as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statues, "Coastal Area Management"
Issued to Ava H. Pailthrop ., authorizing development in Ocean Erodible Area at 216 O.B.E. , as requested in
the permittee's application, submitted 07/20/04 and approved drawings submitted on August 20, 2004.
This permit, issued on August23, 2004, is subject to compliance with the application and site drawing
(where consistent with the permit), all applicable regulations and special conditions and notes set forth
below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may
cause the permit to be null and void.
PERMIT TO CONSTRUCT A SINGLE FAMILY RESIDENCE, GRAVEL DRIVEWAY,
SEPTIC SYSTEM, RETENTION AREAS NOT TO BE LCOATED WITHIN THE 60 FOOT
SETBACK AREA.
ANY OTHER DEVELOPMENT WILL REQUIRE ADDITIONAL AUTHORIZATIONS
THE FOLLOWING CONDTIONS SHALL APPLY!
All proposed development and associated construction must be done in accordance with the
permitted work plat drawing(s) with conditions that reads as follows:
1. All construction must conform to all other local, State and Federal regulations.
2. Any change or changes in the plans for development, construction, or land use activities will
require a re-evaluation andmodification of this permit.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on December 71,
2007
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management,

3. Pursuant to 15 NCAC, Subchapter 7J. 0406 (b), this permit may not be transferred, or otherwise
disposed of to a third party; except by the Division Director.
4. Prior to initiating land -disturbing activities, adequate sedimentation/erosion control measures must
be employed to prevent the movement of unconsolidated materials into the marsh or water. These
measures must remain in place until such time as the area is properly stabilized with vegetated cover.
5. Any structure authorized by this permit shall be relocated or dismantled when it becomes
imminently threatened by changes in shoreline configuration. The structure(s) shall be
relocated or dismantled within two (2) years of the time when it becomes imminently
threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline
recovery or beach renourishment takes place within two (2) years of the time the structure
becomes imminently threatened, so that the structure in no longer imminently threatened, then
it need not be relocated or dismantled at that time. This condition shall not affect the permit
holder's right to seek authorization of temporary protective measures allowed by CRC Rules.
6. All construction shall meet all requirements of chapter.157.060 and Chapter 158.00 located
in the Town of Holden Beach Code of Ordinances and any other sections that apply to the
construction of the single family residence.
7. Section 158.09 (C)(4) states in part that it is the intent of these regulations that stormwater
flow be contained within property lines in question, and not be directed onto adjacent real
estate.
8. All pilings shall be a least five feet below mean sea level.
9.The space below the lowest floor that is located in V Zones must either be free of
obstruction or constructed with non -supporting breakaway materials. Preferred
construction materials are open wood latticework or insect screening. However, solid
breakaway wall panels are allowed.

10. All development shall meet all the requirements of section 157. 060 and 157. 8.
11. This permit may be renewed for one (1) year is requested before the expiration date.
12. The NC Residential Building Code also requires that the garage shall be separated from the
residence and its attic area by not less than % inch gypsum board applied to the garage side
13.The Brunswick County Health Department requires that no pilings be located within five feet of
any portion of the septic system. The retention areas shall be located at least 25 feet from all portions
of the septic system.
14. The lot is located within a Base Flood of VE with an elevation of 18.
15. All development shall meet all requirements of the Town of Holden Beach Code of Ordinances.
16. All development shall meet the approved stormwater plan. The highest point of the finished
structure shall not be higher than 44.4 above mean sea level.
17. The innovative storm water system authorized with this permit must be maintained for the life of
the structure addressed.
18. Applicant qualifies for this exception because the lot was recorded prior to June 1, 1979,
and does not meet the setback of 195 feet from the fast line of stable natural vegetation.
19. This lot was recorded prior to June 1, 1979, and cannot be enlarged by combining it with a
contiguous lot(s) under the same ownership.
20. The development is set back as far landward from the first line of stable natural vegetation as
possible, such that the structure is a minimum of 60' landward of this line, and is entirely behind the
frontal dune. This permit authorized a structure that will be set back 60 feet from the first line of
stable natural vegetation.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on December 31,
2007

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosio rate for the area where your property is located is
feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as _--L-JOeet landward in a major storm.

Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued developmentfor inthis
area expire on December 31 of the third year fllowing the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.

municipality of Town of Holden
Beach, a locality authorized to issue
CAMA permits in the areas of envir-
onmental concern, hereby gives NO-
TICE that on July 22, 2004, applicant
