This permit, issued on May 18, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes. set forth below. Docking Facility Expansion 1) This permit authorizes only the finger pier and boat lift, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management,Program. Signature of Permittee David W. Chappel ADDITIONAL CONDITIONS Permit No. 52-22 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes one (1) additional formalized boat slip for a maximum of three (3) formalized boat slips at this docking facility. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access to the east. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed. of to a third party without the written approval of the Division of Coastal Management. 11) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2022-00663). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4497 and assigned the project DWR Project No. 2022-0409. David W. Chappel, located at 5007 Holly Lane., in Morehead City, Carteret County. The authorized project consists of the expansion of an existing docking facility to three slips. The proposed project has been determined to comply with the Rules of the Coastal Resources Commission and as such, a permit has been issued to authorize the development. I have enclosed a copy of the permit modification for reference. If you wish to contest our decision to issue this permit, you may file a request for a Third -Party Appeal pursuant to N.C.G.S. 113A-121.1(b). The Chair of the Coastal Resources Commission will consider the case and determine whether to grant your request to file a Contested Case Hearing in the Office of Administrative Hearings. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days of the disputed permit decision. The site is found by following Highway 70 East into the Morehead City town limits. Continue along Highway 70 through the 4-way lights at the intersection of Highway 24 and Bridges Street Extension for approximately .23 miles and turn right onto Rochelle Drive. Follow Rochelle Drive for .56 miles and turn right onto Holly Lane. Continue on Holly Lane for approximately 300 feet. The property is located on the left. The site is along the north side of Bogue Sound and stabilized with a bulkhead, has an elevation of 4' above NHW and has 92' of shoreline per the applicant. The waters of Bogue Sound adjacent to the project areas are classified as "SA, HQW" by the Division of Water Resources. The waters of Bogue Sound within this area are open to shellfish harvesting and are not PNA. According to the 2008 NC DMF SAV delineations via google earth special data, there is sparse SAV along the landward section of the pier but no SAV within the existing and proposed slip areas. There is no dredging proposed within navigable waters and there are no known historic or archaeological areas of value known within the project sites. 10. Anticipated Impacts: The development would shade 432 sf and incorporate 656 sf of shallow bottom habitat. The proposed slip relocation and third slip addition would not interfere with navigation, would meet the '/4 width rule and not extend into the channel portion of Bogue Sound. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. The waters of Bogue Sound are open to shellfish harvest and are not designated as a Primary Nursery Area. Overview: The project is located at 5007 Holly Lane, Morehead City, Carteret County. The site is along the north side of Bogue Sound. The site is .54 acres (23,609sf) in its entirety and is 4' above NHW. Existing development includes a single-family residence with driveway, bulkhead and existing two slip docking facility. The applicant is proposing to relocate the existing wet -slip and tie pilings that are currently along the west side of the pierto the east side of the pier. They are also proposingto add a third slip with boatlift and two finger piers to the existing two slip docking facility. Areas of Environmental Concern (AEC) in the project area include Trust Areas (PTA). Bogue Sound is classified as SA/HQW, is not a Primary Nursery Area, and is open to shellfishing. According to the 2008 NC DMF SA V delineations via google earth special data, there is sparse SAV along the landward section of the pier but no SAV within the existing and proposed slip areas. There is no dredging proposed within navigable waters. There are no coastal wetlands and no known historic or archaeological areas of value within the project site. Anticipated impacts: The development would shade 432 sf and incorporate 656 sf of shallow bottom habitat. The proposed slip relocation and third slip addition would not interfere with navigation, would meet the Ya width rule and not extend into the channel portion of Bogue Sound. There would be no impacts to wetlands, shellfish or SAV resources. