Shellfish Lease Demonstration 1) The shellfish lease demonstration originally proposed for this project and indicated on the attached application and workplans shall require a shellfish lease from the Division of Marine Fisheries in lieu of permit authorization from the Division of Coastal Management. Any and all reference to the originally proposed shellfish lease demonstration in the attached permit application or workplan drawings is hereby considered null and void. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 3) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 1 formalized boat slip. `z 9 2011 Shoreline Stabilization nnrr D C'TY 6) The breakwater shall be positioned no more than 5 feet waterward of the wategvVedge'of existing emergent wetlands at any point along its alignment. 7) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized sills. 8) The wooden sill shall be constructed with an equal gap between each sheathing board totaling at least one inch of open area for every linear foot of wooden. The sills shall have at least one, five foot opening at every 100 feet. The sill sections may be staggered and overlap as long as the five-foot separation between sections is maintained. Overlapping sections shall not overlap more than 10 feet. 9) The permitted sills shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles or other suitable materials approved by Department personnel. 10) Sills shall be marked at 50 foot intervals with yellow reflectors extending at least three feet above normal water level. 11) No backfill of the sill or any other filling of wetlands, estuarine waters, public trust areas or high ground is authorized by this permit. 12) The permittee shall maintain the sills in good condition and in conformance with the terms and conditions of this permit or the remaining sill structure shall be removed within 90 days of notification from the Division of Coastal Management. NC Seafood Industrial Park Authority Permit No. 77-17 Page 3 of 3 ADDITIONAL CONDITIONS General 13) No attempt shall be made by the permittee to prevent the free and full use by the public of all navigable waters adjacent to the authorized work. 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: This permit does not convey any rights, either in real estate or material. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-201700723). NOTE: The N.C. Division of Water Resources has assigned the project DWR Project No. 2017-0485. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. APR 7 - 2017 DMEC Wanchese Seafood Industrial Park Dock, Living Shoreline and Shellfish Aquaculture Demonstration Dare County, North Carolina Proiect Narrative Applicant: Wanchese Seafood Industrial Park in partnership with The North Carolina Coastal Federation Prepared By: The North Carolina Coastal Foundation 637 Harbor Road Wanchese, NC 27981 and Quible and Associates PO Box 870 Kitty Hawk, NC 27949 RECEIVED January 24, 2017 APR 17 2017 DCM- MHD CITY Lot 4C- Wanchese Seafood Industrial Park Wanchese Seafood Industrial Park CAMA Major- Project Narrative 219/17 Project Introduction The North Carolina Coastal Federation, a non-profit organization that focuses on restoring, educating and advocating for a healthy coast recently moved offices to the Wanchese Seafood industrial Park and has entered a long-term lease agreement with the park for Lot-4C. This lot is adjacent to the shoreline of Broad Creek, NC. The Coastal Federation has partnered with the Industrial Park as well as the engineering firm Quible and Associates to design a dock for access to Broad Creek. In addition, the Coastal Federation has proposed a series of living shoreline sills (or marsh toe sills) that will protect existing coastal marsh from erosion. Living shorelines stabilize estuarine shorelines while maintaining the connectedness of upland and intertidal habitats, thereby preserving natural ecological processes and providing valuable and increasingly scarce estuarine habitat. Finally, the Coastal Federation has partnered with North Carolina Sea Grant to design and permit demonstration oyster aquaculture sites near the dock and living shoreline. There is a growing awareness of oyster aquaculture as an industry in North Carolina but there is dirth of demonstration and extension services offered to perspective aquaculturists. North Carolina Sea Grant has received funding from NOAA to help remedy this by creating four aquaculture demonstration sites along the coast. This site would serve as their northern most site for the state. Project Need The property is under a long-term lease with the Coastal Federation. The Federation is a private non- profit conservation group working to protect and restore coastal water quality and habitats throughout North Carolina coast. The construction of the pier will serve as a research pier and a working pier for shoreline enhancement projects in the region. It is a stated goal of the federation to protect the natural functions of estuarine shorelines and to restore and sustainably manage oysters. This will be an ideal setting