(See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or C., ontinuance as the case may be. „`This permit must be accessible on -site to Department "personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on .. Signature of Pemmittee Town• of Swansboro i ADDITIONAL CONDITIONS Upland Development Permit #112-05 Page 2 of 3 Unless specifically altered herein, this minor modification authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the sidewalk, trellis and landscaping, all as expressly and specifically set forth in the attached workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this.permit. Contact a Division of Coastal Management representative at (252) 808-2808 for this determination. Sedimentation and Erosion Control In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Kayak Launch Unless specifically altered herein, this minor modification authorizes the kayak launch and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this kayak launch without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 8y" No attempt shall be made by the permittee to prevent the full and free use .by the public of all navigable waters at or adjacent to the authorized work. 9j The permittee shall maintain the authorized work in good condition and in conformance with the terms :-and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. U) • .. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. Skvarla, III Secretary 1/30/14 Please find enclosed a request from Coastal Planning Services, hic. on behalf of the Town of Swansboro to modify State Permit #112-05. The original permit was issued on 9/6/05 to the Town of Swansboro for the construction of a dockwalk adjacent to the White Oak River in Swansboro. This permit is set to expire on 12/31/14 due to the permit extension act. The current modification request is to construct a kayak launch and make improvements to Bicentennial Park in Swansboro. The kayak launch will consist of a 4'X30' gangway extending off the existing bulkhead. Placed on the waterward end of the gangway will be a 10'XIT floating platform and a 4.58'X24.75' double kayak ramp. A 6'X45.5' wooden boardwalk running along the bulkhead cap will connect the kayak facility to the existing boardwalk. The kayak.facility will be connected to the parking lot by a 6'X54' concrete sidewalk. A large expanse of impervious gravel will be removed during this process resulting in impervious coverage being reduced from 44% to 42%. Various landscaping along with a 8'X72' open air trellis will be incorporated into the project. A check in the amount of $100.00 was submitted for processing. The Proposal appears to be consistent with the use standards found in 15A NCAC 07H .0208 and .0209. I recommend that this minor modification be issued contingent upon all general and specific conditions placed on the original permit. Vinson, AICP ti�oa ti Ner Enclosures ClUaDa I Town of Swansboro Bicentennial Park Improvements Major Permit 112-05 Modification Request Introduction Major CAMA permit 112-05 was issued to the Town of Swansboro on September 6, 2005. The expiration of this permit has been extended until December 31, 2014, in accordance with Session Law 2009-406, as amended by Session Law 2010-177. The permit authorizes construction of Phase I of the Town's Dock Walk project along the White Oak River. This phase has been built, and consists of t 615 linear feet of public boardwalk beginning at Riverview Park (located off NC Highway 24 between Main and Elm Streets). A minor modification to the permit was approved in May 2008 to construct a covered platform as part of Phase I. Plans for future development at the time of permit issuance included extension of the boardwalk along the shoreline to Bicentennial Park. The Town of Swansboro is requesting a minor modification to permit 112-05 to construct improvements at Bicentennial Park. These improvements include an extension of the existing boardwalk, installation of a kayak launch with floating dock and gangway, addition of a sidewalk connecting the existing parking area to the kayak launch, installation of an open trellis, and landscaping. Repaving of the existing parking area (end of Front Street) was recently accomplished as repair and maintenance. Existing Conditions Bicentennial Park is located in downtown Swansboro on NC Highway 24 (Corbett Avenue) at the White Oak River Bridge. Although the park is located on both sides of the bridge, the project area is limited to the park area north of Highway 24 and the adjacent end of Front Street, measured from the intersection with Highway 24. Existing improvements include a fishing pier with shelter, picnic facilities, brick walkways, bulkhead, a section of boardwalk along the shoreline, benches, historical markers, restroom facilities, parking area, and a connecting walkway beneath Highway 24. Proposed Improvements Z Town of Swansboro is requesting authorization to construct several improvements to the park. A proposed wooden boardwalk extension will measure 6' x 45.5' and will connect the end of the existing boardwalk to the proposed kayak launch facility, as shown on project plans. Safety railings will be installed on the waterward side of the existing and proposed walkway sections. Town of Swansboro CAMA Permit 112-05 Modification Request January 23, 2014 Page 1 The proposed floating kayak launch facility will consist of a floating aluminum gangway and polyethylene platform and launch. The gangway will measure 4' x 30'. The floating platform will measure 13' x 9.75' with a 24.75' x 4.83' kayak launch. Rails will extend from the launch for approximately 8' on both sides at either end. The facility will include guardrails on the gangway and security curbing on the floating platform. It is designed to meet ADA accessibility requirements. A new sidewalk measuring 6' x 54' (at the center line) will connect the existing parking area to the kayak launch. An existing open-air trellis adjacent the existing restroom will remain, with a new 8' x 72' open- air trellis proposed for location adjacent the existing concrete sidewalk. A grassed picnic area is planned adjacent the opposite side of the existing concrete sidewalk, to be bordered by the new section of boardwalk and new sidewalk. An area of hard -packed gravel adjacent the shoreline was determined by the project engineer to be impervious. The impervious area will be removed and replaced with grass. Large scattered chunks of impervious concrete are found along the Front Street end and coastal marsh line. The chunks of concrete will be removed, possibly by using a backhoe or similar equipment. Areas of new landscaping are located on three sides of the park (adjacent Highway 24, adjacent Front Street, and adjacent the new trellis). Installation of new grass sod is proposed for all remaining pervious areas. An existing wooden bulkhead is located along the shoreline, beginning adjacent the White Oak River Bridge and continuing mid -way of the proposed new sidewalk (see project plans). Repairs to the bulkhead, as needed, are also proposed. Summary The proposed improvements to Bicentennial Park will expand water -based recreational opportunities for residents and visitors to Swansboro. The project is consistent with policies for improving public water access and other recreational opportunities that are contained in several Town of Swansboro plans and policy documents. The Bicentennial Park improvement project will implement policies contained in the Town of Swansboro Land Use Plan, Waterfront Access and Development Plan, Comprehensive Parks and Recreation Plan, and report of the Downtown Renaissance Committee. In addition to implementing locally adopted public access and recreation policies, the proposed improvements will result in a decrease in impervious area at the project site. The square footage of the Coastal Shoreline AEC at the project site (Bicentennial Park and the end of Front Street) measures 19,383 square feet. Existing impervious areas measure 8,468 square feet, or 44% of the AEC area. Disturbed area resulting from the proposed improvements will total no more than 6,000 square feet. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. Town of Swansboro Permit #112-05 Page 3 of 3 ADDITIONAL CONDITIONS General 13) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina.
