This permit, issued on February 28, 2017 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the parking lot
reconfiguration, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020

I. In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter entering adjacent wetlands, watercourses and property.
Stormwater Management
'The Division Energy, Mineral and Land Resources approval of this project under stormwater management
rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8
170111, which was issued on 1/23/17. Any violation of the permit approved by the DEMLR shall be
,--.considered a violation of this CAMA permit.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to project
initiation.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers has assigned the project Action ID SAW-2005-9988760.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

This project is for the improvement and expansion of parking opportunities at a public access boat ramp. This project will
rearrange the existing gravel surface and also increase parking by using a permeable parking surface. Concrete ADA
parking spaces and sidewalks will also be constructed. The boating access area will be open to the public 24 hours a day.

Basic site construction methods will be used. Equipment used will include an excavator, dump trucks, bulldozer, and roller.

and assocated sidewalks will be also be constructed.

NARRATIVE
The Shell Rock Landing Boating Access Area project is located in Swansboro, NC at the end of
Shell Rock Landing Rd (SR 1503) near the Intercostal Waterway. The existing property is used as a
North Carolina Wildlife Resources Commission boating access area. Currently there are a gravel
parking area, paved boat ramp, and floating dock on the site. On -site parking is limited due to the
impervious surface restrictions, as the site is within the 575' AEC of the adjacent SA:ORW waters.
This project proposes to improve the parking areas on site to better serve the public and maximize
available on -site parking opportunities while also ensuring compliance with all associated permits.
Improvements to the on -site parking area include the rearranging of existing gravel and the use of a
pervious parking surface. The cross section includes filter fabric, #57 stone and a permeable plastic
grid, which is considered a pervious surface as described in Session Law 2015-149, House Bill 634.
The parking lot is being expanded to increase parking for trailered and non-trailered vehicles, as well
as an increase in ADA parking.

original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
[phone] within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application: Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.

On January 23, 2017, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) received a request to exclude the subject proposed redevelopment project from Stormwater Management
Permit requirements. Staff review of the plans and supporting documentation has determined that the project
proposes activities that are excluded from State Stormwater permitting requirements as set forth in Section 2.(d)(3)
of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A NCAC 2H.1000, as
amended.
Therefore, the director of the DEMLR is hereby providing confirmation that the subject project is excluded from
State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as
shown on the plans submitted to this Office; 2) The total proposed built -upon area of 31,561 square feet does not
exceed the existing built -upon area of 31,561 square feet; and, 3) The proposed stormwater control, sheet flow and
encourage the infiltration of runoff due to the proposed pervious parking areas, provides equal protection of surface
waters as the existing stormwater control, which is sheet flow. The 31,561 square feet of built -upon area allocated
to this 126,324 square foot project area includes 31,259 square feet of proposed built -upon area and 302 square feet
of built -upon area allocated for future improvements. The project is proposing 27,232 square feet of #57 stone laid
at least four inches thick over a geotextile fabric as a pervious surface for various parking stalls and drive areas. The
underlying soil must not be mechanically compacted prior to installation. If, in the future, this pervious surface is
found to no longer meet SL 2015-149, a plan revision or permit application will be required. Any future areas of
#57 stone proposed within this development will need prior approval from the Division in order to demonstrate that
the improvements are still considered pervious under the latest definition of built -upon area.
Under Section .1003 (b) of the stormwater rules, the entire common plan of development must be permitted.
Therefore, any future development or changes to the proposed development, including, but not limited to, the
relocation of built -upon area and the construction of additional built -upon area, will require approval or a
Stormwater Management permit application and permit issuance from the DEMLR prior to any construction.
Construction of the project prior to receipt of the required approval or permit or failure to maintain compliance with
the exclusion conditions, are violations of Title 15A NCAC 2H.1000 and Session Law 2008-211, and may result in
the initiation of appropriate enforcement action.

