This permit, issued on July 14, 2022 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Excavation within Drainage Canals
1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
excavation or filling shall be permitted within the North Boundary Canal between February 15 and
June 30 of any year without the prior approval of the Division of Coastal Management, in
consultation with appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -4.9 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
- Iwetlands is not authorized. -
5) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing(s).
6) No excavation shall take place within 5 feet of the bank edge.
7) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall'immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
Dredge Material Disposal
8) No dredge material shall be permanently placed within 30 feet of the normal water line.
9) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
.construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
10) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
11) The permittee and/or their contractor shall take all necessary precautions to ensure that the dredge
material is properly contained during transport to the disposal site, and that all the proper coordination
has taken place with the local or state governments to ensure that any damage to public streets caused by
transport of the dredge material has been addressed.
12) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
Maintenance Excavation
13) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A. statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for dredge material disposal, and the estimated amount of material to be removed.
The location, design and holding capacity of the dredge material disposal site shall be approved
by a representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the pemuttee's signature shown anew on the original plan.

Sedimentation and Erosion Control
14) An Erosion and Sedimentation Control Plan modification may be required for this project. If required,
this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity.
Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 943
Washington Square Mall, Washington, NC 27889.
15) In order to protect water quality, runoff from construction shall not visibly,increase the amount of
suspended sediments in adjacent waters.
16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

17) This permit shall not be assigned, transferred, sold, or otherwise disposed_ of to a third party without the
written approval of the Division of Coastal Management.
18) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
19) The pemuttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2022-00445).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Water Quality
Certification No.004961 and assigned the project DWR Project No. 2022-0510.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $475 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.

Typical projects are running about 100 days and I am waiting on comments from DWR 401. 1 was in
the process of creating the extension notification today since the 75 day date of 5/25 just passed.

HI Gregg; I'm working in the field so it's been a little challenging for me to access the documents you
need. I'll also be out of the office all next week with no internet access so I'm trying to make sure
you have what you need. I'm sending additional documents some of which may be duplicates of
what I sent earlier. For the third offload site (Tomlinson) Ty Fleming had difficulty tracking down the
proper representative for the owner (Brickhouse Heirs) and the waiver form we mailed to the
address on record at the Register of Deeds was incorrect. Ty was able to contact the owner to send a
signed permission letter granting the County to access the property and conduct the project. We
were hoping that would be adequate. I have attached that letter.

I have figured out the Hopkins waiver, which is for the offload site. So please disregard that
question. I do have a few though below...
1. The agent authorization in the application is for the Hopkins to WK Dickson. I do not see an
agent authorization from Tyrrell Co. to WK Dickson.
2. The third offload site (Tomlinson), is there a signed waiver form available? I have the other
two offload sites waivers (Hopkins and GSM Properties).
3. Two riparian notifications for the Town of Columbia.

Good morning Gregg. Hopefully I can clarify how we anticipate the sediment being handled. What
we propose anticipates offloading the sediment from the barges directly into trucks parked on the
timber mats. The mats would extend to the edge of the channel to facilitate the offloading process.
The trucks would then be driven to one of the two upland spoil areas where the sediment would be
placed. We are specifying that the trucks be sealed or lined to prevent the sediment from leaking
out during transport. We would also including language that the contractor must remove the
temporary timber mats and restore the offload areas to their original grades. If there is a concern
regarding the possibility of the sediment being placed on the timber mats, we can include language
clarifying that the sediment cannot be temporarily stored on the timber mats and must be
transferred directly from the barges to trucks (or some type of container). While it's unlikely that a
contractor would opt to move the sediment twice, I'd like to include the use of additional containers
to avoid telling a contractor they have to place the material directly into a truck in case they may
have other methods in mind. I prefer instructing contractors regarding what they cannot do as
opposed to mandating how they will conduct their operations. That's assuming your primary
concern is placing the sediment directly on the mats at any time.

Looking at the project I have a question about the 100x100 temporary matted sites within the
wooded wetlands. We have some language in our rules that do not allow dredge material to be
placed within the 30ft buffer from NWL, even temporarily. Can you give more detail as to how the
material is going to get from the barge to the upland disposal site? For example, will the dredge
material go directly from the barge to a waiting truck on the timber mats, then driven to the upland
disposal site?

