Signature of Permittee 1 Resources Commission Permit No. 43-17 lr Page 2 of 3 ADDITIONAL CONDITIONS Boat Ramp The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. In accordance with commitments made by the pemuttee, a mussel relocation methodology has been developed for the area associated with the boat ramp and public fishing area, as described in the memo from WRC dated 2/20/17. Relocation of the mussel beds shall be completed prior to any in -water activity. Docking Facility '..In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no pile driving associated with the docking facility shall be permitted between February 15 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. This permit authorizes only the pier and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit authorizes no formalized boat slips. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Cultural Resource Protection Prior to the initiation of any land -disturbing activities authorized by this permit, the permittee shall, in coordination with the N.C. Department of Natural and Cultural Resources (NCDNCR), develop and implement an archaeological survey for site 31 GA4. Initiation of permitted land -disturbing activities `shall not begin until written approval is obtained from NCDNCR, and a copy of such approval has been submitted to the Division of Coastal Management. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a thud party without the written approval of the Division of Coastal Management. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. E:. Received ]AN 12 2017 Proposed NCWRC Gatlington Landing Boating Access Area p� ennAr CAMA Permit Narrative DMEC December 2016 NC Wildlife Resources Commission is applying for a CAMA Major Permit for new public boat ramp and fishing pier construction in Gates County on the Chowan River. The project site is owned by NCWRC and is within the Commission's 31,300 acre Chowan Swamp Game Land. The area is currently partially cleared by previous development but no structures exist. It is accessed by a dirt/gravel road and has historically been used as a recreational swimming, fishing, and small boat access point. This area of the game land is In a Natural Heritage Area. The new access development is confined to an Exclusion Zone. The proposed project scope includes widening and improving the existing 4200' gravel road, constructing a new gravel gravel parking lot, constructing a new single lane concrete boat ramp, installing a new floating dock parallel to the ramp, constructing concrete ADA parking spaces, and constructing a wood fixed fishing pier and walkway. The proposed boat ramp will be 15'-wide and 97'-long. It will reach a depth of -5' (based on NWL=O) to connect to the river channel and no dredging beyond the end of the ramp will be required. The proposed floating dock is 48'-long and 8'-wide. This dock will assist users of all ability levels in launching and recovering of boats and be steady in choppy conditions which Increases public safety. The proposed parking lot is 33,350 FT2 in area and will have 25 vehicle -trailer spaces, 8 single car parking spaces, and additional ADA parking spaces. The proposed fishing pier will be 30'x12' and will be accessed by a 5'-wide, 20V-Iong wood walkway connecting the ADA parking through the AEC. Upon completion this project would be a NCWRC Boating Access Area (BAA) and Public Fishing Area (PFA) open to the public free of charge 24/7. The concrete boat ramp slab will be poured on high ground. The rock base will be placed by long -reach excavator and then the ramp slab will be pushed into place with a bulldozer. No live concrete will come into contact with the river water. A turbidity curtain will be in -place during in -water work. No wetlands are present in the development area. This area of the Chowan River is known habitat of State -rare mussels. NCWRC-Aquatic Diversity staff conducted a mussel survey in the development area in April 2016. This survey Identified areas of dense and less -dense mussels. This proposed development avoids the dense mussel areas found In the survey. Also, as recommended by NCWRC-Aquatic Diversity staff, a mussel relocation will take place prior to in -water construction. The proposed project will result in 0.209% impervious surfaces in the game land. NCWRC has applied for a Low Density Stormwater Permit as part of this project on 9/1/2016; Permit #SW7160905 was issued 11/15/2016. The project is designed to allow sheetflow off of smooth surfaces and provides a 50' vegetated offset as required by Coastal Stormwater rules. NCWRC has accepted a cost estimate and proposal from NCDOT to improve the gravel road and construct the new gravel parking lot. North Carolina Wildlife Resources Commission Gatlington Landing Field Investigation Report Page 2 Proiect Setting The property is in Gates County along the Chowan River, at the end of an unnamed gravel road — 4,200' (.8 miles) northwest of Sandbank Road (SR1200), on the Chowan River. The site is located within the 31,100-acre multitrack Chowan Swamp Game Land, managed by the North Carolina Wildlife Resources Commission. The total area of existing impervious surface within the Game Lands is less than %of a percent. The immediate area to be developed is within a Natural Heritage Exclusion Zone at Gatlington Landing, and consists of approximately 2.2 acres with 800' of shoreline. The project site is 2.5 miles south of the North Carolina/Virginia Line. While the property is not zone by the County, it is listed as conservation in the Gates County Land Use Plan. A remnant dwelling foundation is located