for shoreline protection and oyster aquaculture demonstrations. The purpose of the proposed shellfish demonstrations is to provide a site for seeing first hand a variety of shellfish growing techniques. This will be helpful as the aquacufture industry continues to grow and expand in the state. Existing Conditions The site is a 0.65 acre (28,435 sq. ft.) parcel of land located along Harbor Road and owned by the N.C. Seafood Industrial Park Authority (Seafood Park) in Wanchese, Dare County, North Carolina, and on a long term lease with the North Carolina Coastal Federation. The parcel of land (Lot 4C) is located adjacent to the Roanoke Sound (Broad Creek). The upland portion of the property is dominantly covered with maintained grasses with areas of gravel and concrete. Wetlands along the shoreline contain wax myrtle, groundsel bush, black needle rush, smooth cordgrass, giant cordgrass and Phragmites spp. The existing conditions on the lot include a one and a half story frame building, asphalt parking lot, generator and cell tower located on the southern part of the property. The waters off shore where shellfish lease demonstrations and living shoreline demonstrations are proposed are classified as SA- open waters. RECEIVED APR 17 2017 ®CM- MH® CITY Lot 4C- Wanchese Seafood Industrial Park Wanchese Seafood Industrial Park CAMA Major- Project Narrative 2/9/17 Proposed Work -Dock Currently proposed work requiring CAMA permitting includes construction of an 8 ft x 215 linear foot (LF) fixed pier with a 12 ft x 20 ft tee platform on the end. The pier is proposed to begin on Lot 4C, and extend out 215 LF (as shown on the CAMA plan). The proposed pier is to contain a boat slip with a boat lift as shown. Adjacent to the proposed pier there is a proposed 8 ft x 16 ft floating platform for water access and kayak/ paddle -craft launching. Logging mats will be used to cross wetlands for construction of the proposed pier, Proposed Work- Livin¢ Shoreline In addition, along 500 LF of the shoreline the federation proposes to install demonstration living shoreline techniques. Five different shoreline stabilization techniques are proposed and detailed below. The first would be to construct a low -profile sill out of granite rip -rap, the second would be constructed of bagged oyster shells, the third would be a low profile wooden sill and the fourth would be an alternative design of either oyster domes and/or crab pots. Rip -Rap Sill Construction Approximately 100 linear feet of shore -parallel, low profile, rip -rap sill will be constructed no more than 5' from the waterward edge of existing coastal marsh shoreline at the project site. Stone will be composed of NCOOT Class II granite rip -rap, weighing between 25 - 250 ibs and measuring between 9 — 23 inches. Prior to placement of the riprap a geotextile filter fabric will be installed to reduce scouring and uneven settlement. Water depths along the shoreline range from 2.3-3.2'. Initially the crest of the sill may extend 8 —12 inches above the MHW elevation, however, after settlement, it should average approximately 6 inches, giving a maximum height of the sill after settlement to be 3.7'. To allow for fish passage and water circulation a 10' gap between this sill structure and the next will be provided at an interval of 1 every 90-100'. Reflective tape, extending a minimum of 3' above MHW, will be placed along the sill at 50' intervals. Ouster Shell Bag Sill Construction Approximately 100 linear feet of shore -parallel, low profile, oyster shell bag sill will be constructed no more than 5' from the waterward edge of existing coastal marsh shoreline at the project site. Nylon mesh material will be filled with recycled oyster and clam shells to create bags weighing between 15.25 Ibs and measuring approximately 2-3 feet in length and 6-8 inches in diameter. The sill will be constructed so that initially the top of the sill may extend 8 —12 inches above the MHW elevation, however, after settlement, it should average approximately 6 inches. Water depths along the shoreline range from 2.3-3.2'. Maximum height of the sill would be 37. To allow for fish passage and water circulation a 10' gap between this sill structure and the next will be provided at an interval of 1 every 90- 100'. Reflective tape, extending a minimum of 3' above MHW, will be placed along the sill at 50' intervals. See construction drawings for further details. Wooden Low-Proflie Sill Construction Approximately 100 linear feet of a shore -parallel, low -profile, wooden sill will be constructed no more than 5' from the waterward edge of existing coastal marsh shoreline at the project site. The wooden sill will be constructed of treated lumber. The sill will be constructed of wooden planks/boards spaced with a 1 inch gap between the boards. The sill will extend, on average 6-8 inches above MHW. To allow for fish passage and water circulation a 10 foot gap between this sill structure and the next will be provided at an interval of 1 every 90-100'. Reflective tape, extending a minimum of 3' above MHW, will be