Tyrrell County
The County of Tyrrell is proposing to conduct maintenance excavation within three existing man-made
drainage canals. Two Canals are located outside the Town of Columbia jurisdiction and one is located within the
Town limits of Columbia. A scoping meeting was held at the Washington Regional Office on February 26, 2020 for
this project in which many permitting and resource agencies were present. The canal locations are as follows:
SR 1213, (Bridgepath Rd.)
SR 1209, (Soundside Rd.)/AKA Roughton B Canal
N. Road St. in Columbia, North Boundary canal
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in Estuarine Water and Public Trust Area. It is staffs recommendation that the proposed project
appears consistent with 15A NCAC 07H .0208 as described below.
The proposed canal maintenance excavation is consistent with 15A NCAC 07H .0208(b)(1)(F) which states
"Any canal or boat basin shall be excavated no deeper than the depth of the connecting waters". The applicant is not
proposing to excavate the canals any deeper than the connecting waters. The applicant proposes that maintenance
excavation will not extend to the hard bottom of the original canal excavation and all maintenance excavation will
slope from upstream to downstream end, to provide positive water flow and preventing an area of greater water
depth upstream.
Staff recommend the following conditions be included in addition to the standards permit conditions if the project is
permitted.
No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work.
The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is
not authorized.
All excavated materials shall be confined above normal water level and landward of regularly or irregularly flooded
marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or
surrounding waters.
The spoil disposal area must be inspected and approved by a representative of the Division of Coastal Management
prior to the commencement of any excavation activities.

Consistency Determination: The request is consistent with/not in conflict with the Tyrrell
County/Town of Columbia Land Use Plan certified by the CRC
on March 25, 2010.
Overview: The project area consists of three (3) man-made canal sections, three (3) sites along
the canal sections, and two (2) inland properties:
• 3,320 linear feet of the Bridgepath Canal, a 30 to 40 foot wide and 2 foot deep canal
section just east of Bridgepath Road/SR 1213;
• 3,053 linear feet of the Roughton B Canal, a 30 to 40 foot wide and 2 foot deep canal
section north of the intersection of Snell Road and Soundside Road;
• 1,200 linear feet of the North Boundary Canal, a 40 foot wide and 2.5 foot deep canal
section west of N. Road Street;
• a .23 acre portion of property adjacent to Bridgepath Road/SR 1213, south of the

• a .23 acre portion of the property at 3289 Sound Side Road, northwest of the Roughton B
Canal;
• an unmeasured portion of a property located on a boat basin south of the North Boundary
Canal at the terminus of the Godfrey Avenue cul-de-sac;
• a 1.25 acre area located on a larger property owned by Tyrrell County at 832 US Highway
64, and;
• areas totaling 4.31 acres located on a larger property owned by Chris Hopkins at 2455
Sound Side Road.
The Bridgepath Canal and Roughton B Canal are finger canals located off of a larger canal that
connects to the Albemarle Sound and the North Boundary Canal connects to the Scuppernong
River. The North Boundary Canal and adjacent site on Godfrey Avenue are within the Town of
Columbia corporate limits and the property at 832 US 64 is in the Town of Columbia's Extra -
Territorial Jurisdiction (ETJ). The remaining locations are in Tyrrell County.All locations within
the project area are in the AE Floodzone..
Maintenance dredging to a to a depth of approximately -4.9 feet below Normal Water Level (NWL)
of a 3,320 linear foot section of the Bridgepath Canal, a 3,053 linear foot section of the Roughton
B Canal, and a 1,200 linear foot section of the North Boundary Canal; associated disturbance to

The waters of the Albemarle Sound associated with the Bridgepath Canal and Roughton B Canal
are classified as SB and Coastal Waters in this area and are closed to shellfishing. The North
Boundary Canal is classified as SC and Joint Waters in this area and is closed to shellfishing. A
review of Submerged Aquatic Vegetation and potential historic resources or archeological sites
was not provided.
Anticipated Impacts resulting from this project are expected to include: the dredging of 4.68 acres
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the temporary
impact to .46 acre of Section 404 Wetlands, and the coverage of 5.51 acres of Highground outside
of an AEC.
Impacted Section 404 Wetlands appear to be within the Coastal Shoreline AEC.
Basis for Determination:
The Tyrrell County Future Land Use Plan Map identifies the Bridgepath Canal and Roughton B
Canal canals as "Conservation", which includes land and water areas that are environmentally
sensitive, including areas of environmental concem, as indicated on Page 133. The North
Boundary Canal is not identified.