within the project area —85' from normal water level (NWL). Also located on the property is a remnant boat ramp that falls outside of the Natural Heritage Exclusion Zone. Average elevation of the property is -T above NWL. Soils at this site are listed as Aab (Alaga sand), which are a sandy, excessively draining soil. Flood zone designation at the site is AE and considered to be at high risk of flooding. No wetlands were found within the project area. Vegetation on the property include, but is not limited to, bald cypress (Taxodium distichum), ash (Fraxinus excelsior), loblloy pine (Pins teada), greenbrier (Smilax rotundifolia), poison ivy (Toxicodendron radicans), pokeweed (Phytolacca americans), spotted spurge (Chamaesyce maculate), and wild grape vine/riverbank grape (Vitis nparia). Gatlington landing is open to the public and is used as a passive recreational site for swimming and fishing with no facilities on the property and no formal parking. The site is partially wooded with shrub brush undergrowth with a grassy clearing where a 10' wide gravel road accesses the site. The shoreline is open along —175' with 80' of sandy beach. Water depths In this area are approximately -3' at a distance of 20' offshore and between -6 and -7' at a distance of 50' offshore. The narrative submitted states that the Chowan River is a known habitat for "state -rare mussels". Further research into the presence of mussels within the project area revealed that the Chowan River Freshwater Mussel Survey, conducted in 2009 by Alderman Environmental Services, Inc., identified three freshwater mussels (tidewater musket, eastern lampmussel, and eastern pondmussel) listed by the NC WRC as "Threatened" and one mussel (yellow lampmussel) that is listed as "Endangered". The yellow lampmussel is also listed as Federal Species of Concern by the US Fish & Wildlife Service. According to the US Fish & Wildlife Service "Federal Species of Concern are species that appear to be in decline or otherwise in need of conservation and are under consideration for listing or for which there is insufficient information to support listing at this time". Develooment Proposal North Carolina's Wildlife Resources Commission (NC WRC) proposes to develop a formal boat access and fishing pier in the upper Chowan River in Gates county. The nearest ramp in Gates County is — 9 miles south of the project site, just below the Chowan River bridge to Winton. This site will provide 35 parking spaces including; 25 boat trailer spaces, 8 vehicle spaces and 2 ADA compliant spaces to access the following improvements: Ramp development will include the construction of a 9T x 15' boat ramp, with an 8' wide concrete access on the right side accessing a 48' x 8' floating courtesy dock. The ramp will extend 41' waterward of NWL and will be 8" thick concrete poured on high ground and pushed into place over 6" of No. 57 stone. Riprap will be placed along the sides of the high ground section of the ramp to prevent erosion. A 20' x 23' concrete apron will be placed on the landward side of the ramp. Archaeological assessment of site 31 GA4 has revealed that the prehistoric and historic components of this site have the potential to yield important information about the Middle Woodland Period and the nineteenth-century economic development of Gates County, respectively. We concur with the project archaeologists that this site is eligible for listing in the National Register of Historic Places. While this site is significant; the integrity of 31 GA4 is spatially variable. Excavations by JRIA demonstrated that the northern portion of the site has been significantly damaged by twentieth- century earth -moving activities (see attached map). Therefore, construction associated with the proposed NC Wildlife Resources Commission (NCWRC) boat access area in the northern portion of the site — including the proposed dock, boardwalk, and concrete ADA parking area —will have no adverse effect on site 31 GA4. Intact subsurface features were encountered in the southwestern portion of site 31 GA4. The potential effects of the proposed project on 31 GA4 in this area will be dependent on the extent of planned ground disturbance. We recommend that project designers for the proposed boat access area consult with the Office of State Archaeology (OSA). In addition to technical. assistance in project development, the OSA can provide on -site monitoring for the NCWRC should such measures be considered necessary. REGAN secretary BRAXTON DAVIS Director North Carolina's Wildlife Resources Commission (NC WRC) proposes to develop a formal boat access and fishing pier in the upper Chowan River in Gates county. This site will provide 35 parking spaces including; 25 boat trailer spaces, 8 vehicle spaces and 2 ADA compliant spaces to access the following improvements: Ramp development will include the construction of a 97' x 15' boat ramp, with an 8' wide concrete access on the right side accessing a 48' x 8' floating courtesy dock. The ramp will extend 41' waterward of NWL and will be 8" thick concrete poured on high ground and pushed into place over 6" of No. 57 stone. Riprap will be placed along the sides of the high ground section of the ramp to prevent erosion. A 20' x 23' concrete apron will be placed on the landward side of the ramp. Extending from the two handicap parking spaces (on the southwest side of the boat ramp) will be a wooden slatted walkway —155' x 5', leading to a 40.5' x 5' "L" shaped pier and terminating at a 30' x 12' platform elevated —2.5' above NWL. A 36' x 5' wooden walkway will also extend from the handicap spaces