Ross Jr., Secretary CERTIFIED MAIL RETURN RECEIPT REQUESTED Town of Swansboro C/o Mr. Steve Edwards 502 Church Street Swansboro, NC 28584 Dear Mr. Edwards: November 06, 2008 This correspondence is in reference to the letter received October 29, 2008, submitted by you on behalf of the Town of Swansboro. The letter requests a refinement of development authorized under State Permit #112- 05. This permit was originally issued to the Town of Swansboro on June 03, 2005, and is set to expire on December 31, 2008. The permit authorizes a dock walk along the White Oak River in Swansboro, Ouslow County. The current request is for: 1) Installation of benches and lighting along the permitted walkway; 2) Construction of a 12' x 12' shelter over the existing decking at the entrance to the dock walk; 3) Installation of 2 picnic shelters; 4) Installation of a fence; 5) Landscaping as depicted on plats. The proposed development modifications are depicted on the plats received October 29, 2008. I agree with Jonathan Howell, Coastal Management Representative, that the proposed development is consistent with the general and specific use standards found in 15A NCAC 07H .0209, and is in keeping with the original intent of the permit. Please consider State Permit #112-05 refined by way of this letter to include the above described development changes. Note that this refinement must be attached to the original permit for Division inspection, and all other conditions of the original permit still apply. The permit authorized the construction of an elevated dock walk. The request is to add benches and lighting along the existing walkway, cover an existing platform, and install a (2) picnic shelters and a fence on highground outside the 75' AEC. The applicant is also proposing landscaping outside of the AEC in association with the permitted dock walk. State Permit #112-05 was issued on 9/6/05 and is set to expire on 12/31/08. The proposed work is consistent with 15A NCAC 71-1.0208 and 15A NCAC 7H .0209. I recommend the project be authorized under a Letter of Refinement.