This project is consistent with the Onslow County Land Use Plan.
The applicant proposes to redevelop an existing boat ramp by expanding an existing
parking lot. The project is located at 248 Shell Rock Landing Road in Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine
Shoreline. Waters at the project site are classified as SA-ORW and are not open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Onslow County Land Use Plan and
offer the following comments.
The general area of the project is classified as Residential/Agriculture.
In general, Onslow County allows development in Conservation classified AECs which is

9. NARRATIVE DESCRIPTION: The North Carolina Wildlife Resources Commission
project is located at 248 Shell Rock Landing Rd. in the Hubert area of Onslow County.
The project site is found by turning off of Hwy. 70 and onto Queens Creek Rd. in
Swansboro. At the terminus of Queens Creek Rd., turn left onto Great Neck Landing Rd.
before turning right on the Shell Rock Landing Rd. That the terminus of Shell Rock
Landing Rd. will be the Shell Rock Boating Access Area. The project is located on a high
ground cut off the AIWW.
The property is 2.9 acres in its entirety and averages +7' NHW in elevation. The property
is cleared and vegetated with various grasses. Existing on high ground is an existing gravel
parking areas. Two existing boat ramps and a floating dock provide launching access to the
public.
This area of the AIWW is classified as SA-ORW and is a not Primary Nursery Area. The
adjacent waters of the AIWW are open to the harvesting of shellfish but the basin connecting
to the ramp is closed. The Onslow County LUP classifies the area within the 575' Estuarine
Shoreline AEC as Conservation and all other areas Agricultural/Residential.'
10. PROJECT DESCRIPTION: The applicant is proposing to redevelop an existing gravel
parking area into a renovated 62 space parking lot. The new parking lot would be lac in
size. It would provide 49 trailer spaces, 10 non -trailer spaces and 3 handicap spaces. No
portion of the parking area would be within the 30' buffer. The engineer (McGill &
Associates) has stated that the design will meet the 25% impervious limitation. This would
be accomplished by using a permeable grid in the parking areas and gravel in the driving
areas. The gravel would be a combination of #57 stone and abc stone. A sedimentation and
erosion control plan and a stormwater plan have both been applied for.
11. ANTICIPATED IMPACTS: A total of 2ac would be disturbed on high ground during
construction of this project. Temporary sedimentation could occur during construction.
This project should increase public access to Public Trust Waters. The engineer has
stated that impervious area within 575' of NHW will not exceed 25%

If this agency does not render a permit decision within 70 days from the
12/28/2016, you may request a meeting with the Director of the Division of
Coastal Management and permit staff to discuss the status of your project. Such

NCGS 113A-119(b) requires that Notice of an application be posted at the
location of the proposed development. Enclosed you will find a "Notice of Permit
Filing" 'postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in

AMENDMENT I "ADJUSTED AREA OF MAINTENANCE"
This amendment (the "ADJUSTED AREA OF MAINTENANCE") is made and entered into as
of the 1st day of June, 2008 by and between the North Carolina Wildlife Resources Commission,
acting by and through its Executive Director, hereinafter called the COMMISSION, and the
County of Onslow, acting by and through the County Commission, hereinafter called the
COUNTY.

BACKGROUND AND PURPOSE OF AMENDMENT
1.1 PRIOR AGREEMENT
The COMMISSION and the COUNTY are parties to a MEMORANDUM OF
AGREEMENT assigning total jurisdiction and responsibility for the maintenance
and operation of a public boating access area to the COMMISSION as described
in the agreement fully executed on Ze day of January, 2002.
1.2 ALLOCATION OF PROPERTY FOR ACCESS AND FACILITY
IMPROVEMENTS
Facility patrons are utilizing portions of property under jurisdiction and
maintenance control of both the COMMISSION and the COUNTY. Further, the
COMMSSION proposes to implement site improvements that extend intaik ar; E !V E
area maintained by the COUNTY.
EXECUTION OF ADDENDUM AGREEMENT

Concurrently with the execution of this Amendment, The COMMISSION andIG M - M H D C
COUNTY hereby amend the MEMORANDUM OF AGREEMENT to adjust the area
assigned to the COMMISSION for operation and maintenance. Upon execution of this

agreement, the area defined in the MEMORANDUM OF AGREEMENT shall be
redefined including the area described in Exhibit A, "Site Expansion".
3. NO OTHER MODIFICATIONS
Except as specifically amended herein, all of the other terms and conditions of the

a CAMA permit, $130.00 for an erosion control permit, and $500.00 for a stormwater permit.