toward the boat ramp and the concrete access to the floating courtesy dock. The nearest ramp in Gates County is — 9 miles south of the project site, just below the Chowan River bridge to Winton. The location is a remote rural location and will not have a bathroom facility. The proposed location of the ramp and dock will require the relocation of a known freshwater mussel habitat, including three species identified by the NC WRC as being "Threatened". The development with result in the require the relocation of approximately 3,885sf of mussel habitat. SECTION .0200 — THE ESTUARINE AND OCEAN SYSTEMS 15A NCAC 07H .0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. (2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant has complied with the following standards: (A) The location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas; Shellfish beds will be relocated by the NC WRC to protect a State Endangered Species. (B) Development shall comply with state and federal water and air quality; Consistent: Not an issue. (C) Development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources; Consistent: No known sites. (D) Development shall not increase siltation; Consistent: As designed siltation should not be an issue. (E) Development shall not create stagnant water bodies; Consistent: Open design (F) Development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources; and The location is a known habitat for a state endangered species of mussel. (G) Development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. (3) When the proposed development is in conflict with the general or specific use standards set forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the activity associated with the proposed project will have public benefits as identified in the findings and goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse effects of the project, that there is no reasonable alternate site available for the project, and that all reasonable means and measures to mitigate adverse impacts of the project have been incorporated into the project design and shall be implemented at the applicant's expense. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The combined area will be within the limitation. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: None proposed. (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; Consistent: NIA (E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; Consistent: NIA (F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use; Consistent: Single story proposed. (G) Pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: <100' (ii) not extending into the channel portion of the water body; and, Consistent: The proposed pier and platform will be outside of any navigation channel. (III) not extending more than one-fourth the width of a natural water body, or human made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one- third the width of the water body. (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. We have reviewed the information provided and offer the following comments. One previously recorded archaeological site, 31 GA4, is located in the proposed project area. This site, which has yielded prehistoric pottery fragments, has not been assessed to determine whether it is eligible for listing in the National Register of Historic Places. Prior to the initiation of any ground disturbing activities within the project area, we recommend an assessment of site 31 GA4 be conducted by an experienced archaeologist. The purpose of this assessment will be to evaluate the significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources must be assessed prior to the initiation of construction activities. Please note that our office now requests consultation with the Office of State Archaeology Review Archaeologist to discuss appropriate field methodologies prior to the archaeological field investigation. In addition to a standard subsurface archaeological survey through shovel testing, we also recommend limited mechanical stripping be conducted in portions of the project area that have especially high probability for archaeological remains. We collected over 2,000 mussels within four contiguous 20-m survey sections at Gatlington Landing (Table 1). We documented the presence of six species of freshwater mussel; Eastern Elliptio (Elliptio complanata), Northern Lance (Elliptio fisheriana, Significantly Rare), Yellow Lampmussel (Lampsilis cariosa, State Endangered), Eastern Lampmussel (Lampsilis radiata, State Threatened), Tidewater Mucket (Leptodea ochracea, State Threatened), and Eastern pondmussel (Ligumia nasuta, State Threatened). In addition, please see below for a brief description of the mussel survey and planned freshwater mussel relocation effort. MUSSEL SURVEY The upstream section, Section 1, contained the highest density of freshwater mussels (42% of mussels collected) and provided suitable habitat for the six species. Section 2 contained the second highest density of mussels (24%) and provided suitable habitat for the six species; however, we observed a distinct habitat change approximately halfway through the section. Specifically, the substrate in Section 2 changed from suitable habitat (i.e., stable mud and sand) to low quality habitat (i.e., shallow sand covering hard clay). Section 3 (proposed boat ramp area) contained the lowest density of mussels (10%) and provided suitable habitat for four species. Within Section 3, the majority of the mussels were collected in >1 in depth of water, where near shore unsuitable clay habitat shifted to deeper water and stable