as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statues, "Coastal Area Management'
Issued to ___Craig Wenger & Elisabeth Olbing-Wenner , authorizing development in Esturine
5hore1in9 ___ at _102 Maryland as requested in the permittee's application, dated August 6.
2004 . This permit, issued on August 19, 2004, is subject to compliance with the application and
site drawing (where consistent with the permit), all applicable regulations and special conditions and notes
set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action,
or may cause the permit to be null and void.
This permit authorizes construction of a deck less than 200 sq feet with three W pilings within the 75 AEC area
(1) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings(s) dated received 8/6/04
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and
Federal regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
(5) Pursuant to NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, or otherwise
disposed of to a third party.
(6) All disturbed areas shall be vegetatively planted and mulched within 30 days of construction
completion.
This permit action may be appealed by the perrnitlee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on December 31,
2007
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.

In 1974, the North Carolina General Assembly passed the Coastal Area
Management Act and set the stage for guiding development in fragile
and productive areas that hwd—he state's sounds and oceanfront. Along
with requiring special care by those who build and develop,. the General
Assembly directed the Coastal Resources Commission (CRC) to imple-
ment clear regulations that minimize the burden on the applicant.

Caxc'na Beach, North Carolina in New Hanover County
Please take notice that I have been assigned to handle the Third Party Hearing Requests
filed by The Martins and The Hubbards C' petitioners") in two separate third party requests.
They both challenge CAMA Minor Permit #CB-2004-35, issued to on August 19, 2004 for
construction on Maryland Road in Carolina Beach, NC. Both Petitions were filed on August 24,
2004, but did not include responses to the three criteria required for a third party appeal petition.
DCM staff contacted petitioners, notified them that the petitions were incomplete. DCM staff
received complete petitions on August 31 st and September 1st respectively. As the first attempts
were not complete, the 15 day time period did not start running until the complete petitions were
received.
A copy of the petitions are attached. The Chairman's decision for the Martin Petition
will be due by Wednesday September 15, 2004. The Chairman's decision for the Hubbard
Petition will be due by Thursday September 16, 2004.

(7) The development authorized under this permit must be accomplished a minimum of 30' landward of
the normal high water contour/normal water contour, maintaining this as a vegetated buffer area.
(� Prior to initiating land -disturbing activities, adequate sedimentation/erosion control measures must be
employed to prevent the movement of unconsolidated materials into the marsh or water. These
measures must remain in place until such time as the area is properly stabilized with vegetated cover.

Pursuant to NCGS 113A-119(b), the Town of Carolina Beach, a locality authorized to issue
CAMA Permits in areas of environmental concern, hereby gives notice that on August 6.2004
Donald Wagner applied for a CAMA Permit to build 200 sq foot of decking within the 75 feet
AEC at: 402 Maryland Ave. Carolina Beach, N.C. The application may be inspected at the
address listed below. Public comments received by August 18, 2004 will be considered. Later
comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision
in this matter will be provided upon written request.

Dear Mr. Wenger:
The Wilmington Regional Office conducted a site meeting with you at the subject property
to determined if the changes you are proposing will require a modification to your 401 Water Quality
Certification No. 020167. You proposed to subdivide the existing single family residential lot into
two single fancily residential lots. This office has no objections to the proposed changes provided
there are no additional impacts to any wetlands on the property. Please note that all of the conditions
in the 401 Certification No. 020167 issued on February 11, 2002 are still in effect including the
following:
1). Any remaining wetlands and waters on the property need to be placed in a deed notification
or similar mechanism to notify the state in order to assure compliance for future wetlands
and/or waters impacts. These mechanisms shall be put in place within 30 days of the date
of this letter or the issuance of the 404 permit (whichever is later). A sample deed
notification can be downloaded from the 401/Wetlands Unit web site at
httn://h2o.enr.state.ne.us/newetIands. Please provide this Office a copy of the recorded
plat.
Please provide this office with the final recorded plat with the required deed notifications on
both lots. If you have any questions concerning this matter, please call me at (910)-395-3900.

You have our approval, in accordance with the attached conditions, to place fill in 0.047 acre of wetlands in order to construct
residence your property in New Hanover County, as described in your application received by the Division of Water Quality on February,
2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 310f
which can be downloaded from our web site at http://h2o.enr.stste.nc.us . This Certification allows yov to use Nationwide Permit Numbr
18 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before yo
go ahead with your project including (but not limited to) Sediment and Erosion Control, Non -Discharge and Water Supply Watershe
regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the Gener,
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you must
notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner
must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed
below:
1. A deed notifications or similar mechanism shall be placed on this property for all remaining jurisdictional wetlands and waters or area
within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the
issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit
web site at hM:ffh2o.enr.state.nc.us/ncwetlands .
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150E of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its condition:
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

A site visit on January 24, 2002 accompanied by a review of your submitted plat received January
7, 2002 for development of a lot at 402 Maryland Avenue in Carolina Beach, New Hanover County,
NC has led to the conclusion that your proposed development is outside of the Division of Coastal
Management's Area of Environmental Concern (AEC). The plat shows all proposed development to
be located at least 75 feet from mean high water and outside of all coastal wetlands (the "CAMA
Line" depicted on the plat represents the 75 foot AEC line). Therefore, you will not be required to
obtain a CAMA permit for the proposed development. Please be advised that any development within
75 feet of mean high water, whether it's construction, grading, filling or any type of land disturbing
activity, will require further review and will likely necessitate issuance of a CAMA permit. This letter
does not relieve you of the responsibility of obtaining any other applicable State, Local or Federal
authorizations. I would also like to bring to your attention that because federal authorization is needed
to develop in the adjacent "404 wetlands", any proposal for development in the 75 foot AEC will
require a CAMA major permit.

PERMIT
In 1974, the North Carolina General Assembly passed the Coastal Area
Management Act and set the stage for guiding development in fragile
and productive areas that border the state's sounds and oceanfront. Along
with requiring special care by those who build and develop, the General
Assembly directed the Coastal Resources Commission (CRC) to imple-
ment clear regulations that minimize the burden on the applicant.
This application for a minor development permit under CAMA is part
of the Commission's effort to meet the spirit and intent of the General
Assembly. It has been designed to be straightforward and require no
more time or effort necessary from the applicant. Please go over this
folder with the Local Permit Officer (LPO) for the locality in which you
plan to build to be certain that you understand whatinformation he or
she needs.
Under CAMA regulations, the minor permit is to be issued within 25
days once a complete application is in hand. Often less time is needed if
the project is simple. The process generally takes about 18 days. You
can speed the approval process by making certain that your application
is complete and signed, that your drawing meets the specifications given
inside and that your application fee is attached.
Other permits are sometimes required for development in the coastal
area. While these are not CAMA-related, we urge you to check with the
Local Permit Officer to determine which of these you may need. A
listing is included on page 2 of this folder.
