This permit, issued on September 29, 2004, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. PERMIT TO CONSTRUCT A SINGLE FAMILY RESIDENCE, INSTALL SEPTIC SYSTEM, and 4 FOOT WALKWAY AND GRAVEL DRIVEWAY AND RETNETION AREAS. ANY OTHER DEVELOPMENT WILL REQUIRE ADDITIONAL AUTHORIZATIONS THE FOLLOWING CONDTIONS SHALL APPLY! All proposed development and associated construction must be done in accordance with the permitted work plat drawing(s) with conditions that reads as follows: 1. All construction must comply with the NC Building Code and all other Federal, State, and Local regulations, including the National Flood Insurance Program. 2. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit It is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Pursuant to 15 NCAC, Subchapter 7J. 0406 (b), this permit may not be transferred, or otherwise disposed of to a third party, except by the Division Director. 4. Prior to initiating land -disturbing activities, adequate sedimentation/erosion control measures must be employed to prevent the movement of unconsolidated materials. These measures must remain in place until such time as the area is properly stabilized with vegetated cover. 6. All construction shall meet all requirements of chapter.157.060 and Chapter 158.00 located in the Town of Holden Beach Code of Ordinances and any other sections that apply to the construction of the single family residence. 7. All pilings shall have a tip penetration of at least 5.0 feet below mean sea level. 8. All development shall meet chapter 94, 157.060 and all other regulations located in the Towns Code of Ordinances. 9. The approved drawing and stormwater plan is dated 09/20/04 and stamped by Mr. Winkler. 10. The structure must be located entirely off of the frontal dune. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Minor Permit #HB 2004-076 Page Three MANAGEMENT 11. This permit may be renewed for one (1) year is requested before the expiration date. 12. The Brunswick County Health Department requires that no pilings be located within five feet of any portion of the septic system. The retention areas shall be located at least 25 feet from all portions of the septic system. 13. The house is being proposed to be located within a Base Flood of VE with an elevation of 19. 14. All development shall meet all requirements of the Town of Holden Beach Code of Ordinances. 15. The innovative storm water system authorized with this permit must be maintained for the life of the structure addressed. 16. Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure shall be relocked or dismantle within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recover or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. 18. A copy of this permit shall be available onsite for regulatory inspection. 19. No disturbance of the frontal dune shall be allowed. 20. This permit is being issued using a 60 foot setback. Meets the regulation 15A NCAC 07H .0104. This permit action may be appealed by the pernittee or other qualified persons within twenty (20) days of the issuing date. The frontal dune labeling the dune crest, and both landward and oceanward toe of the frontal dune also needs to be shown on the survey. Please have your surveyor to contact me at (910) 842-6488 so that I may meet with him and determine the location of the frontal dune. The retention areas shown on the proposed plan are located within the 60 foot setback and are not allowed. The proposed plan shows a cantilevered section over what appears to be the frontal dune and is not allowed by Town Ordinance. The Zoning Permit application needs to be completed. Information that proves that the lot was platted prior to June 1, 1979 needs to be submitted if you are proposing to use the exception that allows the 60 foot setback to be used instead of the existing 120 foot setback. If using this exception only gravel is allowed to be located under the house and the stormwater plan shows a proposed concrete slab. 15 NCAC 07H .0309(b) Once the corrections have been made on the storm water plan, survey and zoning permit resubmit to town hall and the review process will then continue. INSTALLATION REQUIREMENTS 1. The installer shall be currently registered with this department. 2. A ore -installation conference is to be held on the site prior to beginning any site modification or construction of the proposed structure or the sewage collection, treatment, and disposal system. Attending these conferences shall be representatives of the State of Local Health Department; project engineer or designer; contractor; builder; proposed system operator/installer; and the owner or his authorized agent. 3. The contractor shall be responsible for notification of the engineer and the BCHD for system inspection in stages as required and prior to backfilling any portion of the system. No portion of the system shall be backfilled or placed into use without prior approval of the BCHD. 4. The system shall be installed in accordance with the approved set of plans and specifications. Any deviation in site modifications, plans, specification, layout, materials or other system component shall be approved by the design engineer and the Brunswick County Health Department prior to installation of the system. Failure to do so may result in delay or refusal of final approval of the system, and may render the Permit null and void. 5. The system shall be installed in a timely manner and staged so as to avoid unnecessary exposure to weather. 6. The location and identification of all property lines, easements, water lines, and other appropriate utilities shall be the responsibility of the installer. 7. Other: OPERATION PERMIT REQUIREMENTS 1. An Operation Permit shall be issued by the BCHD prior to placing the system into use, or making any connections to the system. 2.
