This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian

Subject: CAMA General Permit Application for B-5996 Brunswick Bridge No. 126 Replacement on SR
1300 Ash Little River Road over Cawcaw Swamp WBS number: 48191.1.1
Dear Mr. Lane:
The North Carolina Department of Transportation is proposing to replace Brunswick County
Bridge No. 126 on Ash Little River Road (SR 1300) over Cawcaw Swamp. Existing bridge No.
126 is a 3-span bridge measuring 121 feet in length with a deck width of 29 feet. The replacement
structure will be a 3-span cored slab bridge measuring approximately 130 feet in length providing
a minimum of 30 feet, 10 inches clear roadway width. The bridge will include two 11-foot lanes
and 4-foot 5-inch paved shoulders. The approach roadway will extend approximately 375 feet
from the north end of the bridge and 295 feet from the south end of the bridge. The bridge length is
based on preliminary design information and is set by hydraulic requirements. Top -down bridge
construction methodology will be utilized to minimize impacts. Replacement of the bridge will
require 354 sq. ft. of fill impacts and 410 sq. ft. of mechanized clearing impacts to non -coastal
wetlands. The bridge replacement will require relocation of ATMC line telephone/cable line to be
directionally bored under Cawcaw Swamp. Traffic will be detoured offfsite approximately 8.5
miles during construction.

The proposed project will replace the existing bridge on Ash Little River Road (SR 1300) over Cawcaw Swamp in Brunswick
County. The project will replace the existing reinforced concrete (RC) floor with RC caps and timber piles bridge with a cored
slab bridge at the same location. The project work will consist of grading, widening, drainage improvements, bridge
replacement, and pavement markings. The work will be conducted using standard road construction equipment. Equipment
will be stored and staged on -site in upland areas.Top-down bridge construction methodology will be utilized to minimize
impacts.

The STIP description of the project is to replace Bridge 126 over Cawcaw Swamp on Ash Little River
Road (SR 1300) in Brunswick County.
The existing structure is a 121-foot long reinforced concrete (RC) deck with 1-beams that was
constructed in 1966. The structure includes reinforced concrete caps with timber piles and consists of
three spans: 1 @40 feet, 6 inches, 1 @40 feet 4 inches, and 1 @40 feet 6 inches and has a deck width
of 29 feet.
NCDOT proposes to replace the existing structure with a new 3 span 130-foot cored slab structure that
has a 30-foot, 10-inch clear roadway deck that includes two, 11-foot lanes with 4-foot 5-inch paved
shoulders. Project construction will extend approximately 375 feet from the north end of the bridge
and 295 feet from the south end of the bridge.
B. Description of Need and Purpose:
NCDOT Bridge Management Unit records indicate Bridge No. 126 has a sufficiency rating of 21.51 out
of a possible 100 for a new structure.
Bridge No. 126 has timber elements that are 55 years old and is classified as structurally deficient.
Timber components have a typical life expectancy between 40 to 50 years due to the natural
deterioration rate of wood. Components of both the concrete superstructure and wooden substructure
have experienced an increasing degree of deterioration and are no longer feasible to address through
maintenance activities.
The purpose of this project is to replace the current, structurally deficient bridge with a new structure at
the same location to minimize impacts and costs.

Action subcategories identified in past NCDOT-FHWA CE Programmatic Agreements (see
Appendix D). Pre -approval as a CE does not exempt activities from compliance with other
federal environmental laws.

