This permit, issued on May 27, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina Replacement
1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
portion of the marina development shall take place between February 15 and September 30 of any
year without the prior approval of the Division of Coastal Management, in consultation with
appropriate resource agencies.
2) This permit authorizes only the replacement and the relocation of the docks, piers, and other
structures and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part
of this marina without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharged at the marina shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) This permit authorizes a maximum of 42 formalized boat slips located as shown on the drawing labeled
Sheet 1 of 5. The docking of vessels at any location not shown on the permitted drawings shall be
considered a violation of this permit.
5) The marina shall display a sign showing the location of the nearest pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main piers.
6) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access to the north.
7) Should the adjacent lot owned by the application to the east be sold prior to the initiation of construction
of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving
the minimum setback, and authorization to construct the portion of the docking facility within the
property owner's riparian setback, and submit it to the Division of Coastal Management prior to
initiating construction of the docking facility.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
Shoreline Stabilization - Bulkhead
11) The bulkhead shall extend a maximum of two (2) foot waterward from the waterward edge of the
existing bulkhead at any point along its alignment at the time of construction.
12) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
13) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
14) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.

15) The bulkhead shall be constructed prior to any backfilling activities.

16) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
17) This permit does not authorize any excavation waterward of the approved alignment.
18) The fill material shall be clean and free of any pollutants except in trace quantities.
19) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
20) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
21) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Easement
22) An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management, prior to the construction of any new boat slips or other docking facilities authorized under
this permit.
Sedimentation and Erosion Control
43) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
44) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
45) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backftlling activities.
General
46) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
47) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.

48) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2022-00320).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Water Quality
Certification No. 004717 and assigned the project DWR Project No. 2022-0167.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal high water level unless specifically
exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer
regulations in place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project.

Mr. Steve Trowell has submitted a CAMA Major Permit application on behalf of Mrs. Debbie Minor and
Bath Marina for the demolition and reconstruction of 42 slip stick -built marina and the relocation of two separate
finger piers within their riparian shoreline at 101 Carteret Street in Bath, Beaufort County, North Carolina.
This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in a Public Trust Area. It is staffs recommendation that the proposed project appears consistent with
15A NCAC 07H .0208 as described below.
The location of the Manna meets the requirements found in 15A NCAC 07H .0208(b)(5)(H) which states
that "Marinas shall be designed so that the capability of the waters to be used for navigation or for other public trust
rights in estuarine or public trust waters are not jeopardized while allowing the applicant access to deep waters".
15A NCAC 07H .0208(b)(5)(I) states in part that "Marinas shall be located and constructed so as to avoid adverse
impacts on navigation throughout all federally maintained channels and their boundaries as designated by the US
Army Corps of Engineers". Although there is not a federally maintained navigation channel along this shoreline no
structures will encroach in the setback nor will any new structures exceed the existing pier length. This pier will not
exceed the `/4 width of the creek nor the length of the existing pier.
Siting requirements found in 15A NCAC 07H .0208(b)(5)(A)(iii) state an open water site located outside a
primary nursery area which utilizes piers or docks rather that channels or canals to reach deeper water. Although
this project is not consistent with the above siting requirements this is a replacement of an existing marina facility
and structures. The proposed project is also located directly beside HWW 92 bridge that crosses Bath Creek (CAMA
Major Permit) and is the main thoroughfare into the town of Bath.
Staff recommend the following conditions be included if the project is permitted.
No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina/docking facility. Any sewage discharge at the marina/docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
2. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, may become a permanent part of this marina/docking facility without permit modification. No
non -water dependent uses of structures may be conducted on, in or over public trust waters without permit
modification.
3. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4. The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
5. The permittee shall maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he/she abandons the permitted
activity without having it transferred to a third party.
6. This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8. This permit authorizes a maximum of 42 boat slips. At no time shall more than 42 vessels be moored or
docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
9. Prior to construction of any new boat slips or other docking facilities under this permit, the permittee shall
contact Department of Administration's State Property Office as required under N.C.G.S. 146-12(e) to
determine if any Easements are required.

