Eakes, 5451 Ormondsville Rd., Ayden, NC 28513 Authorizing development in Beaufort County at adj. to a man-made canal off the Pamlico River, at 158 Swan Point Dr., in Washington , as requested in the permittee’s application dated 2/14/22 (MP- 1) and 2/11/22 (MP-4), including attached workplan drawings (3), 1-3 of 3 all dated 2/18/22. This permit, issued on May 6, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Boathouse 1) This permit authorizes only the boathouse and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) Bradley B. Eakes Permit No. 45-22 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any new formalized boat slips. The docking facility is authorized for no more than two (2) formalized boat slips. 5) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 6) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2022-00516). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 2021-1179 v2. Bradley B. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal high water level unless specifically exempted by Environmental Management Commission’s (EMC) Tar Pamlico River buffer regulations in place at the time of such development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in AEC's with the Estuarine System, including 15A NCAC 07H. 0207 and .0208, and have found the project to be consistent. It is staffs recommendation that the proposed project is consistent with 07H.0208 (6)(B) which states in part "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet." Mr. Eakes' proposal includes a 487ft2 boathouse that will connect to the adjacent existing 392ft2 boathouse making his total shading impact 879ft2 of his allowable 1,280ftz. Currently the project site is developed with a single family dwelling including a maintained upland grass yard, bulkhead, upland basin, finger pier,l boathouse and 1 uncovered boatlift (GP 79887B). The site is t0.63 acres in size and faces the man-made basin on the southern side of the property. The project site has ±160 linear feet of shoreline along the man-made canal with an approximate elevation of 18" above NWL. The length of the shoreline along the canal is bordered by an existing bulkhead with upland grasses between the bulkhead and the existing single-family dwelling. The water depth in the upland basin is t4' and there were no SAV's present at the time of the field visit by DCM staff. The upstream (west) property is a developed lot with a single family dwelling with upland grasses and various woody shrubs. The downstream (east) property is currently a maintained undeveloped home site with various upland grasses and trees. The upstream is stabilized with a vertical bulkhead and the downstream property has an old dilapidated bulkhead and upland basin. Neither the upstream nor the downstream property has any development waterward of Normal Water Level (NWL). This area of the Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River is classified as coastal fishing waters at this site and the site is not located in a primary nursery area. The property is subject to the Tar -Pamlico Riparian Buffer rules enforced by the N.C. Division of Water Resources. Project description The applicant proposes the installation of a 17'4" by 28' boathouse on the east side of his property over the existing boatlift and finger pier in the upland basin adjacent to an existing boathouse. Once installed the new boathouse will connect with the existing boathouse to create a one roof structure. The boathouse will create shading impacts in Estuarine Waters and the Public Trust Area AEC. Anticipated impacts The addition of the boathouse will result in short-term localized turbidity from the installation of the 2 poles required to support the roofline of the new structure. The proposed boathouse will add an additional 487ftz to the existing 392111 boathouse making the total impact 879ft2 of the allowable 1,280ft2 on Mr. Eakes' lot. The dimension of the boathouse will be 17' 4" x 28'. The boathouse will be used to store and protect boats when they are not being used. I currently have two boats and only one of them is covered by an existing boathouse, while the other is in the weather uncovered. Two additional pilings will have to be washed down to support the structure. All other pilings needed for the project are already existing.
