Signature of Permittee i AR-160 Permit N6. 127-17 Page 2 of 3 ADDITIONAL CONDITIONS Reef Structure In accordance with commitments made by the pernttee, reef construction within the site shall be accomplished by the placement of up to 100,000 tons of bridge rubble placed at three locations within the AR-160 boundary, as depicted in the attached workplan drawings. All materials shall be free from loose dirt or pollutants except in trace quantities. The navigational clearances of the reef material shall not exceed -30 feet as measured from mean lower low water. Pemutte shall be responsible for relocating or removing any individual reef unit that violates :the authorized clearances. ,,No material shall be placed at any time in any waters outside of the alignment of the reef site boundaries as indicated on the attached workplan drawings. The permittee shall be required to repair, maintain and/or remove any components of the reef that are displaced from the reef site boundaries as depicted in attached workplan(s). The permittee shall be responsible for removing all portions of the reef should the site be terminated or displaced beyond :repair. This permit does not authorize the placement of material within any rocky outcroppings/hard bottoms. Use of the permitted activity shall not interfere with the public's right to free navigation on all navigable waters of the United States. The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corp. of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. DAVIS (Wre"'ar The North Carolina Division of Marine Fisheries (NC DMF) Artificial Reef Program has been formally operating since the 1970's, and has a total of 68 permitted artificial reefs and oyster sanctuaries within the state of North Carolina. Twenty-five (25) of these sites are in the states estuaries, while 43 are in ocean waters. In 2016, the NC DMF released an artificial reef guide which outlines each of the artificial reefs and oyster sanctuaries. The artificial reef guide provides material information, latitude longitude information, and a figure of the material on each of the reef sites. A pdf version of the hardcopy reef guide can be found at: 4fa488b49cbb& rgroupld=38337. The NC DMF Artificial Reef Program has also developed an interactive reef guide, set up in an ArcGIS format is available here: httos•//ncdenr maps arceis com/aos/wcbavvviewer/index.html?id=3b27e8594cb6444c88b5525b f763aa55. The interactive guide is complete with material shapefiles, latitude/longitude information, side -scan sonar imagery, and much more. This is available for review by the public, state, and federal agencies. Materials For reef construction, NCDMF intends to use only biologically suitable materials that are approved for reef building. Accordingly, NCDMF adheres to program documentation which details specifications for acceptable reef construction materials, based on federal and state guidance (references available upon request). It should be specially noted that all materials placed at the state's artificial reef sites are free of hydrocarbons, contaminants, and toxins, as required by the United States Army Corps of Engineers (USACE), the Environmental Protection Agency (EPA), the United States Coast Guard (USCG), and other agencies involved in permitting of artificial reefs. All trash, wood, lines, and floating debris must also be removed. It should be noted that lead based paint is not likely a problem as the bridge was blast cleaned in the 1980's and 2011. It should also be noted that materials are visually inspected by NCDMF and/or the contractors, to ensure there is no oil, hydrocarbons, or contaminants. If materials are found to be contaminated, the material would be disposed of properly and not put on our artificial reefs. Finally, it should be noted that rebar will be limited to 3" in length on all bridge materials, but will be cut flush when feasible. The demolition and disposal portion of this contract will be completed in coordination with the North Carolina Division of Marine Fisheries (NCDMF) Artificial Reef Program. Demolished bridge material will be transported to four (4) (AR-130, AR140, AR-140, AR-160) existing ocean reef sites to create artificial reef habitat (Figure 1). In this project, DMF's role will be to ensure the sites 1) are appropriately permitted, 2) materials meet acceptable use guidelines, and 3) operations comply with established permit conditions. PCL construction will conduct all phases of demolition and deployment on site, with support provided by division staff for material placement. General Information AR-160 is located within the three -nautical mile boundary line, whereas AR-130, AR- 140, and AR-145 are in federal waters. This CAMA permit application will only address those planned enhancements at AR-160. Site AR-160 AR-160 is located at 35 43.888' N 75 26.77]' W, or 5.7 nm southeast of the Oregon Inlet sea buoy. The site is defined by a 1500 ft. radius circular boundary, encompassing a total area of 162.27 acres in