Beaufort County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 101
Carteret Street adjacent and within Bath Creek in Bath, NC. Our comments are provided in accordance
with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et seq.), the Magnuson -Stevens Fishery:Conservation andManagement Act (FCMA), as
amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.-S.C. 703-712 et seq.).
The applicant proposes, to reconstruct a 35-slip marina within the same location and footprint as, the
existing facility. This includes a 6' by 246' fixed timber pier, eighteen 3' by 30' finger piers, and 37 tie
piles. In addition to the reconstruction, the proposal includes the relocation of two existing finger piers
into the marina's riparian area, the installation of one 12' by 12' boatlift and one 15' by 15' boatlift. This
expands the slip count within the marina to 42 slips. Water depths within the marina range between -5' to
-9' NWL. In addition to the marina construction, the applicant proposes to replace the bulkhead with a
new vertical bulkhead installed2' waterward the existing structure. A concrete gazebo will be demolished
during bulkhead installation and later replaced in the same configuration. Bath Creek is classified SB
NSW by the Environmental Management Commission, is subject to the NC Division of Water Resources'
Tar/Pamlico Buffer Rules, and is designated a primary nursery area (PNA) by the NCWRC.
The NCWRC has reviewed the projectapplicationand does not object to permit issuance within the
designated PNA. PNAs are defined as those areas inhabited by the embryonic, larval oriuvenile.life

factors. As a designated PNA, the shallow water habitats of Bath Creek provide important rearing areas
for this variety of estuarine fishes and invertebrates that need relatively undisturbed conditions during
certain times of the year. Therefore, the NC WRC requests a February 15 — September 30 in -water
moratorium be included as a permit condition.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The proposed work is located at 101 Carteret Street, Bath, within Beaufort County. The applicant
proposes to replace a 246' by 6' fixed timber pier that includes 35 slips, eighteen (18) 3' by 30'
finger piers, and 37 tie pilings. The replacement will be in the same footprint as the existing
structure. The applicant also proposes to relocate two existing finger piers to areas that are within
the riparian area. The applicant also proposes to install 2 boatlifts (one that is 12' by 12 and one
that is 15' by 15'), bringing the total marina slip count to 42. Lastly, the proposal includes
installation of a bulkhead replacement that will be located 2' waterward of the existing bulkhead.
The applicant will also be replacing a gazebo that is located on the site. Water depths in the
project area range from approximately -5' to -9' at the terminal end.
The proposed project is located within waters that have been designated as Primary Nursery Area
(PNA) under jurisdiction of the NC Wildlife Resources Commission (WRC). Areas that are
designated as PNA exhibit the water and habitat needs of various commercially, recreationally,
and environmentally important species of finfish and shellfish. These areas provide nursery,
refuge, and foraging abilities during life history stages that are critical to survival. Therefore, it is
crucial that these areas be protected. Taking into consideration the PNA designation and the
importance of PNA waters, DMF recommends that any permit issued includes a 15 February
through 30 September moratorium on all in -water work in order to protect the resources that
utilize this area.

Attached hereto is a copy of Certification No. WQC004717 issued to Deborah Minor, dated
March 23, 2022. This approval is for the purpose and design described in your CAMA Major
Permit application received by the Division of Water Resources (DWR) on February 2nd,
2022. This certification is associated with the use of Regional General Permit Number 291
once issued to you by the U.S. Army Corps of Engineers. The plans and specifications for
this project are incorporated by reference as part of this Water Quality Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must
be given a copy of this Certification and is responsible for complying with all conditions.

Certification does not authorize any person to interfere with the riparian rights, littoral
rights, or water use rights of any other person and does not create any prescriptive right or
any right of priority regarding any usage of water. This Water Quality Certification shall not
be interposed as a defense in any action respecting the determination of riparian or littoral
rights or other rights to water use. No consumptive user is deemed by virtue of this Water
Quality Certification to possess any prescriptive or other right of priority with respect to
any other consumptive user.
Upon the presentation of proper credentials, the Division may inspect the property.
This Water Quality Certification shall expire on the same day as the expiration date of the
corresponding Section 404 Permit. The conditions shall remain in effect for the life of the
project, regardless of the expiration date of this Water Quality Certification.
Non-compliance with or violation of the conditions herein set forth may result in
revocation of this Water Quality Certification for the project and may also result in criminal
and/or civil penalties.
If you are unable to comply with any of the conditions of this Water Quality Certification
you must notify the Washington Regional Office within 24 hours (or the next business day
if a weekend or holiday) from the time the permittee becomes aware of the circumstances.
The permittee shall report to the Washington Regional Office any noncompliance with,
and/or any violation of, stream or wetland standards [15A NCAC 02B .0200] including but
not limited to sediment impacts to streams or wetlands. Information shall be provided
orally within 24 hours (or the next business day if a weekend or holiday) from the time the
permittee becomes aware of the non-compliance circumstances.
This approval and its conditions are final and binding unless contested [G.S.143-215.5].

