This permit, issued on May 12, 2022 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
re subject to fines, imprisonment or civil action; or may cause the permit to oe nuu ana vora.
1) Unless specifically altered herein, this Minor Modification authorizes the extension of the previously
authorized docking facility landward to the high ground and the reconfiguration of the platform to
include the boat davits, all as expressly and specifically set forth in the attached letter and workplan
drawings. Any additional development activities may require a modification of this permit.
2) This permit authorizes the two davit style boat lifts. These davit lifts require the vessels to be stored
on the docking facility structure and not over water. Therefore, these davit style lifts are not
considered formalized boat slips. This Minor Modification does not authorize any formalized boat
slips.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on_
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No portion of the docking facility shall exceed a maximum of 18 feet from existing waterward edge of
Coastal Wetlands.
4) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation to verify waterward edge of docking facility.
6) This Minor Modification shall be attached to the original Permit No. 83-20, which was transferred to the
permittee on 9/4/20, as well as all subsequent modifications, refinements, and renewals, and copies of all
documents must be readily available on site when Division personnel inspect the project for compliance.
7) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2017-00168.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2019-0563.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

Please find correspondence enclosed dated February 13, 2022 from Mr. Kurt Held
requesting a permit modification. State Permit #83-20 was issued for home and dock
construction at 270 Straits Point Road adjacent to Mekins Creek, Craven County. The
permit expires on December 31, 2023.
The request by the permittee is to modify the dimensions of the authorized docking facility.
This reconfiguration would remain within the existing footprint of the previously
authorized docking facility. The proposal would increase the authorized pier length
landward an additional 6, and alter the approved platform dimensions to 13' by 25'. The
applicant is also proposing to add two davit lifts to the proposed platform.
The Morehead City District staff would recommend approval of the proposed
reconfiguration as being consistent with the current conditions of permit # 83-20. A
processing fee of $100 (check # 2995) has been received in order to process the request.

Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the homesite,
culvert, retaining walls and driveway, and other associated infrastructure, all as expressly and
specifically set forth in the attached permit application and workplan drawings.
2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved

ADDITIONAL CONDITIONS
3) The portion of the driveway requiring wetland fill shall not exceed 10 feet in width.
4) The alignment of the authorized driveway and retaining walls shall be staked by the permittee and
verified by a representative of the Division of Coastal Management within a maximum of 30 days prior
to the start of construction.
5) The retaining walls shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet
piles, or other suitable materials approved by Division personnel.
6) The retaining walls shall be constructed prior to any backfilling activities.
7) The retaining walls shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
8) This permit does not authorize any excavation waterward of the approved retaining wall alignment.
9) The fill material shall be clean and free of any pollutants except in trace quantities.
10) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted retaining walls.
11) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
12) The limits of disturbance within the Coastal Wetlands associated with the construction of the authorized
septic system shall be limited to the area necessary to trench the septic lines through the Coastal
Wetlands, all as depicted on the attached workplans. Regrading of the disturbed area to pre-existing
contours must be completed upon completion of construction. Unless specifically altered herein, any
grading or land disturbance activity located outside this area may require a modification of this permit.
Sedimentation and Erosion Control RECEIVED
13) Appropriate sedimentation and erosion control devices, measures or structures slf BRieliApleMented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

14) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the retaining wall cap immediately following completion of backfilling activities.
Docking Facility
15) This permit authorizes only the pier and platform, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust
waters without permit modification.

16) No portion of the authorized docking facility shall extend more than one quarter of the width of the water
body. Measurements to determine width of the water body shall be made from the normal high water line
or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more
restrictive.
17) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
18) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
19) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
20) This permit authorizes a maximum of I formalized boat slip.
21) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
22) The authorized structure and associated activity shall not cause an unacceptablA1R(MrVEt);vith
navigation and shall not exceed the dimensions shown on the attached permit drawings.

23) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a ttd�a�tyl�v�[hout the
written approval of the Division of Coastal Management.
24) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
25) All debris associated with the removal or construction of the permitted facility shall be contained within
the authorized project area and removed to an appropriate upland location.
26) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 18 and
Regional General Permit 56 (Action ID SAW-2017-00168).

dependent activities are not authorized within 30 feet of the normal high-water level.