Tyrrell County identifies the canal access sites along the Bridgepath Canal and Roughton B Canal
as "Rural". The Town of Columbia identifies the canal access site at the terminus of Godfrey
Avenue on its Future Land Use Plan Map as "Medium Density Residential'. The spoil retention
site at 2455 Sound Side Road is identified as "Rural" by Tyrrell County and the Town of Columbia
identifies the spoil retention site on its Future Land Use Plan Map at 832 US Highway 64 as
"Mixed Use".

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The applicant is proposing to conduct maintenance excavation within Bridgepath canal,
Roughton B canal, and North Boundary canal. The spoils from the excavation will be placed at
2455 Soundside Road and 832 Highway 64. Approximately 7,563 linear feet (LF) of canals will
be excavated, resulting in roughly 20,000 cubic yards (CY) of fine sediment being removed.
Additionally, approximately 5.5 acres will be disturbed for spoil disposal.
DMF does not have concerns with the Bridgepath and Roughton B canals. However, the North
Boundary canal is connected to waters designated as Anadromous Fish Spawning Area (AFSA)
under joint jurisdiction between DMF and the North Carolina Wildlife Resources Commission
(WRC). Waters designated as AFSA are areas where evidence of spawning of anadromous fish
has been documented by direct observation of spawning, capture of running ripe females, or
indication of eggs or early larvae. It is expected that the proposed work will result in increases in
turbidity, which can be detrimental to these species during spawning period. As such, DMF
recommends that the North Boundary canal maintenance excavation adhere to a 15 February
through 30 June moratorium for all in -water work. This will minimize the likelihood of impacts
to AFSA habitat associated with the proposed work.

SUBJECT: CAMA Dredge/Fill Permit Application for County of Tyrrell, Tyrrell County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildliferesources: The project areas are within Bridgepath,
Roughton B, and North Boundary canals near Columbia, NC. Our:comments are provided in accordance
with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16
U.S.C. 661 et 9eq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as
amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.).
The applicant proposes to conduct maintenance excavation within three existing drainage features within
or near Columbia, NC. Bridgepath and Roughton B canals drain into the Albemarle Sound, are bordered
by wooded wetlands, and are covered with alligator weed. Both canals are approximately 30' to 40' in
width and -2' in depth. North Boundary Canal is located within Columbia and drains into the
Scuppernong River. it is approximately 40' in width and averages -2.5' in depth. It is .bordered by wooded
wetlands and mixed -use uplands. Tyrrell ''County proposes to remove sediment from these systems to
achieve a final project depth of -4.9'. Excavation would occur for' 1,200' within North Boundary Canal,
3,320' in Bridgepath Canal, and 3,053' in Rdughton B Canal. Material would be removed from North
Boundary Canal and placed to dry in an upland area before being transported to an agriculture field.
Material from Bridgepath and RoughtonB Canals will be placed on private upland agriculture fields
between project sites. The US Amiy Corps of Engineers (USAGE) and NC Division of Coastal
Management (NCDCM) staff conducted site visits to determine if wetlands were in the areas of access
and deposition. Bridgepath and RoughtonB canals are classified SB by the Environmental Management

Commission while North Boundary Canal is classified SC by the Environmental Management
Commission.
The NCWRC has reviewed the project description and is familiar with the project area. Staff participated
in a February 26, 2020 NC Department of Environmental Quality (NCDEQ) scoping meeting and have
reviewed previous project proposals. This area of Tyrrell County has numerous drainage features that
have been maintained to some extent. Some of these features provide important aquatic habitat
opportunities, including North Boundary Canal. North Boundary Canal is designated an anadromous fish
spawning area (AFSA) by the NCWRC and NC Division of Marine Fisheries (NCDMF). These
designated systems are important for the spawning and procreation of anadromous species such as
blueback herring, striped bass, and various shad species and should be protected during important
biological times of the year.
Overall, the NCWRC does not object to permit issuance. Bridgepath and Roughton B Canals are
proposed in a manner to minimize impacts to important environmental resources such as wetlands and
can proceed as proposed without additional conditions. The methodology for North Boundary Canal also
takes into consideration the minimization of impacts to adjacent wetlands. However, due to the
designation of the system as AFSA and the important habitat opportunities North Boundary Canal
provides, a February 15 — June 30 in -water work moratorium should be included as a permit condition.