E. Special Proiect Information:
Replacing the existing structure in place would require the use of an off -site detour, from Ash Little
River Road (SR 1300) to No. 5 School Road (SR 1305) to Pea Landing Road NW (SR 1304) to
Hickman Road (SR 1313) back to Ash Little Road. The length of the proposed off -site detour is 8.5
miles. Brunswick County Schools has indicated that three buses take 24 trips over Bridge 126 each
day. The detour route will increase travel time to and from schools. They have requested that
NCDOT contact them well in advance of closing the road. Brunswick County Emergency
Management System (EMS) has indicated that the proposed detour will have a low impact on their
response time.
Streams and wetlands in the project area are shown in Figure 3 from the Natural Resources Technical
Report (NRTR). Based on slope stake limits plus 25 feet, the proposed project would impact less than
0.1 acre of Wetlands WA and WB. As the facility would cross Cawcaw Swamp with a bridge, no
stream impacts are anticipated. While the US Army Corps of Engineers (USACE) will make the final
determination as to the permit required, at this time it is anticipated that an Individual Permit will not be
required and that the project would qualify as a Nationwide Permit 3 and corresponding Section 401
Water Quality General Certification. The project is not anticipated to have floodplain or floodway
impacts.
In coordination with the Division of Coastal Management (DCM), it has been determined that Cawcaw
Swamp is a CAMA Area of Environmental Concern (AEC), therefore a CAMA Permit will also be
required for the construction of this project. Impacts to the AEC are not anticipated to be substantial.
Estimated Cost: Based on the current design, the following costs are anticipated for this project:

Public Involvement: NCDOT notified area landowners as well as the Brunswick County School and
Emergency Management System. County comments are summarized above. No landowner
comments were received with regards to the project.
Traffic Data: Based on data from NCDOT, average daily traffic on Ash Little Road was
approximately 1,600 vehicles per day in 2015 and is estimated to be 3,200 vehicles per day in 2025.
Approximately 6 percent of the traffic was estimated to be trucks/duals.

and NCDOT for the northern long-eared bat (NLEB) (Myotis septentrionalis) in eastern North
Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and
activities. Although this programmatic covers Divisions 1-8, NLEBs are currently only known in 19
counties, but may potentially occur in 11 additional counties within Divisions 1-8. NCDOT, FHWA, and
USACE have agreed to two conservation measures which will avoid/minimize mortality of NLEBs. These
conservation measures only apply to the 30 current known/potential counties shown on Figure 2 of the
PBO at this time. The programmatic determination for NLEB for the NCDOT program is May Affect,
Likely to Adversely Affect. The PBO will ensure compliance with Section 7 of the Endangered Species
Act for ten years (effective through December 31, 2030) for all NCDOT projects with a federal nexus in
Divisions 1-8, which includes Brunswick County, where B-5996 is located.

Project Description: The project involves the replacement of Bridge No. 126 over Cawcaw Swamp on
SR 1300 (Ash -Little River Rd NW) in Brunswick County, North Carolina. The archaeological Area of
Potential Effects (APE) encompasses all areas of potential ground disturbing activity as depicted on the
attached GIS mapping. It measures approximately 800ft in length (400ft from each bridge end -point) and
150ft in width (75ft from the SR 1300 center -line).
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
Permitting and funding information was reviewed for determining the level of archaeological Input required by
state and federal laws. Based on the submitted "request for cultural resources review" form, the project Is
federally -funded with federal permit interaction. As such, Section 106 of the National Historic Preservation Act will
apply and the Federal Highway Administration (FHwA) will serve as the lead federal agency. Next, construction
design and other data was examined (when applicable) to define the character and extent of potential impacts to
the ground surfaces embracing the project locale.
Once an APE was outlined, a map review and site file search was conducted at the Office of State Archaeology
(OSA) on Friday, February 8, 2019. No NRHP eligible archaeological sites or any other previously documented
archaeological sites are located within or adjacent to the APE.
Examination of National Register of Historic Places (NRHP), State Study Listed (St.), Locally Designated (LD),
Determined Eligible (DE), and Surveyed Site (SS) properties employing resources available on the NCSHPO website
is important in establishing the location of noteworthy historic occupations related to a perspective construction
Impact area. A cross-check of these mapped resources concluded that none of the above properties with possible
contributing archaeological components are situated within or proximal to theAPE.
In addition, historic maps of Brunswick County were appraised to Identify former structure locations, land use
patterns, cemeteries, or other confirmation of historic occupation in the project vicinity. Archaeological/historical
reference materials were inspected as well. In general, the cultural background review established that no
previously recorded archaeological sites, cemeteries, or NRHP listed archaeological sites are located within the
APE. Based on cultural -historical factors, the APE is considered to have a low potential for the documentation of
archaeological resources.
Further, topographic, geologic, flood boundary, and NRCS soil survey maps were referenced to evaluate
pedeological, geomorphological, hydrological, and other environmental determinants that may have resulted in
past occupation at this location. Aerial and on -ground photographs (NCDOT Spatial Data Viewer) and the Google
Street View map application (when amenable) were also examined/utilized for additional assessment of
disturbances, both natural and human induced, which compromise the integrity of archaeological sites.

