and
one floating dock Dredging will occur within the historically dredged area and will terminate in depths of
-5' NLW. Material will be moved offsite. The existing gravel parking lot will be paved and have 27
marked parking areas. This area of Stump Sound is classified SA ORW by the Environmental
Management Commission, is open to shellfish harvesting, and is designated a primary nursery area
(PNA) by the NC Division of Marine Fisheries (NCDMF).
Biologists with the NCWRC have reviewed the permit application and do not object to site
redevelopment. To minimize impacts to important aquatic resources, we support any in -water work
moratorium requested by a representative of NCDMF or the current moratorium listed as a condition
under the existing permit.

On November 7, 2016, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) received a complete request to exclude the subject proposed redevelopment project from Stormwater
Management Permit requirements. Staff review of the plans and supporting documentation has determined that the
project proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section
2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC
2H.1000, as amended.
Therefore, the director of the DEMLR is hereby providing confirmation that the subject project is excluded from
State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as
shown on the plans submitted to this Office; 2) The proposed built -upon area of 31,288 square feet does not exceed
the existing built -upon area of 38,956 square feet leaving 7,668 square feet available for future development; and, 3)
The proposed stormwater control, vegetated sheet flow and/or infiltration in vegetated areas, provides equal
protection of surface waters as the existing stormwater control, which is vegetated sheet flow and/or infiltration in
vegetated areas.
Under Section .1003 (b) of the stormwater rules, the entire common plan of development must be permitted.
Therefore, any future development or changes to the proposed development, including, but not limited to, the
relocation of built -upon area and the construction of additional built -upon area, may require approval or a
Stormwater Management permit application and permit issuance from the DEMLR prior to any construction.
Construction of the project prior to receipt of the required approval or permit or failure to maintain compliance with
the exclusion conditions, are violations of Title 15A NCAC 211.1000 and Session Law 2008-211, and may result in
the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and
approvals, which may be required by Federal, State, or local government agencies, rule or law. If you have any

THAT WHEREAS, the party of the second part desires to encroach on the right of way of \ as

with the construction and/or erection of: Boating access area renovation to include the installation of two ramps with a floating
dock, as well as a free standing floating dock in the location of the existing ramp.
Proposed maintenance dredging of channel approx. 930' in length by 15' in width
WHEREAS, it is to the material advantage of the party of the second part to effect this encroachment, and
the party of the first part in the exercise of authority conferred upon it by statute, is willing to permit the
encroachment within the limits of the right of way as indicated, subject to the conditions of this agreement;
NOW, THEREFORE, IT IS AGREED that the party of the first part hereby grants to the party of the second
part the right and privilege to make this encroachment as shown on attached plan sheet(s), specifications and
special provisions which are made a part hereof upon the following conditions, to wit:
That the said party of the second part binds and obligates himself to install and maintain the encroaching facility in such safe
and proper condition that it will not interfere with or endanger travel upon said highway, nor obstruct nor interfere with the proper
maintenance thereof, to reimburse the party of the first part for the cost incurred for any repairs or maintenance to its roadways
and structures necessary due to the installation and existence of the facilities of the party.of the second part, and if at anytime
the party of the first part shall require the removal of or changes in the location of the said facilities, that the said party of the
second part binds himself, his successors and assigns, to promptly remove or alter the said facilities, in order to conform to the
said requirement, without any cost to the party of the first part.
That the party of the second part agrees to provide during construction and any subsequent maintenance proper signs, signal
lights, flagmen and other warning devices for the protection of traffic in conformance with the latest Manual on Uniform Traffic
Control Devices for Streets and Highways and Amendments or Supplements thereto. Information as to the above rules and
regulations may be obtained from the Division Engineer of the party of the first part.
That the party of the second part hereby agrees to indemnify and save harmless the party of the first part from all damages
and claims for damage that may arise by reason of the installation and maintenance of this encroachment.
It is clearly understood by the party of the second part that the party of the first part will assume no responsibility for any
damage that may be caused to such facilities, within the highway rights of way limits, in carrying out its construction and
maintenance operations.
That the party of the second part agrees to restore all areas disturbed during installation and maintenance to the satisfaction
of the Division Engineer of the party of the first part. The party of the second part agrees to exercise every reasonable
precaution during construction and maintenance to prevent eroding of soil; silting or pollution of rivers, streams, lakes, reservoirs,
other water impoundments, ground surfaces or other property; or pollution of the air. There shall be compliance with applicable
rules and regulations of the North Carolina Division of Environmental Management, North Carolina Sedimentation Control
Commission, and with ordinances and regulations of various counties, municipalities and other official agencies relating to
pollution prevention and control. When any installation or maintenance operation disturbs the ground surface and existing
ground cover, the party of the second part agrees to remove and replace the sod or otherwise reestablish the grass cover to
meet the satisfaction of the Division Engineer of the party of the first part.
That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary
by the Division Engineer of the party of the first part.
That the party of the second part agrees to have available at the encroaching site, at all times during construction, a copy of
this agreement showing evidence of approval by the party of the first part. The party of the first part reserves the right to stop all
work unless evidence of approval can be shown.
Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the
second part agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has
been completed. Unless specifically requested by the party of the first part, written notice of completion of work on highway
projects under construction will not be required.
That in the case of noncompliance with the terms of this agreement by the party of the second part, the party of the first part
reserves the right to stop all work until the facility has been brought into compliance or removed from the right of way at no cost
to the party of the first part.
That it is agreed by both parties that this agreement shall become void if actual construction of the work cor�Rr