mud substrate. The downstream section, Section 4, contained 23% of the mussels collected during the survey and provided suitable habitat for five species. Section 4 included a downstream shift from low quality mussel habitat to suitable habitat and the majority of mussels were collected within the downstream portion of this section (i.e., suitable habitat outside of the construction area). Based on the findings of the mussel survey, the public fishing area has been relocated to avoid impacts to dense mussel populations. Mussel surveys have not been conducted within the relocated public fishing area; however, prior site visits indicate that this area contains lower quality habitat (i.e., unconsolidated detritus) and is located within an area that has already experienced past impacts due to an old boating access. All freshwater mussels collected within the salvage areas will be relocated to suitable habitat upstream and/or downstream of the impact areas. Mussel salvage efforts will be conducted within 30-days of construction and exact timing will be coordinated with construction crews so that salvages can be conducted as close to construction date as possible. The salvage effort will include a minimum of a three -person crew and will use snorkel/surface-supplied diving equipment to conduct a minimum of two survey passes within the impact areas. The first -pass target depletion will be set at 80% and if the second -pass results in the collection of more than 20% of the initial number of freshwater mussels we will conduct additional passes until a pass yields less than 20% of the first -pass. All mussels will be held in submerged mesh bags while the survey is being conducted, handled for data recorded, and subsequently transported to near -by relocation area. DATE: February 15, 2017 Consistency Determination: The request is consistent with/not in conflict with the Gates County Comprehensive Plan certified by the CRC at their February 8, 2017 meeting. Overview: The 2.2 acre project site has approximately 800 linear feet of shoreline along the Chowan River. The site is located within the 31,300 acre multi -tract Chowan Swamp Game Land managed by the NC Wildlife Resources Commission. The Chowan River is 530 feet wide at the project location. Water depths in this area are approximately -3 feet at a distance of 20 feet offshore and between -6 feet and -7 feet a distance of 50 feet offshore. The site is partially wooded and has approximately 175 feet of open shoreline and 80 feet of sandy beach shoreline. The average elevation of the site is approximately 7 feet above Normal Water Level (NWL). The project site is located within the AE Floodzone. The site has historically been used as a passive recreational swimming, fishing and small boat access point. The site is currently open to the public for recreation and hunting. The site is accessed from Sandbanks Road via a 10 foot wide by 4,200 foot long game lands gravel road. Existing site improvements consist of a remnant dwelling foundation. Existing shoreline improvements consist of a remnant boat ramp. There are no formal access amenities or parking facilities. The boat ramp will extend 41 feet waterward of NWL. The concrete access connecting to the floating dock will be located on the south side of the boat ramp. Riprap will be placed along the ramp and concrete access to prevent erosion. Each wooden walkway will extend from the handicapped accessible parking area to provide access to the boat ramp and fishing platform. Erosion control measures will be included in the widening of the gravel access roadway. The waters of the Chowan River are classified as B in this area and are closed to shellfishing. This area of the game lands is located within a Natural Heritage Area and the project site is located within an Exclusion Zone. This area of the Chowan River is known habitat for State -rare mussels. A 2009 survey identified three (3) freshwater mussels listed as "Threatened" and one (1), the yellow lampmussel, listed as "Endangered" by the INC Wildlife Resources Commission. The yellow lampmussel is also listed as a "Federal Species of Concern" by the US Fish and Wildlife Service. Proposed development avoids dense mussels found in an April 2016 survey. A mussel relocation will take place prior to any in -water construction. A review of historic and archaeological resources was not provided. Anticioated Impacts resulting from this project are expected to include: the dredging of 4,500 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the filling of .27 acre of Public Trust/Estuarine Shoreline AEC; the shading of 563 sq. ft. of Public Trust Area/Estuarine Waters AEC and 1,287 sq. ft. of Public Trust/Estuarine Shoreline AEC; the temporary disturbance of 4,066 sq. ft. of Public Trust/Estuarine Shoreline AEC, and; the filling of 1.65 acre of High Ground outside of an AEC. Development will result in the relocation of approximately 3,885 sq. ft. of mussel habitat. Basis for Determination: The Gates County Future Land Use Map identifies the site area as "Conservation". As indicated on Page 5-4, this "...sector includes land areas that are intended to remain largely in their natural state with only limited development. These lands provide significant ecosystem services in the form of stormwater inundation, aquifer recharge, air purification, and habitat for wildlife." Currently the property (Chowan Swamp Game Land) has no formalized boating, fishing, or swimming area but the area of the proposed project has become a popular location for these activities. The ramp to be constructed will be 97' x 