This permit, issued on June 8, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the docks, piers, boat lift, platform, and other structures and uses located
in or over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) This permit authorizes a maximum of 2 formalized boat slips.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of
the width of the water body. Measurements to determine width of the water body shall be made from the
normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water
body, whichever is more restrictive.
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the pernttee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
5) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
6) The authorized ten -foot (10') section of pier spanning the navigable shore parallel slough shall provide a
minimum vertical navigational clearance of 6 feet, as measured from the normal -high water level to the
lowest portion of the pier structure. The authorized pier shall provide a minimum horizontal navigational
clearance of 6 feet.
7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) No attempt shall be made by the permitted to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
10) Should either adjacent lot be sold prior to the initiation of construction of the docking facility, the
permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and
authorization to construct the portion of the docking facility within the property owner's riparian setback
and submit it to the Division of Coastal Management prior to initiating construction of the docking
facility.
11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Sedimentation and Erosion Control
12) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.

13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
15) All construction debris associated with the removal or construction of the permitted docking facilities
shall be contained within the authorized project area and disposed of in an approved upland location.
16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any authorizations
required from the U.S. Army Corps of Engineers.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4501 and assigned the project DWR Project No. 20220402.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

The project site is located at 724 Alyssum Avenue adjacent to Piney Point Creek in Caswell Beach, NC.
The property is within the Arboretum neighborhood and totals approximately .05 acres. The shoreline for the
property running along the meandering high water line is approximately 180 ft. According to the applicant, the
average elevation of the entire tract is approximately 15' above Normal High Water (NHW). A single-family residence
occupies the lot owned by Ms. Crystal Wise. Highground vegetation on site consists primarily of lawn grasses,
ornamental shrubs, pines, and cedar trees. The wetland boundary begins near the southern property line and
extends in an easterly direction over the entire shoreline. Vegetation is composed primarily of Black Needlemsh
(Juncus roemertanus), Salt Meadow Hay (Spartina patens) and Salt Marsh Cordgrass (Spartine altemiflora). and
measures approximately 50' in width. Salt Marsh Cordgrass grows from the high water line and extends
approximately 250' to the north towards Piney Point Creek. A shallow slough, runs from the marsh and connects with
Piney Point Creek to the north. Another large expanse of Salt Marsh Cordgrass, measuring approximately 275' in
width, then extends north between the slough and the main channel of Piney Point Creek.
The Brunswick County Land Use Plan classifies the adjacent waters as Conservation. The waters of Piney Point
Creek are classified SA by the Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by
the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to construct a private two slip docking facility. A pier, measuring 680' in length by 6' in width,
is proposed originating from the property over coastal wetlands running parallel to the shallow slough and extending to
the main channel of Piney Point Creek. The pier is proposed to cross the open water slough and would span a 10 ft.
section, which would be elevated to a height of 6' above Mean High Water (MHW) (see Sheets 3 and 6 of 6). The pier
to the east is also elevated over the slough to allow for canoe and kayak access within the navigable area. The pier
would lead to a 10' in length by 16' in width fixed T-head located at the waterward edge of marsh. A ramp would lead
from the end of the pier at the T-head onto a 10' in length by 16' in floating dock aligned parallel to the channel. A
10' long by 3'wide finger pier would extend watelward from the western end of the fixed "T' head to a boatlift measuring
12.5' long by 12.5' wide located in water depths between -2 ft. and — 5 ft. at MLW (NAVD 88) (see Sheets 2-5 of 6).
10. ANTICIPATED IMPACTS:
The docking facility would incorporate approximately 3,848 sq. ft. of Estuarine Waters and Pubic Trust Area and
would shade approximately 1,650 square feet of coastal wetlands. The dock, as proposed, would encroach into both
adjacent 15' Riparian Corridor Setbacks. Waivers have been obtained from both adjacent riparian property owners
and is provided with the application package. The proposed docking facility would extend approximately 35' into
Piney Point Creek, which measures approximately 144' across in this area, thus conforming to the Y. width rule. It
does not appear to encroach into the channel and does not exceed the established pier line. The pier would be
elevated allowing navigation within the slough adjacent to Piney Point Creek. Minor increases in turbidity should be
expected during construction.

