Proiect Settin The property proposed for development is located at 415 Goose Nest Lane in Perquimans County and consists of approximately 1.08 acres adjacent to Albemarle Sound. The property currently contains a single family dwelling, two outbuildings, fencing, a driveway and failing bulkhead. The properties to the east and west are both residential lots. Vegetation on the site includes, but is not limited to, indigenous yard grass, ornamental flowers, and shrubs. Soil Types include Roanoke Siit Loam (RO). The property has an elevation of approximately 6 feet above normal water level (NWL) along the shoreline. The shoreline is 150 feet in length and currently is bulkheaded along the entire shoreline. The water classification for this area is Primary Recreation, Salt Water (SB) and are estuarine waters that are closed to shelifishing. The water depths within the project area range from - 3 to -4 feet and submerged aquatic vegetation was not observed in within the project area, but it was outside of the growing season. Development Proposal The applicant proposes to replace 130 feet of an existing 150 foot wooden bulkhead with vinyl an average of 2 feet waterward of the existing bulkhead. The applicant also proposes to include 10 foot return walls on each end of the bulkhead. The applicant also proposes to construct a 20 foot wide by 50 foot long boat ramp with an associated 4 foot by 47 foot courtesy pier. The boat ramp will also include a 25 foot by 15 foot concrete/gravel access drive connecting to it. The applicant also proposes to construct a 47 foot by 6 foot shoreside dock running parallel to the bulkhead connecting the courtesy pier to the main pier to the west of the boat ramp. The applicant also proposes to place a 47 foot by 4 foot boardwalk landward of the shoreside dock. The main pier is proposed to be 134 foot long by 6 foot wide and be elevated 1 foot above the bulkhead with a 14 foot by 4 foot finger pier on the west side of the dock leading to a 12 foot octagonal gazebo, a 25 foot by 16 foot "T" shaped covered end platform with an additional open 8 foot by 15 foot and 5 foot 6 inches by 16 foot lowered platform area to the west side of the covered area and a set of 3 foot by 6 foot steps on the north side of the open platform. The applicant also proposes to install a 12 foot by 12 foot boatlift and 3 mooring pilings for a total slip count of three. Anticipated Impacts The proposed development will result in the excavation of 50 square feet, filling of 260 square feet and the shading of 1,974 square feet of the Estuarine Waters and Public Trust Area of Environmental concern. It will also result in the filling of 11,250 square feet of Estuarine Shorelines AEC. Temporary turbidity will possibly occur during construction. Nov, Project Narrative for Joseph Harper Powell and Brenda Powell Revised January 5, 2022 Location: The applicant's property is located at 415 Goose Nest Lane (SR #1443), Goose Nest Lane Subdivision, Perquimans County. The property is located south of Harvey's Point Testing Facility along the shores of the Albemarle Sound. History and Existing_ Conditions: Goose Nest Lane is a nineteen -lot residential subdivision that was platted in 1978. All lots within the subdivision have bulkheads in varying condition. Twelve of the nineteen lots have piers, with the longest being 150' in length, located two lots west of the applicant's property. A longer —250' pier is located in an adjacent subdivision—2,200' east along the same shoreline. Seven of the nineteen lots in the applicant's subdivision have boat ramps. There are no public ramps along the Albemarle Sound in Perquimans County. The closest public ramp to Goose Nest Lane is 9.4 miles north along the Perquimans River near the Town of Hertford. Lots to the east and west of the applicant's lot are developed with single family dwellings, out building, bulkheads and piers. Located to the north is the Harvey's Point Testing Facility. The nearest pier west of the applicant's is property is —67', and to the east is —73' (measured from the riparian line). The width of the waterbody (Albemarle Sound) varies between 7.5' miles to 9 miles from the shoreline of Goose Nest Lane south to Tyrell County. Located—5,250' southeast of the applicant's property is a Military Danger Zone Restricted Area (MDZRA) associated with the Harvey Point Testing Facility. The applicant's property is developed with a single-family dwelling, multiple out buildings, fencing, associated infrastructure, and a failing bulkhead. Elevations of the property are between 4' and 8' with an average of 6' above normal water level (NWL). Elevation of the existing bulkhead is 4' above NWL. Water depths along the bulkhead average 3' below NWL, water depths 50' waterward of the bulkhead average 3'-6" and at 150' the depth is 4'. Vegetation on the property in limited to domestic gasses, ornamental flowers and shrubs, and Bradford pear trees. The adjacent water bottom is a fine silty sand with no submerged aquatic vegetation. While historically SAVs have been known to inhabit areas adjacent to the applicant's shoreline and late fall and early winter is not a favorable time for submerged aquatic growth, no vegetation has been found within the project area over that past five years. This finding is based on residents that fish and crab the waters adjacent to Goose Nest, myself as a Field Representative working with the Division of Coastal Management in the area, and as a recreational fisher living in Perquimans County and frequenting the area. In addition, the applicants have sustained water depths of 3' and greater within the project area. :_. SAM 4:r-17 0 i 2U22 1 The projects ite is located within the Coastal Waters of the State of North Carolina, are designated as Estuarine Waters, and are classified as "SB" primary recreation/saltwater. There are no known archeological, geological or historical sites associated with the applicant's property. Proposed Development: The Powell's would like to make the following improvements to their property to access the Albemarle Sound: 1) Bulkhead: Replace 130' of a 150' failing wooden bulkhead (with a vinyl bulkhead) an average of 2' waterward of the existing structure with a total height of 5' above normal water level (A 1' increase from the existing bulkhead). Return walls will extend 10' landward at the property lines. A proposed boat ramp will be placed along 20' of the 150' shoreline with 50' return walls extending landward from the new bulkhead alignment. Fill excavated for the boat ramp will be used as back fill and spread and graded along the applicant's shoreline. If additional fill is needed it will be obtained from a commercial provider. Associated fill and grading will be limited to a distance of 75' from the completed project shoreline. 