Re: Objection to the Issuance of CAMA General Permit #86400A for a Docking Facility Project located at
3302 Bay Drive, Kill Devil Hills.
Dear Ms. Wilson:
This letter is in response to your objection as an adjacent riparian property owner to a permit request from
Emanuelson & Dad, LLC on behalf of Phillip & Catherine Radzikowski, for the construction of a docking facility
consisting of a 277'x5' pier, 9'x9' platform, and a 12'xl 2' wet slip created by the placement of 4 tie piles. This project
is located at 3302 Bay Drive, Kill Devil Hills in Dare County and within Kitty Hawk Bay.
Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established
Rules for General Permits for this type of development that are found in 15A NCAC 07H,1200.
The Division of Coastal Management has reviewed your objections, along with all aspects of this development
proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for
this type of development, Our review of the proposed development has found it to be consistent with the Rules of
the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied, Therefore,
the Division of Coastal Management issued General Permit #86400A on June 13, 2022 (copy attached) for the
proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the
Division of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal,
please contact this office so that we can provide you with the appropriate forms and addresses.

I write regarding a certified letter, received May 21,2022,
from Lorelei Zumbrunnen of Emanuelson & Dad with attached
Adjacent Riparian Property Owner Notification/Waiver Form,
pertaining to the above -referenced project. Attached to the form
is a sketch/photocopy of the proposed pier that is so dark I
cannot read it. As the owner of 3300 Bay Drive, I object to the
proposed pier and would appreciate discussing it with you in
detail. I have called your office and left messages but to date
have not received a call back.
Pursuant to instructions, I am responding within the ten
(10) day notice period that I object to the construction of the
277' pier. I have signed the Form noting my objection and mailed
it to Emanuelson & Dad, together with a copy of this letter.

This letter is in reference to our phone conversation on May 23, 2022, during which we
discussed questions and concerns you had with a docking facility that is being proposed at the
property adjacent to yours at 3302 Bay Drive in Kill Devil Hills. I have enclosed with this letter
additional information concerning the proposed project as it relates to the Coastal Area
Management Act (CAMA) and associated state rules and regulations.
Among the documents is a copy of the CAMA General Permit rules for piers and docking
facilities, where I have highlighted rules relevant to the proposed project and specific ones that
we talked about over the phone. Also included is an aerial plat demonstrating the total proposed
pier length in relation to the established pier line along that area of shoreline and a copy of the
project drawing submitted to us as part of the permit application.