Description of review activities, results, and conclusions: HPOWeb reviewed on 20 February
2019 and yielded no NR, SL, LD, DE, or SS properties in the Area of Potential Effects (APE).
Brunswick County current GIS mapping, aerial photography, and tax information indicated a
wooded, undeveloped APE with one residential property dating to the 2010s (viewed 20
February 2019). Built in 1966, Bridge No. 126 is not eligible for listing In the National Register
as it is neither aesthetically nor technologically significant. Google Maps "Street View"
confirmed the absence of significant architectural and landscape resources in the APE (viewed
20 February 2019).
No architectural survey is required for the project as currently defined.
Wiry the available information provides a reliable basis for reasonably predicting that there
area: The APE extends 500 feet from either end of the existing bridge (NE -SW) and 200 feet to
either side of the SR 1300 (Ash -Little River Road NW) (SE -NW) to encompass anticipated
construction activities and possible project Impacts. Comprehensive architectural survey of
Brunswick County (2009-2010), as well as other investigations, recorded no properties in the
APE. County GIS/tax materials and other visuals clearly illustrate the absence of significant
architectural and landscape resources. No National Register -listed properties are located within
the APE.
Should any aspect of the design change, please notify
NCDOT Historic Architecture as additional review may be necessary.

1) The Corps of Engineers believes that there may bejurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AID constitutes the applicants acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative orjudicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AID, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation ofjurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following
information:

State project B-5996 involves the replacement of 1 @ 40'6", 1 @ 40'4", 1 @ 40'6" reinforced concrete floor with RC caps and timber piles bridge on SR 1300 (Ash Little River RD)
that conveys Cawcaw Swamp with 2 @ 40'-0", 1 @ 50'-0" 21"Cored Slab bridge.
There are JS and wetlands present within the project. This project includes 0.127 miles roadway improvements of SR 1300. The proposed bridge does not contain deck drains. All
storm water from the bridge and approaches will be collected by storm drainage systems and discharge into Rip -Rap pads at Sta.17+65 LT and Sta.19+60 LT.

Thanks so much for taking a look and providing the comments. Attached is a revised MP-5 and additional cross -sections
that include the proposed bridge and roadway fill. NCDOT authorizes the $800 debit from WBS No. 48192.1.1 to cover
the two GP permit fees from DCM. Please let me know if you need any additional information in order to process this
application.

Hi Sean,
I was able to get to the application today and look it over.
We need authorization to debit the $400 for the bridge and $400 for the utility relocations, so a total
of $800 for the bridge and utility relocation.
On MP-5 form:
- (1)(e)(iv) revise number to indicate vertical clearance under existing bridge
- (1)(k) revise number to indicate vertical clearance under proposed bridge
- (3)(g) complete this section for the roadway work on each end of the bridge
Please provide at least one cross section of the proposed bridge. Typically I like to see more cross
sections of the road, however, since there is only on area with fill extending into wetlands I will
accept the cross section at Sta: 20+00.
I appreciate the follow up. Let me know if you need additional information on anything.