CONDITIONS OF CERTIFICATION [15A NCAC 02H .0507(c)]
1. Turbidity Standard
The Permittee shall adhere specially to 15A NCAC 02b .0220 Tidal Saltwater Quality for
Class SC Waters; (19) Turbidity: the turbidity in the receiving water shall not exceed 25
NTU; if turbidity exceeds this level due to natural background conditions, the existing
turbidity level shall not be increased. [15A NCAC 02b .0221]
2. Construction Moratoriums and Coordination
If activities must occur during periods of high biological activity (i.e., sea turtle nesting, fish
spawning, or bird nesting), then biological monitoring may be required at the request of
other state or federal agencies and coordinated with these activities.
All moratoriums on construction activities established by the NC Wildlife Resources
Commission (WRC), US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries
(DMF), or National Marine Fisheries Service (NMFS) to less impacts on trout, anadromous
fish, larval/post-larval fishes and crustaceans, or other aquatic species of concern shall be
implemented. Exceptions to this condition require written approval by the resource agency
responsible for the given moratorium.
3. Dredging shall not cause Shellfish Closures
The effluent water from the dredge spoil should not be released into open shellfish waters.
Shellfish Sanitation and the Division of Water Resources must be notified if this is to occur.
4. No Waste Spoil Solids or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Buffer Authorization Application. All
forestry operations activities shall be performed so that no violations of state water quality
standards, statutes, or rules occur [15A NCAC 02H .0502 and .0502]:
For this project, you have submitted a plan for restoration of the buffer, and that plan
(attached) is herein approved, and has been determined to meet the expectation of "in -
kind" restoration, based on pre -construction site conditions.

7. Deed notifications or similar mechanisms shall be placed on all lots/parcels with
retained jurisdictional wetlands, waters, and state regulated riparian buffers within the
project boundaries in order to assure compliance with NC Water Quality Certification Rules
(15A NCAC 02H .0500), NC Isolated Wetland Rules (15A NCAC 02H .1300), and/or State
Regulated Riparian Buffer Rules (15A NCAC 02B .0200). These mechanisms shall be put in
place at the time of recording of the property or individual parcels, whichever is
appropriate.

Justification: A project that affects waters shall not be permitted unless the existing uses, and
the water quality to protectsuch uses, are protected. In determining that the proposed
activity will comply with state water quality standards (including designated uses, numeric
criteria, narrative criteria and the state's antidegradation policy), the Division must evaluate
if the activity has avoided and minimized impacts to waters, would cause or contribute to a
violation ofstandards or would result in secondary or cumulative impacts.
8. The permittee shall report to the DWR Washington Regional Office any
noncompliance with, and/.or any violation of, stream or wetland standards [15A NCAC
02B .0200], including but not limited to sediment impacts to streams or wetlands.
Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.

Justification: Timely reporting of non-compliance is important in identifying and minimizing
detrimental impacts to water quality and avoiding impacts due to water pollution that
precludes any best use on a short- term or long-term basis.
9. No waste, spoil, solids, or fill of any kind shall occur in wetlands or waters beyond
the footprint of the approved impacts (including temporary impacts).

Justification: Surface water quality standards require that conditions of waters be suitable for
all best uses provided for in state rule (including, at minimum: aquatic life propagation,
survival, and maintenance of biological integrity; wildlife, secondary contact recreation;
agriculture), and activities must not cause water pollution that precludes any best use on a
short-term or long-term basis.
10. - When applicable, all construction activities shall be performed and maintained in
full compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of
1973). Regardless of applicability of the Sediment and Pollution Control Act, all projects
shall incorporate appropriate Best Management Practices for the control of sediment and
erosion so that no violations of state water quality standards, statutes, or rules occur.

Design, installation, operation, and maintenance of all sediment and erosion control
measures shall be equal to or exceed the requirements specified in the most recent version
of the North Carolina Sediment and Erosion Control Manual, or for linear transportation
projects, the North Caroline Department of Transportation Sediment and Erosion Control
Manual.
All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil)
sites, including contractor -owned or leased borrow pits associated with the project.
Sufficient materials required for stabilization and/or repair of erosion control measures
and stormwater routing and treatment shall be always on site.
For borrow pit sites, the erosion and sediment control measures shall be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual. Reclamation measures and implementation shall
comply with the reclamation in accordance with the requirements of the Sedimentation
Pollution Control Act and the Mining Act of 1971.

lubrication, and general equipment maintenance shall be performed in a manner to
prevent, to the maximum extent practicable, contamination of surface waters by fuels and

quality standards require that conditions of waters be suitable for all best uses provided for in
state rule (including, at minimum: aquatic life propagation, survival, and maintenance of
biological integrity; wildlife, secondary contact recreation; agriculture); and activities must
not cause water pollution that precludes any best use on a short-term or long-term basis.
14. The permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with §303(d)of the Clean Water Act), and any other appropriate requirements
of State and Federal Law.

and conditions of this permit in the construction and maintenance of this project and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this Water Quality Certification. A copy of this
Water Quality Certification shall be available at the project site during the construction and
maintenance of this project.