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as "Low Density Residential" and "Conservation/Open Space' (due to the sites location in Coastal Wetlands, Estuarine Waters and Public Trust Area AECs). The major permit supervisor Mr. Jonathan Howell who is also the acting District Manager, has approved the riparian line location shown on the most recent revised drawing that was sent to you via email on May 2, 2022. Typically on shorelines void of existing piers you are correct in that the riparian lines are drawn from the channel 90 degrees to where they intersect normal high water. In the case where the shoreline has existing piers, DCM has the authority to determine riparian lines. In this case we determined this was the best alignment for this shoreline due to all of the existing piers and their current alignments. The proposed riparian line determination as shown on the most recent revised drawing meets the specific and general conditions of the NC Coastal Resources Commission's rules and the Coastal Area Management Act. As far as the distance of their proposed project, they are not asking to extend into Bogue Sound more than what their existing docking facility is currently at, which is approximately 295' to 300' from the existing bulkhead along their shoreline. Their docking facility is approximately 27' landward of your outer boatlift pilings and does not extend beyond the landward side of your existing platform. The proposed development would be a minimum of 15' from the riparian line location that we approved and would be more landward than your outer boatlift area and therefore you should have reasonable egress and ingress still for your boat. The Coastal Resource Commission determined that 15' on either side of the riparian lines (30' total) is a reasonable distance for this type of activity. The application will be taken off hold and will continue through the major permit process. As an objecting party you will be notified when a permit decision has been reached and will be given the opportunity to appeal any permit decision made. In looking over the attached drawing, my question is how is the riparian line drawn between 2 landowners with existing piers that are not parallel, but generally perpendicular to the water channel? The Riparian Line seems to be drawn parallel to Chappel's pier. If drawn from the property line point parallel to my pier, the proposed project appears to violate the 15 ft setback by about 5-7 ft? This intrusion will clearly impact our ability to get a boat safely in to our day dock. A fair drawing would be making the riparian line the average of the directions of my pier and his pier. His pier is slanted toward my pier. This would suggest that his addition should not come out as far as indicated in the sketch. I am surprised that CAMA does not see this. Is there a legal precedent on this situation. If so, please provide. NOTE: I drew a riparian line drawn parallel to my pier and its associated 15 ft setback. This line shows that the proposed boat lift violates the 15 ft setback by about 5-7 ft. I will send a photo of that sketch by separate email. 2. As I requested before, we need a distance limitation on how far he can build out his pier. That distance should be noted on the permit. CAMA should be fair about the determination of the riparian line in cases like this with existing docks. A few feet matters in this case since it affects the safe and rightful use of our pier and day dock, which is directly opposite the proposed boat lift. 3. We object to intrusion into the 15 ft setback of a fairly drawn Riparian Line. I you can't mail me a proper copy of the drawing, can I come by your office to pick one up. I have some issues with his drawing. By my scaling from the drawing he shows the Chappel lot to be 100 ft wide and I believe it is only 92 ft wide. He also appeared to start the riparian line off of my bulkhead, and the property line is about 1.5 to 2 ft east of that. I am not sure he positioned the piers correctly, he shows them to be about 88-90 ft apart, whereas I think it is a few feet less than that. My pier is also not drawn to how it was built, so we need to check on some of these basics since that governs the riparian rights of each owner. The riparian line he drew is not quite parallel to the piers and it is pushed toward my pier. From what I have seen on google earth the riparian line, if drawn perpendicular to the main waterway should slant the other way, more easterly. All this means that I don't believe, without a more professionally developed drawing that the proposed project can be done without affecting my riparian rights and water access. The reason this is important to my family is that we would like to be able to safely get our boat out of the boatlift and a few ft to 10 ft of encroachment is significant.The EW boadift is the one that can lift the new boat that we now have. Further, we also use the day dock, which is on the east side and parallel to our pier. We pull the boat in there to load up. The day dock is also where other visitors dock their boats and we occasionally jet ski from there. Safe access to that area is therefore important to us and we need the riparian offset to be maintained so that one can enter that area at low speeds when wind and/or current must be considered. Clearly, if he builds out too far west, it seems to use that this access will be impaired. Can you give me a call. I'd like to find out how these things are settled. I am simply looking out for my family's rights to water access within the law. Unfortunately in this case a professional drawing with a proper determination of the riparian line (does CAMA do this?) may be needed since a lot depends on that. My son in law sent me a 2004 article, which helped me understand some of the issues (below is an except) and I have assumed the article is still applicable in NC.