3.1 Section 6. a. Project Narrative
3.1.1 Project Location and Existing Conditions
The project is adjacent to Piney Point Creek at 724 Alyssum Avenue on Caswell Beach, Brunswick County. There
is a single-family residence currently located on the property. There are piers or docking facilities currently
located on the property. Water depths, Mean High Water, and Mean Low Water was located by ESP Associates,
Inc. on November 12, 2021. DCM Staff confirmed riparian lines and mean high / mean low water in February
2022. DRG Staff performed a preliminary coastal wetland delineation in February 2022. See Appendix B for
details. Waters in the project area are classified as SA HC W and are open to shellfishing. The area is a primary
nursery area.
3.1.2 Proposed Action
The applicant proposes installation of a fixed pier, fixed platform with access ramp, fixed lift access, boatlift, and
floating platform. The proposed fixed access pier will measure 6' wide x -680' long with an upland landing 10'
above the existing coastal wetland line. A 10' section of the fixed pier will be elevated at least 6' above Normal
High Water over the slough center line as indicated on the Figures. The fixed platform will measure 16' wide x
10' long with a 3' wide x 10' fixed lift access and access ramp. A 12.5'x 12.5' boatlift is proposed. The floating
platform will also measure 16' wide x 10' long. The proposed facility will have a total of one boatlift and one
temporary wet slip tie-up. Length of shoreline at Mean High Water is 260'. There is no upland work proposed
on the property. See Appendix A for details.

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for the Crystal
Wise, for State approval for development of the subject property located at 724 Alyssum Avenue in Caswell beach,
Brunswick County. It was received as complete on March 8, 2022 and appears to be adequate for processing at this
time. The projected deadline for making a decision is May 22, 2022. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th
day.
If this agency does not render a permit decision within 70 days from March 8, 2022, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

I imported a 2021 Google Earth aerial - still grainy at that scale but the edge of marsh is more defined. Western
water access? At this point our client is the only one that doesn't have water access due to the riparian line

7Thisproject appears to be consistent with the Town of Caswell Beach Land Use Plan.
The applicant proposes to construct a private two -slip docking facility with an elevated
10 ft. section over Piney Point Slough. The project is located at 724 Alyssum Avenue
adjacent to Piney Point Creek in Caswell Beach, Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW, CW and PT.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Caswell Beach Land Use
Plan and offer the following comments.
The general area of the project is classified as residential, while the AECs impacted by
the work are classified as Conservation.
In general, the Town of Caswell Beach allows development in Conservation classified
AECs which is consistent with the State's minimum use standards. The Town of Caswell
Beach Land Use Plan contains some policies, which exceeds the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the Town of Caswell Beach Land Use Plan.

SUBJECT: CAMA Dredge/Fill Permit Application for Crystal Wise, Brunswick County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 724
Alyssum Avenue adjacent to Piney Point Creek in Caswell Beach, NC. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of
1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as
amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act
(FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et
seq.).
The applicant proposes to construct a 680' by 6' pier that leads over coastal wetlands and a shallow
slough to the main channel of Piney Point Creek to create a two -slip docking facility. The end of the pier
would terminate in a 10' by 16' fixed pier that ramps down to a 10' by 16' floating dock aligned with the
creek channel. A 10 by 3' forger pier would extend waterward from the fixed platform to a boat lifl

continue to allow access for small vessels. Piney Point Creek is classified SA by the Environmental
Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine
Fisheries.
The NCWRC has reviewed the permit application and has considered its impacts on environmental
resources. Piney Point Creek is designated a PNA. PNAs are defined as those areas inhabited by the
embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable

physical, chemical or biological factors. As a designated PNA, shallow water habitats and coastal
wetlands provide important rearing areas for this variety of estuarine fishes and invertebrates that need
relatively undisturbed habitats. During construction, the wetlands and open water areas within the project
area will be disturbed. These wetlands provide important water quality functions and habitat opportunities
to PNAs. Therefore, to minimize impacts to this resource, an April I — September 30 in -water moratorium
should be placed on the project. This includes construction in open water and within wetlands or lands
regularly inundated. Matting should be used to minimize the effects of temporary impacts from heavy
equipment during construction.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated March 7, 2022 and received by this office on March 14, 2022. The waters of Piney
Point Creek are classified as SA;HQW by the Division of Water Resources (DWR).
The waters of Piney Point Creek are classified as SA;HQW by the Division of Water Resources (DWR)
and has been determined to be a Primary Nursery Area (PNA) by the Division of Marine Fisheries
(DMF). Please understand that the waters around your project area have been identified as a Nursery
Area and the DWR supports the recommendations of the Division of Marine Fisheries and the Wildlife
Resource Commission regarding in water work moratoriums and any other recommendations to
maintain existing uses in accordance with 15A NCAC 02H .OS06 and 15A NCAC 02H .0507(c) which
state Surface water quality standards require that conditions of waters be suitable for all best uses
provided forin state rule (including, at minimum: aquatic life propagation, survival, and maintenance
of biological integrity; wildlife; secondary contact recreation; agriculture); and that activities must not
cause water pollution that precludes any best use on a short-term or long-term basis.
In accordance with the attached General Certification #4501 (GC 4501), the impacts described in
your application do not require written authorization to utilize GC4501. However, you are required
to follow the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including
(but not limited to erosion and sedimentation control regulations and state stormwater
requirements before you proceed with your project). Also, the approval to proceed with your
proposed impacts to waters a depicted inyour application shall expire upon expiration of the 404
or LAMA Permit.