Justification: Those actually performing the work should be aware of the requirements of this
401Water Quality Certification to minimize water quality impacts.
This approval to proceed with your proposed impacts or to conduct impacts to waters as
depicted in your application shall expire upon expiration of the 404 or CAMA Permit. The
conditions in effect on the date of issuance shall remain in effect for the life of the project,

the Bath Marina property located off HWY 99 adjacent Bath Creek in the Town of Bath, Beaufort

Consistency Determination: The request is consistent with/not in conflict with the Town of Bath CAMA
Workbook Land Use Plan certified by the CRC on July 27, 2007.
Overview: The applicant is proposing to demolish and replace an existing 43 slip timber framed marina
with the 35 slip main docking facility that extends 246' waterward replaced in the same footprint and
layout as the existing 35 slip docking area including tie pilings and finger piers. Also proposed is the
relocation of two finger piers into the marina riparian area, remove a covered concrete gazebo install a
new bulkhead and replace the covered gazebo located on her property at 101Carteret Street,
Bath in Beaufort County, North Carolina.
The project site is a heavily developed lot which includes a bath house, gazebo, bulkhead, parking area
and an established marina business that operates at full capacity year around. There is one lot on site
totaling .38 acres or 16,552ft2 in size, has a total shoreline length of±240 linear feet on Bath Creek and is
3.0' in elevation above Normal Water Level (NWL). The lot has been entirely stabilized with a bulkhead
and contains a few ornamental shrubs, upland grasses and various hardwoods on the landward side of
the bulkhead.
AECs involved include Public Trust Areas and Public Trust Shoreline. Bath Creek is classified as SB NSW by
the Environmental Management Commission at the project site. Bath Creek is closed to shellfishing and
designated as an inland primary nursery area. The property is also subject to the Tar -Pamlico Riparian
Buffer rules enforced by the NC Division of Water Resources. The site is located within the Bath Historic
District and at thetime of the field visit by DCM staff no SAV's were present.
Anticipated Impacts: The proposed bulkhead replacement will result in the filling of 480ft2 of creek
bottom and shading impacts of approximately ±4,340ft2 of creek bottom are expected with the
construction of the marina and its associated finger piers. The project will result in the short-term localized
turbidity from the removal and construction of the new marina facilities and bulkhead replacement.

Basis for Determination:
The project site in located in the Town of Bath ETJ and is subject to the Town of Bath CAMA Workbook
Plan. The Plan's Future Land Use Map (FLUM) designates the land as "Moderate Density Residential" and
the water as "Conservation Area".

