This permit, issued on December 15, 2017 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
if these terms may be subject to tines, imprisonment or civil action; or may cause the permit to ce null ana vola.
Pier Facility
1) This permit authorizes only the existing pier removal, new pier, covered platforms, and other
structures and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part
of this pier facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) The pennittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
This permit does not authorize the use of the mooring pilings to be use as permanent authorized slips.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Breakwater
The breakwater alignment shall not deviate from the alignment as depicted on the attached permit
application and workplan drawings.
The permitted breakwater shall be, constructed of treated wood, plastic lumber, metal or vinyl sheet piles
or other suitable materials approved by Department personnel.
height of the permitted breakwater shall not exceed 12 inches above the normal water level.
The breakwater shall be constructed with an equal gap between each sheathing board totaling at least 2
inches of open area for every 1-1.5 linear feet of breakwater.
Breakwaters shall be marked at 50 foot intervals with yellow reflectors extending at least three feet
above mean high water.
Upland Development
Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the
-development of the above referenced property, including the repair and replacement of the pergola and
concrete pad, all as expressly and specifically set forth in the attached permit application and workplan
drawings.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
:.project initiation.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-02150) issued 12/11/17.

ADDITIONAL CONDITIONS
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-1267.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
[phone] within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

to undertake development activities to construct a pier facility and breakwater within Bull Bay,
in Dare County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that

Doug and I finally got a minute to review the project and I wanted to ask about a few more things.
With the width of the pier greater than 6 feet, our calculations puts the total square footage over 2,000ft max
(2,932ft2). 7H .0208(b)(6)(A) and (B) do allow for the greater width and square footage overage if necessary for safe use,
to improve public access, etc. I wanted to ask if that was staffs recommendation.
I wanted to ask more about the mooring pilings. Even if they are used for temporary use can you provide the arc of
swing and typical vessel size?

Overview: The 103.98 acre subject property has approximately 8,165 linear feet of combined
shoreline along a canal, Bunton Creek, and Bull Bay which connects to the Albemarle Sound.
Wooded wetlands are located on the northwest and west sides of the property. The project site
is located at the northeast corner of the property along Bull Bay. Water depths at the project site
range from 3.5 feet to 4 feet below Normal Water Level (NWL). The shoreline area of the project
site is located within an AE flood zone.
The subject property is owned by the state and is used as an environmental education center.
Existing site improvements include twenty (20) multi -unit lodges, director's residence, staff lodge,
conference building, dining hall, infirmary, administration building, maintenance building,
recreational building, environmental learning center, group reception building, boat repair
building, wet labs, a multipurpose building, and boardwalk, along with associated site, sidewalk,
roadway and parking improvements.
Existing shoreline improvements are concentrated at the northeast corner of the subject property
at the project site and consist of approximately 650 linear feet of riprap shoreline, a boat ramp, a
shore side sidewalk with gazebo and pergola, and the remnants of an 8 foot wide by 100 foot long
pier with a 32 foot by 32 foot terminus platform and four (4) mooring pilings. The pier, platform
and pilings along with the boat ramp were permitted and constructed under CAMA Major Permit
56-97 and destroyed in hurricanes Hermine and Matthew. The boat ramp has since been repaired

Installation of an 8 foot wide by 180 foot long pier with two (2) 4 foot by 20 foot platforms, two (2)
pergolas, a 32 foot by 44 foot terminus platform and two (2) mooring pilings, construction of an
80 foot long breakwater, and replacement of a pergola and concrete pad along the shore side
sidewalk connecting to the pier, are proposed. Remnant improvements will be removed and the
new pier facility placed in their location. Benches and steps will be provided on the pier. The pier
will include a handicapped accessible ramp connecting to the terminus platform. The breakwater
will have 2 inch openings every 12 to 18 inches and will extend 12 inches above NWL. The
breakwater is meant to dissipate wave action and protect the new pier.
The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish
taking. The sound is over 10 miles wide at this location. No Submerged Aquatic Vegetation (SAV)
is present at the project site. Wetlands are not indicated at the project site. A review of historic
and archaeological sites was not provided.
Anticipated Impacts resulting from this project are expected to include: the filling of 80 sq. ft. of
Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), and; the shading of
2,932 sq. ft. of Public Trust Area/Estuarine Waters AEC.
Basis for Determination:
The Tyrrell County/Town of Columbia Land Future Land Use Plan Map identifies the project site
as "Conservation". The "Conservation" designation also includes land and water areas which are
environmentally sensitive, including areas of environmental concem, as indicated on Page 133.

As proposed the pier facility has an 8ft wide pier and platform coverage is greater than the max allowable of
2,000ft2 [7H .0208 (b)(6)(A) and (B)]. Due to the 8ft wide pier proposal the entire facility is considered
platform. Field report noted a total of 2,932ft2 of shading for the entire structure. Field staff was asked to
clarify their recommendations on these inconsistencies with rule and on 12/14/17 additional information was
received that the public benefit clause within those rules was staffs recommendation.
In addition, there was an additional request to clarify the use of the tie pilings and the proposed swing of arc.
Staff's response on 12/14/17 was for temporary tie up of ion boats (14-15ft) with a swing of arc of
approximately 25ft. As proposed the tie pilings are only 20ft from each other and may pose an issue,
requiring a permit modification.