15' extending 41' waterward of normal water level. There will be a 48' x 8' floating courtesy pier adjacent to the ramp. For fishing access, a 40.5' x 5' pier with 30' x 12' L-head platform will be constructed. Upland development for this project includes a 35 space parking area and associated walkways. The area is known habitat for several species of freshwater mussels identified as threatened by the NCWRC. While. development in habitats for known threatened species is not ideal it is the consensus that formalizing the areas used for boating and fishing will concentrated impacts to certain areas as opposed to more widespread impacts from activities that the site currently sees. NCWRC biologist has surveyed habitat and presence of mussels in the area and the location of the proposed development have the lowest abundance overall on the site. Additionally, NCWRC biologist will be relocating any mussels from the areas to be disturbed. This area of the Chowan river is designated as an anadromous fish spawning area or AFSA meaning it has been identified by the NCWRC and NCDMF as habitat crucial to the spawning migration of fish such as blueback herring, alewife, and striped bass. In order to reduce the potential for negative impacts from activities that could disrupt spawning activity a moratorium on in -water work from February 15 — September 30 is recommended for the project. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to develop a public boating access area (BAA) at an existing landing area within the Chowan Swamp Game Land The site would provide 25 trailer spaces, 8 vehicle spaces, and 2 ADA spaces. A 97' by 15' boat ramp that terminates into -5' depths with an 8' concrete access to a 48' by 8' floating courtesy dock would be installed 4F waterward NWL. Riprap would be placed along the upland sides to minimize erosion No access channel dredge is proposed. A 40.5' by 5' fixed fishing pier is proposed at the southwest corner of the site. The project area has been surveyed for fresh water mussels by NCWRC biologists. Areas of dense and less dense populations were identified and measures taken to reduce impacts. The Chowan River at this location is classified B by the Environmental Management Commission and is designated an anadromous fish spawning area (AFSA) by the NCWRC. The NCWRC has reviewed the permit application and does not object to the development of the site for a public BAA. This area currently has primitive boating, fishing, and swimming use. The upgraded facility will introduce more users to the area that will likely increase habitat impacts. However, this increase in use has been taken into consideration with site layout and mussel relocation. We collected over 2,000 mussels within four contiguous 20-m survey sections at Gatlington Landing (Table 1). We documented the presence of six species of freshwater mussel; Eastern Elliptio (Elliptio complanata), Northern Lance (Elliptio frsheriana, Significantly Rare), Yellow Lampmussel (Lampsilis cariosa, State Endangered), Eastern Lampmussel (Lampsilis radiata, State Threatened), Tidewater Mucket (Leptodea ochracea, State Threatened), and Eastern pondmussel (Ligumia nasuta, State Threatened). In addition, please see below for a brief description of the mussel survey and planned freshwater mussel relocation effort. MUSSEL SURVEY The upstream section, Section 1, contained the highest density of freshwater mussels (42% of mussels collected) and provided suitable habitat for the six species. Section 2 contained the second highest density of mussels (24%) and provided suitable habitat for the six species; however, we observed a distinct habitat change approximately halfway through the section. Specifically, the substrate in Section 2 changed from suitable habitat (i.e., stable mud and sand) to low quality habitat (i.e., shallow sand covering hard clay). Section 3 (proposed boat ramp area) contained the lowest density of mussels (10%) and provided suitable habitat for four species. Within Section 3, the majority of the mussels were collected in >1 in depth of water, where near shore unsuitable clay habitat shifted to deeper water and stable mud substrate. The downstream section, Section 4, contained 23% of the mussels collected during the survey and provided suitable habitat for five species. Section 4 included a downstream shift from low quality mussel habitat to suitable habitat and the majority of mussels were collected within the downstream portion of this section (i.e., suitable habitat outside of the construction area). Based on the findings of the mussel survey, the public fishing area has been relocated to avoid impacts to dense mussel populations. Mussel surveys have not been conducted within the relocated public fishing area; however, prior site visits indicate that this area contains lower quality habitat (i.e., unconsolidated detritus) and is located within an area that has already experienced past impacts due to an old boating access. Mussel salvage efforts will be conducted within 30-days of construction and exact timing will be coordinated with construction crews so that salvages can be conducted as close to construction date as possible. The salvage effort will include a minimum of a three -person crew and will use snorkel/surface-supplied diving equipment to conduct a minimum of two survey passes within the impact areas. The first -pass target depletion will be set at 80% and if the second -pass results in the collection of more than 20% of the initial number of freshwater mussels we will conduct additional passes until a pass yields less than 20% of the first -pass.
