Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. North River Wetlands Preserve Williston Phase I l) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, all as expressly and specifically set forth in the attached permit application and workplan drawings. In accordance with commitments made by the permittee, a turbidity curtain shall be utilized to ensure that eroded material do not enter into Williston Creek. ;NOTE: The Division of Coastal Management requests that we be provided any sampling reports or other documentation that examines the success of the authorized project. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or -other qualified persons within twenty (20) days of the issuing -,date. Signature of Permittee Coastal Federation Permit No: 06-17 Page 2 of 2 ADDITIONAL CONDITIONS Sedimentation and Erosion Control I ` Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.) General Unless specifically indicated on the attached workplan drawings, this permit does not authorize the construction of any scientific sampling stations, water control structures, walkways, or similar structures. Any future proposal to add such structures shall require additional approval from the Division:- 1 The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. I This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written consent of the Division of Coastal Management. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide Y " ' Permit No. 27 (SAW-2016-02387), which was issued on 12/30/16. The Division of Water Resources authorized the proposed project on 12/22/16 (DWR Project No. 20161174). The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. REGAN secretary TRACY DAVIS Director On November 29, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on December 2, 2016 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. Each of the ditches has a culvert at the end that connects it to the canal. I am not sure if that disconnect makes any difference in whether these count as jurisdictional. In any case, there are 9 ditches with a total length of 1,350 feet. The total impact depends on whether you measure the width at the bottom of ditch (2 feet) or the top, or in the middle. If you look at aerial photography, I measure water width at about 3ft, in which case I get 4,050 sf or 0.09 acres... If you let me know what the standard is, I can make a more exact measurement. There will be no culverts installed. The road will eventually serve as a dike to promote wetland restoration work to the west of this new road (which will be over 1,000 acres). As a result, no culverts are needed at this time. The proposed marsh will be at a similar elevation as the bottom of these ditches.There may be some sections that are filled a little, and some that are lowered. Overall it should be be a minor change in elevation. Williston Creek is SA (Market Shellfishing, Salt Water) and HOW (High Quality Water), it is a Primary Nursery Area (PNA), and is closed to the harvesting of shellfish. The site does not presently contain any Submerged Aquatic Vegetation (SAV), and the bottom substrate consists of fine silt. A review of archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: the disturbance of 507,000 ft2 of high ground. Turbidity to adjacent water could occur during excavation. Basis for Determination: The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as Rural and Conservation due to the sites location in Estuarine Shoreline, Public Trust Area, and Estuarine Waters AECs (Areas of Environmental Concern). The Land Use Plan defines use "Rural" as "....lands that are appropriate for or presently used for agriculture, forestry, mineral extraction, and other uses that should be located in a relatively isolated and undeveloped area. The predominant land uses are agricultural and residential" (pg. 92). Land uses allowed in Areas of Environmental Concern are those consistent with the State's minimum use standards and state and federal regulations. The site can be accessed through the Coastal Federation gate into North River Farms near Otway. Once through the gate, travel along farm roads to the headwaters of Williston Creek. Williston Creek is SA-HQW and is closed to the taking of shellfish. It is a Primary Nursery Area. There does not appear to be any SAVs in this area and the bottom substrate consists of fine silt. A thick fringe of Coastal Wetlands exists at the headwaters of Williston creek. In this area, the creek transitions into agricultural canals that are navigable up until water control devices are meet. This area in Carteret County's LUP is classified as undeveloped. 10. PROJECT DESCRIPTION: The North Carolina Coastal Federation is proposing to convert prior converted agricultural fields back into coastal wetlands. This will be accomplished by excavating landward of an existing agricultural canal. The excavated area will be 3,500' long and 100' landward of the canal. Elevations in the excavated area will go from 1' to -0.5'. The excavated material will be used to create a dike along the entire length of the created wetland. The proposed dike would have a base width of 45' and a top width of 12' with side slops of 5:1. The dike would be a total of 157,500ft2. The project would be planted with native plants once the growing season begins. During construction a sedimentation curtain would be placed in Williston Creek in order to prevent sediment transport into adjacent waters. 11. At completion, approximately 6,000 acres of prior converted cropland will be restored to several wetland habitats, making it one of the largest wetland restoration projects in North Carolina. The area is home to a wide variety of wildlife including bobcats, pygmy rattlesnakes and migratory birds. The site is used for educational activities, recreation and research. The North Carolina Coastal Federation, Unites States Geological Survey, North Carolina State University, and the Duke University Marine Laboratory have conducted research on site. The final portion (2,168 acres) of the site will be restored through the United States Department of Agriculture Natural Resources Conservation Service Wetlands Reserve Program in partnership with the federation. During this process, hydrology will be restored to keep water on -site with the creation of bottomland hardwood forest, tidal and freshwater wetlands in order to improve the water quality of downstream waters. The proposed project seeks to enhance the larger restoration