placed along the sill at 50' intervals. Monitoring and Maintenance As part of the demonstration and research of these techniques, annual monitoring of both the sill and marsh will take place for the first three years. Monitoring will include basic water quality measurements and yearly marsh abundance, diversity and coverage measures. These monitoring results will be made available to any agency wishing a copy. The Coastal Federation is committed to the success of this project and implementation of all phases as funding allows. Proposed Work- OvsterAouaculture Demonstration The North Carolina Sea Grant has secured grant funds from NOAA to implement four oyster aquaculture demonstration leases throughout the state. They have been long time partners with the Coastal Federation in implementing the N,C. Oyster Blueprint for Action- an interagency, long-range plan for restoring and sustainably managing oysters in the state. And have taken the lead in providing extension services to stakeholders interested in pursuing a career in aquaculture. The demonstration site at the Seafood Industrial Park will aid in the expansion and diversification of the NC shellfish aquaculture industry. it is proposed that a 100 ft. x 50 ft. area is designated approximately 30 to 40 feet from the waterward edge of the proposed living shoreline demonstration area. In this 5,000 sq foot demonstration lease four different types of gear would be displayed. Long line cages, floating cages, raised bottom cages with bag Inserts and floating bags would be demonstrated on site. The long term plan for the site is to install nonpermanent structures (anchor screws and PVC pipe risers) for support of various water column culture gear types. In addition, it is planned to install non- permanent bottom culture gear including netting and mesh bags and cages for clam culture. There is no SAV in the proposed area for aquaculture demonstrations. Initially, the following oyster culture gear types are proposed to be deployed: off bottom cages, floating bags, LowProGrol cages, and Oystubeo baskets as part of a long -line culture system. As described in the specifications of the gear, spans or length of rope or line supporting floating or suspended gear will range from 30 to 75'. Anchor screws will be twisted fully into the bottom manually and PVC risers will be jetted in via water pump. For clam culture, deployment of protective netting panels, mesh bags, and mesh cages Is proposed. These gear types will be secured to the bottom with rebar or other staking material. Storm and Hurricane plan The site will be managed according to Coastal Federation and the Industrial Park storm and hurricane policy. If deemed necessary, gear and associated structures will be secured or removed to prevent loss as well as marine debris. August 2016 I. INTRODUCTION DCM-EC The purpose of this document is for Quible & Associates, P.C. (Quible) to provide state and federal regulatory agencies with a review of submerged aquatic vegetation (SAV) in Broad Creek, adjacent to Lot 4 in the Wanchese Industrial Seafood Park (the Site). Proposed future work includes construction of a pier with tee head, boat lift, and floating platform. The August 5'", 2016 SAV survey was conducted to examine the substrate for the presence of SAV, and to document the conditions that may relate to the SAV habitat. Broad Creek is located within the Roanoke Sound which is characterized as a low -salinity, medium -high turbidity shallow water environment. Consequently, the SAV communities are expected to be dominated by species that are adapted to low salinities in shallow water. II. METHODOLOGY The SAV analysis took place on August 9, 2016 by qualified environmental scientists from Quible with guidance from NCCF representatives who had already performed a cursory analysis. The accompanying base map includes 2012 aerial photography provided by Dare County with the study area identified with sampling stations and collected water depths. Water depth surveying was conducted using survey -grade GPS and plotted relative to normal water level (NW L). A bathymetric map was generated using Autocad to clearly identify existing conditions. The method of sampling consisted of a cursory analysis of SAV throughout the Site followed by a detailed survey by performing a series of transects to fully understand the extent and coverage of SAV. At each sampling station, a 1.0 meter x 1.0 meter PVC quadrant (with holes so that it would sink) was haphazardly tossed' into the water. At each station water depths, substrate types, and SAV identification was recorded. Where any live SAV was encountered, coverage estimates were made based on percent cover standards'. In addition, the substrate between sampling stations was observed for the presence of SAV, RECEIVED APR 17 2017 DCM- MHD CITY ' Haphazardly tossed is a term used to indicate that the quadrat was not systematically placed in a location that was observed prior to the quadrat lying on the substrate. August 2016 III. FINDINGS The attached table summarizes coverage estimates at