The proposal is for the construction of a bulkhead, 2-slip docking facility with a pier, 1-head platform, finger piers and 2 boat lifts (2 slips). The water depths within the proposed slip areas are an. average of-2' nlw. The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office recommends the project be authorized as proposed on plats dated received 2/4/2022 and 3/3/2022 contingent upon all applicable general conditions and the following standard conditions: The pier, platform, finger and boatlift should not exceed a maximum distance of 242' waterward of NHW and should not exceed a maximum of 30' from the coastal wetland edge/oyster bed due to the water body width of 121' as well as the channel edge location. No more than two slips (with lifts) are authorized. Bulkhead shall be landward of any coastal or jurisdictional wetland areas. Please note that in coastal wetlands "only uses which are permitted by 15A NCAC 7H will be allowed" per plan Policy 2, pg. 94. Overview: The project is located at 1403 Cove Court (Lot 57) off of Oglesby Rd which is part of the existing Mariners Point subdivision. The site is .46 acres (19,994sf) in its entirety and is an average of 2' above NHW. Existing development includes roads, infrastructure, house, and driveway. The site is bordered by Dill Creek to the east and north. The project is for a bulkhead, pier, platform, finger piers and two boatlifts. Areas of Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal Wetlands (CW) and Public Trust Areas (PTA). This section of Dill Creek is classified as SA/HQW, is a Primary Nursery Area, and is closed to shellfishing. There are Coastal Wetlands present along the shore adjacent to Dill Creek. The wetlands contain Smooth Coordgrass (Spartina altemiflora), and Salt Meadow Grass (Spartina patens). There are also expanses of oyster beds within the waters of Dill Creek adjacent to the proposed dock. The water depths in Dill Creek, according to the applicant, reach -2.6' NLW at the waterward end of the proposed structure. Field work confirms -2' nlw. The substrate in this area is thick organic mud. Anticipated impacts: The proposed pier and bulkhead would incorporate 798 ft2 of high ground while shading and incorporating 1,230ft2 of coastal wetlands and oyster beds. A total 498 ft2 of open water of would be shaded and a total of 896 ft2 would be incorporated by the proposed docking facility. Oyster beds containing healthy populations existing along the shoreline would be disturbed during the construction process as well as temporary turbidity during piling placement. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the existing oyster beds. The channel edge is located approximately 40' from the edge of the coastal wetlands/oyster beds. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as "Low Density Residential" and "Conservation/Open Space" (due to the sites location in Coastal Wetlands, Estuarine Waters and Public Trust Area AECs). The following LUP policies may be applicable to this request: 4.2.6 Areas of Environmental Concern Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and development in AECs. Policy 2, pg. 94: Morehead City considers coastal wetland areas to be valuable passive recreation areas. These areas should be protected in their natural state. Only uses which are permitted by 15A NCAC 7H will be allowed. The Division of Water Resources (DWR) has received a copy of your CAMA Major permit dated March 3, 2022 and received by this office on March 22, 2022. The proposed project would consist of the installation of 280 feet of bulkhead placed landward of the coastal wetlands, a two -slip docking facility which includes a 6' by 285' walkway, 12' by 12' L shaped platform, 6' by 20' finger dock, 6' by 14' finger dock and two 13' by 13' boat lifts. In accordance with the attached General Certification #4497 (GC 4497), the impacts described in your application do not require written authorization to utilize GC 4497. The proposed project is located at 1403 Cove Court, Morehead City within Carteret County. The applicant is proposing to install a new docking facility and sea wall. The proposed sea wall will be approximately 280 linear feet (LF). The proposed docking facility includes a 6' by 285' walkway, 12' by 12' "L" platform, 6' by 20' finger dock, 6' by 14' finger dock, and two 13' by 13' boat lifts. Water depths within the slip areas are -2.2' normal low water (NLW). Logging mats will be used for access to support excavator. Crab Point Bay, which includes the project location, is designated as Primary Nursery Area (PNA) and shellfish have been observed in the project area. DMF is concerned with the proposed project, primarily as it relates to impacts to waters designated as PNA and to shellfish. Areas that are designated as PNA provide the (often very specific) habitat requirements needed for post -larval development of a variety of recreationally, commercially, and economically important fmfish and shellfish species. These areas provide nursery, refuge, and foraging grounds for these species during some of the most critical and vulnerable life history stages. As such, protection of these areas is of the utmost importance. Installation of the proposed structure will likely result in increased turbidity during the installation process, as well as during use of the structure. Increases in turbidity have the potential to injure or kill species by clogging gills. The installation of the proposed structures may also result in mortality of shellfish species by direct installation into shellfish beds. DMF has concerns with the proposal and recommends that the following conditions be included in any permit issued. The permit should include a 1 April through 30 September moratorium for all in -water work associated with the project. This includes any aspect of the project that may result in a disturbance to any portion of the water column and/or seafloor. Although no dredging was proposed, the permit should be conditioned on no new dredging (i.e., for maintenance of slip depth) being allowed in the future, as DMF is generally opposed to new dredging in PNA waters. DMF would also recommend that sling -style lifts be used, as these tend to be less impactful to the substrate (i.e., cause less turbidity during use). If sling -style lifts are not incorporated into the project design, DMF recommends that the lifts include stops at 18 inches above the substrate to State of North Carolina I Division of Marine Fisheries 3441 Arendell Street I P.O. The platform and finger piers should also be prevented from being used as slips, such as by ensuring cleats are not installed and including handrails along the outer edges. It was unclear based on the site plans if any part of the proposed project would be located directly over or in shellfish beds. DMF recommends relocation any shellfish that are located where pilings or seawall would be installed. DMF would also recommend that the applicant utilize a living shoreline rather than installing a sea wall. Living shorelines provide shoreline stabilization while continuing to provide three-dimensional habitat, as opposed to the vertical wall associated with the proposed structure. This would also minimize impacts to shellfish along the shoreline, as they would not need to be relocated and would face less impacts associated with increased turbidity. Additionally, living shorelines tend to be less expensive than sea walls, providing some monetary relief to the applicant. Thank you for consideration of our comments and concerns.
