The reef site boundaries specified within this letter are existing or permitted and have been accurately documented. These boundaries will be kept on file with each related CAMA permit, and on file in with the NC Division of Coastal Management in the 2017 major permit archives under 2017 NC DMF AR BOUNDARY MODIFICATION. If at any time your agency wishes to access these records, apply for a permit or permit modification, or modify a boundary, this letter shall be referenced, along with the appropriate reef site information. This endorsement does not convey an active permit or authorization to conduct development within the newly acknowledged reef site boundaries. Any future development may require modification of an active permit or the need to proceed through the NC Division of Coastal Management's CAMA major permitting process. Division of Coastal Management Department of Environmental Quality RE: NC DMF Artificial Reef Boundary Reconciliation Dear Mr. Bodnar, Thanks for your memo, dated 3/8/17, giving the NCDMF Artificial Reef program guidance on information needed to rectify reef boundaries in North Carolina coastal waters. As requested, we've prepared single page informational sheets on each of our reef sites in coastal waters and attached all available reef information to this cover letter. The informational sheets have been grouped as "Estuarine," including both oyster sanctuaries and estuarine artificial reefs, and "Coastal Ocean," for reef sites located in the ocean within the 3 nautical mile state jurisdictional boundary. Since this package will also be distributed to the US Army Corps of Engineers (USACE), we have prepared similar informational sheets on reefs in federal waters in a section called "Federal Ocean Reefs." As you review the pertinent documents, please consider the following points: For consistency, we propose to standardize all ocean reef boundaries (including those not under the purview of NCDCM/CAMA) as a single centroid coordinate and 1500' radius circle. In most instances this is adequate to incorporate all existing materials, but in some cases, a boundary radius of 3,000' was required. In instances where previous CAMA or USACE permits are described as "unknown," DMF staff could not locate records of these permits. To aid in identification of any missing past permits, we have also attached a table (found on page 72) defining the last known deployment date at each site. For marking, DMF will not maintain buoy markers on any ocean reef. At estuarine reefs, markings will be situated at the agreed corner coordinates. These markings will be either buoys or pilings, based on availability of funding and recommendations of the US Coast Guard (USCG). Markings will remain consistent with USCG Aids to Navigation permits and NOAA navigational charts (once updated following this agreement). - Nothing Compares Stateol'North CaruSna 11Nvlsionot Marine Fsheries 5441 Mendell Street I P.O. North Carolina 28S57 252-726-7021 Once approved by the NC Division of Coastal Management and the USACE, these boundaries will be provided to NOAA National Ocean Service Office of Coast Survey and the US Coast Guard for chart corrections and navigational record -keeping, respectively. Coordinates may also be used to update records in the Marine Fisheries Commission Rulebook or used for DMF proclamations. DMF would like to reserve the future option to add new sites as an amendment to this document. Any new sites will be proposed in consultation with appropriate agencies and in accordance with DMF site selection protocol. We affirm that with this agreement, boundaries contained herein do not authorize new development. The NCDMF requests that once an agreement is reached among agencies, NCDCM provides a letter confirming these boundaries are authorized. We will request a similar confirmation letter from the USACE As an agency, we appreciate the attention NCDCM has given to help reconcile our reef boundaries. I am hopeful that with this agreement, we. can establish consistency and continuity among state and federal agencies.
