Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the demolition and reconstruction within previously existing footprints of a pier, fishing dock and gazebo at Bicentennial Park, all as expressly and specifically set forth in the attached letter and workplan drawing. Any additional land disturbing activities and/or construction may require a modification of this permit. 2) This Minor Modification shall be attached to the original Permit No. 112-05, which was issued on 9/6/05, and all subsequent modifications and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 3) All conditions and stipulations of the active permit remain in force under this Minor Modification, unless specifically altered herein. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the qualified persons within twenty (20) days of the issuing date. State Permit #112-05, Town of Swansboro 3/3/16 Please find enclosed a request from Brittany Shipp on behalf of the Town of Swansboro to modify State Permit #112- 05. The original permit was originally issued on 9/6/05 for the construction of a public dockwalk along the White Oak River in Swansboro. This permit is set to expire on 12/31/16. In the current modification request, the Town of Swansboro wishes to reconstruct a fishing pier and gazebo at Bicentennial Park. The proposed pier will be replaced within the footprint of the existing pier. No expansion of the facility will occur. Written notifications from riparian neighbors have been obtained. A check in the amount of $100.00 was submitted for processing. I recommend that this minor modification be issued contingent upon all general and specific conditions placed on the original permit along with proposed conditions from ACOE and DWR. Webb, MMC-NCCMC pwebbAci.swansboro.nc.us Introduction Major CAMA permit 112-05 was issued to the Town of Swansboro on September 6, 2005. The expiration of this permit has been extended until December 31, 2016. The permits originally authorized construction of Phase I of the Town's Dock Walk project along the White Oak River. The permit was modified in 2014 to include several park enhancements and installation of a kayak launch according to the Waterfront Access and Development Plan. Both of the previous mentioned projects have been completed. Existing Conditions Bicentennial Park is located in downtown Swansboro on NC Highway 24 (Corbett Ave.) at the White Oak River Bridge. The park is located on both sides of the bridge, however, the project site is limited to the north side of Highway 24 and adjacent to the end of Front Street. Improvements to the park that have been completed to date include picnic facilities, brick walkways, pedestrian access under the White Oak River Bridge, restrooms, kayak launch, wooden board walk, and historical markers, benches, as well as a rope and railing system along the boardwalk. Proposed Improvements A request to assess several docks in Swansboro was submitted to Stroud Engineering, P.A. in December 2015. Following the assessment, it was determined the fishing access at Bicentennial Park was "not safe for occupancy. " Additionally, it was noted that "repairs to the facility to render it safe would be extensive" and a recommendation was submitted to "demolish and re- build the structure. " The fishing dock is closed at this time with hopes to demolish and close off the opening that would allow fishing to continue by spring. Grant opportunities are being pursed that would assist the Town with re -construction of the fishing dock. The re -constructed dock is expected to be constructed in the same footprint as existing structure. 601 W. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