Reference the application of Tyrrell County for a Department of the Army permit to
conduct maintenance excavation within 204,000 sq. ft. of the Bridgepath Canal, Roughton B
Canal, and the North Boundary Canal, adjacent to the Albemarle Sound, near the Town of
Columbia, in Tyrrell County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
C�Z Cwt°! I 5. In order to protect juvenile finfish resources, no excavation or filling activities will be
s(ti�u permitted between the dates of April 1 and September 30 of any year without the prior approval
of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers.

V(30 6. All excavate8 matenals will be confined landward of the mean high water level
elevation contour within adequate dikes or other retaining structures to prevent spillover of
dredged materials into any vegetated wetlands or surrounding waters.
7. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
8. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
fiill compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter I I3A Article 4).
9. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU s or less in trout waters, are not
considered significant.
10. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Amiy Corps of Engineers within 24 hours of the pern ittee's discovery of the violation.

Dear Mr. Fleming:
Attached hereto is a copy of Certification No. WQC004961 issued to the County of Tyrrell, dated June 23,
2022. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of this Water Quality Certification. If
you change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be given a copy
of this Certification and is responsible for complying with all conditions. [35A NCAC 02H .0507(d)(2)).
This Water Quality Certification does not relieve the permittee of the responsibility to obtain all other
required Federal, State, or Local approvals before proceeding with the project, including those required
by, but not limited to, Sediment and Erosion Control, Non -Discharge, Water Supply Watershed, and
Trout Buffer regulations.
This Water Quality Certification neither grants nor affirms any property right, license, or privilege in any
lands or waters, or any right of use in any waters. This Water Quality Certification does not authorize
any person to interfere with the riparian rights, littoral rights, or water use rights of any other person
and does not create any prescriptive right or any right of priority regarding any usage of water. This
Water Quality Certification shall not be interposed as a defense in any action respecting the
determination of riparian or littoral rights or other rights to water use. No consumptive user is deemed
by virtue of this Water Quality Certification to possess any prescriptive or other right of priority with
respect to any other consumptive user.
Upon the presentation of proper credentials, the Division may inspect the property.
This Water Quality Certification shall expire on the same day as the expiration date of the corresponding
Section 404 Permit. The conditions shall remain in effect for the life of the project, regardless of the
expiration date of this Water Quality Certification.

Non-compliance with or violation of the conditions herein set forth may result in revocation of this
Water Quality Certification for the project and may also result in criminal and/or civil penalties.
If you are unable to comply with any of the conditions of this Water Quality Certification you must notify
the Washington Regional Office within 24 hours (or the next business day if a weekend or holiday) from
the time the permittee becomes aware of the circumstances.
The permittee shall report to the Washington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next
business day if a weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.
This approval and its conditions are final and binding unless contested [G.S. 143-215.5]. Please be aware
that impacting waters without first applying for and securing the issuance of a 401 Water Quality
Certification violates Title 15A of the North Carolina Administrative Code (NCAC) 2H .0500. Title 15A
NCAC 2H .0500 requires certifications pursuant to Section 401 of the Clean Water Act whenever
construction or operation of facilities will result in a discharge into navigable waters, including wetlands,
as described in 33 Code of Federal Regulations (CFR) Part 323. It also states any person desiring
issuance of the State certification or coverage under a general certification required by Section 401 of
the Federal Water Pollution Control Act shall file with the Director of the North Carolina Division of
Water Quality. Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a
civil penalty assessment of up to a maximum of $25,000.00 per day for each violation.
This Certification can be contested as provided in Chapter 150E of the North Carolina General Statutes by
filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings (OAH) within sixty (60) calendar days. Requirements for filing a Petition are set forth in Chapter
15OB of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code.

CONDITIONS OF CERTIFICATION [15A NCAC 02H .0507(c)]:
1. Turbidity Standard
The Permittee shall adhere specially to 15A NCAC 02b .0220 Tidal Salt Water Quality for Class SB/SC
Waters; (19) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds
this level due to natural background conditions, the existing turbidity level shall not be increased. [15A

2. Construction Moratoriums and Coordination
If activities must occur during periods of high biological activity (i.e., sea turtle nesting, fish spawning, or
bird nesting), then biological monitoring may be required at the request of other state or federal agencies
and coordinated with these activities.

All moratoriums on construction activities established by the NC Wildlife Resources Commission (WRC),
US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries (DMF), or National Marine Fisheries
Service (NMFS) to less impacts on trout, anadromous fish, larval/post-larval fishes and crustaceans, or
other aquatic species of concern shall be implemented. Exceptions to this condition require written
approval by the resource agency responsible for the given moratorium
3. The permittee shall report to the DWR Washington Regional Office any noncompliance with,
and/or any violation of, stream or wetland standards (15A NCAC 02B .0200], including but not
limited to sediment impacts to streams or wetlands. Information shall be provided orally within
24 hours (or the next business day if a weekend or holiday) from the time the permittee became
aware of the non-compliance circumstances.