Reference the application of the Bath Marina for a Department of the Army permit to
install 2 new boat lifts and replace an existing bulkhead, finger piers, tie pilings, and a gazebo,
on property located at 101 Carteret Street, at the Bath Marina, adjacent to Bath Creek, in the
Town of Bath, Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The penmittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
5. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
6. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
7. In order to protect juvenile fmfish resources, no excavation or filling activities will be
permitted between the dates of April 1 and September 30 of any year without the prior approval
of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTUs or less in trout waters, are not
considered significant.
10. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Mr. Steve Trowell has submitted a CAMA Major Permit application on behalf of Mrs. Debbie Minor
and Bath Marina. Included in the application is the proposed demolition and replacement of an existing 43
slip timber framed marina with the 35 slip main docking facility that extends 246' waterward replaced in the
same footprint and layout as the existing 35 slip docking area including tie pilings and finger piers. Also
proposed is the relocation of two finger piers into the marina riparian area, remove a covered concrete
gazebo install a new bulkhead and replace the covered gazebo located on her property at 101 Carteret Street,
Bath in Beaufort County, North Carolina. The project site is a heavily developed lot which includes a bath
house, gazebo, bulkhead, parking area and an established marina business that operates at full capacity year
around. There is one lot on site totaling .38 acres or 16,552ftz in size, has a total shoreline length of f240
linear feet on Bath Creek and is 3.0' in elevation above Normal Water Level (NWL). The lot has been
entirely stabilized with a bulkhead and contains a few ornamental shrubs, upland grasses and various
hardwoods on the landward side of the bulkhead.
The upstream property has a riprapped shoreline and bridge and the downstream property is a
residential property that has stabilized their shoreline with a bulkhead. The upstream property is NCDOT
maintained H W Y 92 right of way and bridge over Bath Creek, the downstream property is a residential home
landward of the bulkhead with no in water development on -site and contains upland grasses and various
hardwood trees.
Bath Creek is classified as SB NSW by the Environmental Management Commission at the project
site. Bath Creek is designated as inland fishing waters by NC Wildlife Resources and the site is located in
an inland primary nursery area. The property is also subject to the Tar -Pamlico Riparian Buffer rules
enforced by the N.C. Division of Water Resources. Water depths at the existing marina range from t5' at the
landward most end to t9' at the terminal end. The site is located within the Bath Historic District and at the
time of the field visit by DCM staff no SAV's were present.
Proiect description
The applicant proposes to construct/replace a 246' x 6' fixed timber pier with 35 slips, eighteen 3'x
30' finger piers and 37 tie pilings in the exact location and footprint of the already existing 35 slip pier
structure. The applicant has proposed to relocate two existing finger piers into the marinas riparian area.
Also included in the proposal is the installation of one 12' x 12' boatlift and one 15'xl5' boatlift to bring the
total marina slip count to 42. In addition, the applicant proposes a bulkhead replacement 2' waterward of the
existing bulkhead, and the removal and replacement of a concrete covered gazebo which will be destroyed
during the bulkhead replacement in the exact same location and footprint. The applicant received the
waiver of the 15' setback and the project has been authorized by The Town of Bath. The entirety of this
project will be located in designated NC Wildlife Resources inland fishing waters and the Public Trust Area.

Anticipated impacts
The proposed bulkhead replacement will result in the filling of 480112 of creek bottom and shading
impacts of approximately t4,340ftz of creek bottom are expected with the construction of the marina and its
associated finger piers. The project will result in the short-term localized turbidity from the removal and
construction of the new marina facilities and bulkhead replacement.

Enclosed is a Major CAMA permit application submitted on behalf of Mrs.Debbie Minor for the
replacement of the existing marina pier and associated slips and mooring structures for the Bath
Marina located off HWY 92 at 101 Carteret Street in the Town of Bath adjacent Bath Creek in
Beaufort County, North Carolina. The existing docks are succumbing to the elements as well as
240 linear feet of wooden bulkhead which will also be replaced. The primary purpose of this work
is to maintain the existing slip infrastructure and maintain current levels of service while making
minor changes in finger pier length and width to provide marina patrons safer access to their vessel
in the existing slips.
The existing main pier system is 246' long and supports access to 35 slips occupied mainly by
sailboats. There will be no increase in the number of slips nor expansion of the marina footprint.
Two existing finger piers that were adjacent the HWY 92 Bridge will be relocated within the
marina riparian area. The three individual finger piers to be constructed off the proposed bulkhead
replacement will provide access to 6 slips bringing the overall slip total to 42. Historically, this
marina has supported as many as 43 slips available for rent. The relocated finger piers will be
within 15' of the riparian line adjacent the Minor residential property for which they have waived
the 15' setback.
The marina has and will continue to enforce a "no live aboard policy" limiting overnight stays to
weekends. There is a marina bathhouse providing bathroom and shower facilities for use by
marina patrons.
Replacement of the bulkhead will necessitate removal of the covered concrete pad (gazebo)
immediately adjacent the bulkhead. The gazebo and associated concrete pad will be replaced
within the existing 24' x 24'footprint. The alignment of the proposed bulkhead will not exceed 2'
seaward of the existing.
A Certificate of Zoning Compliance from the Town of Bath was received on October 27, 2021 for
this project, a copy of which is provided in this application package. Also included are the agent
authorization form, adjacent riparian property notifications, a copy of the deed for the marina
property, applicable application forms, plat work, and a $400 check covering the application fee.
Per the latest guidance from the Division of Water Resources I have submitted the electronic
meeting request on July 17, 2021 for this project in regards to obtaining the 401 Water Quality
Certification and have included the email documentation in this application package. I certi

Coastal Management waiving the setback requirement.

required by N.C.G.S. I I3A-119(b) that an application for a development permit in an Area of

received on 19 January 2022. According to the said application submitted by Bath Marina proposes

Kelly and I have finished reviewing the CAMA Major application submitted for Mrs. Debbie Minor and Bath
Marina. We have found the following changes/additions that will need to be made before we can officially submit
the application to be processed.