total. These reef boundaries have been reviewed and approved by NCDCM (Attachment 1). Site depth is 66 ft. and has a charted minimum vertical clearance of 30 feet. In consideration of site depth and required clearance, this site allows for a construction profile of up to 36 ft. (Figure 2). Based on interpretation of side -scan data, the bottom habitat consists of sand and muddy sand. Surveys revealed no existing shell resource or natural hardbottom within the proposed boundary. To date, approximately 1.43 acres has been developed with the most recent construction occurring in 2002. Existing materials already on AR-160 include two 440 ft. liberty ships, 271 tons of concrete pipe, 215 concrete pilings, and 69 reef balls (Figure 3). Proposed Enhancements Materials In communication with NCDOT and PCL, we estimate to total project tonnage to be up to 100,000 tons of dismantled bridge pieces. These pieces will include bridge spans, bridge piles, bents, double t-girders. Concrete bridge pieces are consistent with state guidelines for acceptable artificial reef materials (Attachment 2). As the NCDOT-PCL contract prescribes, AR-160 will receive approximately 55% (44,000 — 55,000 tons) of the total tonnage. However, given project logistics and relatively unpredictable weather and inlet conditions in this area, AR-160 may receive up to the full complement of 100,000 tons. We propose to permit this site for up to 100,000 tons of the bridge material. Spatial Design of Reef As standard practice the reef program, we maintain a 150 ft. buffer of no construction on the inside perimeter of the reef boundary. The remaining area of the reef is gridded into 150 ft. x 150 ft. grids for spatial reference and planning purposes (Figure 4). In figure 4, these areas are highlighted in orange and labeled as 1, 2, and 3. Zone 1 is 15.5 acres, zone 2 is 24.75 acres, and zone 3 is 15.5 acres of enhancement space. Plans will be to distribute the materials in these areas, starting in zone 1, and not to exceed 36 ft. of vertical profile (Figure 5 and 6). For the purposes of this permit, it should be assumed that a total of 55.75 acres will be impacted as a result of this project. Reef Construction/ Material Deployments Total number of deployment days on site will be determined by the capability of the deployment contractor (PCL). However, we do not anticipate the demolition portion of their contract to extend beyond ten months once demolition commences. Demolition is slated to begin as early as June 2018, but could start as late as November 2018. Construction of the artificial reef can be expected anytime between June 2018 and September 2019. PCL Construction will be conducting all deployments as defined in contract with NCDOT, however NCDMF personal will be on -site for all deployments to make sure permit and vertical clearance compliance is maintained. To guide deployments, program staff will mark daily deployment locations with visible references above the waterline, using recreational grade GPS. NCDMF staff will ensure reef construction operations and methodology are consistent with historically successful practices. Reef Monitoring During construction, NCDMF staff will serve as observer(s) to ensure proper permit and building compliance. Deployed materials will be surveyed with calibrated onboard sonar to verify compliance with vertical clearance requirements. When time allows, staff will survey the sites with bathymetric mapping equipment, as an update to the Artificial Reef program's artificial reef guide and habitat records. Staff will also perform SCUBA surveys on reef sites to observe material condition, as time allows. The Artificial Reef program also employs an online survey for recreational users to provide feedback on Artificial Reefs through its website, including AR-160. Further, artificial reefs are included in MRIP survey questionnaires, which can offer valuable biological information. Protected Resource Avoidance NCDMF staff will perform all avoidance measures as proposed to USACE (July 11, 2017; Attachment 3). During the scoping meeting for this project, no concerns were raised about the construction timeline and potential impacts to protected resources at AR-160. Reef Marking AR-160 is an existing reef site and is clearly marked on NOAA charts. NCDMF will not maintain any physical marking on station. Materials used must meet their intended function, by supporting diverse and abundant biological communities. Selected materials must also be compatible with the aquatic environment in which they are placed. This means they must not pose environmental risks. Also, unstable materials, or those prone to movement; and non -durable, or easily degraded, materials must be precluded from use. The North Carolina Division of Marine Fisheries Artificial Reef Program has produced a comprehensive list of accepted materials for use in partner projects. Proposed Special Conditions for Protected Resources (July 11, 2017) North Carolina Department of Environmental Ouality