Justification: Timely reporting of non-compliance is important in identifying and minimizing
detrimental impacts to water quality and avoiding impacts due to water pollution that precludes
any best use on a short-term or long-term basis.
4. No waste, spoil, solids, or fill of any kind shall occur in wetlands or waters beyond the footprint
of the approved impacts (including temporary impacts).

Justification: Surface water quality standards require that conditions of waters be suitable for all
best uses provided for in state rule (including, at minimum: aquatic life propagation, survival,
and maintenance of biological integrity; wildlife; secondary contact recreation; agriculture); and
that activities must not cause water pollution that precludes any best use on a short-term or
long-term basis.
5. When applicable, all construction activities shall be performed and maintained in full
compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973).
Regardless of applicability of the Sediment and Pollution Control Act, all projects shall
incorporate appropriate Best Management Practices for the control of sediment and erosion so
that no violations of state water quality standards, statutes, or rules occur.
Design, installation, operation, and maintenance of all sediment and erosion control measures
shall be equal to or exceed the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual, or for linear transportation projects, the North
Caroline Department of Transportation Sediment and Erosion Control Manual.
All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites,
including contractor -owned or leased borrow pits associated with the project. Sufficient
materials required for stabilization and/or repair of erosion control measures and stormwater
routing and treatment shall be on site at all times.
For borrow pit sites, the erosion and sediment control measures shall be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Surface Mining Manual. Reclamation measures and implementation shall comply with the

and the Mining Act of 1971.

the waters injurious to public health, secondary recreation, or to aquatic life and wildlife, or

background conditions, the existing turbidity level shall not be increased. As cited in Wetland

odor shall not be present in amounts that may cause adverse impacts on existing wetland uses.
6. Sediment and erosion control measures shall not be installed in wetland or waters except within
the footprint of temporary or permanent impacts otherwise authorized by this Certification. If
placed within authorized impact areas, then placement of such measures shall not be conducted
in a manner that results in dis-equilibrium of any wetlands, streambeds, or streambanks. Any
silt fence installed within wetlands shall be removed from wetlands and the natural grade
restored within two (2) months of the date that DEMLR or locally delegated program has
released the specific area within the project to ensure wetland standards are maintained upon
completion of the project.

Justification: A project that affects waters shall not be permitted unless the existing uses
(including aquatic life propagation and biological integrity), and the water quality to protect
such uses, are protected. Protections are necessary to ensure any remaining surface waters or
wetlands, and any surface waters or wetlands downstream, continue to support existing uses
during and after project completion. The Division must evaluate if the activity has avoided and
minimized impacts to waters, would cause or contribute to a violation of standards, or would
result in secondary or cumulative impacts.
8. If the project is covered by NPDES Construction Stormwater Permit Number NCGO10000 or
NPDES Construction Stormwater Permit Number NCG250000, full compliance with permit
conditions including the erosion & sedimentation control plan, inspections and maintenance,
self -monitoring, record keeping and reporting requirements is required.

cofferdams, and other diversion structures shall be used to minimize excavation in flowing
water.

10. Application of fertilizer to establish planted/seeded vegetation within disturbed riparian areas

minimizes the risk of contact between the fertilizer and surface waters.

11. Any rip -rap used for stream or shoreline stabilization shall be of a size and density to prevent
movement by wave, current action, or stream flows, and shall consist of clean rock or masonry
material free of debris or toxic pollutants. Rip -rap shall not be installed in the streambed except
in specific areas required for velocity control and to ensure structural integrity of bank
stabilization measures.

best uses provided for in state rule, and that activities must not cause water pollution that

12. All mechanized equipment operated near surface waters shall be inspected and maintained
regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or
other toxic materials. Construction shall be staged in order to minimize the exposure of
equipment to surface waters to the maximum extent practicable. Fueling, lubrication, and
general equipment maintenance shall be performed in a manner to prevent, to the maximum
extent practicable, contamination of surface waters by fuels and oils.

13. Heavy equipment working in wetlands shall be placed on mats or other measures shall be taken
to minimize soil disturbance and compaction.