activities by creating 16 acres of salt marsh habitat along 3,500 feet of ditch drainage leading to Williston Creek. The creek exits the property and discharges to Jarrett Bay. It is presumed that natural tidal marsh once extended onto the farm and within the project area. Salt marsh is valuable habitat for juvenile fishery species and other wildlife. The project is being led by the federation with match funding from the National Fish and Wildlife Foundation. The design by Kris Bass Engineering is based on previous successful salt marsh/tidal creek restoration done within North River Farms by the firm. Within 2-3 years of planting, dense natural vegetation will be established. Restored salt marsh on other portions of the property has shown considerable growth within one year after plantings in the fall. Construction of the site will be completed following a designated construction sequence and erosion control plan. A turbidity curtain will be used to contain any excess sediment on site rather than discharging into Williston Creek. Excavation will be completed when conditions are dry as much as possible. Excavated material will be used to construct a dike and roadway along the marsh line to be integrated with the larger restoration activities. At completion, approximately 6,000 acres of prior converted cropland will be restored to several wetland habitats, making it one of the largest wetland restoration projects in North Carolina. The area is home to a wide variety of wildlife including bobcats, pygmy rattlesnakes and migratory birds. The site is used for educational activities, recreation and research. The North Carolina Coastal Federation, Unites States Geological Survey, North Carolina State University, and the Duke University Marine Laboratory have conducted research on site. The final portion (2,168 acres) of the site will be restored through the United States Department of Agriculture Natural Resources Conservation Service Wetlands Reserve Program in partnership with the federation. During this process, hydrology will be restored to keep water on -site with the creation of bottomland hardwood forest, tidal and freshwater wetlands in order to improve the water quality of downstream waters. The proposed project seeks to enhance the larger restoration activities by creating 7 acres of salt marsh habitat along 5,000 feet of canal drainage leading to Williston Creek. The creek exits the property and discharges to Jarrett Bay. It is presumed that natural tidal marsh once extended onto the farm and within the project area. Salt marsh is valuable habitat for juvenile fishery species and other wildlife. The project is being led by the federation with match funding from the National Fish and Wildlife Foundation. The design by Kris Bass Engineering is based on previous successful salt marsh/tidal creek restoration done within North River Farms by the firm. Within 2-3 years of planting, dense natural vegetation will be established. At 0 completion, approximately 6,000 acres of prior converted cropland will be restored to several wetland habitats, making it one of the largest wetland restoration projects in North Carolina. The area is home to a wide variety of wildlife including bobcats, pygmy rattlesnakes and migratory birds. The site is used for educational activities, recreation and research. The North Carolina Coastal Federation, Unites States Geological Survey, North Carolina State University, and the Duke University Marine Laboratory have conducted research on site. The final portion (2,168 acres) of the site will be restored through the United States Department of Agriculture Natural Resources Conservation Service Wetlands Reserve Program in partnership with the federation. During this process, hydrology will be restored to keep water on -site with the creation of bottomland hardwood forest, tidal and freshwater wetlands in order to improve the water quality of downstream waters. The proposed project seeks to enhance the larger restoration activities by creating 7 acres of salt marsh habitat along 5,000 feet of canal drainage leading to Williston Creek. The creek exits the property and discharges to Jarrett Bay. It is presumed that natural tidal marsh once extended onto the farm and within the project area. Salt marsh is valuable habitat for juvenile fishery species and other wildlife. The project is being led by the federation with match funding from the National Fish and Wildlife Foundation. The design by Kris Bass Engineering is based on previous successful salt marsh/tidal creek restoration done within North River Farms by the firm. Within 2-3 years of planting, dense natural vegetation will be established. Restored salt marsh on other portions of the property has shown considerable growth within one year after plantings in the fall. Construction of the site will be completed following a designated construction sequence and erosion control plan. A turbidity curtain will be used to contain any excess sediment on site rather than discharging into Williston Creek. Excavation will be completed when conditions are dry as much as possible. MAIN BRANCH CHECK DAM/SEDIMENT TRAP N.T.S. I. CONSTRUCTION SPECIFICATIONS 1. Place stone to the lines and dimensions shown in the plan on a filter fabric foundation 2. Keep the center stone section at least nine (9) inches below natural ground level where the dam abuts the channel banks. 3. Extend the stone at least one and a half (1.5) feet beyond the ditch banks to keep overflow water from undercutting the dam as it re-enters the channel. 4. Use four (4) to fifteen (15) inch stone (NCDOT class 1 or class B erosion control stone). Place 12 inches of #57 stone on the upstream face of the check dam. 5. Set spacing between dams to assure that the elevation at the top of the lower dam is the some as the foe elevation of the upper dam. b. Protect the channel downstream from the lowest check dam, considering that wafer will flow over and around the dam. 7. Make sure that the channel reach above the most upstream dam is stable. 8. Ensure that channel appurtenances, such as culvert entrances below check dams, are not subject to damage or blockage from displaced stones. It. MAINTENANCE 1. Inspect channel for damage after each runoff event. 2. Remove sediment accumulated behind check dam as needed to prevent damage to channel vegetation, allow the channel to drain through the stone check dam, and prevent large flows from carrying sediment over the dam. 3.
