Pursuant to NCGS 113A-119(B), New Hanover County, a locality authorized to issue CAMA
permits in Areas of Environmental Concern, hereby gives NOTICE that on December 13, 2004,

Dear Mr. & Mrs.
After reviewing your application in conjunction with the development standards required by the Coastal
Area Management Act (CAMA) and our locally adopted Land Use Plan and Ordinances, it is my
determination that no permit may be granted for the project you have proposed.
The decision is based on my findings that your request violates NCGS 113A-120(8) which requires that all
applications be denied which are inconsistent with CAMA guidelines. You have applied to construct a single
family residence which is inconsistent with 15A NCAC 7H.0102 (f) which states that: ... while individuals
undertaking "major development" activities [defined in G.S. 113A-1 18(d)(1)] will seek permits directly from
the CRC. G.S. 113A-118(d)(1) states: A " major development" is any development which requires
permission, licensing, approval, certification or authorization in any form from the Environmental
Management Commission, the Department of Environment and Natural Resources, the Department of
Administration, the NC Mining Commission, the NC Pesticides Board, the NC Sedimentation Control Board
or any federal agency or authority. A State Storm Water Permit (SW8 000710) was issued for your lot on
August 18, 2000, which now requires that you obtain a major permit for the proposed project.
Should you wish to appeal my decision to the Coastal Resource Commission or request a variance from that
group, please contact me so I can provide you with the proper forms and any other information you may
require. The Division of Coastal Management in Raleigh must receive appeal notices within twenty (20) days
of the date of this letter in order to be considered.