Justification: Wetland standards require maintenance or enhancement of existing uses of
wetlands such that hydrologic conditions necessary to support natural biological and physical
characteristics are protected, • populations of wetland flora and fauna are maintained to protect
biological integrity of the wetland; and materials or substances are not present in amounts that
may cause adverse impact on existing wetland uses.
14. In accordance with 143-215.85(b), the permittee shall report any petroleum spill of 25 gallons or
more; any spill regardless of amount that causes a sheen on surface waters; any petroleum spill
regardless of amount occurring within 100 feet of surface waters; and any petroleum spill less
than 25 gallons that cannot be cleaned up within 24 hours.

Justification: Person(s) owning or having control over oil or othersubstances upon notice of
discharge must immediately notify the Department or any of its agents or employees, of the
nature, location, and time of the discharge and of the measures which are being taken or are
proposed to be taken to contain and remove the discharge. This action is required in order to
contain or divert the substances to prevent entry into the surface waters. Surface water quality
standards require that conditions of waters be suitable for all best uses provided for in state rule
(including, at minimum: aquatic life propagation, survival, and maintenance of biological
integrity; wildlife; secondary contact recreation; agriculture); and that activities must not cause
water pollution that precludes any best use on a short-term or long-term basis.
15. The permittee and their authorized agents shall conduct all activities in a manner consistent
with State water quality standards (including any requirements resulting from compliance with
§303(d) of the Clean Water Act), and any other appropriate requirements of State and Federal
Law.

Tyrrell County
Project Setting
The County of Tyrrell is proposing to conduct maintenance excavation within
three existing man-made drainage canals. Two Canals are located outside the Town of
Columbia jurisdiction and one is located within the Town limits of Columbia. A scoping
meeting was held at the Washington Regional Office on February 26, 2020 for this
project in which many permitting and resource agencies were present. The canal
locations are as follows:
SR 1213, (Bridgepath Rd.)
SR 1209, (Soundside Rd.)/AKA Roughton B Canal
N. Road St. in Columbia, North Boundary canal
The canals located off SR 1213 and SR 1209 are finger canals located off a larger canal
that is connected to the Albemarle Sound immediately west of Country Estates
Subdivision at the dead end of SR 1213. The Albemarle Sound is located approximately
0.5 miles downstream of the finger canal connections. These two canals range 30'- 40' in
width and approximately 2.0' in depth. Each canal is bordered on both sides by wooded
wetlands with a large percentage of the surface area covered with Alligator Weed. These
canals are classified SB waters by the Environmental Management Commission and
Coastal Fishing Waters by the N.C. Division of Marine Fisheries.
The County is also proposing to conduct maintenance excavation within North Boundary
Canal (NBC) located in the Town of Columbia off North Road Street. This canal is
approximately 40' in width and has an average existing depth of -2.5 below Normal
Water Level. The canal is bordered to the north by wooded wetlands and the south by
mixed use uplands including residential, commercial and public infrastructure facilities.
This Canal connects to the Scuppernong River 0.35 miles downstream of the proposed
maintenance excavation. The bottom sediment in these canals consists of fine organic
material from normal surface runoff, years without maintenance and recent storm events.
NBC is classified as SC waters by the Environmental Management Commission at the
project site. NBC is also joint fishing waters as classified by the N.C. Division of Marine
Fisheries and the Wildlife Resources Commission.

Proiect Descrintion
The scope of work is to conduct maintenance excavation oft1,200 linear feet in
NBC, :L3,320 feet in Bridgepath canal and f3,053 ft. in Roughton B canal. The final
project depth for all three canals will be approximately 4.9 ft. below NWL. The
maintenance excavation will not extend to the hard bottom of the original canal
excavation. All maintenance excavation will slope from upstream to downstream end to
provide positive water flow and preventing an area of greater water depth upstream. The
maintenance of all three canals will be accomplished by using bucket to barge
methodology. The applicant is not proposing any development activities along the
shoreline of the canals. The spoil generated at the NBC site will be offloaded on private
property uplands on the south side of the canal and allowed to dry and then transported to
a historically farmed field owned by Tyrrell County located of US Highway 64.
The access/offload area for Bridgepath canal will be located immediately adjacent to SR
1213 and the Roughton B canal access/offload will be located at 3289 Sound Side Road.
Both of these access points are wooded wetlands. The applicant proposes to temporarily
impact a 100 ft. x 100 ft. area at each site by cutting trees, grinding stumps to minimize
soil disturbance and installing temporary timber mats. Once the project is complete the
mats will be removed. The applicant is not proposing any wetland fill at this time.
The spoil area for both Bridgepath and Roughton B canal will be located at 2455 Sound
Side Rd. (SR 1209) which is owned by Chris Hopkins. This location is existing cultivated
agricultural fields and is located between both offload sites.
U.S. Army Corps of Engineers staff and the Division of Coastal Management staff
conducted a joint site visit with Ty Fleming, Tyrrell County Soil & Water, and Mark
Senior, supervising consultant, on 9 February 2022 to review all of the access/offload
sites as well as all of the spoil disposal sites.
Anticipated Impacts
Approximately 7,563 linear feet of drainage canals will be excavated for
maintenance purposes. This maintenance excavation activity will likely produce
temporary turbidity. The project will result in an estimated 20,000 cubic yards of fine
sediment spoil. Approximately 5.5 acres will be disturbed for spoil disposal areas.
Approximately 10,000 square feet of wooded wetlands will be temporarily impacted.