8. PROJECT SUMMARY: The applicant proposes to construct pier, covered platforms, and mooring
pilings, and a breakwater on the Albemarle Sound on Clover Way, Columbia, Tyrrell County.

PROJECT SETTING
John Delucia has submitted a Major CAMA/Dredge and Fill request on behalf of the NCSU 4H
Center to construct a pier on the Albemarle Sound. The 12-acre project site is located at 100 North
Clover Way in Columbia, Tyrrell County off SR 1200. The property is currently a public facility with
multiple structures (20 multi -unit lodges, director's residence, staff lodge, conference building,
dining hall, infirmary, administration building, maintenance building, recreational building,
environmental learning center, group reception building, boat repair building, wet labs, and a
multipurpose building) a wetland boardwalk, and gazebo. These structures were all permitted under
Mqj or CAMA permit number 56-97. Along with the previously listed structures, a 100ft by 8ft pier
and 32ft by 32ft platform, four mooring pilings and a boat ramp were permitted with Major CAMA
permit 56-97 and have been destroyed by Hurricanes Hermine and Matthew. The boat ramp has since
been repaired through the DCM general permit process. The shoreline is currently partially protected
with rip rap and wooded wetlands. The Albemarle Sound is over 10 miles wide at the project site and
water depths range from -3.5 feet to -4feet below NWL. The closest pier is over 500 feet to the East
of the project site.
The property to the West of the pier is undeveloped and consists of wooded wetlands with a
boardwalk. The properties to the East of the project site are residential and are currently stabilized by
bulkheads and rip rap. The unprotected wetlands have been eroding since the 4H facility has been
constructed.
The Albemarle Sound at the project site is classified as SB by the Environmental Management
Commission and Coastal by the Marine Fisheries Commission. There is no Submerged Aquatic
Vegetation (SAV) or shellfish present in the project location.
PROJECT DESCRIPTION
The applicant proposes to construct an 180ft by 8ft wide pier with two 20ft by 4ft platforms, a 44ft
by 32ft platform, two mooring pilings, and an 80ft breakwater (with 2" cuts every 12" to 18" in each
24" sheets). The breakwater will be 12" above NWL. The platforms will be partially covered with
pergolas. The applicant is also proposing to repair/replace a pergola and concrete pad landward of
the rip rap connecting the pier to the concrete walkway running parallel NWL. These repairs could
have been exempted from DCM permitting through repair and storm exemptions.
ANTICIPATED IMPACTS
The project will result in localized turbidity due the installation of the pier, mooring pilings and
breakwater. There will be 2,932sq ft of open water that will be shaded from the pier and platforms
and 80sq 8 of soft bottom will become vinyl breakwater.

Eastern 4H Center — Pier Replacement and Breakwater Installation
North Carolina State University is applying for a CAMA Major Permit to allow the
reconstruction of the pier at the Eastern 4H Center facility located in Tyrell County, North
Carolina. The application also requests that a breakwater structure be allowed to further
protect the pier from wave action. The original pier was constructed sometime in late 2001
or early 2002. This pier has experienced storm damage on three occasions with the most
recent damaged during Hurricane Matthew. During that storm, the pier was destroyed
with some pilings and structural members still existing.
The University intends to demolish the remaining existing pier elements and reconstruct
a new pier in its current location. The new pier will be higher above the water level than
the original pier and will have a lower platform. The pier is used by the facility for camp
activities to include fishing and kayaking and will be used as an outdoor teaching area for
small groups. The new pier will have some benches and steps to lower levels. The lowest
platform will utilize marine grade concrete panels to add ballast and to provide a better
walking surface closer to the water. The pier will be constructed on round wooden piles
with heavy timber girders, wooden floor joists and wooden decking. The pier will have an
ADA accessible ramp as shown on the plans. Two mooring pile are proposed for mooring
the safety boat that is used at summer camp and during any water related activities. The
normal water lever was surveyed and found to be at 0,3' MSL. The lower platform will be
approximately two feet above the normal water level with and the u e ier/plafforms
being a little more than five feet above the normal water level. Rep ' e�sting land

The plan also includes the addition of an eighty -foot vinyl breakwater.4s structure is

The University plans to construct this pier in early 2018 so that it will be ready for the 2018
summer camp season. The project will be compliant with the NC Environmental Policy

Columbia, Tyrrell County, North Carolina It was received on 2 October 2017, and appears to be
adequate for processing at this time. The projected deadline for making a decision is 16 December
2017. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day. Kevin Hart, Field Representative for the Division of Coastal Management is
responsible for processing your permit and he can be reached at 252-948-3936 or via email at

If this agency does not render a permit decision within 70 days from 2 October 2017, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private road would lead
one into your property. Failure to post this notice could result in an incomplete application.

plan is to reconstruct this pier to be a bit longer and to include a breakwater for its
protection. The new pier will be in the same location as the original pier. I have also