Division of Marine Fisheries (NCDMF) Proposed Special Permit Conditions USACE General Permits 194 and 291 Any deployment of reef materials during North Atlantic right whale calving season (November 15 through April 15 of any year) must comply with: a. Maximum speed for all vessels involved in placing the reef material is 30 knots. b. Deployments must be conducted during daylight hours when lighting, weather, and sea conditions allow for visual monitoring of the project area. c. Deployment activities will not commence until NCDMF staff reports that no marine mammals or sea turtles have been sighted for at least 60 minutes. d. Deployment activities will cease immediately if sea turtles or marine mammals are sighted within the protected area and will not recommence until the NCDMF staff reports that no mammals or sea turtles have been sighted for at least 60 minutes. 2. If a listed species is seen within 100 yards of the active daily construction operation or vessel movement, all appropriate precautions shall be implemented to ensure its protection. These precautions shall include cessation of operation of any moving equipment closer than 50 feet of a listed species. Operation of any mechanical construction equipment shall cease immediately if a listed species is seen within a 50-ft radius of the equipment. Activities may not resume until the protected species has departed the project area of As own volition. 3. Reef structures shall be sited and installed according to the historically permitted site clearances, listed in Table 1, relative to MLW. 4. Reef structures shall not be placed on natural hard -bottom habitat. 5. Materials should be of sufficient size and relative density to not move from the reef site post - deployment and be clean and free from asphalt, creosote, petroleum, other hydrocarbons and toxic residues, loose free floating material or other deleterious substances. 6. The use of explosives to deploy materials is not authorized 7. Reef materials shall be selected to ensure that ESA -listed species do not become entrapped in reef structures, or entangled in debris (e.g., abandoned fishing tackle, nets, and lines) that may accumulate on artificial reefs: a. Materials used for artificial reef building shall conform to the recommendations in the National Artificial Reef Plan (as Amended): Guidelines for Marine Artificial Reef Materials, Second Edition (Atlantic and Gulf States Marine Fisheries Commissions 2004). Military surplus and vessel structures such as ladders, rails, booms, antennas, etc. will be removed to reduce the potential accumulation of abandoned fishing tackle and lines. Clean steel, concrete bridge or large building demolition materials such as slabs or pilings may be used provided that all steel reinforcement rods are cut at the base of the concrete so no rebar or metal is protruding. 8. Underwater reef cleanup will be performed by NCDMF divers during annual reef site monitoring events. Cleaning reefs in low visibility/high current dive conditions may present diver safety issues with the potential of divers being entangled or snagged. Staff will make every reasonable attempt to clean reef materials of debris during regularly scheduled assessments, without compromising the safety of the crew and divers. The applicant will send confirmation of cleanup to NMFS's Southeast Regional Office (takereport.nmfsser@noaa.gov), including dates of cleanup efforts and results of the clean-up. 9. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/m- es/marnmal/manateeguidelines.prif. 10. The applicant shall follow NMFS's Sea Turtle and Smalltooth Sawfish Construction Conditions in order to further reduce interaction risk, and require all construction workers watch for sturgeon and sea turtles. Operation of any mechanical construction equipment will cease immediately if a protected species is seen within a 50-ft radius of the equipment. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the pemuttee's discovery of the violation. 12. The applicant will adhere to the National Marine Fisheries Service Sea Turtle and Smalltooth Sawfish Construction Conditions, dated March 23, 2006 and will apply these measure to the shortnose and Atlantic sturgeon. 13. The applicant will follow NCDMF Guidelines and Specifications for Acceptable Reef Materials, the ASMFC/GSMFC Guidelines for Marine Artificial Reef Materials, the EPA National Guidance: Best Management Practices for Preparing Vessels Intended to Create Artificial Reefs, and the NOAA/NMFS National Artificial Reef Plan. 14. Artificial Reef-160 (AR-160) is located 35' 43' 89" N, 750 6' 77" W or 5.7 nm southeast of the Oregon Inlet sea buoy. The site is defined by a 1,500 ft. radius circular boundary encompassing a total area of 162.3 acres. Water depth at the site is approximately 66 ft. below mean low water (MLW). Bottom habitat in this area consists of sand and muddy sand. The rules of the Coastal Resource Commission mention "artificial reefs" in 07H.0208(b) (12) Submerged Lands Mining (A) (ii), "Natural reefs, coral outcrops, artificial reefs ... shall be avoided." While there are no development standards for artificial reefs, they are recognized as beneficial fish habitat. The project will enhance an existing reef. Water depths at the site are approximately 66 feet below Mean Low Water (MLW). Bottom habitat in this area consists of sand and muddy sand. The site is known as Artificial Reef-160 (AR-160). Existing enhancements at AR-160 cover 1.43 acres and include two (2) 440 long foot liberty ships, 271 tons of concrete pipe, 215 concrete pilings and 69 reef balls. The reef maintains a navigable water depth of 30 feet below MLW and is a known diving site. AR-160 is located within the 3-mile nautical boundary line for state permit jurisdiction. Placement of up to 100,000 tons of demolition material from the Bonner Bridge removal project within up to 55.75 acres of AR-160 is proposed. A 30 foot navigational water depth will be maintained. The Atlantic Ocean is classified as SB at the project site and is open to shellfishing. A review of significant historic or archaeological resources was not provided. Anticipated Impacts resulting from this project are expected to include: the disturbance of 55.75 acres of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC). Project Setting The North Carolina Division of Marine Fisheries (DMF) maintains several artificial reefs in the waters of the Atlantic Ocean off the North Carolina coast. Artificial Reef-160 (AR-160) is one of those reefs. It is located at 35' 43' 89" N, 750 6' 77" W or 5.7 nm southeast of the Oregon Inlet sea buoy. The site is defined by a 1,500 ft. radius circular boundary, 66 ft. encompassing a total area of 162.3 acres. Water depth at the site is approximately below mean low water (MLW). Bottom habitat in this area consists of sand and muddy sand. Development Proposal The applicant proposes to add demolition material from the Bonner Bridge removal project, to AR-160. DAVIS ENV$AONMENTR, UU4UTY 1)IM[/fY CAMA Major Permit Application Narrative NC Division of Marine Fisheries August 2017 Final North Carolina Artificial Reef Program sites The North Carolina Division of Marine Fisheries (NC DMF) Artificial Reef Program has been formally operating since the 1970's, and has a total of 68 permitted artificial reefs and oyster sanctuaries within the state of North Carolina. Twenty-five (25) of these sites are in the states estuaries, while 43 are in ocean waters. In 2016, the NC DMF released an artificial reef guide which outlines each of the artificial reefs and oyster sanctuaries. The artificial reef guide provides material information, latitude longitude information, and a figure of the material on each of the reef sites. Materials For reef construction, NCDMF intends to use only biologically suitable materials that are approved for reef building. Accordingly, NCDMF adheres to program documentation which details specifications for acceptable reef construction materials, based on federal and state guidance (references available upon request). It should be specially noted that all materials placed at the state's artificial reef sites are free of hydrocarbons, contaminants, and toxins, as required by the United States Army Corps of Engineers (USACE), the Environmental Protection Agency (EPA), the United States Coast Guard (USCG), and other agencies involved in permitting of artificial reefs. All trash, wood, lines, and floating debris must also be removed. It should be noted that lead based paint is not likely a problem as the bridge was blast cleaned in the 1980's and 2011. It should also be noted that materials are visually inspected by NCDMF and/or the contractors, to ensure there is no oil, hydrocarbons, or contaminants. If materials are found to be contaminated, the material would be disposed of properly and not put on our artificial reefs. Finally, it should be noted that rebar will be limited to 3" in length on all bridge materials, but will be cut flush when feasible. The demolition and disposal portion of this contract will be completed in coordination with the North Carolina Division of Marine Fisheries (NCDMF) Artificial Reef Program. Demolished bridge material will be transported to four (4) (AR-130, AR140, AR-140, AR-160) existing ocean reef sites to create artificial reef habitat (Figure 1). In this project, DMF's role will be to ensure the sites 1) are appropriately permitted, 2) materials meet acceptable use guidelines, and 3) operations comply with established permit conditions. PCL construction will conduct all phases of demolition and deployment on site, with support provided by division staff for material placement. General Information AR-160 is located within the three -nautical mile boundary line, whereas AR-130, AR- 140, and AR-145 are in federal waters. This CAMA permit application will only address those planned enhancements at AR-160. Site AR-160 AR-160 is located at 35 43.888' N 75 26.771' W, or 5.7 nm southeast of the Oregon Inlet sea buoy. The