Tyrrell County Maintenance Excavation and Removal of Sediment from Canals Project
Narrative:
Several recent major storm events, including hurricanes Matthew, Florence, and Dorian and Tropical
Storms Hermine and Julia, resulted in the deposition of significant quantities of storm debris and
sediment in the man-made canals in Tyrrell County. This in turn has reduced the flow capacity of the
canals resulting in flooding of roadways and other adjacent land. This proposed canal maintenance
project involves removing accumulated sediments from three selected canals in order to restore their
drainage capacity and reduce the repetitive flooding currently experienced. Design of this project was
initiated in June of 2019 but has been delayed by additional storm damage preventing surveying and
challenges identifying suitable sites for beneficial use of the sediment.
All local records were lost in a fire at the County offices, so official records of when these three canals
were constructed and last maintained is unavailable, therefore it is assumed that they are jurisdictional
waters. However, the canals are straight and there are obvious remnants of past construction and/or
maintenance activities in the form of remnant spoil piles along the Bridgepath and Roughton B Canals.
The area along the N Boundary Canal where spoils were likely places is now developed. Areal imagery
indicates the Canals were constructed prior to 1956. Recent previous work in the canals involved the
clearing of downed trees and snags resulting from past storms to provide continued access to the canals
and to allow the collection of survey data for this project.
This work is in Tyrrell County North Carolina and a portion of the work falls in the jurisdiction of the
Town of Columbia. The project includes excavation and proper disposal of sediment from the three
canals listed below. Tyrrell County is the sponsoring entity and the work is being coordinated through
Ty Fleming with the Tyrrell County Soil and Water Conservation District. Financial assistance for the
design and construction has been provided through a grant from the North Carolina Department of
Agriculture and Consumer Services, Division of Soil & Water Conservation for both woody debris and
accumulated sediment removal.

In order to minimize impacts to the banks of the canals and any adjacent wetlands, the work will be
conducted from within the canals as opposed to from the banks. The work will involve mechanical
excavation from within the canal using excavators mounted on floating barges to remove the sediment,
place it in barges to be transported via the canal to an off-loading area, and then transferred to trucks
which can be sealed or lined to prevent spillage. The material will then be transported via trucks to
upland areas for beneficial use. Two disposal sites are proposed. Sediment from the N Boundary Canal
will be placed on a historically farmed field owned by Tyrrell County located at 832 Hwy 64. Sediment
from the Bridgepath and Roughton B Canals will be placed on several historically farmed fields owned by
Chris Hopkins at 2455 Sound Side Road. The sediment will remain in place until the site flt::7y�

redistributed in the future to adjacent prior -converted farm fields for agricultural purpose a 9022