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by N.C.G.S.
113A-119(b) that an application for a development permit in an Area of Environmental Concern as designated under
the Coastal Area Management Act (CAMA) was received on 2 October 2017. According to the said application
submitted by the NCSU 4-H Environmental Education Center, applicant proposes to construct a pier, covered
platforms, mooring pilings, and a breakwater on the Albemarle Sound on Clover Way, Columbia, Tyrrell County,
North Carolina
A copy of the entire application may be examined or copied at the office of Jonathan R. Howell, District
Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC, during normal business hours.
Public comments received by 28 October 2017 will be considered. Later comments will be accepted and considered
up to the time of permit decision. Project modifications may occur based on farther review and comments. Notice of

THIS DEED, made and entered into this the 21st day of April, 1993,
by CLYDE S. SAWYER and wife, FAYE C. SAWYER, hereinafter called Grantor,
to THE. STATE OF NORTH CAROLINA, of P. 0. Box 629, Raleigh, NC
27602-0629, hereinafter called Grantee;
WITNESSETII:
THAT said Grantor, for and in consideration of the mum of Ten S
N01100 (E10.00) Dollars and other good and valuable considerations to
them paid by Grantee, the receipt of which is hereby acknowledged have
bargained and sold, and by these presents do grant, bargain, sell and
convey to said Grantee, its successors and assigns, in fee simple, a
certain tract or parcel of land in Scuppernong Township, Tyrrell County,
North Carolina, and more particularly described and bounded as follows,
to -wit;
Beginning at an iron pipe which is located by measuring North 80 degrees
27 minutes 23 seconds West 1796.42 feet from North Carolina Geodetic
Survey Monument marked "TY-65.1966", which point of beginning is shown
more particularly on a plat of survey hereinafter referred to, and from
the POINT OF BEGINNING so located running tbence North 07 degrees 40
minutes 05 seconds West 971.40 feet to an Iron rod; thence running North
86 degrees 56 minutes 20 seconds East 577.20 feet to an Iron rod; thence
running North 58 degrees 18 minutes 09 seconds East 115.49 feet to an
iron rod; thence running North 57 degrees 12 minutes 53 seconds East
100.99 feet to a marked tree; thence running North 43 degrees 57 minutes

which Is shown and delineated on a plat of survey entitled "Clyde S.
Sawyer Tract for State of North Carolina" dated March 31. 1993, prepared
by W. N. Haskins, Jr. and of record in the Office of the Register of
Deeds of Tyrrell County 1n Map Cabinet B, Slot 111A
There is also conveyed hereby all the right, title, claim and interest to
any and all lands lying to the north and west of those boundaries
d ascribed herein extending to the high water mark of the Albemarle Sound
(Bulls Bay) and Wharf Creek.
There is also conveyed hereby that certain easement more particularly
described as follows:
Beginning at a point, a concrete marker located in the western right of
Way line of N. C. Secondary Road No. 1202. said point of beginning being
located more particularly by measuring North 1 degree 31 minutes 20
seconds West 2958.23 feet from the point at which the center line of N.
C. Secondary Road No. 1202 intersects the center line of N. C. Secondary
Road No. 1200 and thence measuring South 80 degrees 20 minutes 35
seconds West 30.30 to the point and place of beginning and from the
BEGINNING point so located running thence South 80 degrees 20 minutes 35
seconds West 723.98 feet to an Iron pipe in the base of a pine; thence
running North 12 degrees 49 minutes 00 seconds West 50.08 feet to a
point; thence running North 80 degrees 20 minutes 35 seconds East to a
point in the western right of way line of N. C. Secondary Road No. 1202;
thence running along and with the western right of Way Line of N. C.
Secondary Road No. 1202 South 1 degrees 31 minutes 20 seconds East to
the point and place of BEGINNING and being a 50 foot strip of land
extending along the southern boundary of lands owned by Nanette Smith at
Bulls Bay in Scuppernong Township of Tyrrell County, North Carolina,
shown more particulsry on that certain plat of survey dated January 30,
1983, by John C. Kirkman, Registered Land Surveyor, which is of record
in the Office of the Register of Deeds of Tyrrell County in Map Cabinet
A, Slot 105. For further description reference is made to that certain
Deed of Easement dated February 9, 1984, by and between Rebecca Nanette
Smith and Clyde S. Sawyer and wife and of record in Book 152, Page 494,
in the Office of the Register of Deeds of Tyrrell County, and this
easement is subject always to the terms, conditions and provisions set
forth in said easement.

TO HAVE AND TO HOLD the aforesaid tract or parcel of land, and all
privileges and appurtenances thereto belonging, to the said Grantee, its
successors and assigns, in fee simple, to its only use and behoof
forever.
AND the said Grantor, for themselves and their heirs, executors and
administrators, covenant with said Grantee, its successors and assigns,
that they are seised of said premises in fee and have perfect right to
convey in fee simple, that the same are free and clear from all
encumbrances, and that they do hereby forever warrant and will forever
defend the said title to the same against the claims of all persons
whomsoever.
