BISER Secretary BRAXTON DAVIS NORTH CAROLINA Environmental Quality Director MEMORANDUM TO: FROM: � THRU: Cameron Luck DCM Major Permit Assistant Coordinator, Morehead City Brendan Brock DCM Field Specialist, Wilming Tara MacPherson DCM District Manager, Wilmin to DATE: March 2, 2022 SUBJECT: Permit Modification Request to State Permit No. 111-21, 1002 North Shore, LLC, 1002 North Shore Drive W., Sunset Beach, in Brunswick County Ben Brink, acting as agent for 1002 North Shore, LLC, is requesting a Minor Modi fication to State Permit No. 111-21. This request was submitted in a letter received February 8, 2022 with one (1) revised drawing, page 2 of 3, dated revised February 8, 2022. State Permit No. 111-21 was originally issued to 1002 North Shore, LLC on August 26, 2021 for the construction of a private docking facility consisting of a gazebo and a floating dock with stops along Blane Creek. A proposed boatlift (Slip #2) was denied by resource agencies due to concerns related to low water depths within a Primary Nursery Area. No work has begun at the site of the permitted docking facility. The Minor Modification request consists of shifting the permitted access pier, gazebo, and floating dock approximately 15' the west. The applicant has proposed to straighten out an existing portion of the access pier to extend due north from the bottom of the existing stairs off the bulkhead. Straightening the permitted access pier would shift the footprint to the west and require adding a 4' x 6' section of access pier, increasing the access pier from 6' x 38' to 6' x 42'. No additional shading of Coastal Wetlands is proposed since the 4' x 6' section would be located entirely over high ground. The permitted gazebo would shift to the west and remain waterward of all Coastal Wetlands. The permitted open platform, gangway, and floating dock would also be shifted to the west. Shifting all permitted structures approximately 15' to the west would encroach approximately 15' into the western riparian setback. A new western riparian setback waiver has been obtained. Water depths in the vicinity of the proposed floating dock relocation remain between 0.0' NLW on the landward edge of the floating dock and -0.9' NLW on the waterward edge of the floating dock. Physical stops would be installed on the floating dock consistent with permit condition #6 of State Permit No. 111-21. The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which include the use standards for piers and docking facilities. This office has no objection to the modification of State Permit No. 111-21, provided it is consistent with all other local, state, and federal regulations. 1002 North Shore, LLC has submitted a check (check No. 72544) in the fee amount of $100. By copy of this memo, DCM is requesting that the USACE, NC DWR, NC DMF and the Sunset Beach LPO provide any comments that your agency may have on the proposed project to Gregg Bodnar of DCM's Morehead City office within 14 days of receipt of this memo.
