Authorizing development in Beaufort County at Campbell Creek Impoundment, within Goose Creek
Game Lands, near the town of Aurora , as requested in the permittee's application dated 1/6/17; including attached
workplan drawings (4), all dated 6/16.
This permit, issued on April 3, 2017 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
it mere terms may De suoject to rmes, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization - Bulkhead
1) The bulkhead/riprap shall not extend waterward more than 1.5 feet from the normal water level at
any point along its alignment at the time of construction.
2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved
bulkhead alignment.
3) The alignment of the authorized bulkhead shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall
require the alignment to be re -staked by DCM within a maximum of 30 days prior to the new
expected start of construction.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
The bulkhead shall be constructed prior to any backfilling activities.
The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
;This permit does not authorize any excavation waterward of the approved alignment.
All backfill material shall be obtained from a high ground source and confined behind the permitted
'bulkhead.

Puma House
This permit authorizes only the pump house and other structures and uses located in or over the water
.. that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this pump house without permit modification.
No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
The pump house shall be located be located within the same footprint of the currently existing structure
and shall not be increased in size, unless through permit modification.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Appropriate sediment and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials associated with the discharge line installation, do not enter the adjacent
watercourse.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The construction and/or operation of the authorized pump house shall not directly resiilt in any closure
of any waters that are open to the taking of shellfish. Any such closure directly attributable to the pump
house shall require that the permittee undertake remedial actions to remedy the situation. Such actions
may include, but are not limited to, a removal or mitigative measures to reduce or eliminate the cause(s)
of the closure.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-00456).
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination.
NOTE: The permittee is advised that any development or land disturbing activity, that is considered non -
water dependent is not authorized within 50 feet of the normal water level unless specifically
exempted by' Environmental Management Commission (EMC) Tar Pamlico buffer regulations in
place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project.

PROJECT DESCRIPTION: This proposal represents a plan to protect and enhancDIMreM H D C ITY
of Campbell Creek Waterfowl Impoundment.
Campbell's Creek Impoundment- NAWCA funded wetland enhancement project on NC Wildlife
Resources Commission lands (Goose Creek Game Lands) in Beaufort County, NC: 314-acre
impoundment in need of pumphouse rehabilitation to restore improved water handling capability
for the waterfowl impoundment.
Water management is critical to managing impoundments and the ability to maintain water levels
on Campbell Creek Impoundment enhances productivity by stimulating desirable plant and
invertebrate growth, and reducing stagnant water conditions. Due to age and storm related
damage over the years the Campbell Creek pumphouse has deteriorated and is in need of
replacement. The proposal addresses the replacement of the existing pumphouse and the
upgrading of the pumping system to a new power unit and drive shaft drive system. If upgrades
are not done soon, the ability to pump water into the system will be compromised. As a result,
approximately 314 acres of prime waterfowl and shorebird habitat will be significantly reduced in
value. This project will restore water handling ability by replacement of the existing pumphouse,
power unit and conversion of the belt driven system to a more efficient drive shaft system.
HABITAT TYPES AND WILDLIFE BENEFITTING: This proposal will largely affect
managed emergent estuarine habitat, a decreasing wetlands type. Enhancement of these wetlands
provides feeding habitat for many wetland dependent species including migrating and wintering
waterfowl in the Atlantic Flyway, neotropical migrants and other migratory and non -migratory
waterbirds. The proposed project site are located within the Goose Creek Game Lands, which
provide the highest quality managed habitat under state ownership for Northern Pintails and
American Black Ducks. Other important waterfowl species that will benefit from this project
include American Widgeon and Gadwall. All species will use the area for both migration and
wintering habitat. In addition, the area is at the southern end of the breeding Black Duck range
and this species nests at the proposed sites. Other wetland dependent species that will benefit
include yellow rail, marbled godwit, and semi -palmated sandpiper, which use exposed mudflats
for foraging and resting areas, especially in spring. Pied -billed grebes and Forster's terns will
benefit from enhancement of breeding and forging habitat. Campbell's Creek impoundment is in
danger of being permanently lost due to levee failure. The proposed levee protection work will
serve to "secure" habitat for bald eagles, wood storks, American alligators and diamondback
terrapins.
PUBLIC BENEFITS: The large acreage of public lands in the project area, which is part of the
Goose Creek Game Lands managed by North Carolina Wildlife Resources Commission, attracts
large numbers of people seeking wildlife -based recreation. This recreation includes hunting,
fishing, trapping, birding and other wildlife observation.
CONSTRUCTION TECHNIQUES: The project consists of demolishing the old pumphouse
and removing from the site, establishing new pilings and bulkhead as outlined in the site
construction drawings and building a new pumphouse structure. The pumphouse structure will be
within the footprint of the old pumphouse being replaced. In addition, a new stainless steel pump
discharge tube will be installed, and the existing pump will be retro-fitted from a belt driven
system to a drive shaft driven unit. A new power unit will also be installed in the pumphgv3e
along with a double wall fuel tank.