sediment placement areas will be controlled by a perimeter of silt fence until the sites are stabilized
with vegetation. This fencing will also prevent material from being placed in nearby wetlands and other
jurisdictional waters. NC sediment and erosion control permits will be obtained as disturbed areas will
exceed 1 acre. Temporary wetland impacts of approximately .25 acres are anticipated at the Bridgepath
offload site located at 2455 Sound Side Rd. and at the Roughton B Canal offload site located at 3289
Sound Side Rd. The offload areas are limited to 100' long by 100' wide. Temporary wetland impacts will
be limited to the cutting of trees, the use of stump grinding to minimize soil disturbance, and the use of
temporary timber mats to protect the wetlands and avoid the need for fill. The N Boundary Canal
offload site is located on high ground adjacent to an existing boat yard and no wetlands will be impacted
(see included image).
Surveys of the existing dimensions of the canals along with the depth to sediment and depth to a hard
(parent material) bottom have been conducted to determine original canal depths. Excavation plans,
profiles, and cross sections have been developed to avoid exceeding previous canal dimensions and
depths. Excavation depths have been set to provide for a uniform positive slope from the upstream end
of each canal segment to its downstream end to avoid low "dead spots". In no case will propos
excavation depths exceed the hard bottom. Proposed excavation will be limited to no closer hat 5 feet
from the existing top of bank to protect existing vegetation, wetlands, and to minimize the po ility-of—
the edge of bank sloughing off.
Property owners along both banks of all canals were notified by Certified Mail of the project and given
opportunity to comment. Owners of those properties where access and offload areas will take place and
those upland areas where sediment will be placed have been contacted and provided signed
documentation for right of entry and/or agent authorization forms (see list of Certified Mail receipts and
signed authorizations). Those properties and owners are:

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 11 March 2022. According to the said application submitted by Tyrrell County —
proposes to conduct maintenance excavation within Bridgepath canal, Roughton B canal North
Boundary canal.
A copy of the entire application may be examined or copied at the office of Kelly Spivey,
District Manager, Washington Regional Office, 943 Washington Square Mail, Washington, NC,
during normal business hours. Public comments received by 24 April 2022 will be considered.
Later comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision in
this matter will be provided upon written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of property located Road St, Bridgepath Road Sound Side
Road near the town of Columbia in Tyrrell County, and appears to be adequate for processing
at this time. The projected deadline for making a decision is 251h of May 2022. An additional
75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or
about the 75th day. Kelly Spivey District Manager for the Division of Coastal Management is
responsible for processing your permit and he can be reached at 252-948-3851 or via email
at ke-&vspiveyt@ncdenr.gov if you have any questions.
If this agency does not render a permit decision within 70 days from 11 March 2022, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

This confirms our conversation earlier today and receipt of the three attachments.
We are aware of the planned project to dredge the North Bpundary Canal. The Town of Columbia
supports this project which has been a long-time coming.
Plans to offload the dredge materials at the existing marina will be allowed under the Town of Columbia
Zoning Ordinance, assuming there is approval from the property owner and there is clean-up of the area
upon completion of the project.
This activity is consistent with the Columbia Zoning Ordinance and Land Use Plan.

Good afternoon Mr. White. Per our conversation this morning I'm providing some additional information
regarding the above referenced project. Since a portion of the project appears to be in Columbia's
jurisdiction, we need to demonstrate to CAMA that the project is in compliance with Columbia's zoning
requirements.
I'm attaching some images illustrating the Town's corporate limits (from the County GIS) along with the N
Boundary Canal area we will be working in as well as the spoil location for the material removed. It
appears from the GIS mapping that the spoil area is in County jurisdiction but I wanted to include it just to
make sure.
If you could review these materials and respond with an email confirming that the proposed work is in
compliance with the Town's zoning ordinance that would be greatly appreciated. If you have any

This confirms our conversation earlier today and receipt of the three attachments.
We are aware of the planned project to dredge the North Bpundary Canal. The Town of Columbia
supports this project which has been a long-time coming.
Plans to offload the dredge materials at the existing marina will be allowed under the Town of Columbia
Zoning Ordinance, assuming there is approval from the property owner and there is clean-up of the area
upon completion of the project.
This activity is consistent with the Columbia Zoning Ordinance and Land Use Plan.

Good afternoon Mr. White. Per our conversation this morning I'm providing some additional information
regarding the above referenced project. Since a portion of the project appears to be in Columbia's
jurisdiction, we need to demonstrate to CAMA that the project is in compliance with Columbia's zoning
requirements.
I'm attaching some images illustrating the Town's corporate limits (from the County GIS) along with the N
Boundary Canal area we will be working in as well as the spoil location for the material removed. It
appears from the GIS mapping that the spoil area is in County jurisdiction but I wanted to include it just to
make sure.
If you could review these materials and respond with an email confirming that the proposed work is in
compliance with the Town's zoning ordinance that would be greatly appreciated. If you have any

the designated spoil disposal areas for the maintenance excavation of the Roughton B Canal, the Bridgepath Canal, and the
North Boundary Canal, located near the Town of Columbia, adjacent to the Albemarle Sound, in Tyrrell County, North
Carolina. There are jurisdictional waters and wetlands in the project area but the designated spoil disposal areas do not contain
any wetlands.

Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by
