Covered Pavilion
1) Unless specifically altered herein, this minor modification authorizes only the covered platform, all as
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this dockwalk facility without further permit modification.
No non -water dependent uses of structures shall be conducted on, in or over public trust waters without
permit modification.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2008
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
2) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
3) The roof of the covered platform shall not be designed for second story use.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) This minor modification does not authorize the interference with any existing or proposed Federal
project, and the permittee shall not be entitled to compensation for damage to the authorized structure or
work, or injury that may be caused from existing or future operations undertaken by the United States in
the public interest.
7) This minor modification does not authorize the creation of any formalized boat slips. The addition of
tie -downs, mooring pilings, boat whips, or other formalized moorings shall require further review and a
modification of this permit.
8) , This minor modification shall be attached to the original of Permit No. 112-05, which was issued on
9/6/05 and copies of both documents shall be readily available on site when Division personnel inspect
the project for compliance.
9) All conditions and stipulations of the active permit remain in force under this minor modification, unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff -
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff -colored form), as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time
for assistance. By working in accordance with the permit, you will be helping to protect our vitally important
coastal resources.

Please find enclosed a request from Mr. Steve Edwards acting on behalf of the Town of
Swansboro to renew State Permit #112-05. This permit was originally issued to the Town
of Swansboro on 6/3/05 for a dock walk along the White Oak River in Swansboro. The
permit was issued a minor modification on May 1, 2008 for a covered platform on the
walkway. This is the first renewal request for the permit and the permit expires on
December 31, 2008.
By virtue of Section 15A NCAC 07J .0404, the permittee is allowed a two year extension on this
permit. A check for $100.00 is attached. I recommend the permit be renewed as requested.

for the Town of Swansboro dock walk observation platform project. This project will involve the construction
of an 18' x 18' covered observation platform on the existing dock walk. Mr. Joe Dunnehoo from Oceanside
Engineering was contracted to design the platform and his obligation is complete. Please reference me as
the new contact person for this project and feel free to contact me at any time.
This will be my first project involving CAMA (1 will be receiving support from Richard Banks) and I would like

Good morning Robert and Hugh, Robert thanks for taking the time to talk
to me this morning. As we discussed, the Town of Swansboro is
requesting to modify CAMA Major Permit #112-05 by adding a covered
pavilion to their existing boardwalk. The issue is that the requested
covered pavilion is proposed off of property owned by DOT. Since this
is the case, CAMA just needs someone from DOT to OK this. I have
attached the proposal for you to look over. If either of you are
comfortable giving the OK on this, or can point me in the right
direction, it would certainly be appreciated. If you are OK with the
proposal, simply responding to this email will really be all the "paper
work" we need to issue the modification. Thank you gentlemen and give
me a call if you have any questions.

Re: Minor Modification to Permit #112-05
Please find enclosed a request dated 12/27/07 from Mr. Joe Dunnehoo, authorized
agent for the Town of Swansboro, to modify State Permit #112-05, issued to the Town of
Swansboro for the construction of a walkway. This permit was issued on 9/6/05, and is set to
expire on 12/31/08.
The Town of Swansboro has requested to construct a 22' X 22' covered platform
adjacent to 310 W. Corbett Avenue, Highway 24, Swansboro. The property is owned by the NC
Dept. of Transportation. According to the field report, The Town of Swansboro has a permanent
easement from NCDOT on file at the Register of Deeds office in Onslow County. There are no
areas of the existing dockwalk that are considered platform. Providing the use standards in
NCAC 7H .0208 (b)(6) are met, and the following conditions are adhered to,1 recommend that
the permit be modified as requested.
Conditions:
Piers, docks, decks, platforms and boat houses shall be single story. They may be roofed buy
shall not be designed to allow second story use.

Swansboro, Onslow County, North Carolina. Your modification requests the construction of a