130' x 2' = 260sf Shallow Water Bottom Fill 49 3 2022 150' x 75' = 11,250sf of High Ground Fill/Disturbance 2) Boat Ramp: Construct a 20' wide concrete boat ramp terminating in line with the replacement bulkhead (2' waterward of NWL). Of the 20', 16' will be for the boat ramp and the remaining 4' will facilitate the construction of a low (2' above NWL) 4' wide courtesy pier. Constructing the courtesy pier over concrete will reduce the chances of erosion occurring landward of the pier and provide safe access for the applicant to walk a boat off the trailer and out of the ramp safely. In addition, the construction of the pier at 2' will allow the applicants to embark and disembark at a near even elevation with a pontoon boat deck. Ramp Waterward of NWL: 20' x 2' = 40sf Shallow Bottom Excavation/Fill Ramp Landward of NWL: 20' x 48' = 960sf High Ground Excavation. Total ramp length will be 50' (2' waterward of NWL and 48' landward). An additional 20sf water bottom disturbance is anticipated to install a coffer dam if the concrete ramp is poured in place. Anticipated impacts will be temporary. The boat ramp will be constructed by one of two methods: a. BISER Secretary BRAXTON DAVIS Director MEMORANDUM NORTH CAROLINA Environmental Quality TO: Gregg Bodnar, Assistant Major Permits Coordinator Division of Coastal Management, Morehead City THROUGH: Ron Renaldi, District Manager Q A Northeastern District, Division of Coastal Management FROM: Cynthia Rountree, Field Representative (µ Ct DATE: February 22, 2022 SUBJECT: Joseph & Brenda Powell; 415 Goose Nest Lane Major Permit Recommendations The applicant proposes to replace 130 feet of an existing bulkhead with two 10 foot returns, construct a 20-foot-wide by 150-foot-long boat ramp with 50 foot long bulkhead along the side and a 4 foot by 38 foot courtesy pier, a 47 foot by 6 foot shoreside dock, 47 foot by 4 foot walkway landward of the bulkhead, and a 134 foot by 6 foot pier with a 4 foot by 14 foot finger pier leading to a 12 foot by 12 foot octagonal gazebo, a 25 foot by 16 foot covered platform with an additional lower platform, and 3 mooring pilings. The property is located at 415 Goose Nest Lane, Hertford, Perquimans County adjacent to the Albemarle Sound. The development proposal involves the Estuarine Shoreline (ES), Estuarine Waters (EW), Public Trust Area (PTA), and Public Trust Shorelines (PTS) Areas of Environmental Concern. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H .0208 USE STANDARDS (a) addresses General Use Standards, and subparagraph (1) requires that uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, North Carolina Department of Environmental Quality I Division of Coastal Management xxm+.�.�• n>� Elizabeth City Office 401 South Griffin Street. Consistent: The applicant proposes to construct a bulkhead, boat ramp and piers which are listed as water dependent. (a) (2) (A) requires that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The development is consistent with the intent of this rule. (a) (2) (B) requires that the development shall comply with state and federal water and air quality Consistent: This development will not violate water and air quality. (a)(2)(C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a) (2) (D) requires that the development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. (a) (2) (E) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The development will have minimum adverse effects on life cycles or estuarine resources. (a)(2)(G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. (b) Specific Use Standards (b)(6) Addresses Piers and Docking Facilities. (b)(6)(A) requires that Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: The proposed piers shall not exceed 6 feet in width. (b)(6)(B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Consistent: The proposed docking facility shades a total of 1,170 square feet which is less than the 1,200 square feet allowed for the 150 foot shoreline. (b) (6) (F) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed dock and platforms will not have second story use. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Possible Inconsistency: The proposed pier will be 150 feet in length and there is another pier on this shoreline that is 147 feet in length. (ii) not extending into the channel portion of the water body; and Consistent: The proposed dock will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army North Carolina Department of Environmental Quality MEMORANDUM Division of Coastal Management Page 4 of 5 Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed pier will be 150 foot in length with a 1/a width of the waterbody being 13,200 feet. (b)(6)(I) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed dock will remain outside of the 15 foot setback. (b)(7) Addresses Bulkheads. (b) (7) (A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level. Consistent: The proposed bulkhead will average 2 feet waterward of the existing bulkhead. (b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources. Consistent: The propose bulkhead will not be in a coastal wetland area. (b)(7)(C) requires that bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non upland source, the material so obtained may be contained behind the bulkhead. Consistent: The applicant has indicated that the fill will contain sand from an upland location. (b)(7)(E) requires that where possible, sloping rip rap, gabions, or vegetation shall be used rather than bulkheads. Consistent: The proposed development of a bulkhead is on an already bulkheaded shoreline. North Carolina Department of Environmental Quality Division of Coastal Management MEMORANDUM Page 5 of 5 07H .0209 Coastal Shorelines (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Consistent: The development proposal meets the intent of this rule. (d)(1) requires that all development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development does not weaken or eliminate any natural barriers to erosion. (d)(4) requires that the development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development meets the intent of this rule. (d)(5) requires that the development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. Consistent: The proposed development meets the intent of this rule. (8) requires that established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. Consistent: The proposed development meets the intent of this rule. (10) requires that within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the following: (10)(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section; North Carolina Department of Environmental Quality Division of Coastal Management MEMORANDUM Page 6 of 5 Consistent: The proposed development of a boat ramp is listed in 07Ii.0208(a)(1). Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application, and plans,) recommend a Major Permit be issued to Joseph and Brenda Powell.