site is defined by a 1500 ft. radius circular boundary, encompassing a total area of 162.27 acres in total. These reef boundaries have been reviewed and approved by NCDCM (Attachment 1). Site depth is 66 ft. and has a charted minimum vertical clearance of 30 feet. In consideration of site depth and required clearance, this site allows for a construction profile of up to 36 ft. (Figure 2). Based on interpretation of side -scan data, the bottom habitat consists of sand and muddy sand. Surveys revealed no existing shell resource or natural hardbottom within the proposed boundary. To date, approximately 1.43 acres has been developed with the most recent construction occurring in 2002. Existing materials already on AR-160 include two 440 ft. liberty ships, 271 tons of concrete pipe, 215 concrete pilings, and 69 reef balls (Figure 3). Proposed Enhancements Materials In communication with NCDOT and PCL, we estimate to total project tonnage to be up to 100,000 tons of dismantled bridge pieces. These pieces will include bridge spans, bridge piles, bents, double t-girders. Concrete bridge pieces are consistent with state guidelines for acceptable artificial reef materials (Attachment 2). As the NCDOT-PCL contract prescribes, AR-160 will receive approximately 55% (44,000 — 55,000 tons) of the total tonnage. However, given project logistics and relatively unpredictable weather and inlet conditions in this area, AR-160 may receive up to the full complement of 100,000 tons. We propose to permit this site for up to 100,000 tons of the bridge material. Spatial Design of Reef As standard practice the reef program, we maintain a 150 ft. buffer of no construction on the inside perimeter of the reef boundary. The remaining area of the reef is gridded into 150 ft. x 150 ft. grids for spatial reference and planning purposes (Figure 4). In figure 4, these areas are highlighted in orange and labeled as 1, 2, and 3. Zone 1 is 15.5 acres, zone 2 is 24.75 acres, and zone 3 is 15.5 acres of enhancement space. Plans will be to distribute the materials in these areas, starting in zone 1, and not to exceed 36 ft. of vertical profile (Figure 5 and 6). For the purposes of this permit, it should be assumed that a total of 55.75 acres will be impacted as a result of this project. Reef Construction/ Material Deployments Total number of deployment days on site will be determined by the capability of the deployment contractor (PCL). However, we do not anticipate the demolition portion of their contract to extend beyond ten months once demolition commences. Demolition is slated to begin as early as June 2018, but could start as late as November 2018. Construction of the artificial reef can be expected anytime between June 2018 and September 2019. PCL Construction will be conducting all deployments as defined in contract with NCDOT, however NCDMF personal will be on -site for all deployments to make sure permit and vertical clearance compliance is maintained. To guide deployments, program staff will mark daily deployment locations with visible references above the waterline, using recreational grade GPS. NCDMF staff will ensure reef construction operations and methodology are consistent with historically successful practices. Reef Monitoring During construction, NCDMF staff will serve as observer(s) to ensure proper permit and building compliance. Deployed materials will be surveyed with calibrated onboard sonar to verify compliance with vertical clearance requirements. When time allows, staff will survey the sites with bathymetric mapping equipment, as an update to the Artificial Reef program's artificial reef guide and habitat records. Staff will also perform SCUBA surveys on reef sites to observe material condition, as time allows. The Artificial Reef program also employs an online survey for recreational users to provide feedback on Artificial Reefs through its website, including AR-160. Further, artificial reefs are included in MRIP survey questionnaires, which can offer valuable biological information. Protected Resource Avoidance NCDMF staff will perform all avoidance measures as proposed to USACE (July 11, 2017; Attachment 3). During the scoping meeting for this project, no concerns were raised about the construction timeline and potential impacts to protected resources at AR-160. Reef Marking AR-160 is an existing reef site and is clearly marked on NOAA charts. NCDMF will not maintain any physical marking on station. Materials used must meet their intended function, by supporting diverse and abundant biological communities. Selected materials must also be compatible with the aquatic environment In which they are placed. This means they must not pose environmental risks. Also, unstable materials, or those prone to movement, and non -durable, or easily degraded, materials must be precluded from use. The North Carolina Division of Marine Fisheries Artificial Reef Program has produced a comprehensive list of accepted materials for use in partner projects. These materials were