each sampling station. The first column is the sampling station number and the second column is the survey GPS waypoint (205-313). The third and fourth columns are that latitudinal and longitudinal coordinates. The fifth column is the water depth (based on NWQ. The sixth column is the mean cover estimate per station, and the seventh column is the bottom type/notes. The substrate types encountered varied between peat and sand. In general, there is a broad peat bank that extends waterward from the edge of the coastal marsh shoreline. In some areas, there is a layer of sand (of varying thicknesses) overlying the peat. There were scattered oyster shells in some areas. This area has only a minimal amount of SAV present. This has been our experience in Broad Creek in the past for nearby project sites. Some of the limiting factors for making this a prime habitat for SAV include the extensive peat as well as turbid, high-energy waters. The only species of SAV encountered was Ruppia maritima (Widgeon Grass). Widgeon grass was found in only five of the 108 sampling stations which are plotted on the CAMA base map. These areas consisted of patchy SAV (coverages and bottom type are indicated in Table 1). It should also be noted that there were ripped up accumulations of Widgeon grass that appear to have drifted into the area, especially inside the existing gut at the Site. V. Project Setting The property proposed for development is located at 637 Harbor Road in the Wanchese Seafood Industrial Park, and consists of 0.65 acres adjacent to Broad Creek and the Roanoke Sound. The upland portion of the property is covered with maintained grasses with an asphalt parking area and a two-story office building. On the southwestern portion of the property there is a cell tower and generator. Along the shoreline there are various species of small trees and shrubs. The property to the north is an empty lot owned by a private property owner and the property to the south is a commercial property. Vegetation noted on the site includes, but is not limited to, wax myrtle (Myrica cerifera), indigenous yard grass, groundsel brush (Baccharis halimifolia), black needlerush (Juncus roemerianus), smooth cordgrass (Spartina alternaflora), giant cordgrass (Spartina cynosuroides), Phragmites spp. Soil types include, but are not limited to Hobonny muck (HoA). The water classification for this site is High Quality Waters (HQW), Market Shellfishing, Saltwater (SA), and Aquatic Life, Secondary Recreation, Salt Water. Submerged Aquatic Vegetation on the site includes but is not limited to, Widgeon Grass (Ruppia maritima). The property has an elevation of about 4 feet above Normal Water Level (NWL), and the property has a Coastal Wetland fringe. Development Proposal The applicant proposes to construct an 8 foot by 215-foot pier with a 12 foot by 20 foot "T end platform extending over the wetlands into Broad Creek along with an 8 foot by 16-foot floating kayak platform on the eastern side of the pier. At the terminus of the pier the applicant proposes to install a 13 foot by 13-foot boat lift in 3.71 feet of water. The applicant also proposes to construct five 100-foot wetland sills that are 6 feet wide and will extend 1 foot. above Normal Water Level 5 feet from the shoreline. One sill will be composed of NCDOT class II granite rip -rap, weighing between 25-250 pounds. Another will be composed of oyster shell bags 2-3 feet long weighing 15-25 ponds. Another will be composed of wood and will be about a 1 foot in width. The other will be constructed out of oyster domes and /or crab pots. The property is located at 615 Harbor Road Lot 4, Wanchese, Dare County, in Broad Creek off Roanoke Sound. The development proposal involves the Public Trust Area (PTA), Coastal Wetlands (CW) Estuarine Shoreline (ES) and Estuarine Waters (EW) Areas of Environmental Concern. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 07H.0208 Use Standards (a) General Use Standards (a)(1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: The proposed development of a dock, wetland sills and aquiculture demonstration area are consistent with the intent of this rule. (a)(2)(E) Development shall not create stagnant water bodies Consistent: The proposed development of a dock, wetland sills and aquiculture demonstration will not create stagnant water bodies because of the 5 foot gaps proposed between each 100-foot section of sills. Consistent: The proposed development of a dock is less than a quarter width of the waterway and would not impact navigation, the wetland sills are 5 feet from NWL and will not impact navigation and the aquiculture demonstration area is at the farthest 92 feet from NWL which would not impact navigation. (a)(4) Primary nursery areas are those areas in the estuarine and ocean system where initial post larval development of fmfish and crustaceans takes place. They are usually located in the uppermost sections of a system where populations are uniformly early juvenile stages. Marine Fisheries Commission (MFC) and by the N.C. Wildlife Resources Commission (WRC) Consistent: The proposed development of a dock, wetland sills and aquiculture demonstration area are not located in a primary nursery area. (a)(6) Beds of submerged aquatic vegetation (SAV) are those habitats in public trust and estuarine waters vegetated with one or more species of submergent vegetation. These vegetation beds occur in both subtidal and intertidal zones and may occur in isolated patches or cover extensive areas. In either case, the bed is defined by the Marine Fisheries Commission. Any rules relating to SAVs shall not apply to non -development control activities authorized by the Aquatic Weed Control Act of 1991 (G.S. 113A-220 et seq.). Consistent: The proposed development of a dock, wetland sills and aquiculture demonstration area have been located to avoid areas of submerged aquatic vegetation. (b) Specific Use Standards (b)(6) Addresses Piers and Docking Facilities. (b)(6)(A) requires that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Inconsistent: The proposed piers are 8 feet in width which is inconsistent with this rule. (b)(6)(B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Consistent: The proposed platforms are 20 feet by 16 feet with a shaded area of 320 square feet,12 foot by 8 foot with a shaded area of 96 square feet and 13 foot by 13-foot boatlift with a shaded area of 169 square feet for a total of 434 square feet of shading. The shoreline along the project area is 1,710 feet which allows for the maximum of 2,000 square feet of shaded area. (b)(6)(C) requires that piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. Inconsistent: The proposed pier extending over wetlands will be 8 feet wide which is inconsistent with this rule. (b)(6)(E) require that the total area enclosed by an individual boat lift shall not ekeIV D square feet except to accommodate a documented need for a larger boat lift. (b)(6)(F) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed pier is single story. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed pier will not extend beyond the established pier and docking facility length along the same shoreline. (ii) not extending into the channel portion of the water body; and Consistent: The proposed pier will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Q Consistent: The proposed pier and platforms extend into Broad Creek which is 2,237 fete across and will net extend more than '/4 width of the waterway. 4 (b)(6)(I) requires that piers and docking facilities shall not interfere with the access to c riparian property and shall have a minimum setback of 15 feet between any part of ther or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed pier and platforms will not go beyond the 15 foot setbacks. Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application, and plans, I recommend a Major Permit be issued to N.C. Seafood Industrial Park with the following conditions. Overview: The NC Seafood Industrial Park is located on 54 acres adjacent to the Wanchese Harbor Basin, a manmade basin which adjoins Mill Landing Creek to the west and Broad Creek off the Roanoke Sound to the east. The project area includes .65 acre leasehold Lot 4 and the open waters of Broad Creek in front of the lot. The lot has approximately 1,710 linear feet of shoreline along Broad Creek. Water depths in Broad Creek range from 2.3 feet to 3.2 feet at the shoreline. Submerged Aquatic Vegetation (SAV) is located in the creek at this location. A Coastal Wetland fringe is located along the shoreline. Elevations on the lot are approximately 4 feet above Normal Water Level (NWL). Floodzones on the property include VE (11) and AE (8). Existing site improvements on the lot consist of a two-story office building, asphalt parking area, generator, and cell tower. The shoreline is unimproved. Installation of an 8 foot wide by 215 foot long pier with a 12 foot by 20 foot "T" terminus platform, a 13 foot by 13 foot boat lift, and an 8 foot by 16 foot floating kayak platform; installation of a sill demonstration project consisting of five (5) 6 foot wide by 100 foot long wetland sills, and; installation of a 50 foot wide by 100 foot long aquaculture demonstration area are proposed. The pier will be installed over the wetlands and into the creek. The boat lift will be installed at the pier terminus and the kayak platform will be installed on the eastern side of the pier. The five (5) sills will be installed along approximately 500 linear feet of shoreline approximately 5 feet waterward of the shore and extend 1 foot above NWL. The waters of Broad Creek in this area are classified as HQW:SA waters and are open to shellfish taking. A review of potential historic/archaeological resources was not provided. Anticipated Impacts resulting from this project are expected to include: the filling of 3,000 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), and; the shading of 1,464 sq. ft. of Coastal Wetlands/Estuarine Shoreline AEC and 5,761 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Community Village". As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs).
