Authorizing development in Chowan County at adj. to Edenton Bay, at 510 South Broad
Street, in Edenton , as requested in the permittee’s application dated 11/3/21 (MP-
1) and 10/15/21 (MP-4), including attached workplan drawings (4), Sheets 1-4 of 4 all dated 11/21.
This permit, issued on April 13, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

In-Water Work Moratorium
1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish,
pile driving shall be permitted between February 15 and June 30 of any year without the prior
approval of the Division of Coastal Management, in consultation with appropriate resource agencies.
Docking Facility Rebuild
2) This permit authorizes only the docks, piers, tie pilings and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non-water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.

ADDITIONAL CONDITIONS
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharged at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 10 formalized boat slips.
6) The docking facility shall display a sign showing the location of the nearest pumpout facility, including
other appropriate waste disposal information, at the entrance and exit from the main pier.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2022-00053).

ADDITIONAL CONDITIONS
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4501 and assigned the project DWR Project No. 2000-0701 v2.
NOTE: Future development of the permittee’s property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that an application for a development permit in an AEC
as designated under the CAMA was received on 12/16/21. The Town of Edenton
proposes to replace the existing marina with a 116'x8' pier, a 40'x8' platform, five 32'x2'
finger piers and 15 tie pilings creating 10 boat slips within the existing public marina,
located at 510 S. Broad Street adjacent to Edenton Bay in Chowan County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 01/19/22, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state
& federal agencies. Notice of the permit decision in this matter will be provided upon
written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application
submitted for State approval for development to replace the existing waterfront marina located at
510 South Broad Street, Edenton in Chowan County.
It was received complete December 16, 2021 and appears to be adequate for processing at this
time. The projected deadline for making a decision is March 1, 2022. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 16, 2021, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point

PROJECT SUMMARY:
The applicant proposes to replace the existing marine with a 116 foot by 8 foot pier with a 40
foot by 8 foot platform, five 32 foot by 2 foot finger piers and 15 tie pilings creating 10 boat slips
within the existing public marina.
Proiect Settin
The property proposed for development is located at 510 S. Broad Street in Chowan
County and consists of approximately 4.83 acres adjacent to Edenton Bay. The property
currently contains a marina, playground, parking area, lighthouse, sidewalk, breakwater pier
and county buildings. The properties to the north and south are both commercial properties.
Vegetation on the site includes, but is not limited to, indigenous yard grass and deciduous
trees. Soil Types include Urban Land (UR). The property has an elevation of approximately 6
feet above normal water level (NWL) along the shoreline.
The shoreline is 1,072 feet in length and currently is bulkheaded along the entire shoreline.
The water classification for this area is Aquatic Life, Secondary Recreation, Freshwater (C) and
Nutrient Sensitive Waters (NSW) are estuarine waters that are closed to shellfishing. The
water depths within the project area range from -5 to -8 feet. When the site visit was
conducted there was no SAV present in the proposed project area.
Development Proposal
The applicant proposes to replace the existing marina within the same foot print as it currently
resides. The applicant proposes a 116 foot by 8 foot pier with five 32 foot by 2 foot finger
piers 3 on the eastern side and 2 on the western side of the pier. The applicant proposes

Anticipated Impacts
The proposed development will result in the continued shading of 1,568 square feet of the
Estuarine Waters and Public Trust Area of Environmental concern. Temporary turbidity will
possibly occur during construction.

The proposed site is located downtown at the Colonial Waterfront Park in Edenton, NC. The
address is 510 South Broad Street.
Construction Narrative
The Town of Edenton currently has a 10-slip boat dock that is used by and open to public. The
current state of the dock is becoming a safety hazard. This boat dock was built approximately 30
years ago and needs to be removed and replaced. We would remove the current dock, finger
piers, and piles in its entirety and replace it with all new construction. The new structure would
be a mirror image of what is currently in place. There would be no change in size, elevation, or
in the number boat slips. No excavation would be required for the new dock. Most of the worked
would be completed off
a crane barge, with a pile driving rig and small floats.
There are many dependent activities that would benefit from the new dock. This dock would
provide a safe public access to the short-term mooring that is in jeopardy due to the current state
of the old dock.