chosen based on the above criteria, using guidance from internal program studies, The ASMFC/GSMFC Guidelines for Marine Artificial Reef Materials (Second Ed., 2004), The Environmental Protection Agency's (EPA) National Guidance: Best Management Practices (BMPs) for Preparing Vessels Intended to Create Artificial Reefs, and the NOAA/NMFS National Artificial Reef Plan. Any hard, strong building material made by mixing a cementing material (commonly Portland cement) and a mineral aggregate with sufficlentwater to cause material to set and bind. Types include (but are not limited to) oval and round pipe, box culverts. risers, catch - basins, knock -out boxes, bridge rubble and bridge spans, manholes, slabs, pilings, crushed concrete, and pre -designed structures such as Reef Balls or other units. All concrete must be fully cured to ensure environmental compatibility. Proposed Special Conditions for Protected Resources (July 11, 2017) North Carolina Department of Environmental Quality Division of Marine Fisheries (NCDMFI Proposed Special Permit Conditions USACE General Permits 194 and 291 1. Any deployment of reef materials during North Atlantic right whale calving season (November 15 through April 15 of any year) must comply with: a. Maximum speed for all vessels involved in placing the reef material is 10 knots. b. Deployments must be conducted during daylight hours when lighting, weather, and sea conditions allow for visual monitoring of the project area. c. Deployment activities will not commence until NCDMF staff reports that no marine mammals or sea turtles have been sighted for at least 60 minutes. d. Deployment activities will cease immediately if sea turtles or marine mammals are sighted within the protected area and will not recommence until the NCDMF staff reports that no mammals or sea turtles have been sighted for at least 60 minutes. 2. If a listed species is seen within 100 yards of the active daily construction operation or vessel movement, all appropriate precautions shall be implemented to ensure its protection. These precautions shall include cessation of operation of any moving equipment closer than 50 feet of a listed species. Operation of any mechanical construction equipment shall cease immediately if a listed species is seen within a 50-ft radius of the equipment. Activities may not resume until the protected species has departed the project area of its own volition. 3. Reef structures shall be sited and installed according to the historically permitted site clearances, listed in Table 1, relative to MLW. 4. Reef structures shall not be placed on natural hard -bottom habitat. 5. Materials should be of sufficient size and relative density to not move from the reef site post - deployment and be clean and free from asphalt, creosote, petroleum, other hydrocarbons and toxic residues, loose free floating material or other deleterious substances. 6. The use of explosives to deploy materials is not authorized 7. Reef materials shall be selected to ensure that ESA -listed species do not become entrapped in reef structures, or entangled in debris (e.g., abandoned fishing tackle, nets, and lines)that may accumulate on artificial reefs: a. Materials used for artificial reef building shall conform to the recommendations in the National Artificial Reef Pion (as Amended): Guidelines for Marine Artificial Reef Materials, Second Edition (Atlantic and Gulf States Marine Fisheries Commissions 2004). Except that derelict automobiles shall not be used and derelict vessels and military surplus shall have openings on all exposed sides adequate to prevent entrapment of ESA -listed species. Military surplus and vessel structures such as ladders, rails, booms, antennas, etc. will be removed to reduce the potential accumulation of abandoned fishing tackle and lines. Clean steel, concrete bridge or large building demolition materials such as slabs or pilings may be used provided that all steel reinforcement rods are cut at the base of the concrete so no rebar or metal is protruding. 8. Underwater reef cleanup will be performed by NCDMF divers during annual reef site monitoring events. Cleaning reefs In low visibility/high current dive conditions may present diver safety issues with the potential of divers being entangled or snagged. Staff will make every reasonable attempt to clean reef materials of debris during regularly scheduled assessments, without compromising the safety of the crew and divers. The applicant will send confirmation of cleanup to NMFS's Southeast Regional Office (takweport.nmfsser@noaa.gov), including dates of cleanup efforts and results of the clean-up. 9. In order to further protect the endangered West Indian Manatee, 7richechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc- es/mammal/manatee_guidelines.pdf. 10. The applicant shall follow NMFS's Sea Turtle and Smolltooth Sawfish Construction Conditions in order to further reduce interaction risk, and require all construction workers watch for sturgeon and sea turtles.