Construction will involve the use of a barge to move equipment to the site, boats to transport
personnel, and an excavator to demolish and assist in installation of the discharge pipe and
pumphouse construction. All work should be contained to the dike, however if equipment must
walk across the marsh, the contractor will be instructed to use mats to minimize impacts to marsh
vegetation.

113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work

The North Carolina Wildlife Resources Commission has submitted a CAMA Major Permit request for the replacement
of an existing deteriorated enclosed pump house building and installation of a new bulkhead located at the Campbell's Creek
Impoundment, which is located within the Goose Creek Game Land, in southeastern Beaufort County near the Town ofAurora.
The project site can be accessed by boat via the Smith Creek Boating Access Ramp located off NC Highway 33 near the
Beaufort / Pamlico County line. The total project site is approximately 503 acres in size and has approximately 6.3 miles of
shoreline. The project site is a man-made waterfowl impoundment that is managed for waterfowl and other wetland dependent
species. Man-made features on the project site include an earthen dike, water control structures, hunter's bridges, observation
tower, pump house with diesel pump.
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H and 7J concerning development in
Estuarine Water, Public Trust Area and Coastal Shoreline. The existing pumphouse is allon-Conforming structure by definition
of Coastal Management rules. The structure is located over Estuarine Water. However, it is staffs recommendation that the
proposed project meets all criteria set forth in 15A NCAC 07J .0211 which states (1) The structure will not be enlarged beyond
its original dimensions, (2) the structure will serve the same or similar use, (3) there are no practical alternatives for replacing
the structure to provide the same or similar benefits in compliance with current rules, and (3) the structure will be rebuilt so as to
comply with current rules to the maximum extent possible.
The pump house will be replaced with the same dimensions and will be located in the same footprint as the existing
structure. The facility will serve the same use as it was original built. Although there is approximately 12' of uplands located
landward of this pump house it is an earthen dike used to retain water for the waterfowl impoundment and provides a
maintenance corridor around the perimeter of the impoundment. The relocation landward would also likely affect the Tar -
Pamlico Riparian Buffer administered by the NC Division of Water Resources.
Staff recommends that we issue the Permit with following conditions.
1. No attempt will be made by the permitter: to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set
forth in the permit application. No other structure, whether floating or stationary, may become a permanent part ofthis
docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or
over public trust waters without permit modification.
3. The pump house shall not be any larger and Shall be located in the same footprint as the currently existing structure.
4. The alignment of the authorized bulkhead/riprap shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30
days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM
within a maximum of 30 days prior to the new expected start of construction.
S. The bulkhead shall be constructed prior to any backfilling activities.
6. All fill material to be phrced below normal high/normal water level shall be confined behind the permitted
bulkhead.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint
Land Use Plan 2006 Update certified by the CRC on January 13, 2010.
Overview: The applicant is proposing to replace an existing 12' x 16' enclosed pump house building and
install a 38' bulkhead. The project site is located at 76°37'59.00", W 35°17'18.23" N in Campbell Creek,
Beaufort County, North Carolina.
The project site is approximately 503 acres, with approximately 6.3 miles of shoreline. The site is a man-
made water fowl impoundment. Existing features onsite include: an earthen dike, water control
structures, hunter's bridge, observation tower, pump house with a diesel pump.
The project is located in Campbell Creek and is classified as SA (Market Shellfishing, Salt Water), HQW
(High Quality Waters), and NSW (Nutrient Sensitive Waters). The site is a Permanent Secondary Nursery
Area, is not open to shellfishing. The tract is mostly vegetated with Juncus roemerionus, Spartina
cynosuroides, Baccharis angustifolia, Pinus toeda, Phragmites, Eleocharis spp, and upland lawn grasses
on the upland earthen dike. No Submerged Aquatic Vegetation (SAV) was observed within the. project
area. A review archaeological and cultural resources was not provided.
Anticipated impacts resulting from this project are expected to include: the replacement of the
pumphouse will result in the continued usurping and shading of approximately 192 ft2 of Public Trust
Area. The bulkhead will fill approximately 15 ft2 of Estuarine Water. Total upland disturbance will be
approximately 675 ft2. The development will not cause a hazard to navigation and does not exceed one
quarter width of the waterbody.

