The work will be performed in accordance with the latest policies and procedures of the State of North Carolina Department of Transportation (State), the Federal Highway Administration (FHWA), and will be in conformance with the NCDOT Project Delivery Network (PDN) as applicable for Low Impact Bridge Replacement Projects (LIBRP). The existing 4-span (1@18'3", 1@17',1@20'1",1@20'S") bridge, built In 1950, requires replacement of due to deterioration of structural elements. The posted weight limits for the bridge are currently 19 Tons and 28 Tons for single vehicles and truck tractors -semitrailers, respectively. The existing bridge is 75.75 ft. long with a clear roadway width of 20 ft. Bridge No.150057 has a sufficiency rating of 45.99 and is categorized as "Functionally Obsolete". Both superstructure and substructure elements show signs of deterioration, and have had priority maintenance repairs performed on the substructure elements. This is a bridge replacement and safety improvement project. The proposed replacement structure is a 1-span (1@90') 33" Box Beam, with 4.0' caps, and an out -to -out deck width of 30'. Staged Construction — Staged construction was not considered because of the availability of an acceptable offsite detour. New Alignment — Given that the alignment for SR 1391 is acceptable, a new alignment was not considered as an alternative. Offsite Detour (Preferred) — Traffic will be detoured offsite during the construction period. The 1.1-mile offsite detour includes Ball Farm Rd. (SR 1391) to Adams Creek Rd. (SR 1392) to NC 101. American alligator USFWS Recommended Survey Window: year-round (only warm days in winter) Biological Conclusion: Not Required In North Carolina, alligators have been recorded in nearly every coastal county, and many inland counties to the fall line. The alligator is found in rivers, streams, canals, lakes, swamps, and coastal marshes. Adult animals are highly tolerant of salt water, but the young are more sensitive, with salinities greater than 5 parts per thousand considered harmful. The American alligator remains on the protected species list due to its similarity in appearance to the Endangered American crocodile. Species listed as threatened due to similarity of appearance do not require Section 7 consultation with the USFWS. Habitat for American alligator is present in Harlowe Canal within the study area. The riparian system may be deep enough in several parts of the study area for the alligator to migrate. None were observed at the time of the field investigation. Black rail USFWS Recommended Survey Window: April - June Biological Conclusion: No Effect The black rail is typically found in saltwater and brackish marshes with dense cover but can also be found in adjacent upland areas. Though the project contains a small saltwater and brackish marsh area, this wetland is not of sufficient size and is too sparsely vegetated to adequately support the life history and ecology of the black rail. Green sea turtle USFWS/NMFS Recommended Survey Window: April - August Biological Conclusion: No Effect Green sea turtles inhabit temperate and tropical oceans and can be found in lagoons, reefs, bays, mangrove swamps, and inlets where marine grasses are present for foraging. Green sea turtles are not known to nest in North Carolina. The subject project does not contain preferred habitat for the species. Additionally, a review of the March 2021 NCNHP database identified no known occurrences of this species within 1.0 mile of the study area. Hawksbill sea turtle USFWS/NMFS Recommended Survey Window: April - August Biological Conclusion: No Effect Hawksbill sea turtles inhabit tropical and subtropical oceans and can be found in coral reefs, rocky outcrops, shoals, mangrove bays, estuaries, and offshore on floating mats of seaweed. Leatherback sea turtle USFWS/NMFS Recommended Survey Window: April - August Biological Conclusion: No Effect Leatherback sea turtles inhabit tropical waters of the Atlantic, Pacific, and Indian oceans. They are typically found offshore in the open ocean; however, in northern waters they have been documented in bays, estuaries and other inland bodies of water. While infrequent, leatherback sea turtle nests have been confirmed in North Carolina. They typically nest on sandy beaches backed with vegetation in proximity to relatively deep waters. The subject project does not contain preferred habitat or potential nesting areas for the species. Should SHPO and MOT determine the effects will be significant or adverse, then additional review time may be required for the two agencies to develop ways to avoid or minimize the effects. In this case the Categorical Exclusion, if issued, could be amended, or revised to reflect the findings and additional NCDOT commitments. The commitments will be agreed upon by the SHPO and NCDOT cultural resources staff and could range from additional cultural resources studies, adjustments to bridge design or staging areas, or the engagement of a qualified archaeologist to monitor construction activities. Although the Area of Potential Effects (APE) was initially defined as the Study Area, preliminary design plans were later utilized to determine the extent of potential impacts to the resource. As a result of the Historic Architecture survey and subsequent Effects Meeting, the Clubfoot and Harowe Creek Canal was determined eligible for the NRHP per Criterion A in the areas of Transportation and Commerce with its period of significance listed as circa 1800-1911, from its initial construction until the designation of Adams Creek as the preferred route for the Intracoastal Waterway. As an archaeological resource, Site 31 CR481 also presents high research potential. Intact archaeological features (articulated brick and mortar) were identified along the canal bank, approximately 300 yards south of the bridge on Ball Farm Road (SR 1391). Additional archaeological resources potentially present along the 3-mile canal include intact cross -sections of the canal prism and walls, locks, bridge crossings or a possible causeway as well as submerged resources in the canal bed and terrestrial resources along its banks. As such, there is a high potential for archaeological resources that would contribute to the significance of the NRHP-eligible canal, including information regarding construction methods and its overall profile. Bridge No. 57 will be replaced with a single span structure, using an off -site detour. Existing piles will be pulled or cut at the mudline. No bents in the water are proposed. No coffer dams will be used during the bridge replacement. The proposed project has very minor impacts mainly resulting from the removal of the existing vertical wall end bents and the addition of rip rap slope protection going from the toe of slope to the proposed 4-foot caps. Such areas were considered disturbed by the construction of Bridge No. 57 in 1950. It is believed that information regarding the canal's construction methods and intact profile would be present in undisturbed areas away from Bridge No. 57. The proposed project represents an in -kind replacement with impacts confined largely to the existing bridge footprint. Although spanning the canal can be considered an impact to the canal, the undertaking is not altering any characteristics that qualify the canal as eligible for the NRHP. The canal prism or bed will not be impacted during the construction of the new bridge nor are any towpaths, locks, or other canal -related resources present within the APE. Therefore, the proposed plans will not adversely impact the canal. Based on the design plans and in keeping with the determination of the Effects Meeting held on February 24, 2022, we currently anticipate No Adverse Effect to Site 31 CR481 as a result of the undertaking regarding archaeology, and per stipulation V.C. Lb of the PA, we are providing your office with this documentation. For the purposes of Section 106 compliance, the United States Army Corps of Engineers (USACE) will serve as the lead Federal agency; however, should no Federal action be necessary, then the project is considered to be in compliance with NCGS 121-12(a). For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. Reclamation measures and implementation shall comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971. d.