INSTRUCTIONS
When the applicant is a corporation or a municipality, this agreement must have the corporate seal and
be attested by the corporation secretary or by the empowered city official, unless a waiver of corporate
seal and attestation by the secretary or by the empowered City official is on file in the Raleigh office of
the Manager of Right of Way. In the space provided in this agreement for execution, the name of the
corporation or municipality shall be typed above the name, and title of all persons signing the agreement
should be typed directly below their signature.
When the applicant is not a corporation, then his signature must be witnessed by one person. The
address should be included in this agreement and the names of all persons signing the agreement
should be typed directly below their signature.
This agreement must be accompanied, in the form of an attachment, by plans or drawings showing the
following applicable information:
1. All roadways and ramps.
2. Right of way lines and where applicable, the control of access lines.
3. Location of the proposed encroachment.
4. Length and type of encroachment.
5. Location by highway survey station number. If station number cannot be obtained, location
should be shown by distance from some identifiable point, such as a bridge, road,
intersection, etc. (To assist in preparation of the encroachment plan, the Department's
roadway plans may be seen at the various Highway Division Offices, or at the Raleigh
office.)
6. Drainage structures or bridges if affected by encroachment.
7. Typical section indicating the pavement design and width, and the slopes, widths and
details for either a curb and gutter or a shoulder and ditch section, whichever is applicable.
8. Horizontal alignment indicating general curve data, where applicable.
9. Vertical alignment indicated by percent grade, P.I. station and vertical curve length, where
applicable.
10. Amount of material to be removed and/or placed on NCDOT right of way, if applicable.
11. Cross -sections of all grading operations, indicating slope ratio and reference by station
where applicable.
12. All pertinent drainage structures proposed. Include all hydraulic data, pipe sizes, structure
details and other related information.
13. Erosion and sediment control.
14. Any special provisions or specifications as to the performance of the work or the method of
construction that may be required by the Department must be shown on a separate sheet
attached to encroachment agreement provided that such information cannot be shown on
plans or drawings.
15. The Department's Division Engineer should be given notice by the applicant prior to actual
starting of installation included in this agreement.

SP 3 An executed copy of this encroachment agreement shall be present at the
construction site at all times during construction. NCDOT reserves the right to stop
all work unless evidence of approval can be shown. If safety or traffic conditions
warrant such action, NCDOT reserves the right to further limit, restrict, or suspend
operations within the right of way.
SP 4 Materials and workmanship shall conform to the NC Department of Transportation's
Standards and Specifications.
SP 5 The encroaching party is required to contact the appropriate Utility Company (ies)
involved and make satisfactory arrangements to adjust the utilities in conflict with
the proposed work prior to construction.
SP 6 Proper temporary and permanent measures shall be used to control erosion and
sedimentation in accordance with local, State and Federal regulations. If any area in
excess of one (1) acre will be disturbed, the Encroachee shall submit to the District
Engineer's Office a Sediment and Erosion Control Plan which has been approved by
the appropriate regulatory agency or authority prior to beginning any work on the
Right of Way. FAILURE TO PROVIDE THIS INFORMATION SHALL BE
GROUNDS FOR SUSPENSION OF OPERATIONS.
SP 9 Since work will be performed within the North Topsail Beach city limits, it will be
your responsibility to notify the local Municipality prior to beginning work.
SP 14 Approval of this Encroachment does not include any portion of the work outside the
North Carolina Department of Transportation's Rights of Way.

SP 29 All excavations inside the theoretical 1:1 slope from the existing edge of pavement
to the bottom of the nearest trench wall shall be made in accordance with the
following conditions:
A. All trench excavation inside the limits of the theoretical 1:1 slope as defined by

B. The length of parallel excavation shall be limited to the length necessary to install
and backfill one (1) joint of pipe at a time. p

C. Traffic shall be moved to a travel lane outside the limits of a theoretical 1:1 slope
from the bottom of the nearest trench wall to the pavement surface.
D. Installation of trench shoring shall be accomplished with minimal over -
excavation. TRENCH BOXES SHALL NOT BE USED AS SHORING.
E. An NCDOT Inspector, the cost of which to be home by the party of the second
part, shall be assigned to this project if deemed necessary by the Division Engineer.
F. The trench backfill material shall meet the Statewide Borrow Criteria. The trench
shall be backfilled, in accordance with Section 300-7 of the January 2006 Statewide
Standard Specifications for Roads and Structures, which basically requires the
backfill material to be placed in layers not to exceed six (6) inches loose and
compacted to at least 95% of the density obtained by compacting a sample in
accordance with AASHTO T99, as modified by DOT.
G. At the first sign of trench failure, a trench shall be immediately backfilled with
materials consisting of A-1, A-3, A-24 soils or A-4 soils having a maximum of 45%
passing a No. 200 sieve and a maximum P.I. of 6. All work shall cease, the Division
Engineer shall be contacted. The Party of the Second Part shall be required to repair
any damage to the pavement caused by the excavation.
SP 37 This encroachment is approved with the understanding that the North Carolina
Department of Transportation does not guarantee the right of way on this road, nor
will it be responsible for any claim for damages brought by any property owner by
reason of the installation.
SP 43 Ingress and egress shall be maintained to all businesses and dwellings affected by the
project. Special attention shall be paid to police and fire stations, fire hydrants, and
hospitals.
SP 46 If existing guardrail is disturbed, it shall be reset back to NCDOT Standards and as
directed by the District Engineer.
SP 55 The encroaching party shall comply with all applicable state and federal
environmental regulations, and shall obtain all necessary state and federal

completed application requesting State approval for development of property located at 656 Island Drive,
adjacent to Stump Sound, in North Topsail Beach, Onslow County. The projected deadline for malting a
decision on your permit application is March 6, 2017. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 21, 2016, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status
of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