The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future
Land Use Map (FLUM) classifies the site as Conservation I (water).
The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.1 The purpose of the Conservation I classification is to delineate land and water features where there
are serious hazards to personal safety or property, where new development would cause serious damage
to the values of natural systems, or where new development is not permitted by local, state, or federal
policy.
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements'of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).

The North Carolina Wildlife Resources Commission has submitted a CAMA Major Permit
request for the replacement of an existing deteriorated enclosed pump house building and installation
of a new bulkhead located at the Campbell's Creek Impoundment, which is located within the Goose
Creek Game Land, in southeastern Beaufort County near the Town of Aurora The project site can
be accessed by boat via the Smith Creek Boating Access Ramp located offNC Highway 33 near the
Beaufort / Pamlico County line. The total project site is approximately 503 acres in size and has
approximately 6.3 miles of shoreline. The project site is a man-made waterfowl impoundment that is
managed for waterfowl and other wetland dependent species. Man-made features on the project site
include an earthen dike, water control structures, hunter's bridges, observation tower, pump house
with diesel pump. The tract is mostly vegetated with Juncus romerianus, Spartina cynosuroides,
Baccharis angustifolia, Pious taeda, Phragmites, Eleocharis spp., and upland lawn grasses on the
upland earthen dike. The Creek is approximately 300 feet in width at the location of the existing
pumphouse. The property both upstream and downstream is undeveloped timberland.
Campbell Creek is classified as SA HQW NSW by the Environmental Management
Commission at the project site. Campbell Creek at this location is designated Coastal Waters, is not
open to shell fishing and is a Permanent Secondary Nursery Area. No SAV's were observed during
the on -site field visit.
Proiect description
The applicant specifically proposes to replace the existing deteriorated 12' x 16' pile
supported pump house with same size structure and in the same footprint as the existing building,
which is located waterward of Normal Water Level. The existing belt driven pump system will be
replaced with a shaft driven system. A 24" x 35' long discharge pipe will attach to the pump which
will pass through the existing earthen dike to discharge into the water distribution pump hub located
landward, inside the impoundment, of the dike. Additionally, 38' of bulkhead will be installed a
maximum distance of 1.5 ` waterward of Normal Water Level adjacent to the upland portion of the
earthen dike.
Anticipated Impacts
The replacement of the 12' x 16' pump house will continue to usurp and shade
approximately 192 square feet of Public Trust Area The installation of the bulkhead will result
in the filling of approximately 15 square feet of estuarine Water. Total upland disturbance will be
approximately 675 square feet. The development will not cause a hazard to navigation and
doesn't exceed one quarter width of the waterbody.

2. Water Quality Certification

3. During construction of the proposed project, fueling, lubrication and general equipment
maintenance should not take place within 50 feet of a waterbody or wetlands to
prevent contamination by fuel and oils. (15A NCAC 02H .0506 (b)(3) and (c)(3) and 15A
NCAC 026 .0200 (3)(f)]
4. This approval and their conditions are final and binding unless contested. [G.S.143-215.5]
These Certifications can be contested as provided in Articles 3 and 4 of General Statute 150E by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH
filing fee is received in the OAH during normal office hours (Monday through Friday between
8:00am and 5:00pm, excluding official state holidays).
